The following rules and regulations shall apply to all waters within the Town of Southold and to all waters bounding the Town of Southold to a distance of one thousand five hundred (1,500) feet from the shore; provided, however, that they shall not apply to waters within or bounding an incorporated village of the town to a distance of one thousand five hundred (1,500) feet from the shore. § 32-31. Definitions. For the purpose of this Article, the terms used herein are defined as follows: BOATS — Every vessel propelled in any manner. [Amended 5-19-87 by L.L. No. 5-1987] BOWRIDING — The practice of riding on the bow of a vessel when such vessel is not equipped by the manufacturer with facilities for riding on the bow while said vessel is underway. [Added 8-28-1990 by L.L. No. 17-19901 CHANNEL SYSTEM — The bed of a natural waterway with well-defined banks presenting the evidence of the flow of tidal waters and commonly or usually traversed by watercraft; and, in addition, refers to man-made or stabilized waterways designed for the navigation of watercraft. For the purpose of this Article, boat basins and bathing areas are included in the "channel system." [Added 8-28-1990 by L.L. No. 17-19901 PERMANENT MOORING — Any of a number of different mechanical or cable -like systems the intended purpose of which is to permit the securing of a boat to a fixed location. Said system typically consists of an anchoring device (mushroom or other) which is placed on the bottom of the harbor and is connected to a floating device (i.e., ball) by cables and/or lines. [Added 5-10-1983 by L.L. No. 5-1983; amended 6-2-1992 by L.L. No. 12-1992] TEMPORARY ANCHORING — The securing of a boat in a harbor on a temporary basis by means of an anchor carried aboard the boat. [Added 5-10-83 by L.L. No. 5- 19831 3205 8-25-92 § 32-32 SOUTHOLD CODE § 32-33 § 32-32. Sanitary regulations. [Amended 8-10-71] The dumping of oil, 'refuse, garbage, sewage or waste is prohibited. § 32-32.1. Ramps. [Added 8-28-1990 by L.L. No. 17-1990] A. All boat engines must be shut off when loading or unloading at any town boat ramp. B. No person shall park or leave any unattended vehicle on any ramp. § 32-33. Unnavigable boats; hazards to navigation. A. Any boat which becomes a menace to navigation or un- seaworthy, or sinks, grounds or otherwise becomes disabled or incapable of navigation shall be removed or restored to navigable condition by the registered owner upon notice from the Southold Town Board or its designated agent, which notice shall be either by personal service or by certified mail addressed to the registered owner's last known address as given by him or as stated in his certificate of registration. [Amended 8-26-76 by L.L. No. 3-19761 B. If such boat is not removed or restored to navigable condition by the owner within one (1) week after the mailing of said notice, the Southold Town Board or its designated agent may direct the removal or destruction of the boat, and the cost of said removal, including storage charges, shall attach to and shall become a lien upon said boat, and said boat may be sold, upon direction of the court, at public auction to defray said expenses, any • surplus being returned to the owner of record. The town shall not be liable for any damage done to said boat during its removal, storage and sale. 3206 8-25-92 § 32-34 BOATS, DOCKS AND WHARVES § 32-35 § 32-34. Operation of boats near beaches and bathers. [Amended 8-28-1990 by L.L. No. 17-19901 No boat propelled other than by hand shall cruise or be operated within one hundred (100) feet of any lifelines or bathing float or, if there are no lifelines or bathing float, then within one hundred (100) feet of any public or semipublic beach regularly used for bathing or • swimming, nor shall such boat cruise or be operated in excess of five (5) miles per hour within fifty (50) feet of any person bathing or swimming or an anchored or moored boat. § 32-35. Water-skiers. A. No person shall operate a vessel for towing- a person on water skis, a surfboard or similar device unless there is in such boat or vessel a person, other than the operator, of at least ten (10) years of age, in a position to observe the progress of the person being towed. [Amended 3-7-61] B. No person shall ride on water skis, a surfboard or similar device, or use or operate a boat to tow a person thereon, be- tween the period of one (1) hour after sunset and one (1) hour after sunrise. [Amended 3-7-61] C. Permitted areas. (1) No person shall ride on water skis, surfboard or similar device or use or operate a boat to tow a person thereon within one hundred fifty (150) feet of any public or semipublic bathing beach or public dock or within fifty (50) feet of any swimmer or bather or moving or anchored boat, nor shall any such persons engaged in such activities come within three hundred (300) feet of the shoreline unless they approach or depart perpendicularly to or • from the shoreline solely for the purpose of commencing or ending the ride. [Amended 8-28-1990 by L.L. No. 17-1990] (2) [Added 5-20-1992 by L.L. No. 10-1992] The following regulations shall apply only to Hay Harbor: (a) Water skiing is permitted after 5:00 p.m. on weekdays and all day Saturday and Sunday unless 3206.1 8-25-92 § 32-35 SOUTHOLD CODE § 32-36 organized waterfront activities are planned by the Hay Harbor Club. (b) Nater skiers will follow a pattern established by the first boat to start skiing, i.e., clockwise or counter- clockwise. (c) Skiers will remain a minimum of one hundred (100) feet from any dock or shoreline. • D. No person shall be towed on water skis, surfboard, inflatable parasail or similar device, unless such person is wearing a Coast Guard approved personal flotation device of Type I, II or III. [Added 8-28-1990 by L.L. No. 17-19901 E. No person shall be towed on water skis, surfboard, inflatable parasail or similar device or use or operate a boat to tow a person thereon between the period of sunset to sunrise or during periods of limited visibility. [Added 8-28-1990 by L.L. No. 17-19901 § 32-36. Speed limits; manner of operation. A. The Town Board of the Town of Southold may, by resolution, limit the speed of boats in any waters to which this Article applies and shall cause notice of such speed limit to be posted at appropriate places in the areas af- fected. Any person who shall operate a boat in such areas at a greater speed than the speed specified in such notice shall be deemed to have violated this Article. B. Every person operating a boat shall at all times operate the same in a careful and prudent manner and at such a rate of speed as not to unreasonably interfere with, the free and proper use of the waters or unreasonably endanger any person or property. • C. Except where lower maximum speed limits have been posted, no boat shall be operated in excess of forty-five (45) miles per hour in the waters of the Town of Southold. [Added 6-29-88 by L.L. No. 3-1973, as amended; and Art. II, Entrance onto Private Property, adopted 4-7-1970, as amended. 6901 8-25-92 § 6Y-1 SOVTHOLD' CODE § 69-2 ARTICLE I Licensing and Regulation § 69-1. Legislative intens. The purpose of this Article is to prevent business practices of peddlers, solicitors and transient retail businesses from existing in the Town of Southold with certain exceptions, as otherwise provided herein, by providing for the registration and regulation of the conduct of certain peddlers, solicitors and canvassers and otherwise eliminating such practices. § 69-2. Definitions. As used in this Article, the following terms shall have the meanings indicated: PEDDLER — A person who goes from place to place by traveling on foot or by any type of conveyance on the streets or from house to house carrying, transporting or conveying goods, wares, merchandise, foods, farm products or provisions, offering and exposing the same for sale or making sales and deliveries to purchasers or who solicits orders and, as a separate transaction, makes deliveries to purchasers. The word "peddler" shall include the words "hawker" and "huckster." PERSON — Includes the singular and the plural and shall also include and mean any individual, firm, partnership, corporation, voluntary association, incorporated association, club, society or other organization and any officer, employee or agent thereof. ARTICLE I Catching of Shrimp [Adopted by Board of Trustees 6-29-33] § 77-100. Taking of shrimp by nonresidents prohibited. It shall be unlawful for any person not a resident of the Town of Southold to take shrimp from the waters of Brush's Creek, Willes Creek, Downs Creek, James Creek, West Creek, Richmond's Creek, Corey's Creek, Cedar Beach Creek, Goose Creek, Jockey Creek, Town Creek, Mill Creek, Long Creek, Budd's Pond, Dam Pond, Mattituck Creek, Goldsmith's Creek, Squash Creek, Wickham's Creek and Little Creek, or other creeks or inland waters within the bounds of said township. § 77-101. Residence requirements. • Persons shall be deemed to be residents of the Town of Southold at any given date, within the meaning of this Article, when they shall have actually and continuously resided within the said town for a period of at least six (6) months immediately preceding such date. 7702 8-25-92 § 77-102 SHELLFISH § 77-201 § 77-102. Effect. No provision of this Article shall be deemed to prevent any person or persons residing within the Town of Southold from angling for fish for other than commercial purposes. • § 77-103. Penalties for offenses. Any violation of this Article shall be subject to a penalty of not less than five dollars ($5.) nor more than one hundred dollars ($100.) and costs. ARTICLE II Taking of Shellfish and Eels [Adopted by Town Board 6-23-19661 § 77-200. Title. [Amended 7-31-73; 7-7-82 by L.L. No. 5-19821 This Article shall be known as the "Shellfish Law of the Town of Southold." § 77-200.1. Purpose. [Added 7-7-82 by L.L. No. 5-1982] -It is the purpose and intent of this Article to provide for the protection, the preservation and the proper use and maintenance of town waters and lands under town waters, to minimize damage thereto and to enhance their use for the propagation of shellfish and other beneficial marine organisms and thereby protect and promote the public health, safety and welfare of the Town of Southold. • § 77-201. Definitions. For the purposes of this Article, the terms used herein are defined as follows: COMMERCIAL PURPOSES — Any use or purpose other than for food consumption by the persons taking the shellfish or by members of such person's household. 7703 8-25-92 § 77-201 SOUTHOLD CODE § 77-202 EEL — The American eel. [Added 6-2-1992 by.L.L. No. 11- 19921 GUEST — A. person who occupies living quarters in a . dwelling maintained by a permanent resident. PERMANENT RESIDENT — A person who has main- tained a permanent dwelling within the Town of Southold during the period of not less than sixty (60) days im- • mediately preceding the date of his application for a permit hereunder, or the date of taking shellfish if no permit is required. SHELLFISH - Clams, scallops, oysters, blue claw crabs, mussels, periwinkles and conchs. [Amended .7-7-82 by L.L. No. 5-1982]. - TAXPAYER — A person who owns real property as shown on the assessment roll of the Town of Southold. [Added 7-7$2 by L.L. No..5-1982] TEMPORARY RESIDENT — A person who has occupied living quarters within the Town of Southold during the period of not less than seven (7) days immediately preceding the date of his application for a permit hereunder. TOWN WATERS — All waters and lands under tidewater in any harbor, bay or creek, title to which and the right of fishing in which is vested in the Town of Southold and/or in the Board of Trustees of the Town of Southold. § 77-202. Permit requirements. A. Shellfish may be taken from town waters for commercial purposes by a permanent resident over the age of fourteen • (14) years upon first obtaining a commercial 'shellfish permit therefor from the Town Clerk of the Town of Southold. Shellfish may be taken from town waters by a temporary resident upon first obtaining a temporary resident shellfish permit therefor from the Town Clerk of the Town of Southold. 7704 8-25--92 § 77-207 SHELLFISH § 77-200 C. Female blue claw crabs shall not be taken from the waters of the Town of Southold. [Amended 7-14-87 by L.L. No. 12- 19871 D. Crab pots. No individual may set more than one (1) crab pot, and each crab pot and buoy shall have affixed thereto the individual's shellfish permit number. [Added 7-14-87 by L.L. • No. 12-19871 § 77-208: Mussels. [Added' 7.31-73] A. A permanent resident, a taxpayer, a temporary resident or a guest accompanied by a permanent resident may not take more than one (1) bushel of mussels from town waters in one -(1) clay for noncommercial purposes. [Amended 7-7-82 by I.L. No. 5-19821 B. Not more than ten (10) Bushels of mussels may be taken from town waters for commercial purposes in one (1) day by any one (1) person. Two (2) or more persons occupying the same boat may take, in the aggregate, not more than twenty (20) bushels of mussels in one (1) day for com- : mercial purposes. . § 77-208.1. Eels. [Added 6-2-1992 by L.L. No. 11-19921 A. Commercial purposes. No more than fifty (50) eel pots or traps per permittee in town waters shall be permitted. All pots must be identified with the shellfish permit number. B. A permanent resident, taxpayer and temporary resident. No more than five (5) eel pots in town waters shall be permitted. • All pots must be identified with the shellfish permit number. § 77-209. Culling shellfish and restoration of underwater lands. A. Shellfish shall be culled when taken. All shellfish taken which do not comply with the provisions of this Article shall be immediately returned alive to the water. 7700 8-25-92 § 77-209 SOUTHOLD CODE § 77-211.2 B. All lands under town waters disturbed by the taking of shellfish shall be restored to their condition prior to the taking of such shellfish by the person taking such shellfish. § 77-210. Restricted areas. Shellfish shall not be taken from any town waters which have • been restricted by the Town Board of Trustees, provided -that such restricted areas shall have been properly designated by'a resolution duly passed by said Board of Trustees and properly staked and notices posted by said Board of Trustees. § 77-211. Transplanting of shellfish. Notwithstanding any other provision of this Article, the Town Board of Trustees may authorize the transplanting of shellfish in town waters of any age or size, subject to its supervision, when it shall find that such shellfish are. in danger of destruction as the result of predators or other causes. § 77-211.1. Dredges and scrapes. [Added 7-7-82 by L.L. No.. 5- 19821 Except as permitted by § 77-204C of this Article, the use of a dredge, scrape, ell dredge or similar device towed by a boat operated by mechanical power or other means is prohibited in town waters. § 77-211.2. Vegetation removal prohibited. [Added 12-28-1990 by L.L. No. 30-19901 No person shall remove beach grasses or wetland vegetation of any • kind, nor place spoil thereon, in any other area of the Town of Southold without prior written approval by the Board of Town Trustees of the Town of Southold. 7710 5-25-92 U § 77-212 SHELLFISH § 77-212 § 77-212: Penalties for offenses. [Amended 7-31-73 by L.L. No. 1-1973] A. Any person convicted of an offense against any provision of this Article shall be deemed to have committed a violation against such Article and also shallbe liable for any ' such offense .or penalty therefor. B. For every offense against any provision of this Article, :the person committing the same shall be subject to a fine of not more than two hundred fifty dollars ($250.) or im prisonment not exceeding fifteen (15) days, or both such Ape and imprisonment. C: A second conviction for an offense against any of 'the provisions of this Article within a period of one (1) year shall ,constitute and effect an immediate forfeiture of a permit issued to such person. No new permit shall be issued to such person for at least one (1) year ; after such forfeiture. D. Any person committing an offense against this- Article shall be subject to a civil penalty enforceabl6%and collec- tible by the town for each such offense. Such penalty shall be collectible by and in the name of the town. E.
