§ 32-39.2. BOATS, DOCKS AND WHARVES § 32-40
(2) No permanent mooring shall be placed unless authorized
by a permit duly issued by a Bay. Constable or Deputy or
Assistant Bay Constable.
(3) [Amended 11-13-1990 by L.L. No. 25-19901 The
following fees shall be paid for the issuance of a mooring
permit:

(4) All mooring permits shall expire on December 31 of the
year of issuance.
(5) The location of each mooring shall be assigned by the
Fishers Island Harbor Master, who shall be appointed
by the Town Board.
(6) All mooring buoys shall be assigned a number which
shall be affixed to the buoy by the permittee in numbers
at least five (5) inches in height.

Floating Homes

§ 32-40. Legislative findings. -
A. The Town Board finds that watercraft -are being used for
strictly residential purposes on waterways within the Town of
Southold. ' The proliferation of this type of use is expected to
• create significant environmental problems if their prolifera-
tion remains unchecked.
B. The Town Board recognizes that the waterways -surrounding
the town are some of the primary recreation areas on Long

Island. They are used for swimming, fishing and boating by
many of the local residents and visitors. Furthermore, wa-
terways are a major commercial resource providing food and
employment for the harvesters of fish and shellfish. Shellfish
taken commercially from said waterways are distributed to
all areas of the Eastern Seaboard. The Town of Southold has
expended large sums of money to develop and protect the •
harvestable clam stock.'
C. The Town Board acknowledges its duty to protect the health,
safety and welfare of its residents and visitors. The mainte-
nance of high water quality is vital to the use of said water-
ways for recreational and commercial. purposes. The avoid-
ance of all uses and activities which could introduce pollution
in these waterways is of constant concern.
D. The potential influx of craft and vessels for residential pur-
poses creates a substantial danger to water quality in said .
waterways. The residential use -of these vessels is .contrary to
the established character of the Town of Southold and will
severely diminish the recreational and commercial use of said
waterways.
E. The proliferation .of floating homes and marinas which ac-
commodate them will create problems which include, in addi-
tion to water pollution, trash storage and removal, fire pro-
tection, emergency energy requirements during power fail-
ures, loss of mooring piles during winter icing conditions and
damage and sinking of vessels during storms, all of which
conditions impose additional responsibilities on police, 'fire
and other emergency agencies in the town.
F. The Town Board recognizes that the Town of Southold con-
sists primarily of developed year-round- residential. neighbor-
hoods and that: marine recreational uses are incidental to
such residential uses, and that.it is in the best interests of the is
Town of Southold and its residents to restrict and prohibit the
uncontrolled growth and burden on its waterways that would
result if the infusion of floating homes is not controlled..'

§ 100-290. Procedures.
• The Town Board, upon its own motion or -by petition, may, from
time to time, amend, supplement, change, modify or repeal this
chapter, including the Zoning Map, by proceeding in the following
manner:
A. The Town Board, by resolution adopted at a stated meeting,
shall fix the., time and place of a public hearing on the
proposed amendment and cause notice thereof to be given
pursuant to the provisions of the Town Law.
B. The Town Board, before advertising for a public hearing, shall
in a written request. instruct the Town Planning Board to
prepare an official report defining the conditions described in
a : petition and to determine the area so affected, with its .
recommendations.
§ 100-291. Fees. [Amended 11-13-1990 by L.L. 'No: 26-1990]
Every petition for a change or amendment to this chapter or the
Zoning Map shall be filed with the Town Clerk and shall be
accompanied by a fee of one thousand dollars ($1,000.). The fee for a
petition for a change of zone t6 the Affordable Housing District is set
forth in § 100-55B(5xg).
§ 100-292. Notice of proposed change of -zone classification.
• A. In the case of a petition requesting a change in zoning district
classification, in addition to the notice required by law, a
written notice containing, the following information shall be
sent by the petitioner, or his agent, by either certified or
registered mail,, to every owner of property immediately

adjacent thereto. In the event that any petitioner owns or has
any interest in any property immediately adjacent to the
property proposed to be changed in zoning district classifica-
tion, then written notice shall also be given to the owners of the
property adjacent to such other property of the petitioner. For
the purpose of this section, the words "owner" or "property
owner" mean the owner as shown on the current Southold
Town assessment roll. The notice required by this section shall
be mailed by the petitioner, or his agent, within five (5) days
preceding the filing of the petition in the Town Clerk's office.
Proof of mailing of such notice in the form of a sworn
statement shall be filed with the Town Clerk at the time of
filing the petition. Such notice shall contain the following
information:
(1) A statement that the petitioner proposes to file a petition
with the Southold Town Clerk requesting a change of
zone classification.
(2) A description of the property which is the subject of such
petition.
(3) The present zone district classification of the property
and the proposed zone district classification.
(4) A statement that within five (5) days the petition
requesting such change in zone district classification will
be filed in the Southold Town Clerk's office, Main Road,
Southold, New York, and may then be examined during
regular office hours.
(5) A statement that a public hearing with respect to such
petition must be held by the Southold Town Board before
such change of zone can become effective; that the person
to whom the notice is addressed, or his representative, has
the right to appear and be heard at such hearing; and
that a notice of such hearing will be published in the
official town newspaper not less than ten (10) days prior
to such public hearing.

B. In lieu of complying with the provisions of this section, written
verified waivers of notice executed by the persons entitled to
receive such notice may be filed with the Town Clerk at the
time of filing the petition.
C. Failure to comply with the provisions of this section shall not
affect the validity of any action with respect to such petition.

Severability

§ 100-300. Severability.
Should any section or provision of this chapter be decided by the
courts to be unconstitutional or invalid, such decision shall not affect
the validity of the chapter as a whole or any part thereof other than
the part so decided to be unconstitutional or invalid. .

ARTICLE I
.Plans and'Maps For Major Subdivisions
§ A108-1. Sketch plans.
A. The sketch plan initially submitted to the Planning Board
shall be based on the Town Tax Map, at a scale of one (1) inch
• equals one hundred (100) feet, and shall show the following
information:
(1) A key map shop;•ing the location of the proposed subdivi-
sion and the distance to the nearest existing street or
road intersection.

area to be subdivided and within two hundred (200) feet
thereof.

swales vs. roads with curbing and drainage basins within the

• § A108-16. Stripping and stockpiling soil.
Existing topsoil shall be stripped to its full depth between the
right-of-way limits, or as ordered, and stockpiled on the site for fu-
ture use. Stripping shall be completed prior to starting general ex-
cavation in an area.

§ A108-17. Excavation and embankment.
A. Excavation shall consist of the excavation, use of or disposal
of all materials of any description encountered in the course
of construction.
B. The proposed road section in cuts or fills shall meet the exist-
ing abutting surface with a one (1) on two (2) slope or as
shown on the plans. Where the proposed slopes extend beyond •
the bounds of the highway (right-of-way), the necessary re-
leases, easements or deeds must be obtained from the proper-
ty owner or owners.
:C. Roadway embankments shall be constructed with suitable
material from excavation or from acceptable borrow when
necessary. Embankments shall be constructed in successive
uniform layers not exceeding eight (8) inches. Each layer
shall be thoroughly compacted with steel wheel or pneumatic
tired rollers to the approval.of the Construction Inspector.
The drainage system may be installed at'any time before the
final grading of roads is completed.
D. When feasible, excavation and embankment within the con-
struction site shall have a reasonable balance.
§ A108-18. Base course for asphalt pavement.
A. The base course shall consist of three -fourths -inch stone blend
or crushed concrete compacted -to a four -inch depth. If clay or.
other unsuitable material is found below the base course, it
shall be removed and replaced with twelve (12) inches of
compacted bankrun containing ten percent (10%) or more of
gravel. The twelve -inch replacement depth may be modified
according to existing conditions as approved by the Engineer.
B. The soil base shall be compacted to the satisfaction of the En- •
gineer and shall be smooth, parallel to and at the required
depth below the base course. The soil base shall not be in a
muddy or frozen condition before placing base course mate-
rial. The base course material shall. be deposited on the pre-
pared grade by means of dump truck, spreader, tailgate .or

other approved methods of depositing. Spreading the base
course material shall be done by approved spreading equip-
ment. After the loose material has been spread evenly so that
it will have the required thickness after compaction, correct
grade for succeeding courses, segregation of any large or fine
particles corrected, it shall be rolled with approved rollers
weighing not less than ten (10) tons. Rolling must begin at the
• sides and continue toward the center and shall continue until
there is no movement of the course ahead of the roller. A min-
imum of four (4) passes of rollers will be required. Approved
vibratory rollers may be used at the option of the contractor.
Where the use of a roller is impractical, approved vibrating
plate compactors or' impact rammers shall be used to com-
pact the base material.
C. Upon the completion of the base course, the contractor shall
request an inspection by the Engineer or Inspector and shall
not proceed with further road work until such inspection has
been made and the work approved.
§ A108-19. Binder course and wearing course.
A. The binder course shall be two and one-half (2%) inches in
depth. The material shall be local sand and gravel pit run,
passing the three -fourth -inch screen with filler added. The
filler material shall be local fine sand. The combined mate-
rials shall show the following composition:
(1) Passing the three -fourths -inch square sieve: one hundred
percent (100%).
(2) Passing the No. 4 sieve: seventy-five percent (75%) to
ninety percent (90%).
