Amendments noted where applicable.] GENERAL REFERENCES Expenses of town officers — See Ch. 11. Officers and employees — See Ch. 16. § 8-1. Adoption of statutory provisions. The Town Board hereby adopts § 18 of the Public Officers Law and confers the benefits thereof upon all town officers and employees. § 8-2. Town to provide defense for employees. The town shall provide for the defense of any town officer or em- ployee in any civil action or proceeding arising out of the alleged act or omission in which it is alleged that the officer or employee has violated the civil rights of the claimant, petitioner or plaintiff under Sections 1981 and 1983 of the United States Civil Rights Act. The town shall indemnify and save harmless such officer or employee in the amount of any judgment or settlement of claim obtained against such officer or employee. Such legal defense and indemnification shall be provided where the officer or employee at the time of such alleged act or omission was acting in good faith and within the scope of his public employment, powers or duties. Other amendments noted where applicable.] 3202 1-25-86 § 32-10 BOATS, DOCKS AND WHARVES § 32-10 GENERAL REFERENCES Parting at beaches — See Ch. 85. Shellfish — See Ch. 77. Wetlands — See Ch. 97. ARTICLE I Obstruction and Use of Town Waters' [Adopted 5-18-59] § 32-10. Permit required. No person shall place any piles, stakes, buoys, piers, docks, bulkheads or other objects in or on any town waters or public (Cont'd on page 3203) ' Editor's Note: See .also Ch. 97, Wetlands. 3202.1 1-25-86 § 32-39 BOATS, DOCKS AND WHARVES § 32-40 (2) No permanent mooring shall be placed unless authorized by a permit duly issued by a Bay Constable or Deputy or Assistant Bay Constable. (3) [Amended 3-26-85 by L.L. No. 571985] The following fees shall be paid for the issuance of a mooring permit: • . Size of Boat Permit Fee Up to 25 feet $ 10.00 26 feet to 35 feet 25.00 Over 35 feet 50.00 All nonresidents 100.00 (4) All mooring permits shall expire on December 31 of the year of issuance. (5) The location of each mooring shall be assigned by the Fishers Island Harbor Master, who shall be appointed by the Town Board. (6) ° All mooring buoys shall be assigned a number which shall be affixed to the buoy by the permittee in numbers at least five (5) inches in height. ARTICLE IV Floating Homes [Adopted 9-24-85 as Section II of L.L. No. 15-198511 § 32-40. Legislative findings. A.. The Town Board finds that watercraft are being used for strictly residential purposes on waterways within the Town of Southold. The proliferation of this type of use is expected to create significant environmental problems if their prolifera- tion remains unchecked. B. The Town Board recognizes that the waterways surrounding the town are some of the primary recreation areas on Long Editor's. Note: Section I of this local law provided for the renumbering of former Art. TV, Administration and Enforcement, as Art. V, and the renumbering of §§ 32.40 through 32-43, as §§ 32-50 through 32-53. 3209 1-25-86 § 32-40 SOUTHOLD CODE § 32-40 Island. They are used for swimming, fishing and boating by many of the local residents and visitors. Furthermore, wa- terways are a major commercial resource providing food and employment for the harvesters of fish and shellfish. Shellfish taken commercially from said waterways are distributed to all areas of the Eastern Seaboard. The Town of Southold has expended large sums of money to develop and protect the harvestable clam stock. C. The Town Board acknowledges its duty to protect the health, safety and welfare of its residents and visitors. The mainte- nance of high water quality is vital to the use of said water- ways for recreational and commercial purposes. The avoid- ance of all uses and activities which could introduce pollution in these waterways is of constant concern. D. The potential influx of craft and vessels for residential pur- poses creates a substantial danger to water quality in said waterways. The residential use of these vessels is contrary to the established character of the Town of Southold and will severely diminish the recreational and commercial use of said waterways. E. The proliferation of floating homes and marinas which ac- commodate them will create problems which include, in addi- tion to water pollution, trash storage and removal, fire pro- tection, emergency energy requirements during power fail- ures, loss of mooring piles during winter icing conditions and damage and sinking of vessels during storms, all of which conditions impose additional responsibilities on police, fire and other emergency agencies in the town. F. The Town Board recognizes that the Town of Southold con- sists primarily of developed year-round residential neighbor- hoods and that marine recreational uses are incidental to such residential uses, and that it is in the best interests of the Town of Southold and its residents to restrict and prohibit the uncontrolled growth and burden on its waterways that would result if the infusion of floating homes is not controlled. 3210 1-25-86 § 32-41 BOATS, DOCKS AND .WHARVES § 32-41 § 32-41. Definitions. As used in this Article, the words and terms used herein are de- fined as follows: FLOATING HOME — Any vessel in fact used, designed or occupied as a permanent dwelling unit, business office or source of any occupation, or for any private or social club of whatever nature, including but not limited to a structure con- structed upon a barge primarily immobile and out of naviga- tion which functions substantially as a land structure while the same is moored or docked in or on town waterways within the Town of Southold, whether such vessel is self-propelled or not, and whose volume coefficient is greater than three thou- sand (3,000) square feet. Volume coefficient is a ratio .of the habitable space of a vessel measured in cubic feet and the draft of a vessel measured in feet of depth. FLOATING HOME MARINA — Any plot, lot, block or site within the Town of Southold upon which a marina is operat- ed, where one (1) or more sites or.loeations are rented or are offered for rent, sold or offered for sale or otherwise used or offered for use for the location of floating homes. MARINA — Any dock, pier or other facility operated for profit, or to which public patronage is invited, providing moorings, dockage or other marine services primarily for power and sailing yachts; launches or other watercraft, other than floating homes, and which may also be capable of re- moving any and all watercrafts moored or docked within the marina from the water for repair and/or storage. PERSON — Any individual, corporation, copartnership, as- sociation, society or any other combination of -individuals. • TOWN WATERS — All tidal waters bordering on or within the Town of Southold, including but not limited to bays, sounds, creeks, estuaries, inlets and all tributaries thereof, .and extending seaward to a "point one hundred (100) feet from the mean high-water line. 3211. 1--25-86 § 32-42 SOUTHOLD CODE § 32-51 § 32-42. Prohibited acts. A. No person shall place, moor, dock, use or occupy or permit or assist in the placing, mooring, docking, use or occupancy of a floating home in or on town waters. B. No person shall place, moor, dock or store or permit or assist in the placing, mooring, docking or storing of a floating home in a marina in the Town of Southold. C. No person shall operate or cause to be operated a floating home marina or rent or hold out for rent or sell or offer to sell any site, berth or space for the accommodation of a floating home in the Town of Southold. § 32-43. Severability. If any clause, sentence, paragraph, section or part of this Article shall be adjudged by any court of competent jurisdiction to be inval- id, such judgment shall not affect, impair or invalidate the remain- der of this Article, but shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in the litigation in which such judgment shall have been rendered. ARTICLE V Administration and Enforcement [Adopted 6-23-81 by L.L. No. 3-1981] § 32-50. Enforcing officer. It shall be the duty of the Bay Constable and his deputies and assistants to administer and enforce the provisions of this chapter. • § 32-51. Notice of violation. A. Whenever the Bay Constable has reasonable grounds to believe that operations regulated hereby are being con - 3212 1-25-86 § 32-51 BOATS, DOCKS AND WHARVES § 32-52 ducted in violation of the provisions of this chapter or not in compliance with a permit issued pursuant to� this chapter, he may notify the owner of the property or the owner's agent or the person performing such operations to suspend all operations, and any such person shall forthwith cease operations until such notice of violation has been • rescinded. B. Such notice shall be in writing, shall specify the violation and shall state the conditions which must be complied with and the time within which compliance must be completed before operations may be resumed. Such notice shall also inform the person to whom it is directed of his right to apply for a hearing before the Board of Trustees of the Town Southold, as hereinafter provided. C. Such notice shall be served upon the person to whom it is directed by delivering it to him personally or by posting the same in a conspicuous place on the premises where operations are being conducted and mailing a copy thereof to such person by certified mail to his last known address. D. The Bay Constable may extend the time of compliance specified in the notice of violation where there is evidence of intent to comply within the time specified and conditions exist which prevent immediate compliance. E. In the event that the person upon whom a notice of violation has been served shall fail to comply with said notice within the time specified therein or within the time specified in any extension of time issued by the Bay Constable, any permit issued to such person pursuant to this chapter shall be deemed revoked. 0 § 32-52. Hearing. A. Any person affected by a notice of violation issued pur- suant to the preceding section hereof may request and shall be granted a hearing before the Board of Trustees, provided that such person shall file a written request 3213 1-25-86 § 32-52 SOUTHOLD CODE § 32-53 therefor with the Town Clerk within ten (10) days after service of the notice of violation. Such request shall have annexed thereto a copy of the notice of violation upon which a hearing is requested and shall set forth the reasons why such notice of violation should be modified or rescinded. B. The Town Clerk shall present such request to the Board of Trustees at its next regular meeting. The Board of Trustees shall set a time and place for such hearing and shall give the person requesting the same at least five (5) days' notice of the time and place thereof. C. At such hearing, the person requesting the same or his representative shall be given an opportunity to show cause why such notice of violation should be modified or rescinded. After such hearing, the Board of Trustees may sustain, modify or rescind such notice of violation or revoke any permit previously issued and shall specify the reasons therefor. D. -The notice of violation for which a hearing is requested shall continue in effect pending the hearing and deter- mination of the Board of Trustees. § 32-53. Penalties for offenses. A. For every offense against any of the provisions of this chapter or any regulations made pursuant thereto or failure to comply with a written notice or order of the Bay Con- stable within the time fixed for compliance therewith, the owner, occupant, builder, architect, contractor or their agents or any other person who commits, takes part or assists in the commission of any such offense or who shall fail to comply with a written order or notice of the Bay Constable shall, upon conviction thereof, be guilty of a violation punishable by a fine not exceeding two hundred fifty dollars ($250.) or by imprisonment for a period not to exceed six (6) months, or by both such fine and im- prisonment. Each day's continued offense shall constitute a separate, additional violation. 3214 1-25-86 • C7 17� § 32-53 BOATS, DOCKS AND WHARVES § 32-53 B. In addition to the above -provided penalties, the town may also maintain an action or proceeding in a court of com- petent jurisdiction to compel compliance with or to restrain by injunction the violation of this chapter. 3215 1 - 25 - 86 § 65-1 PARKING AT BEACHES § 65-1 Chapter 65 .PARKING AT BEACHES • § 65-1. The Town of Southold provides bathing beaches and recreational facilities and parking areas adjacent thereto -at various locations within the town for the use and enjoyment of residents of the Town of Southold. The use of such facilities by persons other than residents has increased to such an extent that such facilities have become over- crowded, with the result that residents are denied, the use thereof. The Town Board therefore declares it to be the policy. of the Town of Southold to restrict and regulate the parking of vehicles in the park- ing areas adjacent to the bathing beaches and recreational facilities described in this chapter in accordance with the provisions hereof. 6501 1 - 25 -86 § 65-2 SOUTHOLD CODE § 65-2 § 65-2. Designation of parking areas requiring permits. A. The following parking areas are hereby designated as Town of Southold "Parking by Permit Only" areas: (1) Parking area adjacent to the bathing beach located on Gardiners Bay at the terminus of Manhanset Avenue, known as and referred to herein as "Norman E. Klipp • Marine Park."' (2) Parking area adjacent to the bathing beach located on Long Island Sound at Arshamomaque [approximately one hundred (100) feet east of the intersection of County Route No. 27 and Sound View Avenue], known as and referred to herein as "Southold Town Beach." (3) Parking area adjacent to the bathing beach located on Long Island Sound at Southold at the terminus of Hor- ton Lane, known as and referred to herein as "McCabe's Beach." (4) Parking area adjacent to the bathing beach located on Long Island Sound at Southold at the terminus of Kenny Road, known as and referred to herein as "Kenny's Beach." (5) Parking area adjacent to the bathing beach located on Town Harbor at Southold adjacent to North Bayview Road (east of Goose Creek Bridge), known as and re- ferred to herein as "Goose Creek Beach." (6) Parking area adjacent to the bathing beach located on Long Island Sound at Peconic at the terminus of Mill Road, known as and referred to herein as "Goldsmith's Inlet Beach." (7) Parking area adjacent to the bathing beach located on Peconic Bay at New Suffolk at the terminus of First Street, known as and referred to herein as "New Suffolk Beach." Editor's Note: Original Subsection (1) designating Stephenson's Beach as a "Parking by Permit Only" area was repealed 5-25-71. 6502 1-25-56 § 65-2 PARKING AT BEACHES § 65-2 (8) Parking area adjacent to the beach located on the south- erly side of Narrow River Road adjacent to Hallock's Bay at Orient, known and referred to herein as "Narrow River Road Beach."
