Boundary Line Agreement
This Agreement, made the _7�_- _ day of 17',2015, between SAMUEL SINGER, his
heirs, executors, administrators, distributees, tenants, grantees, licensees, invitees, successors,
and assigns, residing at 515 East 72"d, Apt 813, New York, NY 10021 (herein referred as to
"Singer"), And VERONICA M. STANKEWICZ, residing at 43900 Main Road, Peconic, New
York, GERARD M. STANKEWICZ, residing at 1705 Henry's Lane, Peconic, New York
AND DIANE M. STANKEWICZ, residing at 43900 Main Road, Peconic, New York
as heirs of John Stakewicz, Jr., and as owners, their heirs, executors, administrators, distributees;
tenants, grantees, licensees, invitees, successors, and assigns (herein referred to as
"Stankewicz");
WITNESSETH THAT
WHEREAS the aforesaid parties are the owners of contiguous parcels of real estate
comprising the land in the Town of Southold, County of Suffolk and State of New York, on the
southerly side of Main Road, Peconic, NY
WHEREAS Singer is the owner of a 23.7 acre vacant parcel known as, 44030 Route 25,
Peconic NY, further described as Suffolk County Tax Map parcel District 1000 -Section 75 -Block
6 and lot 6.1 (Schedule A-1 attached hereto) and Stankewicz is the owner of a parcel known as
43900 Main Road, Peconic, NY, further described as Suffolk County Tax Map parcels and
District 1000 -Section 75 -Block 6 and lot 5 (Schedule A-2 attached hereto); and
WHEREAS a survey map dated February 1, 2015 of the Singer premises has been
prepared by Nathan Taft Corwin III, Licensed Land Surveyor of the State of New York, a
reduced copy of which survey map is annexed hereto and made a part hereof; and
WHEREAS, the aforesaid survey map indicates that an asphalt driveway is located on
the westerly side of the Singer property outside the easterly property line of Stankewicz at an
irregular distance approximately 30 feet from the true line of division between the said parcel
owned by the Singer and the said parcel owned by Stankewicz; and
WHEREAS, the true line of division between the said parcel owned by the Singer and
the said parcels owned by Stankewicz is the line shown as the westerly property line of the
Singer parcel shown on the attached survey;
NOW THEREFORE in consideration of the mutual promises and conveyances herein
contained, and other good and valuable considerations the receipt of which is hereby
mutually acknowledged, the parties agree as follows:
1. That the true line of division between the said parcels between the westerly
boundary of the property owned by Singer and the easterly boundary of the
properties owned by Stankewicz shall be a line commencing at 437.11' east
along the Southerly Side of the Main Road (Route 25)from the South East corner
of Wells Road and running South 34 degrees 06 minutes 10 Seconds East, 150
feet and running south 55 degrees 00 Minutes 00 Seconds West, 95 feet to land
now or formerly of Sophie Andrade, as shown on annexed survey.
2. This agreement shall run with the lands comprising of the Singer premises and the
Stankewicz premises and shall also be binding upon and inure to the benefit of
the parties hereto, and their respective heirs, executors, administrators, trustees,
beneficiaries, distributees, tenants, grantees, licensees, invitees, successors, and
assigns, the parcels of the Singer and Stankewicz are herein attached as schedule
"A-1" and "A-2", respectively;
Stankewicz herein make no claim of any right, title or interest to the land under
the driveway, the area shown between the driveway on the westerly property line
of the Singer property, and the Stankewicz easterly property line, and areas shown
on the attached survey as "edge of lawn", along the southeasterly land of
Stankewicz; and
4. Stankewicz hereby indemnify and hold harmless Singer for any and all liability or
claims caused by said driveway and such other encroachments, Stankewicz will
maintain proper homeowner's insurance on said property, naming Singer, as
additional insured.
Singer authorizes the driveway, in it's present location and improvement, to
remain for as long as the driveway is needed and maintained by Stankowicz.
6. Singer reserves the right to use the existing curb cut on Main Road and the
existing driveway, for any and all purposes, including but not limited to, as a
common access for the development of the Singer parcel.
7. This agreement contains the entire understanding between and among the parties
hereto with respect to the matters set forth herein. This agreement may not be
modified, altered, terminated, waived, abandoned, or discharged in any manner,
except by an instrument in writing signed by all the parties hereto or their
respective heirs, executors, administrators, trustees, distributees, grantees,
successors, or assigns.
It is understood and agreed that all understandings and agreements heretofore had
between and among the parties hereto are merged in this agreement, which alone
fully and completely expresses their agreement, and that the same is entered into
after full investigation, no party hereto relying upon any statement or
representation made by any other party except as specifically set forth in this
agreement.
