§ 24-1. Purpose.
The purpose of this chapter is to establish standards and
• controls of the various types of fire, intrusion, holdup and other
emergency signals from fire and police alarm services that
require Fire Department or police responses, investigation or
safeguarding of property at the location of an event reported by

a signal which is transmitted by telephone or radio to the Police
or Fire Department from a central station as hereinafter
defined.
§ 24-2. Definitions.
For the purpose of this chapter, the following definitions shall
apply:
ALARM INSTALLATION — Any .fire or police alarm
device or aggregation of fire or police alarm devices
installed on or within a single building or on or within
more than one (1) building or area adjacently located on
a common site at a specific location.
CENTRAL ALARM STATION — Any facility operated
by a private firm that owns or leases a system of fire or
police alarm devices, which facility is manned by
operators who receive, record or validate alarm signals
and relay information about such validated signals to the
Police or Fire Department when appropriate.
DIAL ALARM — Any fire or police alarm device which is
a telephone device or telephone attachment that
automatically or electronically selects a telephone line
connected to a central alarm station or police
headquarters and reproduces a prerecorded message to
report a criminal act or other emergency requiring the
Police or Fire Department.
DIRECT ALARM — Any fire or police alarm device
connected directly by leased telephone wires from the
specified location to police headquarters or the Fire
Department. •
EMERGENCY ALARM — Any fire or police alarm device
designed to be activated by a fire, criminal act or other
emergency at a specific location or by a victim of a
holdup, robbery or other emergency or criminal act at a
specific location.

FALSE EMERGENCY ALARM — Any signal activated
by an emergency alarm to which the Fire or Police
Department responds which is not the result of a fire,
holdup, robbery or other crime or emergency.
FIRE DEPARTMENTS — Buildings owned by the fire
districts of Orient, East Marion, Southold, Cutchogue,
• Mattituck and their respective protection areas.
FIRE OR POLICE ALARM DEVICE — Any device
which, when activated by a fire, criminal act or other
emergency requiring Police or Fire Department response,
transmits a prerecorded message or other signal by
telephone, radio or other means to a central alarm
station or directly to the Police or Fire Department or
produces an audible or visible signal designed to notify
persons within audible. or visible alarm range of the
signal.
INTRUSION — Any entry into an area or building
equipped with one (1) or more fire and police alarm
devices by any person or object whose entry actuates a
fire or police alarm device.
LICENSING AUTHORITY — The Town Board of the
Town of Southold or its designated agent.
POLICE HEADQUARTERS — Police headquarters and
other enclosures housing privately orpublicly owned
equipment serving the police.
TOWN OF SOUTHOLD — All of the Town of Southold,
excluding Fishers Island.
• § 24-3. Permit required.
Any property owner or lessee of property in the Town of
Southold having on his or its premises a fire or police alarm
device or system of fire or police alarm devices shall apply to the
licensing authority for a permit to own or otherwise have such

device on his or its premises. The application shall contain
provisions relating to the device or system of devices installed
or to be installed on the premises. No such device may be
installed on the premises of the owner or lessee and no
presently existing fire or police alarm device complying with the
provisions of this chapter shall be modified after the effective
date of this chapter prior to the licensing authority's having
issued a permit to such owner or lessee. Such permit shall be •
valid for a period of one (1) year from issuance and must be
renewed upon expiration.
§ 24-4. Fees.
Permit fees shall be as follows:
A. Owner or lessee permits:
(1) Initial permit: twenty-five dollars ($25.).
(2) Renewal permit: ten dollars ($10.).
§ 24-5. Intentional false alarms.
It shall be a violation of this chapter to intentionally cause a
false emergency alarm, and any person who does intentionally
cause a false emergency alarm shall be subject to the penalty
provision hereof.
§ 24-6. Charges for false alarms; rules and regulations.
A. Any owner or lessee of property having a fire or police
alarm device or system of fire or police alarm devices on
his or its premises on the effective date of this chapter
shall pay to the town a charge for each and every false
emergency alarm to which the Fire or Police Department
responds, in each calendar year, as follows:

(1) First and second false emergency alarm each
calendar year: no charge.
(2) Third and all. subsequent false emergency alarms
each calendar year: one hundred dollars ($100.).
B. The above charges shall be paid to the Town Clerk.
• Failure to pay any such charges shall subject such
owner, lessee or user to the penalty provisions of this
chapter. -
C. The licensing authority shall promulgate rules,
regulations and standards which may be necessary for
the purpose of assuring the quality, efficiency and
effectiveness of fire or police devices and alarm
installations owned, operated, maintained, installed,
leased or sold by a licensee pursuant to Article 6-D of the
General Business Law of the State of New York and to
facilitate the administration of this chapter. The
Southold Police Department shall enforce the provisions
of this chapter. The aforesaid rules, regulations and
standards shall be set forth in writing, and copies shall
be available for licensees.
§ 24-7. Severability.
If any part or parts of this chapter are for any reason held to
be invalid, such decision shall not affect the validity of the
remaining portions of this chapter. The Town Board hereby
declares that it would have passed the local law enacting this
chapter and each section, subsection, sentence, clause and
phrase thereof, irrespective of the fact that any one (1) or more
sections, subsections, sentences, clauses or phrases might be
• declared invalid.
§ 24-8. Penalties for offenses.
Any person, firm or corporation who or which does not pay
any charge or fee established in this chapter or who or which

violates any provision of this chapter shall be subject to a fine
not in excess of two hundred fifty dollars ($250.) for each
offense. A separate offense shall be deemed committed upon
each day during which a violation occurs or is committed, and
such violation may constitute disorderly conduct, in which
event such person shall be a disorderly person.

Senior Citizen Exemption

§ 85-1. Partial exemption for senior citizens. [Amended

A. Amount of exemption.
(1) Real property owned by one (1) or more persons,
each of whom is sixty-five (65) years of age or over,
or real property owned by husband and wife, one (1)
of whom is sixty-five (65) years of age or over, shall
be exempt from town taxes to the extent provided
subject to the following income limitations:

(2) Such exemption shall be computed after all other
partial exemptions allowed by law have been
subtracted from the total amount assessed.
B. The real property tax exemption on real property owned
by husband and wife, one (1) of whom is sixty-five (65)
years of age or over, once granted, shall not be rescinded
solely because of the death of the older spouse, so long as
the surviving spouse is at least sixty-two (62) years of
age.

§ 85-2. Conditions. [Amended 3-12-1985 by L.L. No.
3-1985]
No exemption shall be granted:
A. If the income of the owner or the combined income of the
owners of the property for the income tax year
• immediately preceding the date of making application for
exemption exceeds the sum of sixteen thousand eight
hundred twenty-five dollars ($16,825.). "Income tax year"
shall mean the twelve-month period for which the owner
or owners filed a personal income tax return or, if no
return is filed, the calendar year. Where title is vested in
either the husband or the wife, their combined income
may not exceed such sum. Such income shall include
social security and retirement benefits; interest;
dividends; total gain from the sale or exchange of a
capital asset, which may be offset by a loss from the sale
or exchange of a capital asset in the same income tax
year; net rental income; salary or earnings; and the net
income from self-employment, but not including a return
r of capital, gifts or inheritances. In computing net rental
income and net income from self-employment, no
depreciation deduction shall be allowed for the
exhaustion, wear and tear of real or personal property
held for the production of income. [Amended 4-5-1988

B. Unless the title of the property shall have been vested in
the owner or one (1) of the owners of the property for at
least twenty-four (24) consecutive months prior to the
date of making application for exemption; provided,
however, that in the event of the death of either a
husband or wife in whose name title of the property shall
have been vested at the time of death, and then becomes
vested solely in the survivor by virtue of devise by or
descent from the deceased husband or wife, the time of
ownership of the property by the deceased husband or

wife shall be deemed also a time of ownership by the
survivor, and such ownership shall be deemed
continuous for the purposes of computing such period of
twenty-four (24) consecutive months, and provided
further that in the event of . a transfer by either a
husband or wife to the other spouse of all or part of the
title to the property, the time of ownership of the
property by the transfer or spouse shall be deemed also a •
time of ownership by the transferee spouse, and such
ownership shall be deemed continuous for the purposes
of computing such period of twenty-four (24) consecutive
months, and provided further that where property of the
owner or owners has been acquired to replace property
formerly owned by such owner or owners and taken by
eminent domain or other involuntary proceedings, except
a tax sale, the period of ownership of the former property
shall be combined with the period of ownership of the
property for which application is made for exemption and
such periods of ownership shall be deemed to be
consecutive for purposes of this Article. Where a
residence is sold and replaced with another within the
state, the period of ownership of both properties shall be
deemed consecutive for the purposes of this Article.
C. Unless the property is used exclusively for residential
purposes.
D. Unless the real property is the legal residence of and is
occupied in whole or in part by the owner or by all of the
owners of the property.
§ 85-3. Applications.
Applications for such exemption must be made by the owner
or all of the owners of the property, on forms prescribed by the
State Board, to be furnished by the appropriate assessing
authority, and shall furnish the information and be executed in
the manner required or prescribed in such forms and shall be

filed in such assessor's office on or before the appropriate
taxable status date.
§ 85-4. Reapplications. [Amended 3-12-1985 by L.L. No.
3-1985]
A. At least sixty (60) days prior to the appropriate taxable
status date, the assessing authority shall mail to each
person who was granted exemption pursuant to this
Article on the latest completed assessment roll an
application form and a notice that such application must
be filed on or before taxable status date and be approved
in- order for the exemption to be granted. The assessing
authority shall, within three (3) days of the completion
and filing of the tentative assessment roll, notify by mail
any applicant who has included with his application at
least one (1) self-addressed, prepaid envelope of the
approval or denial of the application; provided, however,
that the assessing authority shall, upon the receipt and
f , filing of the application, send by mail notification of
receipt to any applicant who has included two (2) of such
envelopes with the application. Where an applicant is
entitled to a notice of denial pursuant to this subsection,
such notice shall be on form prescribed by the State
Board and shall state the reasons for such denial and
shall further state that the applicant may have such
determination reviewed in the manner provided by law.
Failure to mail such application form and notice or the
failure of such person to receive the same shall not
prevent the levy, collection and enforcement of the
payment of the taxes on property owned by such person.
• B. Notwithstanding any other provisions of this Article, in
the event that the owner, or all of the owners, of property
which has received an exemption pursuant to this Article
of the preceding assessment roll shall fail to file an
application for such exemption on or before the taxable
status date, such owner or owners may file, and the
assessing authority shall accept the application,

executed as if such application has been filed on or before
the taxable status date, if such application is filed with
the assessing authority on or before the date for the
hearing of complaints.
§ 85-5. Penalties for offenses.
Any conviction of having made any willful false statement in
the application for such exemption shall be punishable by a fine
of not more than one hundred dollars ($100.) and shall
disqualify the applicant or applicants from further exemption
for a period of five (5) years.
§ 85-5.1. Notice. [Added 3-12-1985 by L.L. No. 3-19851
The assessing authority shall notify, or cause to be notified,
each person owning residential real property in the town of the
provisions of this Article, such notice to be sent with each tax
bill to such persons, and shall be in such form and content as
shall comply with the provisions of Subdivision 4 of § 467 of the
Real Property Law.
ARTICLE II
Business Investment Exemption

§ 85-6. Exemption repealed.
Pursuant to the authority of Subdivision 7 of § 485-b of the
Real Property Tax Law, the partial exemption from taxation,
special ad valorem levies and service charges provided by such
§ 485-b is hereby repealed insofar as such exemption would .
have been applicable to eligible real property assessed for town
purposes.
