must be added to water or waste to produce a residual chlo-
rine content of at least one-tenth (0.1) mg/1 after a minimum
contact time of ten (10) minutes.

COD (denoting Chemical Oxygen Demand) — The quantity
of oxygen utilized in the chemical oxidation of organic and
inorganic matter under standard laboratory procedure ex-
pressed in milligrams per liter (mg/1) by weight. In comput-
ing COD, reference shall be made to the latest edition of
Standard Methods for the Examination of Water and Waste
Water.

pling, repair and maintenance of any portion of the sewage
works lying within said easement. All entry and subsequent
work, if any, on said easement, shall be done in full accor-
dance with the terms of the duly negotiated easement per-
taining to the private property involved.
§ 76-11. Penalties for offenses; disconnectiom-
A. Any person found to be violating any provision of this Article
except § 76-6 shall be served by the District with written no-
tice stating the nature of the violation and providing a rea-
sonable time limit for the satisfactory correction thereof. The
offender shall, within the period of time stated in such notice,
permanently cease all violations.
B. Any person who shall violate any provision of this Article
shall be fined not more than one hundred dollars ($100.) or
imprisoned not more than thirty (30) days or both. Each
day that any violation of this Article continues and each day
that any person continues to discharge prohibited wastes or
substances into any public sewer shall be deemed to be a sep-
arate offense for the purpose of applying the penalty provided
in this section.
C. Any person who fails to cease and desist violation of this Arti-
cle upon notification thereof, may after the period of time
stated in the notice for correction thereof be disconnected
from the public sewer system. Notice of disconnection shall
be served by the District ten (10) days prior to the actual
disconnection.
S§ 76-12. Discretionary monitoring of effluents.
The District may require as a condition to the connection and or
continued use of the District's sewer facilities, that flow -metering,
pH -monitoring and suitable effluent -sampling stations be provided
at the owner(s) expense by industry connected to the District sewer
system as required by prudent engineering standards.

§ 76-22. Liens.
Sewer rents shall constitute a lien upon the real property served by
the sewer system or such part or parts thereof for which sewer rents
shall have been established or imposed. The lien shall be prior and
superior to every other lien or claim except the lien of an existing tax,
• assessment or other lawful charge imposed by or for the state or a
political subdivision or district thereof.
§ 76-23. Actions to collect rents.
The Town Board, on behalf of the sewer district, may bring and
maintain an action as upon contract for sewer rents in arrears,
including penalties and interest, or to foreclose liens for such sewer
rents. As an alternative to the maintenance of any such action, the
Town Board may annually cause a statement to be prepared setting
forth the amount of each lien for sewer rents in arrears, the real
property affected thereby and the name of the person in whose name
such real property is assessed. Such statement shall be presented to
the board or body empowered to levy_ town taxes on or before a date
to be specified by such board or body. Such board or body shall levy
the amounts contained in such statement against the real property
liable at the same time and in the same manner as town taxes, and
such amounts shall be set forth in a separate column in the annual tax
rolls. The amounts so levied shall be collected and enforced in the
same manner and at the same time as may be provided by law for the
collection and enforcement of town taxes.
§ 76-24. Sewer rent fund.
A. Revenues derived from sewer rents, including penalties and
interest, shall be credited to a special fund to be known as the
"sewer rent fund." Moneys in such fund shall be used in the
following order:

and repair of the sewer system or such part or parts
thereof for which sewer rents have been established and
imposed.

(f) A minimum of three (3) off-street parking spaces
shall be provided.
(g) Not more than one (1) accessory apartment shall be
permitted on a lot.

ments of a dwelling unit as defined in § 100-13
hereof. -- .---- -
(i) The exterior entry to the accessory apartment shall,
to the maximum extent possible, retain the existing
exterior appearance of a one -family dwelling.
(j) All exterior alterations to the existing building, ex-
cept for access to the apartment, shall be made on
the existing foundation.
(k) The certificate of occupancy shall terminate upon
the transfer of title by the owner, or upon the owner
ceasing to occupy one (1) of the dwelling units as the
owner's principal residence. In the event of an own-
er's demise, the occupant of an accessory apartment
may continue in occupancy until a new owner shall
occupy the balance of the dwelling or one (1) year
from date of said demise, whichever shall first
occur.
(1) All conversions shall be subject to inspection of the
Building Inspector and renewal of certificate of oc-
cupancy annually.
(m) The building which is converted to permit an acces-
sory apartment shall be in existence and have a val-
id certificate of occupancy issued prior to January
1, 1984.
(n) The existing building, together with the accessory
apartment, shall comply with all other requirements
of Chapter 100 of the Town Code of the Town of
Southold.
(o) Notwithstanding the provisions of § 100-30B hereof,
no site plan approval by the Planning Board shall
be required for the establishment of an accessory
apartment.

§ 100-30B(1) hereof, shall be permitted in or on

more than three (3) rooms in an owner -occupied dwell-
ing for lodging ad serving of breakfast to not more than
six (6) casual antransient roomers, provided that the
renting of suchr ooms for such purpose is clearly inci-
dental and subordinate to the principal use of the dwell-
ing, subject to th following requirements:
(a) That adequate off-street parking spaces shall be
provided for such rented rooms in addition to park-
ing spaces for the use of the family of the owner.
(b) No accessory apartment, as authorized by § 100-
30B(15) her of, shall be permitted in or on premises
for which a bed and breakfast facility is authorized

STREET, MAJOR — A street or highway of great con-
tinuity which serves or is intended to serve as a major
traffic artery within the town or county, or both, and which
is
is designated on the Town Plan as a main arterial highway,
major thoroughfare; parkway or other equivalent term to
identify those streets comprising the basic structure of the
street plan.
STREET, MINOR — A street supplementary to a major
street and of limited continuity which serves or is intended
to serve the local needs of a neighborhood or a section
thereof.
STREET OR RIGHT-OF-WAY WIDTH — The distance
between property lines, measured at right angles to the
center line of the street.
STREET, SECONDARY — A street or road of con-
siderable continuity which serves or is intended to serve as
the principal or collector trafficway between large and
separated areas or districts and which is the main means of
access to the major street or primary road system.
SUBDIVIDER or APPLICANT — Any person, firm,
corporation, partnership or association who shall lay out,
for the purpose of sale or development, any subdivision or
part thereof, as defined herein, either for himself or others.
SUBDIVISION [Amended 9-23-80]:
A. The division of any parcel of land into two (2) or more
lots, plots, blocks, sites or other divisions of land, with
or without streets or highways, including any ex-
tension of any existing street, for the purpose, whether
immediate or future, of sale or building development,
and including resubdivision; provided, however, that
the term "subdivision" shall not include the setoff or
creation of a single lot from a parcel of land, provided
that before any such setoff or creation shall take place,
the owner shall submit such proposal to the Planning
Board for its approval and determination of whether
such setoff or creation constitutes a subdivision. In

making such determination, the Planning Board shall
give considerat on, among other things, to:
(1) Whether ti e lot to be set off is of such, character
as to be sui able for the intended purpose without
danger of : lood or other perils.
(2) Whether a equate provision is or will be made for
drainage, water supply, sewer disposal and other
necessary tilities and improvements. -
(3) Whether t e lot to be set off is of such size as to
conform wig h the present or future development

B. If the PlanningBoard grants approval to set off a lot
as hereinbefore provided, it may impose such con-
ditions as it deems necessary or appropriate.
C. An application tc the Planning Board to set off a lot as
herein provided hall be accompanied by a fee of two
