§ 26-1. Purpose.

§ 26-1. Purpose.
The purpose of this chapter is to authorize public servants of the
Town of Southold to issue and serve appearance tickets in connection
with violations of state statutes, local laws, ordinances or rules and
regulations of the Town of Southold which the public servants are
authorized or required to enforce.
§ 26-2. Certain public servants authorized to issue appearance
tickets.
The following public servants of the Town of Southold are hereby
authorized to issue and serve an appearance ticket with respect to the
violation of a state statute, local law, ordinance, rule or regulation of
• the Town of Southold that such public servants are, respectively,
required to enforce:
A. Constables and Bay Constables. Any statute, local law,
ordinance, rule or regulation involving the public health,
safety and welfare.
B. Dog control officers. Any statute, local law, ordinance, rule or
regulation involving the control of dogs.

C. Building Inspectors. Any statute, local law, ordinance, rule or
regulation relating to fire prevention and safety, health and
sanitation, buildings, zoning. and planning:. [Added 2-29-84

D. Traffic control officers. Any state statute, local law, ordinance,
rule or regulation relating to the movement, parking, stopping.
or standing of vehicles. [Added 6-2-87 by L.L. No. 7-1987]
E. Ordinance Inspectors and Code Enforcement Officers. Any
statute, local law, ordinance, rule or regulation regarding
housing, building, zoning, fire safety, sanitation, amusement,
signs, peddling and any other areas concerning public order
and safety, including but not limited to all chapters of ' the
Code of the Town of Southold. [Added 7-26-88 by L.I.. No.

§ 26-3. Service of appearance tickets.
An appearance ticket other than for a parking violation shall be
served personally.

No person shall ride on water skis; a surfboard or similar
device, or ase or operate a boat to tow a person thereon,
within one hundred fifty (150) feet of any public or semi-
public bati 'ng beach or public. dock or within fifty (50) feet
of any swimmer or bather;.. nor shall any such persons
engaged inl such activities come within three hundred (300)

feet of the shoreline unless they approach or depart per-
pendicularly to or from the shoreline solely for the purpose
of commencing or ending the ride.
§ 32-36. Speed limits; manner of operation.
• A. The Town Board of the Town of Southold may, by
resolution, limit the speed of boats in any waters to which
this Article applies and shall cause notice of such speed
limit to be posted at appropriate places in the areas af-
fected. Any person who shall operate a boat in such areas
at a greater speed than the speed specified in such notice
shall be deemed to have violated this Article.
B. Every person operating a boat shall at all times operate the
same in a careful and prudent manner and at such a rate of
speed as not to unreasonably interfere with the free and
proper use of the waters or unreasonably endanger any
person or property.
C. Except where lower maximum speed limits have been posted,
no boat shall be operated in excess of forty-five (45) miles per
hour in the waters of the Town of Southold. [Added 6-29-88

§ 32-36.1. Equipment. [Added 5-19-87 by L.L. No. 5-19871
A. All pleasure vessels and uninspected commercial vessels shall
be equipped and lighted while under way or at anchor with
any person aboard, as required under the Federal Boat Safety
Act of 1971, as amended, and the regulations adopted
pursuant thereto and contained in Title 46 of the Code of
Federal Rules, Subchapter C, Parts 24, 25 and 26, and
pursuant to the provisions of § 40 of the Navigation Law of the
State of New York. Failure to comply with the equipment and
lighting requirements as set forth'above shall be a violation of
this chapter.

B. The provisions of this section shall not apply to vessels
competing in duly authorized regattas and trials preceding
such regattas.
§ 32-36.2. Operators. [Added 5-19-87 by L.L. No. 5-1987]
A. No person under the age of sixteen (16) years shall operate a •
mechanically propelled vessel unless:
(1) The operator, who is under the age of sixteen (16) years,
is accompanied therein by a person who is sixteen (16)
years of age or older; or
(2) The operator is ten (10) years of age or older and is the
holder of a boating safety certificate issued to him by the
Commissioner of the Office of Parks and Recreation of
the State of New York, pursuant to § 78 of the New York
State Navigation Law.
B. The failure of a person specified in § 32-36.2A(2) hereof to
exhibit a boating safety certificate upon demand to any peace
officer or 'other officer having authority to enforce the
provisions of this chapter shall be presumptive evidence that
such person is not the holder of such certificate.
C. No person who is the owner of a motorboat shall knowingly
authorize or permit the operation thereof unless:
(1) The operator is sixteen (16) years of age or older;
(2) The operator, who is under the age of sixteen (16) years,
is accompanied therein by a person sixteen (16) years or
older; or
(3) The operator is ten (10) years of age or older and is the
holder of a boating safety certificate issued to him by the
Commissioner of the Office of Parks and Recreation of
the State of New York. .
D. No person shall operate a vessel while in an intoxicated
condition or while his ability to operate such a vessel is
impaired by the consumption of alcohol.or by the use of a
drug.

§ 48-1. Definitions.
• Words and terms used in this chapter shall have the following
meanings:
ATTENDANT — Any employee of the Town of Southhold
placed in charge of a town refuse disposal area under the
direction of the Town Board.

PERSON — An individual, an association, a partnership
or a corporation.
REFUSE — Any human, animal or vegetable refuse, offal,
swill, cesspool and/or septic waste, sewage, garbage,
paper, ashes, junk, trash, rubbish, waste, of whatever
material composed, discarded machinery or parts therof,
discarded vehicles or parts thereof and an unlicensed motor •
vehicle parked, stored or standing outside an enclosed
building in an inoperative condition for more than thirty

REFUSE DISPOSAL AREA — The sanitary landfill site
owned and operated by the Town of Southold located north
of County Route 48 at Cutchogue, New York, and any
premises - designated by the Town Board as a "refuse
disposal area" of the town for the disposal of refuse by the
residents of the town. [Amended 10-9-84 by L.L. No. 9-
19841 -
§ 48-2. Dumping prohibited generally. [Amended. 7-31-73]
A. No person shall collect, store, accumulate, throw, cast,
deposit or dispose of, or cause or permit to be collected,
stored, accumulated, thrown, cast, deposited or disposed
of, any refuse upon any premises or upon any street, high-
way, sidewalk or public place within the Town of Southold,
except when authorized by the Town Board.'
B. Nothing contained herein shall be construed so as to
prevent:
(1) The temporary accumulation of refuse by a resident of
the town upon premises occupied by him, to the extent
that such accumulation is ordinary .and necessary for •
his personal household requirements.
(2) The disposal of refuse at any refuse disposal area
maintained or authorized by the Town of Southold.

(3) The proper use of receptacles placed upon the streets
or other public places in the Town of Southold for the
depositing of refuse; provided, however, that such
public receptacles shall not be used for the deposit of
accumulated household garbage.
(4) The engaging in secondhand junk and auto parts
activities and businesses when a license therefor has
• been obtained pursuant to the provisions of the
Southold town ordinance licensing and regulating
secondhand junk and auto parts activities - and
businesses.'
§ 48-3. Town refuse disposal area.
A. No person shall deposit or cause to be deposited in or on
any refuse disposal area maintained by the Town of
Southold any substance of any kind except in the areas
designated by and under the direction of the attendant in
charge, whether such direction is given personally or by
another person by his authority, or by a sign or signs
erected in the refuse disposal area by the authority of the
Town Board or such attendant.
B. No garbage, refuse, rubbish or other material that does not
have its origin within the Town of Southold shall be
deposited or disposed of in the town refuse disposal area.

C. No garbage, rubbish, refuse or other material that does not
have its origin within the Town of Southold shall be conveyed
or transported over any street within the town for delivery to
the town refuse disposal area. [Added 5-3-88 by L.L. No. 11-

40 D. No vehicle shall be permitted to transport refuse into any
refuse disposal area maintained by the Town of Southold
unless such vehicle displays a valid permit and/or license

issued pursuant to the provisions of this chapter. [Added 7-24-

E. The attendant at the town refuse area is authorized to prohibit
the disposal of discarded motor vehicles and/or discarded fuel
tanks having a capacity in excess of five hundred fifty (550)
gallons at the refuse disposal area. [Added 7-15-86 by L.L.
No. 7-1986; amended 9-23-86 by L.L. No. 12-19861 •
§ 48-4. Fees; issuance and duration of permits and licenses.
[Added 10-9-84 by L.L. No. 9-19842]
A. The fees for the issuance of permits and/or. licenses for
vehicles transporting refuse into any refuse disposal area
maintained by the Town of Southold shall be as follows:
(1) Parking permit: for noncommercial vehicles of less
than- one -ton capacity owned by a resident and/or
taxpayer of the Town of Southold and transporting
only household refuse, provided that such vehicle,
dispays a valid parking permit issued pursuant to the
provisions of §65-3 of the Code of the Town of
Southold.
(2) Per -load fee of fifty cents ($0.50) for each non-
commercial vehicle of less -than one -ton capacity which
possesses no permit.
(3) Per -load fee of fifteen dollars ($15.) for each single -axle
truck which does not possess a permit.
(4) Annual fee of twenty-five dollars ($25.) for each
commercial vehicle transporting liquid septic waste,
together with an additional fee of one cent ($0..01) for
each gallon of liquid waste discharged. , •
(5) Annual fee of twenty-five dollars ($25.) for each
commercial contractor's vehicle of less than one -.ton
maximum gross vehicle weight.

(6) Annual fee of twenty-five dollars ($25.) for each farm
vehicle .of one -ton . or more capacity transporting
agricultural waste.
(7) Per -load fee of twenty-five dollars .($25.) for each
double -axle truck which .does not possess a permit.
(8) Annual fee of one hundred dollars ($100.) for each
single -axle vehicle transporting solid waste (garbage).
(9) Annual fee of one hundred dollars ($100.) for each
commercial contractor's vehicle of more than one -ton
capacity.
(10) Annual fee of two hundred fifty dollars ($250.) for each
double -axle and/or compactor -type vehicle trans-
porting solid waste (garbage).
(11) Annual fee of two hundred fifty dollars ($250.) for each
commercial contractor's double -axle and/or tractor-,
trailer combination of more than one -ton capacity.
B. Issuance and duration of permits and/or licenses. All
permits and/or licenses provided for in this chapter shall be
issued by the Town Clerk. All annual permits (including
those previously issued) shall expire one (1) year from the
date of the issuance thereof.
C. Refund of fees. In the event that the Town Clerk has
heretofore issued permits for vehicles transporting refuse
into the town landsite at Cutchogue, and the fees paid
therefor exceed the fees provided for herein, the Town
Clerk is herby authorized to refund such excess fees to the
holders of such permits and/or licenses.
D. Amendment of fees. Notwithstanding any of the provisions
hereof, the Town Board may, by resolution, change, modify
or repeal any of the fees set forth in § 48-4 hereof.
§ 48-5. Conveyance and transportation of refuse.
No person shall convey or transport refuse through the streets
or public places of the Town of Southold in any cart, wagon or

vehicle or by any other means unless adequate care is taken to
prevent the spilling of refuse in such public places and streets.'
§ 48-6. Penalties for offenses. [Amended 7-31-73 by L.L. No. 1, .
1973]
A. Any person committing an offense against any provision of •
this chapter 'shall, upon conviction thereof, be guilty of a
violation punishable by a fine not exceeding two hundred
fifty. dollars ($250.) or by imprisonment for a term not
exceeding fifteen (15) days, or by both such fine and im-
prisonment. The continuation of an offense against the
provisions of this chapter shall constitute, for each day the
offense is continued, a separate and distinct offense
hereunder.
B. Any person committing an offense against this chapter
shall be subject to a civil penalty enforceable and collec-
tible by the town in the amount of one hundred dollars
($100.) for each offense. Such penalty shall be collectible by
and in the name of the town for each day.that such offense
shall continue. .
C. In addition to the above -provided penalties, the Town
Board may also maintain an action or proceeding in the
name of the town in a court of competent jurisdiction to
compel compliance with or to restrain by injunction the
violation of this chapter.
§ 48-7. Revocation of permit and/or license. [Added 5-3-88 by

A. Permits and/or licenses issued under the provisions of this
chapter may. be revoked by the Town Board of the Town of
Southold after notice and hearing for violation of the provisions
of this chapter.

B. Notice of the hearing, for revocation of a permit and/or license .
shall be given in writing, setting forth specifically the grounds
of the complaint and the time and place of hearing: Such
notice shall be mailed, postage prepaid, to the permittee and/
or licensee at his last known address at least five (5) days prior
to the date set for the hearing. Said hearing shall be conducted
in a manner wherein the accused permittee and/or licensee is
• afforded full due process of the law.
C. At the conclusion of said hearing and as a result of the
evidence adduced therein, the Town Board may, in its
discretion, revoke the said permit and/or license or, in lieu
thereof, suspend the subject permit and/or license for a
specified period of time, censure the permittee and/or licensee
or impose a fine, not to exceed two thousand dollars ($2,000.).

§ 69-102 PEDDLING AND SOLICITING § 69-103

It shall be unlawful for a person to act as a hawker, peddler or
solicitor within _the limits of the Town of Southold except in
conformity with the provisions of this Article and without Ent
having obtained and paid for and having in force and effect a
license, as provided herein. Notwithstanding the foregoing
• provisions of this section, a merchant having an established place
of business within the Town of Southold or his employees shall
not be required to obtain a license issued pursuant to the
provisions of this Article.
§ 69.103. Application requirements.
Every applicant for a license under this Article shall file with
the Town Clerk a sworn written application, in duplicate, on a
form to be furnished by said Clerk, which shall give or be ac-
companied by the following:
A. Name and description of the applicant.
B. Permanent home address and full local address of the
applicant.
C. A brief statement of the nature of the business and a
description of the merchandise or service to be sold.
D. If employed, the name and address of the employer,
together with credentials establishing- . the exact
relationship.
E. The length of time for which the license is desired.
F. If a vehicle is to be used, a description of such vehicle and
• its license number.
G. The place where the goods or property to be sold or offered
for sale are manufactured or produced, where such goods or
property are located at the time such application is filed
and the proposed method of delivery.
H. A photograph -of the applicant taken within sixty (60) days
immediately prior to the date of the application, which

photograph shall clearly show the head and shoulders of
the applicant and shall measure two by two (2 a 2) inches.,
I. Two (2) business references located 'in the County of
Suffolk, State of. New York, or, in lieu thereof, such other
available evidence of the character and business respon-
sibility of the applicant as will enable an investigator to
properly evaluate such character and responsibility. •
J. A statement as to whether the applicant has been .con-
victed of, any crime, misdemeanor or violation of any
municipal ordinance, the nature of the offense and the
punishment or penalty assessed therefor.
K. The fingerprints of the applicant.

§ 69-104. Investigation and issuance of license.
Upon receipt of such application, the original shall be referred
to the Chief- of Police of the Town of. Southold, who shall cause_
such investigation of the applicant'sbusiness and moral character
to be made as he deems necessary for the protection of the public
goo .
A. If as a result of such investigation the applicant's character
or business responsibility is found to be unsatisfactory, the
Chief of Police shall endorse on such application his
disapproval, and his reasons for same and return the said
application to the Town Clerk, who ,shall notify the ap-
plicant that his application is disapproved and that no
license will be' issued. A hearing upon such disapproval
shall be held, upon appeal, as provided in §'69-110B.
B. If, as a result of such investigation, the character and business •
responsibility of the applicant are found to be satisfactory, the
Chief of Police shall endorse on the application his approval
and return such application to the Town Clerk, who shall issue
a license to the applicant. Such license shall contain the
signature and seal of the issuing officer and shall show the
name and address of said licensee, the kind of goods to be sold

thereunder, the amount of fee paid and the date of issuance
and the length of time the same shall be operative. [Amended

§ 69-105. License fees. [Amended 11-15-83 by L.L. No. 13-1983;

The nonrefundable fee for each license application pursuant to this
Article shall be one hundred dollars ($100.) per year or twenty dollars
($20.) per day or fraction thereof.
§ 69-106. License conditions.
A. A license shall not be assignable. Any holder of such
license who permits it to be used by any other person, and
any person who uses such license granted to any other
person, shall be guilty of an offense against this Article.
B. Each such license issued shall automatically expire on
December 31 following the date of issuance thereof, but
such license may provide for an earlier expiration date.
C. No applicant to whom a license has been refused or who has
had a license which has been revoked shall make further
application until a period of at least twelve (12) months
shall have elapsed since the last previous rejection or
revocation, unless he can show that the reason for such
rejection or revocation no longer exists.
D. Every licensee, while exercising his license, shall carry the
license with him and. shall exhibit the same, upon demand,
to any police officer or citizen.
§ 69-107. Records.
It shall be the duty of the Town Clerk to keep a record of all
applications and of all licenses granted under the provisions of
this Article, giving the number and date of each license, the name
and residence of the person licensed, the amount of the license fee
paid and also the date of revocation of all licenses revoked.

§ 69.108. Employees of licensee.
Any licensee using a motor vehicle may employ not more than
two (2) persons to.assist in selling and delivering the wares, but
such persons shall' so act only while accompanying, a licensed
peddler, hawker or solicitor.
§ 69-109. Restrictions. [Amended 12-7.76 by L.L. No. 7-19761
A hawker, peddler or solicitor shall:
A. Not engage in such business at any time between the hours
of 8:00 p.m. and 9:00 a.m.
B. Not willfully misstate the quantity or quality of any article
offered for sale.
C. Not offer for sale any unwholesome, tainted, deleterious or
diseased provisions or merchandise. '
D. Keep the vehicles and receptacles used by him in a clean
and sanitary condition and the foodstuffs and edibles
offered for sale well covered and protected from dirt, dust
and insects.
E. Not can attention to his goods by blowing a horn, by
ringing a bell other than a house doorbell, by shouting or
crying out or by any loud or unusual noise.
F. Not stand or permit the vehicles used by him to stand in
one (1) place in any public place or street for more than ten
(10) minutes, or in front of any premises for any time if the
owner or any lessee of the premises objects.
G. Not ' create or maintain any booth or stand or place any
barrels, boxes, crates or other obstructions upon any street
or public place for the purpose of selling or exposing for
sale any .goods, wares or merchandise.
H., Not engage in such business within five hundred (500) feet of
any school between the hours of 7:00 a.m. and 4:00 p.m. on

I. Not bell or peddle prepared foods of any kind, including ice
cream, confectionery, beverages, prepackaged snack foods,
hot dogs, hamburgers and other sandwiches, on any town
beach upon which 'is located a concession stand operated
under an agreement with the town, or on any parking area
adjacent thereto..

STREET EXCAVATIONS § 83-6
A.
The name and address of the applicant.
B.
A reasonably adequate description of the proposed work and
the reason therefor, including a description of the location of
the proposed work.
C.
A statement as to the time when such work will be com-
menced and an estimate of the time when such work shalt be
fully completed and the highway restored to its previous con-
dition as nearly as may be feasible.
D.
A time schedule showing when various portions of the work
will be done.
E.
A reference to the legal authority of the applicant to perform
the proposed work in the public highway.
F.
An estimate of the cost of the proposed work, including such
detail as may be specified by the Superintendent.
G.
Such other information as the Superintendent shall deem
pertinent to effectuate the purposes of this chapter.

§ 83-5. Insurance coverage.
No permit shall be issued until the applicant shall have filed with
the Superintendent evidence that the town has been named as a
primary insured under any insurance policy extending bodily injury
and property damage coverage to the town in amounts of three
hundred thousand/five hundred thousand dollars ($300,000./$500,000.)
for bodily injury and fifty thousand dollars ($50,000.) for property
damage, caused by or attributable to the work to be performed by
the applicant, such insurance coverage to be written by an insurance
company authorized to do business in the State of New York.
§ 83-6. Bonds.
A. No permit shall be issued to any applicant until the applicant
has posted with the Superintendent a surety bond or certified
check in such amount the Superintendent may determine nec-
essary to cover the probable expense to the town of replace-
ment by the town of any highway to its former condition and

to guarantee the performance by the applicant of any of the
conditions contained in the permit and compliance with this
chapter.
B. The above .bond requirements shall include provision for
maintenance by way of a maintenance bond, which bond shall
have a duration of two (2) years from the date of completion
of the work under the permit, in case of all excavations with a •
depth of eighteen (18) inches. or less, and a, duration of three
(3) years from the date of the completion of the work under
the permit for all excavations with a depth greater than
eighteen (18) inches.
§ 83-7. Fees.
A. Each application for a permit hereunder shall be accompa-
nied by a fee of twenty-five dollars ($25.) therefor, to be paid to
the Town Clerk of the Town of Southold. Permit flies for
permits issued pursuant to this chapter shall be as follows:
(1) Twenty dollars ($20.) for each service connection excava-
tion. Additional excavations made in connection with the
same service connection excavation shall be charged at
the rate of ten -dollars ($10.) for each additional excava-
tion.
(2) Ten.dollars ($10.) for the first one hundred (100) linear
feet or any part thereof of street excavations. and ten
cents ($0.10) per linear foot thereafter for all excavation
eighteen (18) inches in depth or less.
(3) Thirty dollars ($30.) for the first one hundred (100) lin-
ear feet or part thereof of street excavation and thirty
cents ($0.30) per linear foot thereafter for all excavations
between eighteen (18) inches and five (5) feet in depth.
(4) Fifty dollars ($50.) for the first one hundred (100) linear
feet or part thereof of street excavation and fifty cents
($0.50) per linear foot thereafterfor all excavations five

in order to minimize damage from erosion, turbidity or.
siltation, saltwater intrusion, loss of fish, shellfish or other
beneficial marine organisms, aquatic wildlife and
vegetation and the destruction of the. natural habitat
thereof, to minimize danger of flood and storm -tide damage .
and pollution, and to otherwise - protect the quality of
wetlands, tidal waters, marshes, ' shore lines, beaches and .
natural drainage systems for their conservation, economic,
aesthetic, recreational and other public uses and values,
and, further, to protect the potable fresh water supplies of
the town from the dangers of drought, overdraft, pollution
from saltwater intrusion and misuse or mismanagement.
Therefore, the Town Board declares that the regulation of
the wetlands of the Town of Southold is essential to the
health, safety and welfare of the people of the Town of
Southold.
§ 97-12. Exceptions.
A. The provisions ofthis chapter shall not affect or prohibit
nor require a permit for the following:
(1) The ordinary and usual mosquito control operations .
conducted by any public authority.
(2) The ordinary and usual operations incidental to the
cultivation and/or harvesting of fish and; shellfish.'
(3) The ordinary and usual operations relative to conser-
vation of soil, vegetation, fish, ' shellfish and wildlife.
(4) The ordinary and usual operations relative to agri-
culture, aquaculture or horticulture.
(5) The ordinary and usual maintenance or repair of a
• presently existing building, dock, pier, wharf, bulk-
head, jetty, groin, dike, dam or other water control
device or structure?
(6) , The construction of a registered bulkhead, which is to
replace an existing functional bulkhead, provided that the

new bulkhead is constructed substantially similar to the
design and measurement of the existing bulkhead and
located in place of the existing bulkhead. The° Trustees
shall be given written notice of the project prior to

B. Nothing contained in this chapter shall be deemed to affect •
any areas in the town within the jurisdiction of the
Southold Town Board of Trustees.
§ 97-13. Definitions.
For the purpose of this chapter, the following terms, phrases,
words and their derivations shall have the meaning given herein:
When not inconsistent with the context, words in the present
tense include the future; words used in the plural number include
the singular number; and words used in the singular number in-
clude the plural number. The word "shall" is always mandatory
and not directory,.
BOARD — Unless otherwise indicated, the Board of

CLERK — Unless otherwise indicated, the Clerk of the

MATERIAL — Soil, sand, gravel, clay, bog, peat, mud or
any other material, organic or inorganic.
OPERATIONS:
A. The removal of material from wetlands.
B. The deposit of material on wetlands. •
C. The erection, construction, alteration or enlargement
of any building, dock, pier, wharf, bulkhead, jetty,
groin or other structure, temporary or permanent, on
wetlands.
PEAK LUNAR TIDES = Those excessively high tides or
spring tides caused by lunar gravitational phenomena.

PERSON — Any person, firm, partnership, associatiorn,.
corporation, company, organization or other legal entity of
any kind, including municipal corporations or govern-
mental agencies or subdivisions .thereof.
TIDAL WATERS - All waters bordering on or within the
boundaries of the Town -of Southold subject to fluctuation in
• depth from peak lunar, storm.or normal tidal action, and in-
cluding but not limited to all brackish and salt waters of
streams, ponds, creeks, estuaries, bays and inlets. [Amended

house trailer, a boarding- or rooming house, convalescent
home, .fraternity or sorority house, hotel, motel, inn,.
lodging or nursing or other similar home or other similar -
structure shall not be deemed to constitute a "dwelling
unit."
FAMILY — One (1) or more persons occupying a dwelling
• unit as a single nonprofit housekeeping unit. More than five (5) .
persons eighteen (18) years of age or older, exclusive of
domestic servants, not related by blood, marriage, or adoption
shall not be considered a "family." [Amended 5-17-88 by L.L.

FLOOR AREA — The sum of the gross horizontal areas of
all floors of the building or buildings on a lot, having a clear
height of not less than six (6) feet, measured from the
exterior faces of exterior walls or from the center line of
party walls separating two (2) buildings, including cellar
and basement areas. [Amended 2-1-83 by L.L. No. 2-19831
FLOOR AREA, LIVABLE — All spaces within the ex-
terior walls of a dwelling unit, exclusive of garages,
breezeways, unheated porches, cellars, heater rooms and
approved basements having a window area of less than ten
percent (10%) of the square foot area of the room. "Usable
floor area" shall include all spaces not otherwise excluded
above, such as principal rooms, utility rooms, bathrooms,
all closets and hallways opening directly into any rooms
within the dwelling unit and all attic space having a clear
height of six (6) feet from finished floor level to pitch of roof
rafter with a clear height of seven (7) feet six (6) inches
from finished floor level to ceiling level over fifty percent
(50%) of the area of such attic space. [Amended 2-1-83 by

• FLOOR AREA RATIO — The floor area in square feet of
all buildings on a lot divided by the area of such lot in
square feet.
GARAGE, PRIVATE — A building used -for the storage
of one (1) or more gasoline or other power -driven vehicles
owned and used by the owner,or_ tenant of the lot on- which

the garage is erected and for the storage of not exceeding
two 12) additional vehicles (not trucks) owned or used by
others.
GARAGE, PUBLIC — A building, other than a private
garage, used for housing or care of gasoline or other power.
driven vehicles, or where such vehicles are equipped for
operation, repaired or kept for remuneration, hire or sale.
HEIGHT — The vertical distance measured from the
average elevation of the finished grade of the land im-
mediately adjacent to the building to the highest point of
the roof for flat and mansard roofs and to the mean height
between eave and ridge for other types of roofs. [Amended

HOME OCCUPATION — This shall be understood to
include the professional office or studio of a doctor, dentist,
teacher, artist, architect, engineer, musician, lawyer,
magistrate or practitioners of a similar character, or rooms_
used for "home occupations," including home baking,
millinery or similar handicrafts, provided that the office,
studio or occupational rooms are located in a dwelling in
which the practitioner resides and provided further that no
goods are publicly displayed on the premises and no sign or
advertisement is shown other than a sign not larger than
two (2) square feet in total area, bearing only the name and
occupation (words only) of the practitioner. [Amended 2-1-

HOTEL — A building occupied as the more or less tem-
porary abiding place of individuals, who are lodging with
or without meals, in which there are more than ten (10)
rooms usually occupied singly and in which no provision is
made for cooking in any room or individual apartment.
JUNKYARD — Land occupied or to be occupied for
storage of old wood, paper, cloth or metal, including old
automobiles, trucks, equipment, machinery, fixtures and
appliances not usable as originally designed, and also
including any portion of such old automobiles, trucks,

than one hundred (100) feet from the top of such bluff or
bank.-
(2)
ank:(2) Except.as otherwise provided in Subsection A(1) hereof,
all buildings located on lots adjacent to Long Island
Sound shall be set back not less than one hundred (100)
feet from the ordinary high-water mark of Long Island
• Sound.
B. [Amended 5-17-88by L.L. No: 15-1988] All buildings
located on lots upon which a bulkhead, concrete wall, riprap or
similar structure exists and which is adjacent to tidal water
bodies other than sounds shall be set back not less than
seventy-five (75) feet from the bulkhead. The following
exceptions will apply:
(1) Buildings which are proposed landward of existing
buildings.
(2) Lands which are not bulkheaded and are subject to a
determination by. the Board of Town Trustees under
Chapter 97 of the Code of the Town of Southold.
(3) Docks, wharves, pilings, boardwalks, stairs, promenades,
walkways, piers, which are accessory_and separate from
existing buildings or accessory structures.'
C. All buildings located on lots adjacent to any freshwater body
shall be set back not less than seventy-five (75) feet from the
edge of such water body or not less than seventy-five (75) feet
from the landward edge of the freshwater wetland, which-
ever is greater.

five (5) members; as provided by the Town Law.

§ 100-131. Objectives.
In considering and acting upon site development plans, the
Planning Board shall take into consideration the public health, safety
and welfare, the comfort and convenience of the public in general and
the residents of the immediate neighborhood in particular, and may
prescribe appropriate conditions and safeguards as -may be required
in order that the- result of its action may, to the maximum extent
possible, further the expressed intent of this chapter and the
accomplishment of the following objectives in particular:
A. Traffic access. All proposed traffic accessways are adequate
but not excessive in number; adequate in width, grade,
alignment and visibility; not located too near street corners or
other places of public assembly; and I other similar safety
considerations.
B. Circulation and parking. Adequate off-street parking and
loading spaces are provided to prevent the parking in public
streets of vehicles of any persons connected with or visiting the
use, and that the interior circulation system is adequate to
provide safe accessibility to all required off:street parking lots.
C. Landscaping and screening. All playground, parking and
service areas are reasonably screened at all seasons of the year
from the view of adjacent residential lots and streets, and that
the general landscaping of the site is in character with that
generally prevailing in the neighborhood. Existing trees over
eight (8) inches in diameter measured three (3) feet above the
base of the trunk shall be retained to the maximum extent
possible.
D. Architectural features. The architectural features of proposed
buildings and signs are in character with that generally
prevailing in the neighborhood. [Added 5-31-88 by L.L. No.

§ 100-132. Effect of approval:
A. No building permit shall be issued for any structure covered
by .this Article until an approved site development plan or

approved amendment of any such plan has been secured by
the applicant retained to the Planning Board and presented to
the Building Inspector.
B. No certificate of occupancy will be issued for any structure or
use of land covered by this Article unless the structure is
completed or the land is developed or used in accordance with
an approved site development plan or approved amendment of
any such plan.
C. Should any site plan approval involve any matter requiring
referral to the Suffolk County Planning Commission, then the
matter shall be referred, prior to final action by the Planning
Board, to the Suffolk County Planning Commission in
accordance with the applicable provisions of law.
§ 100-133. Procedure.
A. Presubmission conference. Prior to the submission of a site
development plan, the applicant or his agent shall meet
