Amendments noted where applicable.] GENERAL REFERENCES Police Department — See Ch. 18. Uniform Fire Prevention and Building Code — See Ch. 45. § 24-1. Purpose. The purpose of this chapter is to establish standards and controls of the various types of fire. intrusion, holdup and other emergency signals from fire and police alarm services that require Fire Department or police responses, investigation or safeguarding of property at the location of an event reported by a signal which is 2401 11 -25 -97 § 24-1 SOUTHOLD CODE § 24-2 transmitted by telephone or radio Lo the Police Fire Department from a central station as hereinafter defined. § 24-2. Definitions. For the purpose of this chapter, the following definitions shall apply: ALARM AGENT — Any person who is employed by any business, firm, corporation or other commercial entity that is licensed hereunder to conduct the business of owning, operating, maintaining, installing, leasing or selling fire or police alarm devices, whose duties include any of the following: selling, maintaining, leasing, servicing, repairing. altering, replacing. moving or installing, in or on any building, place or premises, any fire or police alarm device, as defined in this chapter, within the Town of Southold. ALARM INSTALLATION' — Any fire or police alarm device or aggregation of fire or police alarm devices installed on or within a single building on or within more than one (1) building or area adjacently located on a common site at a specific location. BUSINESS LICENSEE — Any business, film, corporation or other commercial entity- which is in the business owning, operating. maintaining, installing. leasing or selling a fire or police alarm devices, or system of fire or police alarm devices. which business. firm or corporation or other commercial entity is an owner, operator, provider of maintenance service, installer, lessor or seller of said device, or system of devices, subject to the license requirements of this chapter. • CENTRAL ALARM STATION — Any facility operated by a private firm that owns or leases a system of fire or police alarm devices, which facility is manned by operators who receive. record or validate alarm signals and relay information about such validated signals to the Police or Fire Department when appropriate. 2402 11-25-87, § 24-2 ALARM SYSTEMS § 24-2 DIAL ALARM-- Any fire or police alar•rn device which is a telephone device or telephone attachment that automatically or electronically selects a telephone line connected to a central alarm station or police headquarters and reproduces a prerecorded message to report a criminal act or other emergency requiring the Police or Fire Department. • DIRECT ALARM — Any fire or police alarm device connected directly by leased telephone wires from the specified location to police headquarters or the Fire Department. EMERGENCY ALARM — Any fire or police alarm device designed to be actuated by a fire, criminal act or other emergency- at a specific location or by a victim of a holdup, robbery or other emergency or criminal act at a specified location. FALSE EMERGENCY ALARM — Any signal actuated by an emergency alarm to which the Police or Fire Department responds which is not the result of a fire. robbery or other crime or emergency. FIRE DEPARTMENTS — Buildings owned by the Fire Districts of Mattituck, Cutchogue, Southold, East Marion or Orient. FIRE OR POLICE ALARJI DEVICE — Any device which. when actuated by a fire, criminal act or other emergency requiring Police or Fire Department response, transmits a prerecorded message or other signal by a telephone. radio or other means to a central alarm station or directly to the Police or Fire Departments or produces an audible or visible signal designed to notify persons within audible or Asible alarm • range of the signal, except for residential smoke detectors/ alarms. INTRUSION — Any entry into an area or building equipped with one (1) or more police and fire alarm devices by any person or object whose entry actuates a police alarm device. LICENSING AUTHORITY — The Town of Southold or its designated agent. 2403 11 - 25 - 87 § 24-2 SOUTHOLD CODE § 24-3 POLICF. HEADQUAR,TEM — Police headquarters and other enclosures housing privately or publicly owned equip- ment serving the police. TOWN OF SOUTHOLD — All of the Town of Southold, excluding Fishers Island. § 24-3. License required; authority; applications. • A. It shall be unlawful for any person, business, firm, corporation or other commercial entity to operate, maintain, install, lease or sell a fire or police alarm device or devices, or system of fire or police alarm devices, as defined by the terms of this chapter, without first obtaining a license as hereunder provided. B. Authority to grant licenses and permits. (1) The licensing authority is hereby authorized to grant a revocable license to any business. firm, corporation or other commercial entity, authorizing said business, firm. corporation or other commercial entity to do business in the Town of Southold by performing any or all of the following functions: owning, operating, maintaining, installing, leasing or selling a fire or police alarm device or devices or system of fire or police alarm de-ices. (2) The licensing authority is hereby authorized to grant a revocable license to any alarm agent. (3) The licensing authority is hereby authorized to grant a revocable permit to any owner of property located within the Town of Southold, or the lessee thereof, to operate, maintain, install and modify a fire or police alarm device. C. Applications for licenses and permits. Applications for licenses • and permits shall be made as follows: (1) All businesses. firms, corporations or other commercial entities which are in the business of owning, operating, maintaining, installing, leasing or selling a fire or police alarm device or devices, or system of fire or police alarm device or devices, who desire to conduct business in the 2404 ii - - s; § 24-3 ALARM SYSTEMS § 24-:3 Town of Southold shall apply to the licensing authority for a business license, on a form to be supplied by the licensing authority. The application shall contain specific provisions relating to the quality, efficiency and effective- ness of the device or system of devices owned or to be operated, maintained, installed, leased or sold by the • business licensee; testing procedures involved: and any other information the licensing authority shall determine to be law. (2) Such business license shall be issued for a one-year period. on a calendar -year basis or a part thereof, and no license shall extend beyond December 31 of each year. Notwithstanding this provision. a person having a business license may conduct such business through January 31 of the year following the expiration of his business license. (3) :any person who is to be an alarm agent in the Town of Southold, before acting as such alarm agent, shall apply for and receive a revocable alarm agent license. The application shall be made to the licensing authority on a form to be supplied by the licensing authority. The application shall contain specific provisions relating to the fire or police alarm device or devices, holdup alarms, dial alarms or alarm installations which are to be sold, leased, installed, operated or maintain by the alarm agent; the skill and competency of the applicant as an alarm agent; and such other information the licensing authority determines to be reasonably necessary to effectuate the • purpose of this chapter. Such calendar -year basis or a part thereof, and no license shall extend beyond De- cember 31 of each year. The applicant, upon submission of this application, shall be fingerprinted and photo- graped by the Town of Southold Police Department. Notwithstanding this provision. a person having an alarm agent license may act as such alarm agent through January 31 of the year following the expiration of his license. 2405 It - 25 - s; § 24-:3 SOUTHOLD CODE § 24 (4) Any property owner or lessee of property in the Town of Southold having on his or its premises a fire or police alarm device, or system of fire or police alarm devices, shall apply to the licensing authority for a permit to own or otherwise have such device on his or its premises. The application shall contain provisions relating to the device or system of devices installed or to be installed on the premises. Application for permits for fire or police alarm • devices existing in premises on the effective date of this chapter must be made to the licensing authority by December 31, 1987. No such device may be installed on the premises of the owner or lessee, and no presently existing fire or police alarm device complying with the provisions of this chapter shall be modified after the effective date of this chapter prior to the licensing authority's having issued a permit to such owner or lessee. Such permit need not be obtained on an annual basis but shall be obtained each time a device or system is to be installed or modified. § 24-4. License fees. License fees shall be as follows: A. Business license: one hundred dollars (5100.) per calendar year or part thereof. B. Alarm agent: twenty-five dollars ($25.) per calendar year or part thereof. C. Owner or lessee permit: no charge. § 24-5. User fees. There shall be payable to the Town of Southold a fee of two dollars • ($2.) per month for a fire or police alarm device or devices installed on the premises of any owner or lessee. Such user fee shall be payable in the first instance by the business licensee who services the fire or police alarm device or devices of' the owner or lessee, but, upon the failure of the business licensee to make such payments when they become due, the owner or lessee of the premises shall thereupon 2-106 11 -25 -87 § 24-5 ALARM SYSTEMS § 24-7 become liable for any unpaid user fees. Such user fees shall be paid to the Town Clerk monthly in advance of the first clay of each month. Upon failure to make any such payment, the town shall have the right to proceed by civil action to collect such user fees. Failure to make any such payment after written notice thereof has been given to the owner or lessee shall subject such owner or lessee to the penalty provisions of such law. • § 24-6. Suspension or revocation of licenses. A license issued under this chapter may be suspended or revoked by the licensing authority after notice and hearing by the licensing authority for the violation of any of the provisions of this chapter or any regulation or regulations promulgated by the licensing authority pursuant to this chapter. and any license or identification card issued hereunder shall be surrendered immediately to the licensing authority upon such suspension or revocation. No part of a license fee shall be refunded when a license is suspended or revoked. Any applicant whose application for a license or permit has been denied or any business licensee, alarm agent, owner or lessee whose license has been suspended or revoked by the licensing authority may appeal such denial, suspension or revocation in writing to the Town Board at a time and place to be determined by the Town Board in support of his or its contention that the license should not have been denied. suspended or revoked. § 24-7. Records to be kept and provided. Every business, firm, corporation or other commercial entity conducting the business of owning, operating, installing, leasing or selling fire or police alarm devices within the Town of Southold shall maintain complete and accurate records of all installations of alarm systems in the Town of Southold and shall provide such records on a monthly basis for the licensing authority. 2-107 11 - - r § 24-8 SOUTHOLD CODE § 24-8 § 24-8. General Provisions. A. Restrictions: No fire or police alarm device shall be connected directly to the Town of Southold police headquarters or any Fire Department without the express written consent of the Chief of Police or Board of Fire Commissioners, respectively. B. Direct alarm system. Any private firm engaged in the business of burglar alarms or fire alarms and licensed by the Town of Southold will operate a facility which is manned by a trained operator who receives, records and validates alarm signals and relays information about such validated signals to the Southold Town Police Department or Fire Department on a special telephone number set aside for the express purpose of receiving such information. All central station alarm facilities shall have the capability to electronically supervise all alarm systems so that a trouble signal is indicated should there be a fault with any alarm system. The operator of any central alarm company which calls police headquarters or the Fire Department to report an actice alarm will identify himself or herself by name and the name of the company and will provide accurate directions to the protected premises at which the alarm is sounding. The central alarm company shall further provide the name of the caretaker who is responsible for resetting an activated alarm if the property owner or lessee of the property is away. In the event that the caretaker is unavailable, the alarm company shall be responsible for resetting an activated alarm. C. Audible alarm device. Any property owner or lessee of property in the Town of Southold shall, prior to the installation of an audible signal designed to notify persons within the audible range of the signal, obtain a permit for same. Any such alarm device which operates on house current must be equipped with a standby battery power supply sufficient for at least twenty-four (24) hours. Any such alarm device will incorporate a device whereby the system will automatically shut off and/or reset the audible alarm after the alarm has sounded for a maximum period of thirty (80) minutes. All property owners or lessees having such alarm devices on their premises shall further be required to provide the Police Department and Fire Department with the name of a person 2408 11 - 25 - 87 § 24-8 ALARM SYSTEMS § 24-8 who can respond to the premises within a reasonable time. Said person shall have the capability of securing or, in the case of fire, opening up said premises for inspection by the Fire Department. Every such audible alarm device must be equipped with a switch to silence the audible alarm. D. Intentional false alarm. It shall be a violation of this chapter to intentionally cause a false holdup alarm, and any person who • does intentionally cause a false holdup alarm shall be subject to the penalty provisions hereof. E. Charges for false emergency alarms. (1) Any owner or lessee of property having a fire or police alarm device, or system of fire or police alarm devices, on his or its premises on the effective date of this chapter and any user of services or equipment furnished by a licensee under this chapter shall pay to the Town of Southold a charge for each and every false emergency alarm to which the Police or Fire Department responds in each calendar year, as follows: (a) First and second false emergency alarm, each calendar year: no charge. (b) Third and all subsequent false emergency alarms, each calendar year: one hundred dollars ($100.). (2) The above charges shall be paid to the Town Clerk of the Town of Southold. Failure to pay any such charges shall subject such owner, lessee or user to .the penalty provisions of this chapter. F. Rules, regulations and enforcement. The licensing authority shall promulgate rules, regulations and standards which shall be approved by the Town Board that may be necessary for the purpose of assuring the quality, efficiency and effectiveness of fire or police alarm devices and alarm installations owned, operated, maintained, installed, leased or sold by a licensee under this chapter and to facilitate the administration of this chapter. The licensing authority shall administer and enforce the provisions of this chapter. The aforesaid rules, regulations and standards shall be set forth in writing, and copies shall be available for applicants. 2409 11 -25-87 § 24-9 SOUTHOLD CODE § 24-10 § 24-9. Special provisions. A. Central alarm station systems. The licensing authority is hereby authorized to prescribe the locations and the manner of installation of regular business telephone lines into police headquarters from a central alarm station for the express purpose of providing direct telephone communication between the central alarm station and police headquarters for use in reporting alarms. • B. Exceptions. None of the provisions of this chapter shall apply to a fire or police alarm device or devices installed in a motor vehicle or trailer. C. Severability. If any part or parts of this chapter are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter. The Town Board hereby declares that it would have passed the local law enacting this chapter and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one (1) or more sections, subsections, sentences, clauses or phrases might be declared invalid. § 24-10. Penalties for offenses. Any person, firm or corporation who does not pay any charge or fee established in this chapter or who violates any provision of this chapter shall be subject to a fine not in excess of two hundred fifty dollars ($250.) for each offense. A separate offense shall be deemed committed upon each day during which a violation occurs or is committed, and such violation may constitute disorderly conduct. 40 2410 11-25-87 § 65-2 PARKING AT BEACHES § 65-3 C. For the purpose of this chapter, a trailer shall be deemed a separate vehicle. [Added 5-9-721 § 65-3. Parking permits. Parking permits for parking vehicles in the parking areas • designated in § 65-2 of this chapter shall be issued as follows: A. Resident parking permit. (1) [Amended 5-25-71; 3-25-75 by L.L. No. 1-1975; 7-14- 87 by L.L. No. 11-1987] A resident parking permit shall be issued by the Town Clerk or a person designated by him to all persons who are qualified residents of the Town of Southold. Persons applying for resident parking permit shall be requested to sign an application in affidavit form and submit for inspection the following as proof of residence: (a) A valid tax receipt stub for the current year for any taxable real property within the Town of Southold assessed in the name of the applicant. (b) A valid motor vehicle registration in the name of the applicant and to an address located within the Town of Southold or to an address corresponding to the address of a validated tax receipt stub for the current tax year for any taxable real property within the Town of Southold affixed to the application. (c) Such other proof of residence as is satisfactory to the Town Clerk. • (2) The Town Clerk or a person designated by the Town Clerk shall inspect such application to determine that the applicant is a qualified resident of the town. Upon approval of the application, a resident parking permit shall be issued and inscribed with the vehicle license registration number. Such permit shall not be trans- ferred to any other vehicle. [Amended 3-25-75 by L.L. No. 1-1975; 12-28-84 by L.L. No. 10-1984] 6503 iI -_a-�, § 65-3 SOUTHOLD CODE § 65-3 (3) Resident parking permits for motor vehicles shall be permanently affixed to the right side of the. front bumper of such vehicle, and resident parking permits for trailer vehicles shall be permanently affixed to the right side of the drawbar. or tongue of such trailer. [Amended 5-9-72] (4) The fee for the issuance of a resident parking permit shall be such fee as shall be prescribed by a resolution • of the Southold Town Board. [Added 3-25-75 by L.L. No. 1-1975] B. Lessee parking permit. (1) A lessee parking permit shall be issued by the Town Clerk or a person designated by him to all persons who lease or rent property within the Town of Southold but do not qualify as residents as defined in § 65-3A hereof. Persons applying for a lessee parking permit shall present an application in affidavit form, signed by the lessee and the owner of the property, setting forth: (a) The location of the leased or rented property. (b) The persons occupying the same. (c) The term of such tenancy. (2) Upon a determination by the Town Clerk or person designated by him that the applicant is entitled to a lessee parking permit and upon the payment of the permit fee, such permit shall be issued and inscribed with the vehicle license registration number and shall be affixed to the vehicle in the same manner as provided in § 65-3A(3) hereof. (3) The fee for the issuance of a lessee parking permit • shall be such fee as shall be prescribed by resolution of the Southold Town Board. C. Hotel -motel parking permits. (1) Hotel -motel parking permits shall be issued by the Town Clerk or a person designated by him to the 6504 11 -25 -S7 § 65-3 PARKING AT BEACHES § 65-3 (a) The number of rental units available at the ap- plicant's premises. (b) The number of permits applied for. (c) The designated business name, if any, of the premises applied for. • (2) Upon a determination by the Town Clerk or a person designated by him that the applicant is entitled to such permits and upon payment of the required permit fee, permits shall be issued; provided, however, that the number of permits issued shall .not exceed the number of rental units available at the premises applied for. Such permits shall be inscribed with the name of the applicant or the designated business name of the applicant's premises and shall be used only by paying guests occupying the premises for which such permits are issued. (3) Hotel -motel parking permits shall be transferable and shall be issued in a clear plastic case and designed to be affixed temporarily to the interior right-hand windshield or right-hand front door window of the vehicle. The owner or manager to whom such permits are issued shall make no charge for the use of such permits by such guests but may require a deposit, not to exceed five dollars ($5.), to ensure return of a permit. (4) The fee for the issuance of a . hotel -motel. parking permit shall be such The as shall be prescribed by resolution of the Southold Town Board. D. One -day nonresident permits. • (1) One -day nonresident parking permits may be issued for the parking of vehicles on the parking areas at Southold Town Beach, Norman E. Klipp Marine Park and New Suffolk Beach to any person by the at- tendant on duty at such parking areas. [Amended 5-9- 721 (2) Such permit shall be valid only for the day on which the same is issued. 6505 1 1 - 2 5 - § 65-3 - SOUTHOLD CODE § 65-4 (3) The fee for the issuance of a one -day nonresident parking permit shall be such fee as shall be prescribed by resolution of the Southold Town Board. E. Guest permits. [Added 12.28-82 by L.L. No. 94982] (1) Guest parking permits shall be issued by the Town Clerk, or a person designated by the Town Clerk, to all persons who are qualified residents of the Town of • Southhold, as defined in § 65-3A hereof, for use by guests temporarily residing in the dwelling of such resident. A resident applying for a guest parking permit shall present an application in affidavit form, signed by the applicant, setting forth the following; (a) The location of the property to be occupied by the guests. (b) The names and permanent addresses of the guests. (c) The length of time. of the guest occupancy. (2) Upon a determination by the Town Clerk, or person designated by the Town Clerk, that the applicant is entitled to a guest parking permit and upon the payment of the permit fee, such permit shall be issued and inscribed with the vehicle license registration number and shall be affixed to the vehicle in the same manner as provided in § 65-3A(3) hereof. (3) . The fee for the issuance of a guest parking permit shall be such fee as shall be prescribed by a resolution of the Southold Town Board. F. Nonresident seasonal beach parking permit. Beach parking permits for nonresidents for the period April 1 through October 31 may be issued by the Town Clerk of the Town of. • Southold upon application therefor for the annual sum of fifty dollars (850.), which annual sum shall include both the vehicle and the boat trailer. [Added 7-14-87 by L.L. No. 11-1987] 6506 11 _ • .') - s f § 65-4 PARKING AT BEACHES § 65-7 § 65.4. Duration of permits. All parking permits provided for in this chapter, except one -day nonresident permits, shall expire on December 31 of the year in which issued. • § 65-5. Other regulations. Persons using parking areas pursuant to the provisions of this chapter shall comply with all laws, ordinances, rules, regulations and resolutions applicable thereto. § 65.6. Removal of vehicles parked in violation. Any vehicle parked in violation of the provisions of this chapter or any other law, ordinance, rule or regulation may be removed or caused to be removed by a police officer of the Town of Southold and, after such removal, stored or caused to be stored in a suitable place at the expense of the owner. The owner or person in charge of such vehicle may redeem the same upon payment to the Southold Town Police Department of the amount of all actual and necessary expenses incurred in the removal and storage of such vehicle. The said Police Department shall ascertain, to the extent possible, the owner or person in charge of such vehicle and shall notify him of the amount which will be required to redeem the same. § 65-7. Penalties for offenses. [Amended 7-31-73 by L.L. No. 1- 19731 Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation • punishable by a fine not, exceeding two hundred fifty dollars ($250.) or by imprisonment for a term not exceeding fifteen (15) days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder. 6507 11 - 25 - 87 • § 77-202 SHELLFISH § 77-203 C. Shellfish may be taken from town waters for non- commercial purposes by a permanent resident or taxpayer upon first obtaining a permanent resident or taxpayer's permit therefor from the Town Clerk of the Town of Southold. [Amended 7-7-82 by L.L. No. 5-19821 D. Shellfish may be taken from town waters for non- commercial purposes without obtaining a permit therefor by a guest when accompanied by a permanent resident in whose dwelling such guest occupies living quarters, provided that such permanent resident is the holder of a valid' shellfish permit. Notwithstanding any other provisions of this Article, the quantity of shellfish taken by a guest or guests shall be added to the quantity taken by the permanent resident accompanying the guest or guests, and the total amount thereof shall not exceed, in the aggregate, the maximum daily quantity prescribed in this Article for such permanent resident. No person not a permanent resident, a taxpayer, a tem- porary resident or a guest accompanied by a permanent resident shall take shellfish in any manner at any time from town waters. [Amended 7-7-82 by L.L. No. 5-19821 F. The presence of shellfish in excess of the limits, or of less size than that, set forth in this Article, found aboard any boat or vessel in the waters of the Town of Southold, shall be deemed presumptive evidence of a violation of this Article. [Added 7-31-731 G. Shellfish may be taken from town waters for non- commercial purposes by a permanent resident under the age of fourteen (14) years without obtaining a permit therefor. [Added 7-7-82 by L.L. No. 5-19821 § 77-203. Permit fee; expiration; display. A. The fee for a commercial shellfish permit shall be fifteen dollars ($15.). Effective on and after January 1, 1984, the fee for a commercial shellfish permit shall be twenty dollars ($20.). Such permit shall expire on December 31 of the year 7705 11- 2 5 -h § 77-203 SOUTHOLD CODE § 77-204 of its issuance. [Amended 7-7-82 by L.L. No. 5-1982; 11.15- 83 by L.L. No. 13-19831 B. The fee for a temporary resident shellfish permit shall be five dollars ($5.). Such permit shall be issued only for the period of time that such temporary resident occupies living quarters within the Town of Southold. C. The fee for a permanent resident or taxpayer shellfish • permit shall be one dollar ($1.). Effective on and after January 1, 1983, the fee for such permit shall be three dollars ($3.). Such permit shall expire on December 31 of the year of issuance. There shall be no fee for a permanent resident who has attained the age of sixty-two (62) years. [Added 7-7-82 by L.L. The holder of a shellfish permit shall carry the permit assigned to him on his person while engaged in the per- mitted activities, and the failure of such holder to exhibit his permit to an enforcement officer shall be presumptive evidence that no valid permit has been issued to him. § 77-204. Scallops. A. Scallops may not be taken from town waters during the period from April 1 to the third Sunday in September in each year, both dates inclusive. B. Subject to the provisions of this section, during the period from the first Monday after the third Sunday in September to October 9 in each year, both dates inclusive, not more than one-half (1/z) bushel of scallops may be taken from town waters in any one (1) day by hand or with a scalp net. Mussels. [Added 7-31-731 A. A permanent resident, a taxpayer, a temporary resident or a guest accompanied by a permanent resident may not take more than one (1) bushel of mussels from town waters in one (1) day for noncommercial purposes. [Amended 7-7-82 by L.L. No. 5-19821 B. Not more than ten (10) bushels of mussels may be taken from town waters for commercial purposes in one (1) day by any one (1) person. Two (2) or more persons occupying the same boat may take, in the aggregate, not more than twenty (20) bushels of mussels in one (1) day for com- mercial purposes.. § 77-209. Culling shellfish and restoration of underwater lands. A. Shellfish shall be culled when taken. All shellfish taken which do not comply with the provisions of this Article shall be immediately returned alive to the water. B. All lands under town waters disturbed by the taking of shellfish shall be restored to their condition prior to the taking of such shellfish by the person taking such shellfish. § 77-210. Restricted areas. Shellfish shall not be taken from any town waters which have been restricted by the Town Board of Trustees, provided that such restricted areas shall have been properly designated by a resolution duly passed by said Board of Trustees and properly staked and notices posted by said Board of Trustees. 7709 11 - - 87 § 77-211 SOUTHOLD CODE § 77-212 § 77-211. Transplanting of shellfish. Notwithstanding any other provision of this Article, the Town Board of Trustees may authorize the transplanting of shellfish in town waters of any age or size, subject to its supervision, when it shall find that such shellfish are in danger of destruction as the result of predators or other causes. § 77-211.1. Dredges and scrapes. [Added 7-7-82 by L.L. No. 5- • 1982] Except as permitted by § 77-204C of this Article, the use of a dredge, scrape, ell dredge or similar device towed by a boat operated by mechanical power or other means is prohibited in town waters. § 77-212.' Penalties for offenses. [Amended 7-31-73 by L.L. No. 1-1973] A. Any person convicted of an offense against any provision of this Article shall be deemed to have committed a violation against such Article and also shall be liable for any such offense or penalty therefor. B. For every offense against any provision of this Article, the person committing the same shall be subject to a fine of not more than two hundred fifty dollars ($250.) or im- prisonment not exceeding -fifteen (15) days, or both such fine and imprisonment. C. A second conviction for an offense against any of. the provisions of this Article within a period of one (1) year shall constitute and effect an immediate forfeiture of a permit issued to such person. No new permit shall be issued to such person for at least one (1) year after such • forfeiture. D. Any person committing an offense against this Article shall be subject to a civil penalty enforceable and collec- tible by the town for each such offense.
