Amehcfm6ni9'iY6fdd'1 WA -6& *V&9blej 7669' §,- g6-- A0 § 75-1.1 SOUTHOLD CODE § 75-1.2 ARTICLE I General Provisions § 75-1.1. Title. This chapter shall be known and may be cited as the "Southold Scavenger Waste Disposal Law." § 75-1.2. Definitions. Unless the context indicates otherwise, the follwoing terms shall, for the purpose of this chapter, have the meaning herein indicated: BOARD — The Southold Town Board, acting for and on be- half of the Southold Wastewater Disposal District. CARTER — Any trucker, hauler or enterprise that is li- censed within the District to provide on-site system pumping and other maintenance assistance. CESSPOOL — Any cesspool which essentially operates as a combined septic tank/drain field process. Since the solids re- main in one (1) tank, they tend to clog more quickly than sep- tic tanks which have drain field systems. Although these sys- tems were previously in widespread use, they are not ac- ceptable for new construction due to their inefficiencies. DISTRICT — The Southold Wastewater Disposal District. DRAIN FIELD — A tile field consisting of perforated pipes in below -ground trenches, which allow the clarified effluent from the septic tank to percolate to the groundwater (under- ground water) or a circular below -grade tank with openings constructed in the sidewalls which provide for drainage of the treated liquid. EASEMENT — An interest in land owned by another that • entitled its holder to a specific limited use. ON-SITE SYSTEM — Any below -grade cesspool, septic tank and drain field as defined herein for the disposal of sanitary sewage and normal domestic wastes. PERSON — Any person, firm, partnership, association, cor- poration, company, organization or other legal entity of any 7504 9-25-85 § 75-1.2 SCAVENGER WASTES § 75-2.1 kind, including municipal corporations or governmental agen- cies or subdivisions thereof. SCAVENGER WASTE PRETREATMENT FACILITY — A treatment plant designed to receive septage (scavenger waste) and treat it to levels acceptable for discharge to the Greenport Sewage Treatment Plant for further treatment. SEPTAGE (SCAVENGER WASTE) — The solid and liquid 40 material removed from a cesspool or septic tank during pumping. SEPTIC TANK — Any buried, watertight receptacle de- signed and constructed to receive wastewater from a home, to separate solids from liquid, to provide limited digestion of or- ganic matter, to store solids and to allow the clarified liquid to leach into the surrounding soils. SEWAGE TREATMENT PLANT — Any arrangement of devices and, structures used for treating sewage, exclusive of cesspools, septic tanks and drain fields as described herein. § 75-1,3. Purpose. The, Southold Wastewater Disposal District was established by an order of the Southold Town Board, adopted on February 15, 1983, as :amended, -by an order of said Board adopted on May 24, 1983, for the purpose of protecting the ground- and surface waters within said District from the disposition of scavenger waste by providing, a:waste- water pretreatment facility at the site of the sewer treatment plant of the Village of Greenport for the disposal of scavenger waste in the District and providing regulations to protect the health ,and water quality and to prevent the contamination .of the water. supply within .the;District. ® ARTICLE II Transportation ,§'75-2.1. License required. No , person shall engage in the removal of scavenger waste from .any cesspool or septic tank located within the District who does not possess a currently valid license issued by the Southold Town Clerk. 7505 9-25-85 § 75-2.2 SOUTHOLD CODE § 75-2.4 § 75-2.2. License applications. An applicant for a license as required by § 75-2.1 hereof shall file a sworn statement with the Town Clerk on the form prescribed stat- ing the name and address of the applicant; and the type, model and capacity (in gallons) of all vehicles to be used. Additionally, such form shall state: "I, .......... being duly sworn, state and depose that I am famil- is iar with the requirements of the Southold Scavenger Waste Law. That I will report the address and exact location of all septic tanks and cesspools pumped by me or by my business within the Southold Wastewater Disposal District as required by § 75-2.4 of said law and that failure to do so will result in the assessment of a civil penalty of one hundred dollars ($100.) for each violation." § 75-2.3. License fees. Prior to issuance of the license required by § 75-2.1 hereof, the Town Clerk shall collect a fee in an amount prescribed by resolution of the Town Board. § 75-2.4. Pump -out reports. Each carter of scavenger waste, licensed pursuant to this chapter, shall file a report with the Village of Greenport stating the address and exact location of each cesspool or septic tank pumped, on a form to be supplied by the Town Clerk, prior to disposing of a scavenger waste load. Failure of any carter to file such report shall result in the imposition of a one -hundred -dollar civil penalty for each cesspool or septic tank pumped but not reported as required herein. The report shall have the following information: A. The name and address of the owner. B. The address of the system if different than the owner. C. The date of pump -out. D. The quantity of pump -out. E. The type of waste. 7506 9-25-85 § 75-2.4 SCAVENGER WASTES § 75-4.1 F. The signatures of the owner and the hauler. ARTICLE III Construction and Alteration § 75-3.1. Permit required. No person shall construct, modify, repair or replace any septic tank or cesspool, or any part thereof, located within the Southold Wastewater Disposal District, without obtaining a permit from the Town Clerk within five (5) business days prior to the date work commences. Such permit shall state the exact location and address of the work in the manner and form specified by the Town Clerk. § 75-3.2. Civil penalty. Failure of any person to obtain such permit shall constitute a viola- tion punishable by a civil penalty of up to one hundred dollars ($100.). § 75-3.3. Permit fees. The fee charged for such a construction and alteration permit shall be in such amount as shall be, from time to time, prescribed by reso- lution of the Board. ARTICLE IV Septic Tanks and Cesspools 754:1. Affected properties. • All real property within the Southold Wastewater Disposal Dis- trict whereon any on-site disposal system, such as a septic tank or cesspool is constructed or operated, whether the same is within or outside the geographical area of the District, shall be subject to the permit requirement herein provided. 7507 9-25-85 § 75-4.2 SOUTHOLD CODE § 75-4.5 § 75-4.2. Operation permit required. Each owner of real property hereafter operating an on-site sewage disposal system, such as a septic tank or cesspool, except as modified by § 75-4.3 hereof, must, prior to such operation, possess in the name of the owner a current septic tank or cesspool operation permit issued by the Town Clerk. The "owner" is defined to mean a natural person, corporation, the state or any authority or subdivision hereof, the United States or any department or agency thereof and any rent- er, tenant, lessee or occupant of the premises. § 75-4.3. Exceptions. Within five (5) years after the effective date of this chapter, no permit shall be required of any owner, his successors, representatives or assigns, operating such an on-site system, at the date this chapter takes effect, provided that such on-site system is not thereafter pumped or other maintenance measures required. At such time as such on-site system requires pumping or other maintenance mea- sures, the owner shall obtain the permit described in § 75-4.2 above. Subsequent to four (4) years after the effective date of this chapter, owners of on-site systems within the Southold Wastewater Disposal District must obtain an operating permit. § 75-4.4. No permit required of tenants. No permit shall be required of any renter, tenant, lessee or occu- pant, provided that the owner of the premises has a currently valid permit issued in the owner's name or if the owner is excepted pursu- ant to § 75-4.3 hereof. § 75-4.5. Nontransferability of permit. Once a permit has been issued, it may be transferred without charge to subsequent owners by the Town Clerk upon presentation of the deed of conveyance; provided, however, that there is no existing violation as to the operation or other maintenance measures of the system. 7508 9-25-85 § 75-5.1 SCAVENGER WASTES § 75-5.3 ARTICLE V Rates and Fees § 75-5.1. Fees for alteration and construction permits. Fees for permits for new construction, alteration or reconstruction of an on-site system shall be applied to the operating costs of the District. A. The fee for a construction, alteration or reconstruction.perrnit for an on -'site system located on premises used exclusively for residential purposes shall be such fee as shall, from time to time, be prescribed by resolution of the Board. ,B. The fee for a construction, alteration or reconstruction .permit for an on-site system, located on premises used in whole or in part for nonresidential purposes shall be such fee as shall; from time to time, be prescribed by resolution of the Board. §75-5.2. Fees for operation permit: Fees for operation permits shall be applied to the operating costs of the District. A. The fee for an operation permit for an on=site system, located on premises used exclusively for residential purposes shall be such fee as shall, from time to time, be prescribed by resolii- tion of the Board. B. The fee for an operation permit for an 'on-site systerh located on premises used in whole or in part for nonresidential pur- poses shall be such fee as shall; from time to time, be pre- scribed by resolution of the Board: § 75-5.3. Tax rate. The Town Board shall, by "resolution, establish the tax rate to cover the cost of debt service of the Southold Scavenger Waste Pretreat- ment Facility, as well as future capital purchases and administrative costs. Operating and maintenance costs will be collected by user fees as prescribed by § 75-8.1. 7509 9-25-85 § 75-6.1 SOUTHOLD CODE § 75-7.1 ARTICLE VI Construction Requirements § 75-6.1. Standards. All new construction of septic tanks, cesspool or other on-site sys- tems shall conform to Standards for Sewage and Waste Disposal Systems, as then established by the Suffolk County Department of Health Services. § 75-6.2. Location. All new construction shall be located as prescribed by the Suffolk County Department of Health Services and at a location where pumping can occur without trespassing on lands of another owner, unless an express easement for that purpose over another owner's premises exists. § 75-6.3. Covering. All septic tanks and cesspools shall be covered in a manner that permits inspection as provided herein without removal of grass, dirt or other similar landscaping. ARTICLE VII Inspections and Maintenance § 75-7.1. Frequency of inspections; responsibility of owner. A. At the end of three (3) years after issuance of an operation permit hereunder, or sooner as conditions may require as de- termined by the town, the system shall be inspected by quali- fied inspectors employed by the Southold Town Board. The town has the right to waive said inspection. B. In all cases, it shall be the responsibility of the owner to locate and remove the cover of the septic tank or cesspool for inspec- tion by the Town Inspector. Should such- owner refuse to perform. the same„ the town has the right-to,repair said system and'billithe owner therefor. 7511 9'-25-85 § 75-8.1 SOUTHOLD CODE § 75-10.1 ARTICLE VIII Disposal Fees § 75-8.1. Fee to be set by resolution. The Town Board shall, by resolution, set the fee for the transport- ing to and disposing of scavenger waste at the Southold Scavenger Waste Pretreatment Facility, at such fee per gallon as shall, from • time to time, be prescribed by resolution of the Board. The fee to be paid shall be calculated on full -tank capacity and shall be applied against the operation and maintenance costs of the facility. ARTICLE IX Improper Disposal § 75-9.1. Dumping prohibited. No scavenger waste removed from any cesspool or septic tank within the Southold Wastewater Disposal District shall be dumped or disposed at any location within the Town of Southold except at the Scavenger Waste Pretreatment Facility. ARTICLE X Prohibited Wastes § 75-10.1. Prohibited wastes enumerated. Only sanitary sewage and normal domestic wastes shall be dis- charged into on-site wastewater disposal systems. The following waste shall not be discharged into the system and shall be considered as prohibited wastes: A. Industrial waste. B. Automobile oil and other noncooking oils. C. Drainage from basement floors, footings or roofs. D. Toxic or hazardous substances and chemicals, including but not limited to pesticides, acids, paints, paint thinner, herbi- cides, solvents, photographic chemicals and water -softening agents. 7512 9-25-55 7540:1' SCAVENGER WASTES §,75-11.2 E. Nb person' shall knowingly discharge prohibited waste at the Southold Scavenger Waste Pretreatment Facility. ARTICLE' XI' Administration' and- Enforcement' §� 7541.1. Administration and enforcement officer. The Town Board shall appoint a Sanitation Inspector (referred to� iri'thi's chapter as the Inspector) who shall administer and: enforce the prOisions of tfiislchapter. 91' 75-112'. Notice of violation. A. Whenever the Inspector has reasonable grounds to believe that operations regulated; hereby are being conducted. in vio-' lation of the provisions of this- chapter or not in- compliance: with a permit or license issued pursuant to this chapter, he may notify the- owner of the property or the, owner's' agent or the person performing such, operation's; or the carter, to sins= pend' a1T operations, and any such` person shall` forthwith cease' operations until such notice of violation 1ias been{ rescik d'ed'. B'. C. Such notice sliall be served upon• the person' fol whom, it is, directed` by delivering it to him personally or' by posting the same in a conspicuous place on the premises where operati'ons' are being conducted- and mailing a copy thereof to such per- son by certified mail to his last known ad'dre'ss. 7513 9-25-85 § 75-11.2 SOUTHOLD CODE § 75-11.3 D. The Inspector may extend the time of compliance specified in the notice of violation where there is evidence of intent to comply within the time specified and conditions exist which prevent immediate compliance. E. In the event that the person upon whom a notice of violation has been served shall fail to comply with said notice within the time specified therein or within the time specified in any extension of time issued by the Inspector, any permit or li- cense issued to such person pursuant to this chapter shall be deemed revoked. § 75-11.3. Penalties for offenses. A. For each offense against any of the provisions of this chapter or any regulation made pursuant thereto or failure to comply with a written notice or order of the Inspector within the time fixed for compliance therewith, the carter, owner, occupant, builder, architect, contractor or their agents or any other per- son who commits, takes part or assists in the commission of any such offense or who shall fail to comply with a written order or notice of the Inspector shall, upon a first conviction thereof, be guilty of a violation punishable by a fine of not exceeding five hundred dollars ($500.) or imprisonment for a period not to exceed fifteen (15) days, or both. Each day on which such violation shall occur shall constitute a separate, additional offense. For a second and subsequent conviction within eighteen (18) months thereafter, such person shall be guilty of a violation punishable by a fine not exceeding one thousand five hundred dollars ($1,500.) or imprisonment for a period not to exceed fifteen (15) days, or both such fine and imprisonment. B. This: chapter shall be known and may be cited-as:.the,"Highway„ Excavation Law of the Town of Southold." 8301 9.25-85 § 83-2 SOUTHOLD CODE § 83-4 § 83-2. Definitions. For the purpose of this chapter only, certain words and terms used herein are defined as follows: HIGHWAY — All or any portion of any highway, street, sidewalk, public place or right-of-way owned and/or con- trolled by the Town of Southold, exclusive, however, of that portion of any highway, street, sidewalk, public place or right-of-way situate within the territorial limits of the Village of Greenport and exclusive of that portion of any highway, street, sidewalk, public place or right-of-way owned and/or controlled by the County of Suffolk or the State of New York. PERSON — Any natural person, firm, partnership, associa- tion, corporation, company or other organization. SUPERINTENDENT — The Highway Superintendent of the Town of Southold, New York. TOWN — The Town of Southold. TOWN BOARD — The Town Board of the Town of Southold. § 83-3. Permit required. A. No person shall remove from or deposit on any highway any material or intentionally injure any highway or cause to be dug or made any hole or excavation in or under a highway or cause to be erected thereon or therein any object without first having obtained a written permit from the Superintendent so to do. B. This section shall be applicable to and prohibit individuals from depositing materials on public highways as a result of improvement and grading of their property. § 83-4. Applications. Any person desiring a permit shall make application to the Super- intendent, upon forms to be provided by him, which application shall set forth the following: 8302 9-25-85 § 88-4 STREET EXCAVATIONS § 83-6 A. Bonds. A. No permit shall be issued to any applicant until the apliiicalit has posted with the Superintendent a surety bond, de certified check in such amount the Superintendent may determine h6& essary to cover the probable expense to the town 6f `replace= ment by the town of any highway to its former condition and 8303 0-95-85 § 83-6 SOUTHOLD CODE § 83-7 to guarantee the performance by the applicant of any of the conditions contained in the permit and compliance with this chapter. B. The above bond requirements shall include provision for maintenance by way of a maintenance bond, which bond shall have a duration of two (2) years from the date of completion of the work under the permit, in case of all excavations with a • depth of eighteen (18) inches or less, and a duration of three (3) years from the date of the completion of the work under the permit for all excavations with a depth greater than eighteen (18) inches. § 83-7. Fees. A. Each application for a permit hereunder shall be accompa- nied by a fee of twenty-five dollars ($25.) therefor, to be paid to the Town Clerk of the Town of Southold. Permit fees for permits issued pursuant to this chapter shall be as follows: (1) Twenty dollars ($20.) for each service connection excava- tion. Additional excavations made in connection with the same service connection excavation shall be charged at the rate of ten dollars ($10.) for each additional excava- tion. (2) Ten dollars ($10.) for the first one hundred (100) linear feet or any part thereof of street excavations and ten cents ($0.10) per linear foot thereafter for all excavation eighteen (18) inches in depth or less. (3) Thirty dollars ($30.) for the first one hundred (100) lin- ear feet or part thereof of street excavation and thirty cents ($0.30) per linear foot thereafter for all excavations between eighteen (18) inches and five (5) feet in depth. (4) Fifty dollars ($50.) for the first one hundred (100) linear feet or part thereof of street excavation and fifty cents ($0.50) per linear foot thereafter for all excavations ex- ceeding five (5) feet in depth. 8304 9-25-85 § 83-7 STREET EXCAVATIONS § 83-10 (5) Ten dollars ($10.) for each utility repair excavation and five dollars.($&.) for each additional excavation made in corijunction-with said repair. B. The aforementioned fees shall be paid to the Town Clerk prior to theissuance of the permit. • '§ 83-8. Notice..to -public utilities. The -Superintendent shall require any person making .a highway excavation pursuant to .permit granted hereunto to give written no- tice -of such excavation .to public service companies or municipal ,dis- tricts having lines, mains or other property in the streets, and no work shall be commenced or done under such permit until such re- ,quirement of notice has been fully complied with. Proof of mailing of such notice in the form of a sworn statement shall be filed with the .application. '§ 83-9. Protective .measures. Any person making an excavation .pursuant .to this chapter shall erecta suitable barrier or guard for .the protection of persons _using the streets ,or sidewalks and, in addition thereto, shall set up and maintain during the 'hours of darkness sufficient lights ,or flares or retroreflective, barricades to properly illuminate. ,ordelineate the work area and shall also take all necessary precautions for the pro- tection of the town and of public .service companies or municipal dis- tricts and adjoining property owners and others which might be en- dangered by such excavations or the work incident thereto and shall comply with all -'directions .given by the !Superintendent with respect to such barriers, lights, flares and protective measures. 10 -§,83-10. Permit requirements. A. Commencement of work. Work under the permit shall be commenced within thirty (30) days from the date of permit and continued in an expeditious manner. 8305 9-25-85 § 83-10 SOUTHOLD CODE § 83-10 B. Construction. (1) When working on any town road, no pavement cuts or trenches are to be left uncovered or unfilled overnight, except in emergencies, and in such cases adequate pre- cautions must be exercised to protect traffic. (2) When working on any town road, contractors must com- plete final backfilling (See Subsection E hereof.) of any trench within eighteen (18) days from the day of opening. (3) All pipes or mains crossing highway pavements shall, wherever possible, be driven beneath the roadway with- out disturbance to the pavement. The point of driving shall not be less than five (5) feet from the edge of pave- ment. Such crossover pipes shall, whenever possible, be enclosed in sleeves or larger pipes so that repairs or re- placements may be made without further disturbance of the roadway pavement. (4) If the boring method in the driving of crossover pipes is found to be impracticable, the Superintendent shall be consulted to determine the manner of placing the pipe by the open -cut method. This request is to be made in writing to the Superintendent and may be granted upon such conditions as deemed necessary and proper under the circumstances. C. Excavations; method and type of opening. (1) Openings in concrete roads shall have a minimum width of five (5) feet. (2) No roads are to be tunneled, but pipe may be driven or trenched across. (3) All openings are to be made either by pinwheel trench- ing machine or saw cutting, as specified in the permit. D. Restoration of excavation; temporary patching. Upon comple- tion of the final backfilling, if final pavement replacing is not to be accomplished within twenty (20) days from day of open- ing, then the trench will be brought to within two (2) inches of road level and then paved with two (2) inches of asphaltic 8306 9-25-85 § 83-10 STREET EXCAVATIONS § 83-10 concrete within twenty (20) days of opening, which shall be placed as a temporary surface in any pavement opening and shall be maintained .to the same grade as adjacent pavement. E. Procedure for final backfilling. Clean fill will be used,, and the trench shall be compacted in twelve -inch lifts with either vibratory soil compactors or by suitable hydraulic compaction • by water jetting at three-foot intervals. F. Final pavement replacing. (1) Concrete. Minimum size replacements in concrete or as- phalt on ,concrete base shall be ten by ten (10 x 10) feet, or as directed. In all cases, if the ten -by -ten -foot re- placement is within five (5) feet of a joint, the replace- ment must extend to the joint. Concrete openings shall be saw cut, and the mix shall be high early, New York State Specifications Class F, latest revision. (2) Asphalt. The trench shall be compacted to within four (4) inches of the road surface. The existing asphalt sur- face shall then be cut back at least twelve (12) inches on either side of the undisturbed subgrade. At the discre- tion of the Superintendent, the contact surfaces, the patched surface and/or adjacent pavement edges shall be painted and sealed with approved bituminous and/or bluestone material before or after placing the course of asphalt, which shall be four (4) inches of New York State Specification 6F hot plant mix. This course shall be rolled with an eight -to -ten -ton roller and surface varia- tions in excess of one-fourth (1/) inch shall be .eliminate_ d or the pavement relaid. (3) If temporary patching is not accomplished, final pave- ment must be completed within twenty (20) days of open- • ing. If temporary patching is accomplished as specified, then final pavement replacing must be completed within thirty (30) days of temporary patching or within such additional time as may be authorized by the Superin- tendent, at his discretion, upon application. G. Shoulder areas. If the trenchwork is in the earthen shoulder of the roadway, then proper compaction as outlined in Sub - 8307 9-25-85 § 83-10 SOUTHOLD CODE § 83-11 section E above will apply, with the addition of a covering of sod or grass seeding as specified by the Superintendent. H. Traffic control. (1) Maintenance and protection of traffic. Traffic is to be maintained at all times during the progress of this work. Adequate signs, barricades and lights, necessary to pro- tect the public, shall be provided in accordance with the provisions of the New York State Manual of Uniform Traffic Control Devices. Flagmen to direct traffic shall be employed continuously during periods when only one- way traffic shall be maintained or when equipment is operated in the pavement area. (2) No construction material or equipment shall be left on the pavement after working hours, nor shall any con- struction equipment or materials be placed in any manner or location that will obstruct highway or railroad warn- ing signs. (3) Barricades, whether sidewalk or roadway area, shall be prominently displayed. For police convenience the ad- dress and telephone number of twenty -four-hour availa- bility of someone who will reestablish the same in an emergency shall be filed with the Town Police Depart- ment. (4) Access to adjacent properties shall be maintained. I. Notification. The applicant will be responsible to notify the Superintendent twenty-four (24) hours prior to street opening and closing. J. Expiration date. The permit shall expire one (1) year from the date of issue of the permit, unless a different expiration date has been specified by the Superintendent. § 83-11. Completion of work. GENERAL REFERENCES ARTICLE I Organization § A107-1. Powers and duties. The Police Department and its police members have the power and it is their duty to: A. Protect life and property. B. During the temporary absence or disability of the Chief of Police, when no special designation is made by competent authority, the command automatically devolves upon the senior ranking member of the command, who shall possess all the powers and perform all the duties of the Chief of Police, and he shall carry out the orders pre- ® viously given, which orders shall not, except in cases of extreme emergency, be countermanded nor set aside; however, when such ac- tion is taken, a report shall be made to the Chief of Police in writing stating the reasons therefor in such instances. § A107-4. General duties. Within the boundaries of the town, the Chief of Police shall be charged with and be responsible for the enforcement of all laws and ordinances and regulations. § A107-7. Specific duties. A. The Chief of Police shall: (1) Enforce the rules and regulations of the Police Depart- ment and be responsible for the discipline and efficiency of the members of the Department. (2) Provide each member with a copy of the rules and regu- lations and properly instruct him in his duties in such a manner as to render effective police service, that he is instructed with regard to his conduct, on and off duty, so that his conduct will not be detrimental to the good order and efficiency of the Police Department. (3) Assure accuracy in the preparation, maintenance and forwarding of reports and records. (4) Assure that all books and records required to be kept are in conformity with the laws of the State of New York and the rules and regulations of the Department and that entries therein are properly made. A10706 9-25-85 § A107-7 POLICE DEPARTMENT RULES § A107-7 (5) As directed, take inventory, inspect and maintain de- partment buildings, property and equipment, and for- ward a report to the Town Board. (6) Account for the property assigned to and issued for the use of members of the Department and the proper care, economical use, sufficiency and serviceability thereof and shall cause frequent inspections thereof. (7) Submit estimates to the Town Clerk for the preparation of the annual budget by the Town Board. (8) Frequently visit every building or parts thereof assigned to the Department and all parts of the territory within the boundaries of the town and take, or direct to be tak- en, such action as may be required to render effective police service and to maintain proper discipline of the members. (9) When on patrol, and when absent, except with leave, shall keep the Department informed of his whereabouts. (10) Carefully investigate the following occurring within the Department and forward a written report in full detail to the Town Board: (a) The reported death of any member of the Depart- ment, while acting in the discharge of duty. (b) Cases of special faithfulness to duty, exceptional skill and bravery in the performance of duty and police service of an exceptional nature rendered by any member of the Department. (c) Cases of civilians assistance to the Police Depart- ment or any member thereof. (11) Carry out the following, in addition to all other reports, when a member of the Department is injured or a member of the public is injured by a member of the Po- lice Department: (a) Make a careful investigation of the circumstances of the injury and cause witnesses to be interviewed and written statements obtained. This report shall show whether or not, in his opin- ion, such injury was sustained in the performance of police duty, whether or not negligence on the part of the injured member contributed to the injury and the names and addresses of all witnesses. (12) At his discretion, personally inspect the uniform and equipment of members of the Department. He shall at all times give particular attention to the uniforms, equip- ment and general appearance of the members of the force. (13) Carefully observe the police duty performed by proba- tionary patrolmen and report thereon to the Town Board at a meeting previous to the expiration of the probation- ary period. (14) Obtain or cause to be obtained all Police Department property, including all revolvers and pistols, in the pos- session of a member of the force who resigns, retires, is dismissed or enters active military service and obtain all Police Department property and all revolvers and pistols from among the effects of a member who dies, as re- quired by law. (15) Divide the territory within the police jurisdiction of the town into posts, to be divided into such operational patrol sectors or posts as needed for continuous patrol functions. (28) Correct subordinates in a dignified manner. (29) Ensure the security and care of prisoners and sick, in- jured or unconscious persons and obtain medical care when needed. (30) Deal fairly and equitably with subordinates. (31) At all times, conduct himself in a manner which will • provide leadership and guidance to the members of the Department and enhance the public image of the police in general. (32) Cause the vacation list for the following year to be prepared. B. The Chief of Police may excuse for one (1) tour of duty a member of the Department who performs any exceptional act A10709 9-25-85 § A107-7 SOUTHOLD CODE § A107-9 or deed of particular merit, which in his opinion deserves rec- ognition, provided that the exigencies of the service permit. A brief but comprehensive report of the act or deed for which he rewards such member shall be forwarded to the Town Board, and he shall file a copy in the member's service record. ARTICLE III Lieutenant § A107-8. General duties. A Lieutenant or Acting Lieutenant of the Department shall be re- sponsible for the enforcement of all laws and ordinances, department rules and regulations, orders, procedures, discipline, punctuality and attendance, appearance, good order and efficiency of members with- in his assigned jurisdiction. He shall perform such specific duties and functions as assigned by Chief of Police and provide leadership and guidance in developing loyalty and dedication to the Police De- partment of the Town of Southold. § A107-9. Specific duties. A. A Lieutenant shall: (1) Perform such specific duties and functions as assigned by the Chief of Police. (2) Obey all lawful orders. (3) Provide leadership and guidance in developing loyalty and dedication to the police profession. (4) Train, direct, supervise and evaluate members in their . assigned duties. Recommend remedial or disciplinary action for inefficient, incompetent or unsuitable conduct and/or behavior of members. (5) Support a member of his command who is properly performing. (6) Correct subordinates in a dignified manner. A10710 9-25-85 § A107-9 POLICE DEPARTMENT RULES § A107-10 (7) Ensure the security and care of prisoners, sick, injured or unconscious persons and obtain medical care when needed. (8) Assure the accurate preparation, maintenance and for- warding of reports and records. (9) Inventory, inspect and maintain department buildings, property and equipment. (10) Cooperate with other units of the Department, other town agencies and other police agencies. (11) Deal fairly and equitably with subordinates. (12) When in uniform, maintain a professional bearing and render professional courtesy to superior officers. B. The Lieutenant may relieve subordinate member from active duty for a period not to exceed one (1) working day, if such member violates any of the following rules and/or regula- tions: Intoxication on duty, unauthorized use of firearms, sleeping on duty, disobedience of a lawful order, insubordina- tion or disrespect toward a superior officer, violation of any duly constituted law, disorderly conduct, immoral conduct, willful maltreatment of any person. The Chief of Police shall review such action of the Lieutenant and may, in the exercise of his discretion and judgment, ratify or overrule such action of the Lieutenant. C. During the absence or incapacity of the Chief of Police, the Lieutenant shall have and assume all of the powers, duties and responsibilities of the Chief of Police. • ARTICLE IV Sergeants § A107-10. General duties. A Sergeant shall be responsible for the enforcement of all laws and ordinances, Department rules and regulations, orders, procedures, discipline, punctuality and attendance, appearance, good order and efficiency of members within his assigned jurisdiction. A10711 9-25-85 § A107-11 SOUTHOLD CODE § A107-11 § A107-11. Specific duties. A. A Sergeant shall: (1) Perform such specific duties and functions as assigned by his superior officers. (2) Obey all lawful orders. (3) Perform assigned tasks. is (4) Provide leadership and guidance in developing loyalty and dedication to the police profession. (5) Train, direct, supervise and evaluate members in their assigned duties. Recommend remedial or disciplinary action for inefficient, incompetent or unsuitable conduct and/or behavior of the members. (6) Communicate orders, information and instructions. (7) Inform his relief of all necessary police matters. (8) At intervals, inspect personnel, vehicles and equipment. (9) Report to his superior officer absentees and any defi- ciencies in men and equipment. (10) Ensure that department resources are used effectively. (11) Ensure that recovered property is handled in accordance with department procedures. (12) Account for all moneys and valuables received, processed and disbursed in conformance with department proce- dures. (13) Inquire into the circumstances of all arrests to assure that all persons are handled in conformance with de- partment procedures (e.g., prisoner activity log.) • (14) Know and conform to the current bail provisions of the Criminal Procedure Law, State of New York. (15) Report promptly matters of police importance to his immediate superior. A10712 9-25-85 § A107-11 POLICE DEPARTMENT RULES § A107-12 (16) Ensure that all appropriate town, county and state de- partments are informed of emergencies which require their attention. (17) Visit all patrolmen of the force on duty in the territory subject to his supervision. He shall inquire as to the con- ditions of the member's post. - (18) Check all reports at least once each tour of duty and verify that a full and accurate record of duty performed, field reports and all other necessary information has been entered on the appropriate form. The Sergeant shall verify the same entering date, time and signature. (19) Inspect departmental vehicles and equipment assigned to patrolmen each tour of duty for serviceability and cleanliness. (20) Direct activities of subordinate members for the purpose of achieving the objectives of the Police Department. (21) Perform those duties of the members of the force that are applicable to him. (22) When in uniform, maintain a professional bearing and render professional courtesy to ranking officers. B. The Sergeant shall inspect all sectors during his tour of duty. ARTICLE V Civilian Members § A107-12. General duties. A. A civilian member shall be responsible for proper and effi- cient performance of his assigned duties. B. The Chief of Police or his designee shall be in charge of all civilian employees and shall assign civilian duties and respon- sibilities. A10713 9-25-85 § A107-13 SOUTHOLD CODE § A!107-15 § A107-13. Specific duties. A civilian member shall: A. Obey all lawful orders of a superior officer. B. Be bound by rules and regulations, orders and procedures of the Department insofar as they apply. C. Report promptly to superior officers any violation of any law or rules and regulations of which he has knowledge. D. Be responsible for the proper care of town owned or leased property and equipment and shall report any damages or de- fects to the Chief of Police or his designee in writing. § A107-14. Safeguarding information. Civilian members shall safeguard all police intelligence and in- formation from unauthorized people and treat all police matters and all documents as confidential. ARTICLE VI Conduct § A107-15. Rules of conduct. A. A violation of any of the following rules of conduct by a member shall be deemed a violation of these rules and regu- lations, as follows: (1) Conduct which brings discredit upon the Department. (2) Failure to perform a duty. (3) Disobedience. (4) Insubordination or disrespect toward a superior officer at any time. (5) Neglect or dereliction in the performance of official duties. (6) An act of delinquency seriously affecting a members general character or fitness for office. A10714 9-25-85 § A107-15.• POLICE DEPARTMENT RULES § A107-15 (7) Lounging or sleeping on duty. (8) - Absenc& from duty without proper authorization.. (9) Leaving,duty. assignment without being properly relieved, or without proper authorization. (10) Incompetency to perform official duty. (11) . Entering. any tavern or bar in uniform, or any part thereof;except when it is necessary, for inspection ,or. for the immediate performance of a police duty. (12) Drinking alcoholic beverages while on - or, off duty in uniform. (13) Being intoxicated in a public place, whether on or. off duty. (14) Violation of any duly constituted law. (15). Disorderly., conduct. (16) 1 No. officer. shall possessor use ,any •controlled :substances, , narcotics or hallucinogens except,when prescribed.in.the treatment of: the member by a: physician, or. dentist. When the aforementioned subtances are prescribed; of= ficers shall notify the Chief,of Police. (17) Using,coarse, profane or insolent language to.any person. (18) Any conduct unbecoming of an officer, on or. off duty, wherever he may be. (19) Failure to treat any person civilly and respectfully. (20) Willful,maltreatment of any person. (21) Knowingly make a false report; written.or oral! (22) Failure to wear the regulation uniform when, on; duty or, when.so ordered. (23) Failure to maintain a neat and clean appearance of self, uniform and equipment. (24) The use of, tobacco while in uniform in, public; except in police facilities and police vehicles. A107.15 9-25-85 § A107-15 SOUTHOLD CODE § A107-15 (25) Standing or walking with hand in pocket while in uni- form. (26) Receiving or attempting to receive a fee, gift, present or other thing of value from a person under arrest or from someone else on behalf of the arrested person. (27) Receiving, soliciting or attempting to solicit a bribe in any form. (28) Publicly criticizing the official actions of a department member or any local public official, while on duty. (29) Disseminating or releasing any information contained in a department record except in conformance with de- partment orders. (30) Failure to identify self by name, rank and shield number when requested. (31) Failure to seize, record, process and dispose of recovered or prisoner's property in conformance with department orders. (32) Failure to notify a superior officer that a member of the Department is violating a rule or order of the Depart- ment. (33) Deliberate violation of Civil Service Laws or regulations pertaining to police management and control. (34) Possessing or transporting any intoxicating liquor when on duty, except in accordance with department orders. (35) Defacing or neglecting to protect and preserve depart- ment property. (36) Engaging directly or indirectly in those occupations pro- hibited by department orders or laws of the State of New York. (37) Allowing the publication of any photograph of oneself in the regulation uniform which advertises any commodity or commercial enterprise without permission of the Chief of Police. A10716 9-25-85 § A107-15 POLICE DEPARTMENT RULES § A107-15 (38) Communicating or corresponding with other police agen- cies or individuals concerning police matters except in the line of duty. (39) Engaging in any activity, conversation, deliberation or discussion which is derogatory of department policy or individuals, while on duty. • (40) Failing to keep department vehicle in public view when assigned to general patrol, except when authorized by a supervisory officer. (41) Permitting any person not on official business to ride in a department vehicle, unless specifically authorized. (42) Operating a department vehicle out of town except in immediate pursuit of law violators or when on official police business authorized by the Chief of Police or his designee. (43) Operating a department vehicle without proper authori- zation or on other than official police business. (44) Pulling, pushing or towing any vehicle with a depart- ment vehicle, except as authorized by the supervising Sergeant. (45) Altering department equipment in any way except as authorized by the Chief of Police. (46) Carrying any rifle, shotgun, machine gun, gas gun or substituting for the regulation service revolver and wea- pon or adding a concealed auxiliary hand gun not autho- rized by the Chief of Police. (47) Unlawful or unnecessary use or display of a weapon. • (48) Failure to report the discharge of a weapon: (a) Orally and immediately to a supervisory officer; and (b) In writing to the Chief of Police without unneces- sary delay. A10717 9-25-85 § A107-15 SOUTHOLD CODE § A107-15 (49) Selling, giving, lending or disposing of a dangerous weapon as specified in § 265.05 of the Penal Law of the State of New York contrary to the provisions of § 265.10 of the Penal Law and the rules and regulations of the Department. (50) Giving an opinion as to fine or penalty to a violator or suspect. (51) Giving an opinion as to bail, except by those specifically authorized to admit to bail. (52) Failure to take, record and act upon complaints except as prescribed by department orders. (53) Removing, altering or changing any official department record except as provided for in department orders. (54) Displaying in any manner nondepartmental or depart- mental posters or pictures in or on any department property or equipment except in conformance with de- partment orders. (55) .Obligating the Department financially in any manner except as authorized by the Chief of Police or Town Board. (56) Recommending to any citizen any bondsman, lawyer, towing, repair or other professional or commercial service. (57) Failure to report any information of a police nature in conformance with department orders. (58) Failure to obtain official permission to participate in public discussions of police or department business, ex- cept as provided in department orders, while on duty. (59) Interviewing, questioning or interrogating any person in a cell except unruly prisoners. (60) Entering any police lockup except on official police busi- ness. (61) Associating or fraternizing with known criminals, ex- cept in the immediate discharge of official duties or with the authorization of the Chief of Police. A10718 9-25-85 § A107-15 POLICE DEPARTMENT RULES § A107-17 (62) Soliciting or accepting a gift, present, reward, gratuity or other thing of value for any service rendered as a de- partment member, excluding gifts 'received from rela- tives or close friends upon appropriate occasions, except gifts to the Police Benevolent Association. (63) Failure to submit a written report that he is under in- vestigation by any other law enforcement agency to the Chief of Police within twenty-four (24) hours of becom- ing aware of such investigation. (64) Affiliation with any organization or body, the constitu- tion or regulations of which would in any way exact prior consideration and prevent him from performing his departmental duties. (65) No scheduled officer shall be at police headquarters dur- ing the tour of duty except by assignment or permission and 'authority of a superior officer. (66) No member shall endorse any application as a character reference in connection with police matters. (67) Use of the police radio, contrary to Federal Communica- tions Commission regulations. Profanity and nonpolice matters are prohibited. ARTICLE VII Detectives § A107-16. Qualifications. The Chief of Police may assign any qualified member or members to detective duties, provided that he or they have a minimum of two • (2) years of service as a qualified police officer. § A107-17. Assignment. The Chief of Police is authorized to assign or detail members of the Department as plainclothesmen for the purpose of executing war- rants, undercover assignments, stakeouts, police surveillances and investigations of misdemeanors and felonies. A10719 9-25-95 § A107-18 SOUTHOLD CODE § A107-23 § A107-18. Composition. The detective division shall be composed of such number of officers and of such rank as may be assigned to it by the Chief of Police. § A107-19. Additional duties. In addition to the duties set forth herein, the detective division shall be responsible for the investigation of such offenses and the per- formance of such other duties as shall be prescribed by the Chief of Police or officer in charge. § A107-20. Scene of investigation. The detectives shall be in command at the scene of an investiga- tion, and uniformed members shall render all possible assistance as directed by the detective personnel. Upon completion of the investi- gation, the uniform personnel will remain at the scene until it has been cleared and/or secured or as ordered by the detective division. § A107-21. Investigation of questionable deaths. The detectives shall be responsible for all investigations of all ques- tionable deaths and shall assist the Medical Examiner in the preli- minary examinations as to the cause of death. § A107-22. Cooperation with other law enforcement agencies The detective division shall compile all police intelligence received and exchange such intelligence with other law enforcement agencies, when ordered to do so by the Chief of Police. § A107-23. Rules of conduct. All rules of conduct pertaining to and relative to police officers shall apply to detectives and superior officers of the detective division. A10720 9-25-85 § A107-24 POLICE DEPARTMENT RULES § A107-29 §. A107-24. Use of intoxicating beverages. Detectives may use intoxicating beverages during the course of a specific investigation, but the use thereof shall not impair their fitness. • §. A107-25. Inquiries. Detectives shall be careful in their inquiries not to endanger unnec- essarily the reputation, of any person who may be the subject of an investigation. They shall at all times be courteous and considerate in speech and manner. §, A107-26. Requesting assistance. Detectives shall request any needed assistance from the uniformed patrol division through the ranking officer of that division when on duty. § A107-27. Inspections. Detectives shall have in readiness at all times an approved regula- tion uniform and shall appear in the same at departmental inspec- tions and on such other occasions as may be required by the Chief of Police, unless excused for good reason. § A107-25. Records and documents. No record or other document served or maintained by the division shall be detroyed, altered or removed except in compliance with the • law and departmental procedures. § A107-29. Dress. Detectives shall dress in civilian dress clothes unless directed oth- erwise by their Commanding Officer. A10721 9-25-85 § A107-30 SOUTHOLD CODE § A107-33 § A107-30. Procedures. All procedures for the detective division instituted by the Chief of Police will be deemed a rule and regulation and shall have the same effect, as if set forth herein. § A107-31. Monthly report. The Commanding Officer of the detective division shall prepare monthly a report of all arrests, felony and misdemeanor investiga- tions and any other investigations conducted by the detective division. § A107-32. Detectives to be on call. Detectives shall be on call as scheduled. "On call' shall mean avail- able to report for duty when and if their services are needed/required. ARTICLE VIII Members of the Department § A107-33. Duties. A. General duties. A member of the Department shall be re- sponsible at all times for the prevention of crime, enforce- ment of all laws and ordinances, preservation of the public peace, protection of life and property, arrest and prosecution of law violators and professional adherence to department rules and regulations. B. Specific duties. A member of the Department shall: (1) Know and conform to department rules and regulations. (2) Perform assigned duties in a professional manner. is (3) Obey all orders by the superior officers and the Chief of Police. (4) Be in attendance for those hours specifically assigned and will be considered on duty at all times for the pur- pose of rendering emergency police service. A10722 9-25-85 § A107-33 POLICE DEPARTMENT RULES § A107-33 (5) When in uniform, maintain a professional bearing and "render professional courtesy to superior officers. (6) Report immediately any incapacity or inability to per- form Department duties to his supervising officer. (7) Immediately report any change of marital status, ad- dress, telephone number or other matter affecting the administration of the Police Department to the Chief of Police. (8) Receive, record and service immediately all complaints and requests for service. (9) Possess a valid State of New York Operator or Chauf- feur's License. If lost or revoked, immediately report the same to the Chief of Police. (10) Remain on his duty post and leave only with the approv- al of the supervising officer. (11) Provide 'security and 'care for prisoners and others deliv- ered to his custody. (12) Search all prisoners. (13) Have matron or female police officer conduct a search of all female prisoners. (14) Help secure medical attention for all sick and injured persons. (15) When assigned to a police vehicle: (a) Inspect it for damage and defects. (b) Report damage/defect to supervising officer and make entry on activity sheet. • (16) When operating a police vehicle: (a) Use skill, good judgment and care for the safety to persons and property. (b) Obey all traffic regulations unless on emergency assignment. (c) Exercise prudence. A10723 9-25-85 § A107-33 SOUTHOLD CODE § A107-33 (17) Give a minimum of two (2) weeks' notice of intention to resign from the Department and thirty (30) days' notice of his intended retirement. (18) If loss or theft of any concealable weapon occurs, report it immediately to the Chief of Police. (19) Wear the prescribed uniform in the prescribed manner when assigned to uniform duty. (20) Report immediately the loss or damage of any depart- mental equipment in writing to the Chief of Police. (21) Register with the Department all personal firearms capa- ble of being concealed on the person. (22) Notify the appropriate fire department when a fire is discovered. Assist and cooperate with the fire department. (23) Report to the Chief of Police any information of a police nature, including offenses involving himself or others and offenses with which he has been charged, except minor traffic offenses. (24) Obey the laws and ordinances which he is obligated to enforce. (25) Be deemed on duty twenty-four (24) hours per day and subject to recall in the event of an emergency. (26) Court appearances. (a) Members of the Department will appear in court promptly at the time directed in their subpoena or notice of trial. (b) Members who are on duty will advise their super- vising Sergeant or supervising officer at the begin- ning of their tour of duty that they have to make a is court appearance. The supervising Sergeant or of- ficer shall so advise the department court liaison of- ficer, or in his absence, the court clerk, of the fact that the subpoenaed officer is on duty and request that he be kept on patrol, if possible, and subject to call when needed. Compliance with this request is at the option of the court. A10724 9-25-85 §'A107-33. POLICE DEPARTMENT RULES § A107-34 (c) One of the major functions of the court'liaison offi- cer is to coordinate the appearance of'p'olice officers so that minimum duty time is spent waiting in court. He shall coordinate as necessary with both the court and the supervisor of the duty squad. The supervisor shall take steps to assure the appearance ® of the needed officer as quickly as possible after tie- ing notified the officer's presence is needed -in court. (d) ' Officers -will leave the court'immediately upon com- pletion of their testimony and after determining that their further presence is no longer necessary. Officers not on duty will fill out, a; form PDTS405 (report of overtime) and have it signed by either the Judge or the court clerk. The court liaison officer will; in addition to his otherl duties-, see that -officers do not remain in the court any longer, than is necessary. (e) Officers will wear,eith'er;th'e appropriate, uniform of the day or, if off'duty, appropriate civilian clothes: Appropriate civilian clothing must, be clean and' neat and (for male officers) shall mean a shirt -with tie and a suit, or slacks and sport coat. Clothing should not be excessively loud in design or color. Leisure attire or workelothes are not- considered appropriate attire for court. Th'e court liaison offi- cer shall 'report noncompliance with this regulation to the Chief of Police in writing: ARTICLE IX General Rules • §;",A107-34. Maintenance of order. All members of:the Police Department shall be- subject, to these rules and -regulations. Members of the Department, are not merely employees but are officers of this state and town charged with specif- ic�dutieslin maintaining public order and administering justice: A10725. 9-25-95 § A107-35 SOUTHOLD CODE § A107-38 § A107-35. Duty of Department. It is the duty of the Police Department and the members of the Department all times of the day and night to protect life and proper- ty, prevent crime, detect and arrest offenders, preserve the public peace and enforce all laws and ordinances over which the Police De- partment has jurisdiction. § A107-36. Patrol duty. • A police officer regularly performing patrol duty shall proceed to his designated sector or relieving point without unnecessary delay, inspect his post immediately, remain constantly alert and observant, note any condition therein requiring police attention and take ap- propriate action. He is charged with the enforcement of all laws and ordinances; the proper condition and maintenance of departmental equipment, traffic control equipment of all types, streetlights, public highway, curb and sidewalk conditions within the boundaries of the post or sector of which he is assigned; he shall promptly report through official channels any condition requiring attention and shall provide safeguards when necessary. § A107-37. Supervisory officers. A supervisory officer, when on patrol, is charged with the en- forcement of all laws and ordinances and the enforcement of these rules and regulations. He is charged with the proper condition and maintenance of departmental equipment, traffic control equipment of all types, streetlights, public highway, curb and sidewalk condi- tions, within the command to which he is assigned, and he shall promptly report through official channels any condition requiring attention and shall provide safeguards when necessary. § A107-38. Fitness for duty. A member of the Department shall be fit for duty and subject to duty at all times except when on sick leave. A10726 9-25-85 § A107-39 POLICE DEPARTMENT RULES § A107-42 § A107-39. Other occupations. Members shall not engage in any other occupation within four (4) hours prior to reporting for duty. § A107-40. Confidentiality of official business. ® A member of the Department shall treat as confidential the official business of the Police Department. He shall not talk for publication nor be interviewed nor make public speeches, nor shall he impart information relating to the official business of the Department to anyone, except under due process of the law and as directed or with the permission of the Chief of Police. § A107-41. Sidearms. Members shall be responsible for the security of their sidearms at all times. § A107-42. Grooming. A. Hair grooming (male). (1) Regulations are applicable to male employees of the De- partment, and waivers may be granted by the Chief of Police to meet individual needs of special assignments. (2) Hair will be neat, clean, trimmed and present a well- groomed appearance. Hair will not exceed one and one- half (1%) inches in thickness as measured from the scalp; it will not extend below the collar but may extend to mid -ear. • (3) If a member chooses to wear sideburns, they will be neatly trimmed. Sideburns will measure not more than three-fourths (%) of an inch in width and not flare to more than one and one-half (1%) inches or extend below the ear. (4) If a member chooses to wear a mustache it must be neat- ly trimmed and may extend one-half (%) inch beyond and/or below the mouth. A10727 9-25-85 § A107-42 SOUTHOLD CODE § A107-43 (5) Beards, goatees and ponytails or similar configurations will not be allowed. A waiver for medical reasons may be granted by the Chief of Police. (6) Wigs or hairpieces will not be worn while on duty in uniform except for cosmetic reasons to cover natural baldness or physical disfigurement. If, under these con- ditions, a hairpiece or wig is worn, it will conform to the standards as set forth herein for natural hair growth. B. Hair grooming (female). (1) Hair will be neat, trimmed, clean and present a well- groomed appearance. Female personnel's hair will not exceed one and one-half (1%) inches in thickness as mea- sured from the scalp, will not extend below the collar but may extend to mid -ear. (2) Hair longer than above. is permissible, but when in uni- form a member must wear it in a style that conforms to the above. Hair must be pulled back away from the face and secured so that it does not interfere with the proper wearing of issued headgear. In no event shall ponytails or other styles or lengths of hair be exposed which may be readily grabbed by an aggressor. (3) Items used to hold hair up must blend with hair. Decora- tive articles may not be worn in hair. (4) Wigs or hairpieces will not be worn while on duty in uniform, except for cosmetic reasons to cover natural baldness or physical disfigurement. (5) Makeup, if worn, is to be worn in moderation (6) The Chief of Police will have the authority to waive these standards to meet the individual needs for special assign- ment. § A107-43. Sick time. A. Employees of the Department who are ill or injured and un- able to appear for duty should notify headquarters as soon as A10728 9-25-85 § A107-43 POLICE DEPARTMENT RULES § A107-44 possible upon making such a determination in order that a replacement may be obtained if necessary. In no event shall an employee make such notification less than two (2) hours prior to the time at which he is required to report for duty. In the case of civilian clerical employees, such notification shall be made no less than one (1) hour prior to the time at which he is required to report for duty. B. The Chief of Police shall have the authority to require addi- tional information and certification relative to sick -time re- quests in such form as he deems necessary. C. A member of the Department who is sick is assumed to be either at home or in the hospital or a doctor's office receiving treatment. Since the municipality pays the member for such sick time, it has the right to determine if such sick time is justified. Accordingly, the Department reserves the right to call or have its representative visit the residence of the member when such member is on sick call. D. Any member who is absent from duty for illness or injury, regardless of the duration, shall complete a form PDTS-109 (affirmation relative to illness or injury) and submit such form upon his return to duty. E. Notwithstanding any of the foregoing provisions, the Chief of Police shall have the right to require that the employee pre- sent himself to a physician acting at the request of the Chief of Police for the purpose of an examination. Such examina- tion shall be a charge against the Town of Southold. F. The failure of a member to comply with the above provisions could lead to a forfeiture of pay for such sick days. • ARTICLE X Word Usage § A107-44. Definitions; word usage. A. Word usage. MEMBER — Any employee of the Department, including civilian employees of the Department. OFF DUTY — All hours, other than when on duty. OFFICER — A member of the Police Department possessing police powers. ON DUTY — Hours specifically assigned to a member or any time involved serving during a police emergency even though a member was not specifically assigned. PROFESSIONAL — Conduct in accordance with the tenets of the Law Enforcement Code of Ethics, which is incorporat- ed herein and made a part of these rules. REGULATION EQUIPMENT — Equipment which meets specifications established by a department order. SUPERIOR OFFICER — A person holding a higher super- visory or command position. For a violation of the foregoing rules and regulations, or disobe- dience, or of incompetency to perform official duty, or of any act of • delinquency seriously affecting his general character or fitness for office, a member of the Police Department may be punished by rep- rimand, by forfeiture and withholding of salary or compensation, by extra tours or hours of duty, by suspension from duty, or by dismis- sal from the Department, in accordance with the provisions of Local Law No. 2-1964, a local law relating to the establishment of a Police Department for the Town of Southold, enacted on September 29, 1964.2 ARTICLE XII Construal of Provisions § A107-46. Conflict with Police Benevolent Association agree- ments. ARTICLE I Plans and Maps For Major Subdivisions § A108-1. Sketch plans. A. The sketch plan initially submitted to the Planning Board shall be based on the Town Tax Map, at a scale of one (1) inch equals one hundred (100) feet and shall show the following information: (1) A key map showing the location of the proposed subdivi- sion and the distance to the nearest existing street or road intersection. (2) All existing structures, wooded areas, streams or water- front and other significant physical features within the area to be subdivided and within two hundred (200) feet • thereof. (3) The name of the subdivision property owner and all of the adjoining property owners as listed on the town tax rolls. A statement in affidavit form shall be submitted setting forth the names and addresses of all persons, corporations, partner- ships and associates having an interest, direct or indirect, in the subdivision, and nature of such interest. § A108-2. Preliminary plans. A. Scale of map shall be one (1) inch equals one hundred (100) feet with two -foot contours extending two hundred (200) feet outside the limits of the project. B. Plans shall show all significant existing features, such as roads or streets, wooded areas, buildings, marshland, watercourses, sewers, water mains, etc. C. Highways shall be a minimum of fifty (50) feet in width and designed to the requirements of two hundred (200) feet visi- bility on.horizontal curves, depending on the curve data as • specified herewith. Profiles shall be designed to provide satis- factory sight distance of not less than two hundred (200) feet at vertical curves. D. Plan and profile for all proposed paved roads shall be laid out in a centerline station numbering system. E. Profiles for all roads shall be at a scale of one (1) inch equals five (5) feet vertical and one (1) inch equals fifty (50) feet horizontal. F. Drainage structures shall show such details as location, pipe • sizes, depth of excavation, type of catch basins and manholes, headwalls, recharge basins and leaching systems. Necessary easements for drainage facilities and for side slopes shall be shown. G. A test hole will be required at the proposed site for each re- charge basin Type A. The test hole must indicate sand and gravel at least five (5) feet below design depth. H. Borings shall be taken at, two -hundred -foot intervals for a depth of four (4) feet in the roadway to determine the type of soil present: This information shall be shown on the construc- tion .plans. §; A-108-3. Final plans. Final plans shall be submitted, upon receipt. of -written approval, and the, return of:one (1) copy of the preliminary plan approved, or approval as corrected, as follows: A. Final plans and profiles shall be to scales as indicated for preliminary plans showing actual distances along roads. B. Exact location and types of all drainage structures. C. Exact location of curbing and'sidewalks. D. Exact location of all easements. E. Location of street trees. F. Concrete monuments, four by four by thirty (4 x 4 x 30) inches, shall .be shown at all changes of, alignment, at points of curvature- and tangency and at one hundred (100) feet along curves. These monuments, together with the beginning and ending..of all roads, shall be shown on both sides of the highway. A10806 9-25-85 § A108-4 HIGHWAY SPECIFICATIONS 1§ A108-4 § A108-4. Construction plans. A. Construction plans shall be submitted for approval upon re- turn of final plans. Six (6) copies of construction plans shall be submitted. B. No work shall be done on major subdivision projects until ap- proved construction plans have been received by the sub- divider. C. The plans shall be at a minimum scale of one (1) inch equals one hundred (100) feet. All roads shall show beginning and ending stations. D. Roadway profiles shall be at a scale of one (1) inch equals five (5) feet vertically and one (1) inch equals fifty (50) feet horizontally. E. Profiles to show original ground elevations, grades, .stationing and elevations of grade intersections, length and corrections for vertical curves, including high and low points and drain- age structures where applicable. F. Drainage structures shall be exactly located by stations with details showing cover elevation, invert elevations, size and type of pipe and type of structure. Separate drawings shall be shown on the plans for drainage structures showing classifi- cation, type of grate, frames, covers, rings, size and number. Complete details for each type of recharge basin Type A shall also be shown separately. G. Typical road sections shall indicate width of right-of-way and easements, width of pavement, type of pavement showing surfacing and base material, sidewalks, type of curbs, road crown and shoulder grading. • H. All boring information as required, shall be shown on con- struction plans. I. The Highway Department, Construction Inspector and Plan- ning Board shall be notified two (2) days, before each phase of construction is begun if different from construction schedule. A10807 9-25-85 § A108-5 SOUTHOLD CODE § A108-8 ARTICLE II General Construction Requirements § A108-5. Progress schedule. A progress schedule of proposed major subdivision work shall be submitted by the subdivider. The schedule shall indicate the planned commencement and completion dates for the major items of work involved in the project. The schedule shall be reviewed by the Super- intendent of Highways and the Town Engineer for approval. Upon approval, or approved as corrected, the work shall be adhered to by the subdivider for the orderly performance and completion of the work. § A108-6. Responsibility of developer. A. The developer is responsible for keeping town roads, streets and private property free of debris and damage caused by construction operations or by stormwater runoff from the de- velopment sites. Any damage so caused shall be immediately repaired by the developer at his own expense. B. It shall be mandatory upon the subdivision developer that the work proceed in accordance with the best construction prac- tice and that all necessary measures be taken for the protec- tion of the public health, safety and welfare. § A108-7. Traffic maintenance. The flow of traffic or the safety thereof on any public street or highway within the town shall not be restricted or endangered in any way by construction operations, equipment, vehicles or materials connected with road construction by subdivision development. • § A108-8. Stormwater runoff. Stormwater runoff from developments must be confined to the site unless adequate facilities exist. Methods of providing temporary drainage shall be approved by the Town Engineer. Rainfall runoff onto roads, streets or private property is prohibited. A10808 9-25-85 § A108-9 HIGHWAY SPECIFICATIONS § A108-12 § A108-9. Protection of new drainage installations. All drainage facilities during construction shall be cleared of lumber debris, dirt or other objectionable material after completion and shall be maintained in a clean condition until time for use. • § A108-10. Topsoil removal. Topsoil shall not be removed from developments without approval from the appropriate town departments. § A108-11. Street name signs. The name of streets and roads may be proposed by the owner or owners of property dedicating such highways, but the name of such highway shall be subject to the approval of the Town Board and the Planning Board. Street identification signs, stop signs, dead-end signs or other signs required shall be of a type approved by the Su- perintendent of Highways. Signs shall be provided by the subdivider and placed at all intersections and at other locations as directed by the Superintendent of Highways. § A108-12. Dead-end streets. A. All highways ending at tidewater shall terminate one hundred (100) feet back from the mean high-water elevation. Each dead-end road shall have a dead-end sign on a ten -foot steel U -type signpost. B. All dead-end highways must have a width of not less than one hundred (100) feet for a distance of one hundred (100) feet from the dead end to provide for a turnaround, all of which must be cleared of trees, bushes and stumps. A guardrail shall be installed along the entire dead-end length. Such guardrail shall be on galvanized steel (flex -beam type), 12 - gauge, eighteen and one-half (18%) inches in width erected on four -inch- by six-inch- by seven -foot- , CCA .6, treatment posts placed in the ground for a depth of three (3) feet. The A10809 9.25 : 85 § A108-12 SOUTHOLD CODE § A108-15 dead-end sign shall be placed in the center of the dead-end width in the rear of the guide rail with posts spaced at twelve (12)'feet on center. §' A'108-13: Drainage easements. A. Where it is necessary to have a drainage area located beyond the fifty -foot bounds of the highway, fee title to such area shall be conveyed to the Town of Southold, together with the necessary land to connect such area to the bounds of the highway. Easements shall have a minimum width of twenty (20) feet. B. Corrugated pipe having a minimum diameter of eighteen (18) inches, extending from the drainage area to the bounds of the highway, shall be installed with clean-out boxes at one -hun- dred -fifty -foot intervals. f A10844. Temporary roads. A. When temporary traffic is permitted on• subdivision roads prior to construction of stabilized base courses and asphalt binder courses, a passable all-weather road must be main- tained at all times with specific attention to winter and spring weather. B. Traffic on stabilized base courses and asphalt binder courses shall be subject to approval by the Superintendent of High- ways. ARTICLE III Roadway Construction § A108-15. Clearing and grubbing. Clearing and grubbing shall consist of the removal of all trees, brush, stumps, fences, debris and other miscellaneous materials within the designated right-of-way areas as shown on the plans. Off - A10810 9-25-85 § A108-15 HIGHWAY SPECIFICATIONS § A108-18 site disposal: all tree trunks, stumps, roots and other materials shall be removed from the site and disposed of by the contractor at the town landfill. § A108-16. Stripping and stockpiling soil. • Existing topsoil shall be stripped to its full depth between the right-of-way limits, or as ordered, and stockpiled on the site for fu- ture use: Stripping shall be completed prior to starting general ex- cavation in an area. § A108-17. Excavation and embankment. A. Excavation shall consist of the excavation, use of or disposal of all materials of any description encountered in the course of construction. B. The proposed road section in cuts or fills shall meet the exist- ing abutting surface with a one (1) on two (2) slope or as shown on the plans. Where the proposed slopes extend beyond the bounds of the highway (right-of-way), the necessary re- leases, easements or deeds must be obtained from the proper- ty owner or owners. C. Roadway embankments shall be constructed with suitable material from excavation or from acceptable borrow when necessary. Embankments shall be constructed in successive uniform layers not exceeding eight (8) inches. Each layer shall be thoroughly compacted with steel wheel or pneumatic tired rollers to the approval of the Construction Inspector. The drainage system may be installed at any time before the final grading of roads is completed. D. When feasible, excavation and embankment within the con- struction site shall have a reasonable balance. § A108-18. Base course for asphalt pavement. A. The base course shall consist of three -fourths -inch stone blend or crushed concrete compacted to a four -inch depth. If clay or other unsuitable material is found below the base course, it shall be removed and replaced with twelve (12) inches of compacted bankrun containing ten percent (10%) or more of A10811 9-25-85 § A108-18 SOUTHOLD CODE § A108-19 gravel. The twelve -inch replacement depth may be modified according to existing conditions as approved by the Engineer. B. The soil base shall be compacted to the satisfaction of the En-. gineer and shall be smooth, parallel to and at the required depth below the base course. The soil base shall not be in a muddy or frozen condition before -placing base. course mate- rial. The base course material shall be deposited on the pre- pared grade, by means of dump truck, spreader; tailgate or other approved methods of depositing. Spreading the base course material shall be done by approved spreading equip ment. After the loose material has been spread, evenly so that it will have the required thickness after compaction, correct grade for,succeeding courses, segregation of any large or fine particles corrected, it shall be rolled with approved rollers weighing not less than ten (10), tons. Rolling must begin at the sides and continue toward the center and shall continue until there is no -movement of the course ahead, of the roller. A min- imum of four (4) passes of rollers will. be. required. Approved vibratory rollers may be used at the option of the contractor: Where the use -of a roller is impractical, approved vibrating plate compactors or impact rammers shall be used to com- pact the base material. C. Upon the completion of the base course, the contractor shall request an inspection by the Engineer or Inspector and shall not proceed with further road work until such inspection has been made and the work approved. A108-19. Binder course and wearing course. A., The binder course shall be two , and one-half '(2%) inches in depth. The material shall be local sand and gravel pit run, passing the three -fourth -inch screen with filler added. The • filler material shall be local fine sand. The combined mate- rials shall show. the following composition: (1) Passing the three -fourths -inch square sieve: one hundred percent (100%). (2) Passing the No. 4 sieve: seventy-five percent .(75%) to ninety percent (90%). A10812 9-25-85 • § A108-19 HIGHWAY SPECIFICATIONS § A108-19 (3) Passing the No. 10 sieve: fifty percent (50%) to seventy- five percent (75%). (4) Passing the No. 40 sieve: twenty-five percent (25%) to fifty percent (50%). (5) Passing the No. 80 sieve: twelve percent (12%) to twenty percent (20%). (6) Passing the No. 100 sieve: four percent (4%) to twelve percent (12%). (7) Asphalt cement grade AC -20: six percent (6%) to eight percent (8%). (8) Temperature range placing: two hundred twenty-five degrees to two -hundred seventy-five degrees Fahrenheit (225° to 275° F.). B. The wearing course shall be one and one-half (1%) inches in depth. The coarse aggregate shall consist of crushed stone, the fine aggregate sand and mineral filler. The mineral filler shall consist of limestone dust, cement or silica sand. C. The binder course shall be placed on the stabilized base course when it has been satisfactorily completed and ap- proved by the Engineer or Inspector. The material shall be placed only when the surface to be covered is dry, clean and weather conditions in the opinion of the Engineer are suita- ble. All defective areas in the base course shall be repaired as directed. The bituminous courses shall be placed with an ap- proved finishing paver with screed heating equipment, capa- ble of placing a fourteen -foot width and to such appropriate loose depth that when the work is completed the required, compacted thickness will have been met. The courses shall be compacted with ten -ton tandem steel wheel rollers or vibrato- ry rollers of a type as approved by the Engineer. During the initial rolling, rollers shall travel parallel to the center line beginning at the edge and working toward the center, over- lapping on successive passes by one-half (%) of the roller wheels. A minimum of four (4) passes of rollers will be required. D. The temperature of the material, when placed, shall not be less than two hundred twenty-five degrees Fahrenheit (225° F.). No material shall be placed when the air and surface on which the material is to be placed is below forty degrees Fahr- enheit (40° F.). § A108-20. Asphalt pavement cores. When requested by the Superintendent of Highways, cores shall be taken by a reliable testing laboratory, after approval of the laborato- ry by the Town Engineer, at the developer's expense. One (1) core from the finished pavement for each five hundred (500) feet of road will be required. A10814 9-25-85 § A108-21 HIGHWAY SPECIFICATIONS § A108-21 § A108-21. Drainage design criteria. All stormwater collection systems shall be designed in accordance with the following minimum standards and shall be submitted on design sheets to be reviewed by the Town Engineer. A. Rational method. The rational method shall be as follows: Q = Aci • Where Q = Discharge in cubic feet per second (c.f.s.). A = Tributary drainage area in acres within the subdivi- sion and shall include areas outside the subdivision. c = Coefficient of runoff drainage area. Manholes. Maximum distance between manholes,shall -be four hundred (400) feet. " Manholes shall be installed where there are changes in pipe alignment, grade, pipe size change and at road intersections or other locations where catch basins, inlets or laterals are to be connected. § A108-24. Drainage pipe. The' -minimum diameter of stormwater drainage pipe' shall be eighteen (18) inches. The pipe shall be 14 -gauge galvanized corrugat- ed steel, aluminum or reinforced concrete. Other types of drainage pipe may be used only with approval of the Suprintendent of High- ways. A10816 9-25-85 § A108-25 HIGHWAY SPECIFICATIONS § A108-26 § A108-25. Pipe installations. The trench width shall be the diameter, plus twenty-four (24) inches. Trench bottoms shall be flat and to the required pitch with holes as necessary for bells, joints and jointmaking. Sheating and bracing of trenches and structure excavation shall be used whenever soil conditions or depths of trenches indicate caving. Backfill in trenches under paved areas shall be compacted with vibrating plate compactors or impact rammers. § A108-26. Recharge basins Type A. A. Recharge basins are designed to return stormwater to the ex- isting groundwater aquifer. An area of eight (8) acres or more shall be deemed necessary for a recharge basin. In areas less than eight (8) acres, other drainage facilities may be installed as approved by the Town Engineer. B. All stormwater recharge basins Type A shall be designed to provide storage based on anticipated runoff from a six-inch rainfall in twenty-four (24) hours on the tributary area under conditions of total potential development multiplied by a weighted runoff coefficient [minimum twenty hundredths (0.20)]. C. The depth of recharge basins will be determined from design. This measurement shall be two (2) feet below the elevation of the berm or elevation of grate at the inlet basin at the low point in the tributary drainage system, whichever is the lowest. D. A test hole shall be required at the bottom elevation of re- charge basins and shall indicate at least five (5) feet of good leaching material. E. Fencing, complete with gate, shall be installed before excava- tion. F. If feasible, the area of the recharge basin shall be cleared of trees, only where excavation and grading is required, and A10817 9-25-85 § A108-26 SOUTHOLD CODE § A108-27 that a natural tree screening shall remain along the perime- ter of the basin. G. Asphalt gutters will be required around sections of the pe- rimeter or recharge basins where possible erosion from up- land runoff{may occur. H. Asphalt gutters shall have an elliptical section four (4) feet in width, a depth of six (6) inches and four (4),inches in thick- ness. The asphalt gutters shall be installed where necessary in the perimeter of the recharge basin as directed by the En- gineer. The outfall of the gutter shall be carried through the berm and down the slope to the bottom of the recharge basin. An asphalt spillway apron, eight by eight (8 x 8)'feet and four (4) inches in depth, shall be placed on the bottom of the re- charge basin at the gutter. I: Alternate methods to direct the outfall flow from asphalt gut- ters into the recharge -basin can be submitted for approval. J! Headwalls on all'outfall drainage lines into recharge -basins Type A shall'be concrete. §• A•108-27. Landscaping of recharge basins Type A. Topsoil shall be placed six (6) inches in depth on the bank around' the recharge basin from the inside of the fence to a line four (4)'feet down from the top of the slope. All topsoil areas shall be limed, fertil- ized and seeded. The area around the fence shall have screen plant- ing parallel to and outside the fence around the entire recharge ba- sin; except at the gate. A. Topsoil. Topsoil shall consist ofnatural loam free of refuse, stones larger than one (1) inch, weeds or other objectionable material. It shall contain not less than five percent, (5%) and not -more than twenty percent (20%) organic material. Topsoil shall be six (6) inches in depth when compacted. The surface shall be smoothly- graded to meet established elevations and' adjacent ground levels. B. Liming. Limestone shall be agricultural limestone with a to- tal -carbonate content of not less than eighty percent (80%) or A10818 9-25-85 § A108-27 HIGHWAY SPECIFICATIONS § A108-27 forty-five percent (45%) calcium oxide equivalent for the pur- pose of calculations. Total carbonates shall be considered as calcium carbonate. Limestone shall be evenly distributed at the rate of fifty (50) pounds per one thousand (1,000) square feet and worked into the top three (3) inches of the soil. C. Fertilizing. Not less than five (5) days after the application of • limestone, commercial fertilizer 5-10-5 shall be evenly dis- tributed at the rate of twenty (20) pounds per one thousand (1,000) square feet and worked into the top three (3) inches of the soil. D. Seeding. Grass seed shall be fresh, recleaned seed containing at least twenty percent (20%) of chewing, creeping, red, mead- ow or alter fescue with a minimum germination of eighty percent (80%). Inert matter and weed seeds shall not exceed eight percent (8%). The seedman's certificate of analysis shall be available for inspection. Grass seed shall be sown evenly at the rate of four (4) pounds per one hundred (100) square feet. The seed shall be covered to a proper depth by raking or oth- er suitable means. After seeding and raking, the surface shall be rolled with an approved roller, weighing at least one hundred (100) pounds. Grass seeding shall be done between April 1 and May 30 or between August 15 and October 15 and shall not be accepted unless there is a uniform growth evident over all seeded areas. E. Screen planting. (1) All trees shall be nursery grown and shall be nominal columnar or narrowly pyramidal habit of growth typi- cally characteristic of the particular variety. Only the following species and varieties are acceptable: ® (a) Douglas fir (pseudotsuga menziesii). (b) Canadian hemlock (tsuga canadensis). (c) Colorado spruce (picea pungens). (d) Native cedar (thuja accidentalis). (e) Norway spruce (picea excelsa). A10819 9-25-85 § A108-27 SOUTHOLD CODE § A108-30 (2) All evergreen trees shall be moved with a burlap and tied with a good grade of haylop or heavy twine. The size of ball for all specified evergreen trees shall be a min- imum of twelve (12) inches in diameter and deep enough to include all lateral roots. All evergreen trees shall be set plumb at such level that after settlement they have the same relationship to the elevation of the surrounding ground a& they had to the ground from which they were dug. All trees shall be planted, and the holes backfilled and tamped with topsoil. The screen planting shall be maintained and all dead or dying trees replaced by the developer until such time as the recharge basin has been accepted by the town. . § A108-28. Recharge basins: Type B.' Recharge basins Type B may be used for drainage runoff from small tributary areas with the exception of clay, unsuitable material, etc. when approved ; by the Superintendent of Highways and - the Town Engineer. For details, see Standard Sheet No. SD -696? § A108-29: Design criteria for leaching basins. The -design criteria for leaching basins shall be as follows: Vc = ARC. Where Vc = Volume capacity in cubic feet. A = Tributary drainage area in square feet within the subdivi- sion and shall include areas outside the subdivision if necessary. R- = Two (2) inches of rainfall. C = Weighted coefficient for runoff of the drainage area (min- imum C = 0.30). § A108-30. Stormwater drainage systems. Stormwater drainage systems shall consist of catch basins. -and in- terconnected leaching basins. Systems can be within the right-of-way or in other approved locations with different arrange- ments of leaching basins where soil conditions are suitable for infil- tration. For details see Standard Drawing No. SD -697.3 § A108-31. Additional standards. This system, catch basin and leaching basin, shall be used for mi- nor drainage areas only. The catch basin shall be substituted with a precast concrete catch basin and appropriate casting when shown on the plans. The leaching basin shall have a six-inch reinforced con- crete cover instead of a casting when approved by the Superinten- dent of Highways. For other details see Standard Drawing No. SD -694.4 § A108-32. Concrete footings and cutoff walls. Concrete footings and cutoff walls shall be placed on undisturbed original ground. If undercut, the bearing areas shall be consolidated with mechanical tampers or filled with concrete. Concrete shall be three thousand (3,000) pounds at twenty-eight (28) days. Exposed surfaces shall have a finish acceptable to the Construction Inspector. For construction details, dimensions, reinforcing, etc., see Standard Sheet No. SD -7615 § A108-33. Curbs and gutters. A. All types of concrete curbing and gutters shall have three thousand (3,000) pounds per square inch at twenty-eight (28) days. Exposed surfaces shall have a wood float finish or as is directed. B. Concrete curbs shall be installed on both sides of all roads within major subdivisions or developments. A10821 9-25-85 § A108-33 SOUTHOLD CODE § A108-36 installed at all intersections for at least ten (10) feet on each side of the curve and at least ten (10) feet on each side of a drainage inlet structure intake and also on both sides of any road having grades of five percent (5%) or more. C. The curb to be constructed shall conform to the type as shown on a plan of typical road sections. Expansion joints of one -half- inch premolded bituminous material shall be placed at twen- ty -foot intervals on all type of curb, including integral curb. and gutter. Expansion joints shall also be placed on both sides of curb inlet castings. D. The subgrade for all types of curbs and gutters shall be con- solidated with mechanical tampers before forms are placed. E. Where curbing has been waivered and not required by the Superintendent of Highways, the Planning Board and the Highway Committee, a detailed drawing of the cross section of the road. shall be shown. Without such curbing details of the road, surfacing and shoulder grading must be submitted. §' A,108-34: As -constructed survey. An as -constructed curb and drainage installation survey will be required and submitted for approval before permission will be given to construct pavement. § A108-35. Sidewalks. Sidewalks shall be constructed of one -to -two -to -four concrete mix consisting of one (1) part cement, two (2) parts of fine aggregate and four (4) parts of coarse aggregate. Compressive strength at twenty- eight (28) days shall not be less than three thousand (3;000) pounds. Sidewalks shall be four (4) inches in depth, except at driveways where they shall be six (6) inches in depth. Widths, expansion joints, • mesh reinforcing, finishing and curing, protection in freezing weath- er, etc., shall be as required by the Superintendent of Highways. § A108-36. Concrete cylinders. Cylinders shall be taken to determine the strength of concrete at twenty-eight (28) days as required by the Superintendent of High - A10822 9-25-85 § A108-36 HIGHWAY SPECIFICATIONS § A108-40 ways. Cylinders shall be made and tested by an approved testing laboratory at the expense of the developer. The number of cylinders to be tested shall be two (2) each per day of the different types of concrete placing or as directed. § A108-37. Granite curb. Granite curb may be used when approved by the Superintendent of Highways. The subgrade in trenches for the poured concrete foundation shall be compacted with vibrating plate compactors or other approved methods. The use of compacting equipment may be waived, providing that the trench subgrade is in undisturbed natural ground. For other construction details, see Standard Drawing No. SD -851.6 § A108-38. Fire wells. Requirements for fire wells, location, type and number of deep or shallow fire wells shall be determined by the Planning Board and approved by the Commissioners of the Fire District where proposed subdivisions are located. § A108-39. Fencing and curbs at recharge basins. Fencing shall include the installation of green vinyl -clad chain link fencing, gates, curbs and all other related items of sizes and re- quirements as specified on Standard Drawing No. SD -764? § A108-40. Seeding. • Seeding for slopes, shoulders and other areas where shown on the plans or as required in these specifications shall be in accordance with the requirements for seeding as shown for landscaping at re- charge basins Type A. The soil shall be made loose and" friable for a depth of one (1) foot below the bottom of all pits. V. Where, in, the opiniom of the Engineer, the subgrade material, is unsuitable, the size of the pits shall be' dug wider and deep- er than normally required. The' bottom, and sides shall be backfilled with topsoil and thoroughly worked into place. E. Backfill for tree pits shall consist of topsoil and manure mixed in the proportions of seventy-five percent (75%) topsoil' and twenty-five percent (25%) manure. Trees shall' be handled so that the ball will not be loosened. After the backfill has been firmed under the ball and around it in six-inch to eight - inch lifts, it shall b'e thoroughly settled with water. A10824 9-25-85 § A108-41 HIGHWAY SPECIFICATIONS § A108-41 F. Staking of trees shall be done immediately after planting and maintained until final acceptance. Trees shall stand plumb after staking and shall be supported by two (2) stakes, eight (8) feet or more in length, driven -into the ground for three (3) feet and fastened securely with double strand No. 12 steel wire through reinforced black rubber hose at the trees. G. Trees shall be wrapped with new six-inch plain burlap ban- dage when directed by the Engineer. The bandage, when used, shall cover the entire surface of the truck to the height of the first branches. H. Pruning of any badly bruised or broken branches shall be done as directed and the cuts painted with an approved tree paint depending on the size of the cuts. All trees shall be sprayed with an approved antidesiccant, using a power spray to apply an adequate film over trunks, branches and/or over the foliage when directed by the Engineer. I. At the time of planing the soil, around the trees shall be tho- roughly saturated with water and as many times thereafter as seasonable conditions require during. the period to final acceptance. J.
