TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or successors and assigns of the party of the second part forever. The use for which the Unit is intended is that of a one family residence, subject to the applicable governmental regulations and the restrictions contained in the Declaration. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. Grantor and Grantee both covenant that membership in the Bayview Water Homeowners Association, Inc. is a condition of and ownership of the premises herein conveyed and the ownership and membership set forth herein, by operation thereof, transfers membership in the Bavview Water Homeowners Association, Inc. Grantee herein, his heirs, successors, and assigns, covenant that they will abide by all rules and regulations and pay all assessments which may be imposed by Bayview Water Homeowners Association, Inc. in order to maintain the water supply system. This conveyance has been made in the regular course of business actually conducted by the party of the first part. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires. -2-
