A. At the shopping center located on the north side of New
York Route 25, approximately one thousand four
hundred (1,400) feet west of Cox Lane in the Hamlet of
Cutchogue, commonly known as the "Key Food Shopping
Center," such fire lane to be thirty (30) feet in width from
the southerly sidewalk curbline on the south side (front)
of the building and extending for the entire length of the
store building.

B. At the shopping center located on the north side of New
York Route 25, having ingress and egress on both Route
25 and Factory Avenue in the Hamlet of Mattituck,
commonly known as the "A & P Shopping Center," such
fire lane to be twenty-four (24) feet in width, from the
southerly and westerly sidewalk curbline on the south
and west (front) side of the building and extending the
entire length of the L-shaped store building; i.e., four
hundred sixty-six (466) feet along the southerly face of
the building and two hundred twenty-two (222) feet

§ 92-46. Parking or standing prohibited during certain

No person shall park or stand a motor vehicle in any parking
space designated for the parking of motor vehicles by
individuals with handicapped license plates or permits as set
forth below, unless said vehicle displays such valid handicapped
• license plate, or a valid handicapped parking permit displayed
in the manner and location designated by law or regulation, in
any location listed below:

Emergency Removal of Vehicles
is
§ 92-50. Authority to remove vehicles.
When any vehicle is parked or abandoned on any highway
during a snowstorm, flood, fire or other public emergency which
affects that portion of the public highway upon which said
vehicle is parked or abandoned, or when any vehicle is found
unattended on any highway where said vehicle constitutes an
obstruction to traffic, or when any vehicle is parked or
abandoned on any highway where stopping, standing or
parking is prohibited, said vehicle may be removed or caused to
be removed by a police officer.

After removal of any vehicle as provided in this article or the
removal, seizure, storage and/or impoundment of any vehicle
pursuant to any other provision of law, the police officer may
store or cause such vehicle to be stored in a suitable place at the •
expense of the owner. Such owner or person in charge of the
vehicle may redeem the same upon payment to the Southold
Town Police Department of the amount of all expenses actually
and necessarily incurred in effecting such removal. The
expenses, charges and costs associated with such removal are
set by resolution of the Town Board of the Town of Southold.
Such resolution shall be posted at the Police Department and
the Town Clerk's bulletin board.
§ 92-52. Notice of removal.
The Southold Town Police Department shall ascertain, to the
extent possible, the owner or person in charge of such vehicle
and notify him of the removal and disposition of such vehicle
and of the amount which will be required to redeem the same.
ARTICLE VI
Penalties
§ 92-60. Penalties for offenses. [Amended 5-13-1997 by
L.L. No. 10-19971
A. Every person convicted of a traffic infraction for a
violation of any provision of this chapter which is not a
violation of any provision of the Vehicle and Traffic Law
of the State of New York shall, for a first conviction
thereof, be punished by a fine of not more than $50 or by
imprisonment for not more than 15 days, or by both such
fine and imprisonment; for a second such conviction
within 18 months thereafter, such person shall be
punished by a fine of not more than $100 or by

imprisonment for not more than 45 days, or by both such
fine and imprisonment; upon a third or subsequent
conviction within 18 months after the first conviction,
such person shall be punished by a fine of not more than
$250 or by imprisonment for not more than 90 days, or
by both such fine and imprisonment.
• B. All persons cited on a town parking summons for a
violation of this chapter, permit parking or parking
related violations shall be subject to a fine of $35 and
shall answer and/or appear on or before the designated
return date. Persons failing to appear on or before the
designated return date shall be subject to the following
surcharges in addition to the prescribed fines:
(1) For failing to answer and/or appear within three
months of the return date: $20.
(2) For failing to answer and/or appear within six
months of the return date: an additional $20 in
- addition to the surcharge imposed in Subsection
B(1) above.
