If any clause, sentence, paragraph, section or part of this article shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof but shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in the controversy in which such judgment shall have been rendered. § 6-40. Effective date. This article shall take effect immediately upon filing with the Secretary of State as provided by law. ARTICLE II Southold Community Preservation Project Plan [Adopted 8-25-1998 by L.L. No. 14-19981 §§ 6-41 through 6-44. (Reserved) § 6-45. Legislative findings; purpose. A. The Town of Southold possesses a rich heritage of open space and scenic and natural resources and historic places which are vital to the town's sense of place and to its economic success as a community. However, the lands which comprise these resources are rapidly being lost to development, and the town's special identity is in danger of being damaged forever. In furtherance of its goal of • preserving the town's remaining open space and natural, scenic and historic treasures, the Southold Town Board finds it necessary to adopt a plan for their conservation. Such plan is specifically authorized under § 64-e of the New York Town Law and will serve as the basis for the expenditure of any moneys from the Southold Community Preservation Fund, including those moneys 611 06-10-2005 § 6-45 SOUTHOLD CODE § 6-50 realized under this chapter's two -percent real estate transfer tax, which is also authorized by Town Law § 64-e and Article 31-D of the New York Tax Law. B. It is the purpose of this article to establish and create the Southold Community Preservation Project Plan to help guide the town's efforts to preserve open spaces and natural, scenic and historic places and to implement the requirements of Town Law 64-e and Article 31-D of the New York Tax Law. §§ 6-46 through 6-49. (Reserved) § 6-50. Community preservation project plan adopted. [Amended 2-4-2003 by L.L. No. 2-2003; 4-12-2005 by L.L. No. 5-20051 A. For the reasons set forth in § 6-45 hereof, the Town Board of the Town of Southold hereby approves and adopts the community preservation project plan prepared by the Town's Planning Department, the Land Preservation Committee, the Peconic Land Trust and Central Data Processing and presented to the Town Board on August 4, 1998, during the work session portion of the Town Board meeting, said plan being intended to constitute the Southold Community Preservation Project Plan which is required by § 64-e of the New York Town Law and Article I of Chapter 6 of the Southold Town Code. B. The Town Board of the Town of Southold hereby approves and adopts the January 2003 update to the • community preservation project plan prepared by the Land Preservation Department and Central Data Processing Department and presented to the Town Board on January 21, 2003, during the work session portion of the Town Board meeting. The 1998 List of Eligible Parcels shall be replaced by the January 2003 List of 612 06-10-2005 § 6-50 COMMUNITY PRESERVATION FUND § 6-54 Eligible Parcels presented to the Town Board during the January 21, 2003, work session. C. The Town Board of the Town of Southold hereby approves and .adopts the March 2005 update to the community preservation project plan which adds certain parcels in the Great Pond Wetland and Dune Area in • Southold to the List of Eligible Parcels. The text of the plan adopted by the Town Board in 1998 (plan dated July 1998) shall remain as adopted in 1998, with an updated March 2005 Executive Summary and updated cover pages. The January 2003 List of Eligible Parcels shall be revised as of March 29, 2005, to include the identified Great Pond Wetland and Dune Area parcels. • §§ 6-51 through 6-53. (Reserved) § 6-54. Severability. Highway specifications — See Ch. A108. § 80-1. Intent. It is the intent of the Town Board to place the responsibility of keeping sidewalks clean with the property owners adjacent to the sidewalk. § 80-2. Snow and ice removal; general maintenance. Each owner or occupant of any house or other building, and any owner or person entitled to possession of any vacant lot, and any person having charge of any church or any public building in the town shall, during the winter season or during the time snow shall continue on the ground, keep the sidewalk in front of the lot or house free from obstruction by snow or ice and icy conditions and shall at all times keep the sidewalk in a clean condition, free from filth, dirt, weeds or other obstructions or encumbrances. 8001 06-10-2005 § 80-3 SOUTHOLD CODE § 80-3 § 80-3. Penalties for offenses. [Added 3-1-2005 by L.L. No. 3-2005] Any person violating any of the provisions of this chapter shall be guilty of a violation and, upon conviction thereof, shall be punishable by a fine not exceeding $250 for each offense. Subdivision of land — See Ch. A106. 8701 06-10-2005 § 87-1 SOUTHOLD CODE § 87-2 § 87-1. Purpose and intent. As set forth in numerous comprehensive planning documents, the Town's goals include the preservation of open space, agricultural lands and recreational landscapes; preservation of the rural, cultural, and historic character of the hamlets and surrounding countryside; preservation of the natural environment and prevention of further deterioration of resources; preservation and promotion of a broad range of housing and business opportunities to support a socioeconomically diverse community; and increased transportation efficiency. To achieve these goals it is the intent and purpose of this chapter to provide for the transfer of sanitary flow credits, and thereby transfer development potential from areas designated for preservation to areas designated as more appropriate for higher -density residential development. Unless expressly permitted herein, the transfer of development potential may not occur in the Town of Southold. § 87-2. Definitions. As used in this chapter, the following terms shall have the meanings indicated: DEVELOPMENT RIGHTS — The rights permitted to a lot, parcel, or area of land under a zoning ordinance or local law regarding permissible use, area, density, bulk, or height of improvements executed thereon. Development rights may be calculated and allocated in accordance with such factors as area, floor area, floor area ratios, density, height limitations or any other criteria that will effectively quantify a value for the development right in a reasonable and uniform manner that will carry out the objectives of this chapter. A development right includes but is not limited to a sanitary flow credit. RECEIVING DISTRICT — One or more designated districts or areas of land to which development rights generated from one or more sending districts may be 8702 06 -10 - 2005 § 87-2 TRANSFER OF DEVELOPMENT RIGHTS § 87-3 transferred and in which increased development is permitted to occur by reason of such transfer. SENDING DISTRICT — One or more designated districts or areas of land from which development rights are designated for transfer and use in one or more receiving districts. SANITARY FLOW CREDIT — One of the development is rights allocated to a lot or parcel. A sanitary flow credit is equivalent to a right to develop a single-family residential parcel with an individual on-site sewerage system, or its nonresidential wastewater flow equivalent. See Suffolk County Sanitary Code § 760-605. (Other approvals will be required prior to development, including compliance with the Town Zoning Code.)' TRANSFER OF DEVELOPMENT RIGHTS — The process by which development rights are transferred from one lot, parcel, or area of land in any sending district to another lot, parcel, or area of land in one or more receiving districts. § 87-3. Development Rights Bank. The Town hereby establishes a Transferred Development Rights Bank (TDR Bank) in which development rights may be received, retained and sold by the Town Board in the best interests of the Town. All development rights transferred into the bank must first be accepted by Town Board resolution in accordance with the terms of this chapter. All receipts and proceeds from sales of development rights sold from the Town bank shall be deposited into a special municipal account known • as the "Community Preservation Fund," to be used in a manner specified in Chapter 6 of the Town Code. A. The only development right that may be transferred into and out of the TDR Bank is a sanitary flow credit. 1 Editor's Note: See Ch. 100, Zoning. 8703 06-10-2005 § 87-3 SOUTHOLD CODE § 87-4 B. The lands from which development rights to be transferred into the bank were acquired shall remain preserved in perpetuity by a permanent conservation easement or other instrument that similarly preserves community character as defined and set forth in the definition of "community preservation" in Chapter 6 of the Town Code. The easement or other document shall be in a form approved by the Town Attorney. § 87-4. Sanitary flow credit transfer. The sanitary flow credit transfer will allow the Town to bank sanitary flow credits from preserved land in the TDR Bank, and later sell those credits for use exclusively in connection with affordable housing. The sale price of the credits shall be determined by resolution of the Town Board, and shall consider such factors as the appraised value of the sanitary flow credit and the public benefit provided to the community. All transfers of Sanitary Flow Credits pursuant to this chapter must pass through the TDR Bank. A. Designation of sending and receiving districts. (1) The sending district shall be any zoning district in the Town of Southold that is not defined as a receiving district. (2) The receiving district shall be any lands designated Business (B), Hamlet Business (HB), Residential Office (RO), or land designated as Affordable Housing District (AHD) after March 1, 2005. B. Designation of development rights. A development right for the purposes of this chapter, shall be limited to a sanitary flow credit. • 8704 06-10-2005 § 87-5 TRANSFER OF DEVELOPMENT RIGHTS § 87-6 § 87-5. Determination of sanitary flow credit to be deposited into TDR Bank. A. Upon receipt of a contract (executed by the seller) for the Town's acquisition of a parcel of property or the development rights thereon, and prior to the public hearing on the purchase, the Land Preservation ® Coordinator shall provide to the Town Board a calculation of the sanitary flow credits available, subject to survey, for transfer from the parcel of property upon the closing of the contract in accordance with its terms. B. Following the closing on the parcel, sanitary flow credits shall be placed into the Town TDR Bank by resolution of the Town Board, which resolution shall set forth the number of sanitary flow credits and the source of the credits. The Town Clerk shall maintain a log detailing the credits transferred into the bank, as provided by the Land Preservation Coordinator in a form approved by the Town Board. C. The Town Clerk shall forward the resolution to the Tax Assessor's office, the Land Preservation Department, the Special Projects Coordinator and the Planning Depart- ment for inclusion into the Town database and GIS system. § 87-6. Irreversible transfer. No development rights shall be transferred back to the sending parcel once' the development rights have been transferred. No development rights may be transferred out of a parcel which has previously had all of its development rights ® extinguished under the Town of Southold, Suffolk County or New York State acquisition of development rights program or other easement, transfer, restrictive covenant or otherwise. 8705 06-10-2005 § 87-7 SOUTHOLD CODE § 87-7 § 87-7. Procedure for transfer of development right from the TDR Bank to receiving district. Upon application of the owner of an individual parcel in a receiving district, the Town Board may permit the transfer of a development right to such parcel by proceeding in the manner set forth below: A. Notice to adjacent property owners shall be given by the applicant in the same manner as set forth in § 100-292 relating to change of zone applications. B. The Town Board, before publishing notice for a public hearing, shall comply with all State Environmental Quality Review Act (SEQRA) requirements, and costs associated with review shall be paid by the applicant. C. The Town Board, before publishing notice for a public hearing, shall, in a written request, instruct the Town Planning Board and the Building Inspector to prepare an official report regarding the proposed transfer, including the Planning Board recommendations. The Building Inspector report shall certify the use in the zone proposed and comment on the proposed project. The Planning Board report and recommendations shall consider the factors set forth in § 87-7E below. D. The Town Board, by resolution adopted at a stated meeting, shall fix the time and place of a public hearing on the proposed transfer and cause at least 10 days' notice of such hearing to be published in the official newspaper. E. Before the transfer of development rights may be authorized to any receiving district, the Town Board shall determine, after evaluating the effects of potential increased development which is possible under the transfer of development rights provisions, that the district contains adequate resources, environmental quality and public facilities, including adequate transportation, water supply, waste disposal and fire protection, and that there will be no significant environ - 8706 06-10-2005 § 87-7 TRANSFER OF DEVELOPMENT RIGHTS § 87-8 mentally damaging consequences, and that such increased development is compatible with comprehensive planning and the development otherwise permitted by the Town and by the federal, state and county agencies having jurisdiction to approve permissible development within the district. F. Where a transfer of development rights affects districts 40 in two or more school, special assessment, or tax districts, it may not unreasonably transfer the tax burden between the taxpayers of such districts. G. Following the public hearing, the Town Board may by resolution authorize the transfer of sanitary flow credits. The resolution shall state that the applicant shall receive a sanitary flow credit certificate, which shall not be signed by the Supervisor and released by the Town Clerk to the applicant until the covenants and restrictions as set forth at § 87-9 have been filed and such filing has been approved by the Town Attorney. § 87-8. Sanitary flow credit certificate. A. An applicant must obtain and present a sanitary flow credit certificate to the Building Department prior to receiving a building permit. B. The sanitary flow credit certificate shall state the specific use for the transferred credit and may be used only for construction of the project listed on the certificate. C. The Town Clerk shall maintain a log detailing the sanitary flow credit certificates that have been issued by the Town Board, and such log shall contain the source • and location of the transferred credit. D. The Town Clerk shall provide notice of the issuance of a sanitary flow credit certificate to the Town Attorney, Tax Assessors Office, the Land Preservation Department, the Special Projects Coordinator and the Planning Depart- ment. 8707 06-10-2005 § 87-9 SOUTHOLD CODE § 87-10 § 87-9. Covenants and restrictions. A. Following the Town Board resolution granting a transfer of a sanitary flow credit to a recipient pursuant to the procedures set forth in this chapter, the applicant shall file in the office of the Suffolk County Clerk covenants and restrictions in a form approved by the Town Attorney. The covenant§ and restrictions shall contain terms and conditions as the Town Board and the Planning Board deem necessary to ensure that the dwelling unit created by the transferred credit remains affordable in perpetuity, and shall be leased or sold only to eligible individuals registered with the Town of Southold Housing Registry. The sale and/or lease of the dwelling unit that has been constructed with the transferred credit shall be administered through the Town of Southold pursuant to the provisions of Chapter 98 (Housing Registry) and §§ 100-50 through 100-59 (AHD), and the sale and/or lease price shall be set by resolution of the Town Board. B. A copy of the filed covenants and restrictions must be filed with the Town Clerk within 30 days of the approving resolution. No sanitary flow credit certificate shall be issued until the covenants and restrictions have been filed and such filing has been approved by the Town Attorney. C. The Town Clerk shall forward the covenants and restrictions to the Town Attorney, Tax Assessor's Office, the Land Preservation Department, the Special Projects Coordinator and the Planning Department for inclusion into the Town database. § 87-10. Revocation. is Failure to comply with any of the requirements set forth in this chapter may result in revocation of the transferred sanitary flow credit. A sanitary flow credit may be revoked by Town Board resolution, following a public hearing, after 10 days' 8708 06-10-2005 § 87-10 TRANSFER OF DEVELOPMENT RIGHTS § 87-12 written notice of the hearing, by personal service or certified mail, has been given to the property owner. § 87-11. Expiration. Any sanitary flow credit transferred to a recipient for construction of a dwelling unit shall expire and be returned to is the bank one year after transfer if the dwelling unit has not been issued a certificate of occupancy, unless an extension of time has been requested by the property owner and granted by the Town Board. A request for an extension of time shall be made one month in advance of the expiration. A sanitary flow credit shall be returned to the bank by resolution of the Town Board, and notice thereof shall be given by the Town Clerk to those town departments referenced in § 87-8D. • § 87-12. Return of credit. In the B, HB or RO Zoning District, a property owner may apply to the Town Board to return the transferred sanitary flow credit to the bank and extinguish the affordable housing covenants and restrictions applicable to the property. The Town Board shall hold a public hearing on the application, and notice shall be given in accordance with Chapter 58. A sanitary flow credit shall be returned to the bank by resolution of the Town Board, and notice thereof shall be given by the Town Clerk to those Town departments referenced in § 87-8D. 8709 06-10-2005 ZONING § 100-256. The Planning Board shall hold a public hearing to consider the application. Notice shall be provided pursuant to Chapter 58. Notwithstanding this requirement, with respect to applications involving modifications to existing structures with no substantial change to the existing footprint, where the Planning Board determines that such modifications or any change • in use will not require significant changes to existing major site design features, as well as applications involving uses strictly related to agriculture (but excepting retail winery operations), the Planning Board shall have the discretion to waive the public hearing requirement and may act on such application by filed resolution at a duly noticed public meeting. I. Prior to the Planning Board's endorsement of the site plan, the applicant must sign a statement placed on the site plan indicating his/her knowledge and acceptance of the conditions of approval. J. Amendments to an existing site plan may he acted upon in the same manner as a new site plan. K. A guaranty of performance may be required for all public improvements as part of the conditions of approval. Such guaranty shall he based on a listing of required site improvements in accordance with Chapter A106 of this Code. L. Within 10 days of final approval, a copy of the endorsed site plan shall be sent to: (1) The Building Department. (2) The Town Engineer. • (3) The Town Trustees, when applicable. (4) The Highway Department. (5) The Zoning Board of Appeals, when applicable. M. The Planning Board shall have the right to deny the proposed site plan for lack of compliance with the 10155 06-10-2005 § 100-254 SOUTHOLD CODE § 100-256 provisions of the Town Code, The Planning Board shall notify the applicant, in writing, within 10 days of such determination, of the reasons for such denial. § 100-255. Duration of plan. A. An approved site development plan shall be valid for a period of three years from the date of approval. All work proposed on the plan shall be completed within three years from the date of approval unless a longer period was approved or the applicant obtains an extension from the Planning Board. B.' All site plans which have received final approval prior to the enactment of this Article shall remain valid for a period of three years from the date of such enactment. This period will begin when all governmental approvals have been obtained. § 100-256. Application requirements. [Amended 3-27-2001 by L.L. No. 7-2001; 12-14-2004 by L.L. No. 25-2004; 3-29-2005 by L.L. No. 4-20051 A. Submission of a complete site plan application shall consist of: (1) A completed site plan application form. (2) The site plan review fee, as specified in Subsection B below.' (3) A completed environmental assessment form. (4) Nine copies of the site plan. (5) Four copies of a property survey, certified by a • licensed land surveyor. B. Site plan design shall include the following items: (1) Technical data: (a) The lot, block and section number of the property, taken from the latest tax records. (b) The name and address of the landowner on • record: [1] The names and addresses of adjoining landowners. [2] The name and address of the applicant, if not the same as the landowner. (c) The name and address of the person, firm or organization, preparing the map, sealed with the applicable New Fork State license seal and signature. (d) Date, graphic scale and North point, whether true or magnetic; if magnetic, show the date of reading. (e) A survey prepared by a licensed surveyor or civil engineer. The site plan may reference a land surveyor's map or base reference map. All distances shall be in feet and hundredths of a foot. All angles shall be given to the nearest 10 seconds or closer. The error of closure shall not exceed one in 10,000. (f) The locations, names and widths of all rights- of-way within 500 feet of property lines. If none exist within 500 feet of the subject property, • indicate the distance to the nearest intersection with a public street. (g) A separate key map showing location and owners of all adjoining lands within 500 feet, as shown on the latest tax records, at a scale of one inch equals 100 feet. 10157 06-10-2005 § 100-256 SOUTHOLD CODE § 100-256 (h) The location, width and purpose of all existing and proposed easements, setbacks, reservations and areas dedicated to public use within or adjoining the property. (i) A complete outline of other existing easements, deed restrictions or covenants applying to the property. (j) Existing zoning, including zone lines and dimensions. (k) Site plans drawn at the scale of one inch equals 20 feet. If all required information cannot be shown clearly on one plan, the information should be separated as follows: [1] Alignment and schedule plan. [2] Grading and drainage. [3] Landscaping. [4] Other, e.g., site utilities. (2) Natural features: (a) Existing contours with intervals of two feet or less, referred to mean sea level as per United States Geological Survey datum. (b) Boundaries of any areas subject to flooding or stormwater overflows, tidal bays, saltwater marshes, beaches and all freshwater bodies, including wetlands and intermittent streams, perimeter boundaries of shoreline bluffs, dunes and beaches. (c) The location of existing natural features, • including but not limited to natural drainage swales, watercourses, wooded areas and wetlands, as defined by the New York State De- partment of Environmental Conservation and the Board of Trustees of Southold Town, marshes, ponds, dunes, bluffs, beaches, 10158 06-10-2005 § 100-256 ZONING § 100-256 kettleholes, escarpments, wildlife habitats, flood hazard areas, erosion -prone areas and trees of six inches in diameter at a point three feet above the trunk base. (d) The location of any existing cultural and historical features within 500 feet of the property boundaries. (3) Existing building structures and utilities: (a) The locations, dimensions and outlines of all buildings, as defined in § 100-13 of this chapter, and all uses of the site. (b) Paved areas, including parking areas, sidewalks and vehicular access between the site and public streets. (c) The locations, dimensions, grades and flow directions of any existing culverts, waterlines or sewage disposal systems, as well as other underground and aboveground utility poles and utility lines within and adjacent to the property. (d) The location and use of all buildings and structures, including curbcuts, within 200 feet of the boundary of the subject property. (4) Proposed construction: (a) The location of proposed buildings or structural improvements, indicating setbacks from all property lines and horizontal distances from existing structures. (b) The location and design of all uses not requiring is structures, such as off-street parking and loading areas and pedestrian circulation. (c) The location, direction, power level and time of use for any proposed outdoor lighting or public address systems. 10158.1 06-10-2005 § 100-256 SOUTHOLD CODE § 100-256 (d) The location and plans for any outdoor signs must be in accordance with applicable sign regulations. (e) The location and details of aprons, curbs, sidewalks, fencing (type and location), and grading, including existing and proposed topography with two -foot contours (on site and 200 feet beyond the property line) and spot elevations for buildings and all structures, drainage calculations, details of drainage structures and watershed areas, where applicable. (f) Grading and drainage plans shall be based upon site stormwater retention, in conformance with Chapter A108, Highway Specifications. (g) The location and listing of landscaping, buffering and street tree plans, including type, material, size, quantity and location. (h) The location of water and sewer mains, electrical service, cablevision and telephone installations, ground transformers, fire wells and fire hydrants and/or any alternate means of water supply and sewage disposal and treatment. (i) Building elevations for all facades and floor plans showing the proposed use of floor area. D. Notwithstanding the foregoing, the Planning Board shall have the discretion to waive any or all of the requirements of this § 100-256 by resolution at a duly noticed public meeting, for those applications involving modifications to existing structures with no substantial is change to the existing footprint, where the Planning Board determines that such modifications or any change in use will not require significant changes to existing major site design features, as well as applications involving uses strictly related to agriculture (but 10158.2 06-10-2005 § 100-256 ZONING § 100-257 excepting retail winery operations), if it determines such requirements are not necessary to protect and maintain the public health, safety, or welfare and to further the objectives set forth in § 100-252. § 100-257. Architectural review standards. [Added 5-15-1995 by L.L. No. 7-19951 Site plans shall be reviewed for conformance with the following criteria: A. Appropriate diversity of design elements from another structure or structures located or proposed to be located on the same street or corner thereof and within 500 feet of the site of the structure for which a site plan or building permit has been requested, in respect to one or more of the following features of exterior design and appearance: (1) Substantially identical facade, disregarding color. (2) Substantiallyidentical size and arrangement of either doors, windows, porticoes, porches or garages or other openings or breaks or extensions in the facade, including reverse arrangements. (3) Other substantially identical features, such as but not limited to setbacks from street lines, heights, widths and lengths of elements of the building design and exterior materials and treatments. B. Minimize or eliminate visual discord or dissimilarity with respect to other structures located or proposed to be located on the same street or a corner thereof and within • 500 feet of the site of the structure for which a building permit is requested, in respect to one or more of the following features of exterior design and appearance: (1) Facade, disregarding color. 10158.3 06-10-2005 § 100-257 SOUTHOLD CODE § 100-258 (2) Size and arrangement of doors, windows, porticoes, porches or garages or other openings, breaks or extensions in the facade. (3) Other significant design features, such as but not limited to heights, widths and lengths of elements, roof structures, exposed mechanical equipment, service and storage areas, retaining walls, landscaping, signs, light posts, parking areas and fences, service and loading areas. C. Maximize sensitivity to visual appearance and qualities of exterior design, including with respect to signs, considerations of the harmony of colors or compatibility of the proposed structure with the terrain in which it is to be located, including but not limited to excessive divergences of the height or levels of any part of the structure from the grade of the terrain. § 100-258. Architectural Review Committee. [Added 5-15-1995 by L.L. No. 7-19951 A. The Architectural Review Committee shall consist of five members appointed by the Town Board to serve at the pleasure of the Board without compensation. If possible, the members of the Committee shall be appointed from the following categories: two members shall be architects or landscape architects, one member shall be from the Landmark Preservation Commission and 10 members shall be appointed from the hamlets of the Town. The hamlet members shall vary and shall sit only on the site plans which are proposed in their hamlet. The hamlet members shall be from the following areas: two from Fishers Island, two from Orient/East Marion/Greenport, • two from Southold/Peconic, two from New Suffolk/Cutchogue and two from Mattituck/Laurel. [Amended 10-3-1995 by L.L. No. 20-19951 B. The term of office of the Architect and Landmark Preservation Commission members of the Committee 10158.4 06-10-2005 § 100-258 ZONING § 100-259.1 shall be three years, provided that those members first appointed shall be appointed for one-, two- and three- year terms, respectively. The hamlet members shall be appointed for two-year terms, with the first appointments to be appointed for a one- and two-year term, respectively. ® § 100-259. Land clearing. [Added 8-8-1995 by L.L. No. 17-1995 2] No person shall undertake or carry out land clearing, including grading, clearing, cutting and filling, excavating or tree removal associated therewith, without first having obtained site plan approval. Weeding, gardening, mowing and the selective pruning of vegetation or selective cutting of diseased or dead trees shall not be included herein. Any landowner found guilty of violating this section shall be fined up to $5,000. Site plan approval shall be withheld until and unless a plant restoration plan for that site is approved by the Planning Board. § 100-259.1. Standards for residential site plans. [Added 1-18-2005 by L.L. No. 1-20051 A. The Planning Board's review of the application and plans with respect to residential site plans shall include their compliance with the following: (1) The requirement that the applicant attend a presubmission conference, at which time the applicant, the Planning Board and planning staff shall discuss the salient design features of the • application. (2) The applicable provisions of this chapter. (3) Where applicable, Town Law § 274-a and General Municipal Law § 239-m. (4) Construction standards and specifications of the Town highway specifications, Chapter A108 of the is Code of the Town of Southold. (5) The requirements of the existing resources and site analysis plan(s) (ERSAP) and the allowable density of dwelling units as calculated using the yield plan criteria for standard subdivisions set forth in §§ 106-11A and B(2) of the Code of the Town of Southold, Subdivision of Land. (6) The provisions of Article XI, Cluster Development, of Chapter A106 of the Code of the Town of Southold, Subdivision of Land, as may be applied by the Planning Board in its discretion to residential site plans where it determines that such cluster development shall benefit the Town and the natural and scenic qualities of open lands. In doing so, the Planning Board shall establish conditions on the ownership, use and maintenance of such open lands as it deems necessary to assure the preservation of the natural and scenic qualities of such open lands and shall not permit the use of such lands for the fulfillment of the park and recreation requirement. The procedures set forth in Article XI, of Chapter A106, Subdivision of Land, shall govern except as modified herein. To the extent that this provision may be construed to be in conflict with Town Law • § 278 regarding clustered development, Town Law § 274-a regarding site plan review, or Town Law § 267, 267-a, 267-b or 267-c regarding the authority of the Zoning Board of Appeals, this provision supersedes and amends such sections insofar as they place any limitation on the Planning Board's 10158.6 06-10-2005 § 100-259.1 ZONING § 100-259.1 application of such clustered development to residential site plans or the requirement of the fulfillment of the park and recreation requirement. (7) Design considerations: (a) The location, arrangement, setbacks, size, design, and general site compatibility of buildings, structures', landscaping, lighting, and signs, in keeping with the character of the community; (b) The adequacy, safety and convenience of vehicular traffic access and circulation, including driveways, rights-of-way, curb cuts, intersections, pavement surfaces, traffic controls, and designated areas for access to public transportation; (c) The adequacy, safety and convenience of pedestrian and bicycle traffic and circulation, including sidewalks, walkways, and pedestrian/vehicle conflict points; (d) The sufficiency, convenience and appearance of off-street parking and loading areas, including visitor and overflow parking, parking and storage for trailers, boats, and recreational vehicles, and the provision of alleyways; (e) The provision of and adequacy of emergency lanes, exits, tap streets, other safety zones, and the provision of fire hydrants to promote the public safety; and (f) The proximity of recreational facilities and open • space. B. Preliminary hearing requirement. Prior to and in addition to the public hearing required by § 100-254H, the Planning Board shall hold a separate preliminary hearing on the application with notice provided pursuant to Chapter 58. 10158.7 06-10-2005 § 100-259.1 SOUTHOLD CODE § 100-259.1 C. Affordable housing requirement. Every new residential site plan involving the creation of five or more dwelling units shall comply with the requirements of § A106-11B(2)(c) of the Code of the Town of Southold, Subdivision of Land, pertaining to the provision of affordable housing. The requirements applicable to lots within subdivision in that subsection shall apply equally to dwelling units in affected residential site plans. D. Park and recreation requirement. The provisions of § A106-60 of the Code of the Town of Southold, Subdivision of Land, pertaining to the reservation of parkland in subdivisions, shall apply equally to residential site plans approved under this chapter, except the fee per lot therein shall herein be applicable to each dwelling unit. E. Performance bond requirement. The provisions of Article IX, Bonds and Other Security, and Article X, Required Public Improvements; Inspections; Fees, of Chapter A106, Subdivision of Land, of the Code of the Town of Southold, shall apply equally to residential site plans approved under this chapter. Pursuant to Municipal Home Rule Law § 10, § 100-259.1B, C and D herein supersede and amend New York State Town Law § 274-a regarding site plan review to the extent that the Planning Board is empowered to impose affordable housing, park and recreation and performance bond requirements in the residential site plan review process. F. Phased development. The Planning Board shall permit the phased development of residential properties that meet all other applicable standards, but shall condition the approval of the development of any permitted phase upon the maintenance of the undeveloped phases in their undeveloped condition, and shall prohibit all clearing and site preparation on such undeveloped phases until such time as development is permitted. G. Planning Board authority to vary requirements for setbacks, building length and separation and courts. 10158.8 06-10-2005 • is § 100-259.1 ZONING § 100-259.1 (1) The Planning Board shall have the authority to reduce or amend yard setback requirements for individual buildings in favor of a perimeter setback for entire groups of buildings, to require that setbacks from interior streets be varied, and to reduce or amend the requirements of §§ 100-233 and 100-234. In making these decisions, the Planning • Board shall take into consideration the benefit to the applicant, as weighed against the detriment to the health, safety and welfare of the neighborhood or community. In making such determination, the Planning Board shall also consider: (a) Whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties will be created by the granting of the amendment; (b) Whether the benefit sought by the applicant can be achieved by some method feasible for the applicant to pursue, other than the sought variance; (c) Whether the variance is substantial; (d) Whether the proposed variance will have an adverse effect or impact on the physical or envi- ronmental conditions in the neighborhood or district; and (e) Whether the alleged difficulty was self-created, which shall be relevant to the decision but shall not necessarily preclude the proposed amendment or variance. • (2) This provision supersedes and amends New York State Town Law §§ 267, 267-a, 267-b and 267-c insofar as these sections give such authority to the Zoning Board of Appeals. 10158.9 06-10-2005 § 100-259.2 SOUTHOLD CODE § 100-260 § 100-259.2. Fee schedule for site plan applications. [Added 3-29-2005 by L.L. No. 4-20051 A. The fee for new site plan applications, including without limitation applications relating to vacant sites or sites with no previously approved site plan, shall be a flat fee of $500 plus an additional $500 for each acre (or fraction thereof) in excess of the first acre, plus $0.10 for each • gross square foot of proposed construction. B. The fee for amended site plan applications shall be a flat fee of $250 plus $0.10 for each gross square foot of proposed construction in excess of the square footage of construction included in the previously approved site plan. C. The fee for agricultural site plan applications, excepting retail winery operations, shall be a flat fee of $500. ARTICLE XXVI Special Exception Uses [Added 1-10-1989 by L.L. No. 1-19891 § 100-260. Purpose. The provisions of this Article are designed to provide for administrative review of selected types of proposed land uses. Certain uses which are allowable under zoning are nevertheless so likely to significantly affect their surroundings that they require individual review to assure compatibility with existing land use patterns, community character and the natural environment before being permitted to come into existence. Similarly, certain authorized uses may take on such diverse forms in their actual implementation that it is wise to review • and pass upon the adherence of each individual proposal to standards and guidelines previously established for the use involved.
