Purpose and objectives. § 39-3. Requirements. § 39-4. Statement of domestic partnership. § 39-5. Filing of statements; fees. [HISTORY: Adopted by the Town Board of the Town of Southold 12-16-2003 by L.L. No. 27-2003. Amendments noted where applicable.] § 39-1. Title. This chapter shall be known and may be cited as the "Town of Southold Domestic Partnership Law." § 39-2. Purpose and objectives. A. The Town's interest in strengthening and supporting all caring, committed and responsible family forms has led to the definition and recognition of "domestic partnership" (explained below) as a relationship and family unit. B. This article establishes a mechanism for the public expression and documentation of the commitment reflected by the domestic partnership whose members cannot or choose not to marry. C. It is appropriate and fair that certain of the societal privileges and benefits defined in this new legal relationship be available to Southold Town residents. 3901 2-25-2004 § 39-3 SOUTHOLD CODE 139-4 § 39-3. Requirements. A domestic partnership shall exist between two persons if the following is true: A. The persons arc not related by blood closer than would bar marriage in the State of New York. B. Neither person is married. C. Both persons are 18 years of age or older. D. Both persons are competent to enter into a contract. E. The persons declare that they are each other's sole domestic partner. F. The persons currently share a primary residence within the Town of Southold and declare that they intend to do so for the indefinite future. G. The persons declare that they are in a relationship of mutual support, caring and commitment and are responsible for each other's welfare. For these purposes, "mutual support" means that they contribute mutually to each other's maintenance and support. H. Both persons agree to file a termination of partnership if there is a change in the status of their domestic partnership. I. The persons shall file a statement of domestic partnership as set forth in this chapter and pay the required fee. • § 39-4. Statement of domestic partnership. • A. Contents. (1) Domestic partners may make an official record of their domestic partnership by completing, signing and submitting to the Town Clerk a statement of domestic partnership. 3902 2-25-2004 § 56-2 LANDMARK PRESERVATION § 56-3 (2) Encouraging the identification and recognition of historic resources which represent distinctive elements of historic, architectural and cultural heritage; and (3) Providing for the careful, thoughtful and informed evaluation of any proposed demolition or removal or • alteration of the facade of any historic landmark affected by this chapter; (4) Promoting heritage tourism; and (5) Maintaining visual compatibility with the historic character of neighboring properties in public view. § 56-3. Definitions. A. Unless specifically defined below, words or phrases in this chapter shall be interpreted as to give them the same meanings they have in common usage and as to apply this chapter consistent with its statement of purpose. B. As used in this chapter, the following terms shall have the meanings indicated: ADAPTIVE REUSE — A process that adapts buildings for new uses while retaining their historic features. ALTERATION — Any act, process or work that significantly changes the exterior appearance or exterior architectural features of a landmark, including the renovation, restoration, reconstruction, obstruction, addition to or removal of any part of such a landmark. DEMOLITION — The destruction, razing, disassembly or collapse of a landmark, or the engagement in acts that will necessarily cause such effect. FACADE — The elevations/faces of a landmark visible from a public street. 5603 12-15-2004 § 56-3 SOUTHOLD CODE § 56-4 HISTORIC — Those landmarks designated as such pursuant to § 56-10 of this chapter. REMOVAL — Any relocation of a landmark on its site or to another site. § 56-4. historic Preservation Commission; membership; terms; powers and duties. 0 A. There is hereby created a commission to be known as the "Town of Southold Historic Preservation Commission." The Historic Preservation Commission shall consist of five members to be appointed by the Town Board, to the extent available in the community, as follows: (1) At least one member shall be an architect experienced in working with historic buildings; (2) At least one member shall have demonstrated significant interest in and commitment to the field of historic preservation; and (3) All members shall have a known interest in historic preservation and architectural development within the Town of Southold. B. Members of the Historic Preservation Commission shall serve for terms of four years with the exception of the initial term of one of the members which shall be for one year, two which shall be for two years, and two which shall be for three years. C. There shall be a Secretary to the Commission who shall be responsible for the keeping of meeting minutes, publication of meeting minutes, posting of public notices • and any other relevant duties. D. The Chair, the Vice Chair and the Secretary of the Commission shall be elected by and from the members of the Commission annually at the first regular meeting of the calendar year, except for the first organizational meeting convened after this chapter is enacted. 5604 12-15-2004 § 57-1 LITTERING § 57-4 TOWN — The Town of Southold. VEHICLES — Every device in, upon or by which any person or property is or may be transported or drawn upon a highway or public street. § 57-2. Litter in public places. A. No person shall throw or deposit litter in or upon any street, sidewalk or other public place within the town except in public receptacles or in authorized private receptacles for collection, or as provided in Chapter 48, Garbage, Rubbish and Refuse. B. Persons placing litter in public receptacles or in authorized private receptacles shall do so in such a manner as to prevent it from being carried or deposited by the elements upon any street, sidewalk or other public place or upon private property. C. No person shall sweep into or deposit in any gutter, street or other public place within the town the accumulation of litter from any building or lot or from any public or private sidewalk or driveway. D. Persons owning or occupying property shall keep the sidewalk in front of their premises free of litter. § 57-3. Litter from vehicles. A. No person shall throw or deposit litter from any vehicle upon any street or other public place within the town or upon private property. B. No person shall drive or move any vehicle or truck within the town, the wheels or tires of which carry onto or deposit in any street, alley or other public place sticky substances or foreign matter of such kind as adheres to the road surface. § 57-4. Litter in parks, beaches and bodies of water. A. No person shall throw or deposit litter in any park or beach within the town except in public receptacles and in such a '5'703 § 57-4 SOUTHOLD CODE § 57-6 manner that the litter will be prevented from being carried or deposited by the elements upon any part of the park or beach or upon any street or other public or private place. Where public receptacles are not provided, all such litter shall be carried away from the park or beach by the person responsible for its presence and properly disposed of elsewhere, as provided herein. B. No person shall throw or deposit litter in any pond, river, stream or other body of water within the town. § 57-5. Litter on private property. A. No person shall throw or deposit litter on any private prop- erty within the town, whether owned by such person or not and whether occupied or vacant, except that the owner or person in control of private property may maintain authorized private receptacles for collection in such a manner that litter will be prevented from being carried or deposited by the elements 'upon any street, sidewalk or other public place or upon private property. B. The owner or person in control of private property or any portion thereof shall at all times maintain the premises or that portion controlled by him free of litter, except when stored properly in authorized private receptacles for collection, when ,such person shall have actual notice thereof or when said litter shall have been present a suf- ficient .length of time to constitute constructive notice. § 57-6. Handbills. A. In public places. No person shall throw or deposit any • handbill in or upon any sidewalk, street or other public place within the town. No person shall hand out or distribute any handbill in any public place except to persons willing to accept it. B. On vehicles. G. Upon recommendation of the Planning Board and approval of the Town Attorney, the Building Inspector may revoke an existing certificate of occupancy upon a • showing that the subject premises is being occupied or used in violation of an approved site plan and may direct that , such occupancy or use be discontinued. The Town Attorney is authorized to commence proceedings in a court of appropriate jurisdiction to restrain said use or occupancy. § 100-254. Review procedure. ,[Amended 545-1995 by L.L. No. 7-1995; 12-27-1995 by L.L. No. 25-1995;12-14-2004 by L.L. No. 25-2004] . A. Presubmission conference. Prior to the submission of a site development plan, the applicant or his agent shall meet with the Planning Board or its representative. The purpose of such conference shall be to discuss proposed uses or development plan elements that shall be submitted to the Planning Board -in order for said Board to determine conformity with the provisions and intent of this article. Said meeting shall take place within 30 calendar days from the date of written request therefor. B. Site development plan. Nine copies of the site development plan application and any related information as defined during the presubmission conference shall be submitted to the Planning Board within four months of the presubmission conference. If a site development plan application is not submitted within four months following, a presubmission conference, another conference may be required by the Planning Board. . (1) Within 10 business days of receipt of the application, the Planning Board shall determine 10151 02-15-2005 § 100-254 SOUTHOLD CODE § 100-254 whether to accept, reject or request revision of the application. (2) If the Planning Board determines said application to be acceptable but in need of revision, it shall notify the applicant, in writing, wherein said application is deficient within 30 calendar days. (3) Within the thirty -calendar -day period from receipt of the application, the following shall also take place: the site plan reviewer (or other delegate of the Planning Board) shall hold a joint meeting with a representative of the Building Department authorized to review building plans, for the purpose of making a joint recommendation as to whether the site plan application complies with all applicable zoning regulations or whether any variances are required from the Zoning Board of Appeals; that recommendation shall be forwarded to the Building Inspector, who shall either endorse or revise that recommendation; and in the event the Building Inspector's zoning determination indicates that a variance is required, the site plan reviewer (or other delegate of the Planning Board) shall so inform the applicant; and in the event the applicant wishes to proceed with the application as submitted, the Building Inspector shall issue a notice of disapproval at that time. This procedure shall also apply to any amendments to the site plan application. (4) In the case of a variance or special exception application requiring site plan approval, the site development plan application shall be subjected to preliminary review and written comments by the Planning Board within 60 days of such request by 40 the Board of Appeals. (a) In no case may the Planning Board grant site plan approval prior to the issuance of a special 10152 02-15-2005 § 100-256 ZONING § 100-257 excepting retail winery operations), if it determines such requirements are not necessary to protect and maintain the public health, safety, or welfare and to further the objectives set forth in § 100-252. § 100-257. Architectural review standards. [Added '5-15-1995 by L.L. No. 7-19951 Site plansshall be reviewed for conformance with the following criteria: A. Appropriate diversity of design elements from another structure or structures located or proposed to be located on the same street or corner thereof and within 500 feet of the site of the structure for which a site plan or building permit has been requested, in respect to one or more of the following features of exterior design and appearance: (1) Substantially identical facade, disregarding color. (2) Substantially identical size and arrangement of either doors, windows, porticoes, porches or garages or other openings or breaks or extensions in the facade, including reverse arrangements. (3) Other substantially identical features, such as but not limited to setbacks from street lines, heights, widths and lengths of elements of the building design and exterior materials and treatments. B. Minimize or eliminate visual discord or dissimilarity with respect to other structures located or proposed to be located on the same street or a corner thereof and within 500 feet of the site of the structure for which a ,building permit is requested, in respect to one or more of the following features of exterior design and appearance: (1) Facade, disregarding color. 10158.3 06-10-2005 § 100-257 SOUTHOLD CODE § 100-258 ,(2) Size and arrangement of doors, windows, porticoes, porches or garages or other openings, breaks or extensions in the facade. (3) Other significant design features, such as but not limited to heights, widths and lengths of elements, roof structures, exposed mechanical equipment, service and storage areas, retaining walls, landscaping, signs, light posts, parking areas and fences, service and loading areas. C. Maximize sensitivity to visual appearance and qualities of exterior design, including with respect to signs, considerations of the harmony of colors or compatibility of the proposed structure with the terrain in which it is to be located, including but not limited to excessive divergences of the height or levels of any part of the structure from the grade of the terrain. § 100-258. Architectural Review Committee. [Added . 5-15-1995 by L.L. No. 7-1995] A. The Architectural Review Committee shall consist of five members appointed by the Town Board to serve at the pleasure of the Board without compensation. If possible, the members of the Committee shall be appointed from the following categories: two members shall be architects or landscape architects, one member shall be from the Landmark Preservation Commission and 10 members shall be appointed from the hamlets of the Town. The hamlet members shall vary and shall sit only on the site plans which are proposed in their hamlet. The hamlet members shall be from the following areas: two from Fishers Island, two from Orient/East Marion/Greenport, • two from Southold/Peconic, two, from New Suffolk/Cutchogue and two from Mattituck/Laurel. [Amended 10-3-1995 by L.L. No. 20-19951 B. The term of office of the Architect and Landmark Preservation Commission members of the Committee 10158.4 06-10-2005 § 100-258 ZONING § 100-259.1 shall be three years, provided that those members first appointed shall be appointed for one-, two- and three- year terms, respectively. The hamlet members shall be appointed for two-year terms, with the first appointments to be appointed for a one- and two-year term, respectively. • § 100-259. Land clearing. [Added 8-8-1995 by L.L. No. 17-1995 2] No person shall undertake or carry out land clearing, including grading, clearing, cutting and filling, excavating or tree removal associated therewith, without first having obtained site plan approval. Weeding, gardening, mowing and the selective pruning of vegetation or selective cutting of diseased or dead trees shall not be included herein. Any landowner found guilty of violating this section shall be fined up to $5,000. Site plan approval shall be withheld until and unless a plant restoration plan for that site is approved by the Planning Board. § 100-259.1. Standards for residential site plans. [Added 1-18-2005 by L.L. No. 1-20051 A. The Planning Board's review of the application and plans with respect to residential site plans shall include their compliance with the following: (1) The requirement that the applicant attend a presubmission conference, at which time the applicant, the Planning Board and planning staff shall discuss the salient design features of the • application. At such conference, the applicant shall 2 Editor's Note: This local law also provided as follows: "The purpose of this ordinance is to allow owners to take advantage of the existing vegetation on-site when developing a landscaping plan as part of site plan approval, and to prevent clear cutting of properties prior to site plan approval." 10158.5 06-10-2005 § 100-259.1 SOUTHOLD CODE § 100-259.1 be provided with a copy of the then -existing design manual as adopted by the Planning Board. (2) The applicable provisions of this chapter. (3) Where applicable, Town Law § 274-a and General Municipal Law § 239-m. (4) Construction standards and specifications of the Town highway specifications, Chapter A108 of the Code of the Town of Southold. (5) The requirements of the existing resources and site analysis plan(s) (ERSAP) and the allowable density of dwelling units as calculated using the yield plan criteria for standard subdivisions set forth in §§ 106-11A and B(2) of the Code of the Town of Southold, Subdivision of Land. (6) The provisions of Article XI, Cluster Development, of Chapter A106 of the Code of the Town of Southold, Subdivision of Land, as may be applied by the Planning Board in its discretion to residential site plans where it determines that such cluster development shall benefit the Town and the natural and scenic qualities of open lands. In doing so, the Planning Board shall establish conditions on the ownership, use and maintenance of such open lands as it deems necessary to assure the preservation of the natural and scenic qualities of such open lands and shall not permit the use of such lands for the fulfillment of the park and recreation requirement. The procedures set forth in Article XI, of Chapter A106, Subdivision of Land, shall govern except as modified herein. To the extent that this provision may be construed to be in conflict with Town Law § 278 regarding clustered development, Town Law is § 274-a regarding site plan review, or Town Law § 267, 267-a, 267-b or 267-c regarding the authority of the Zoning Board of Appeals, this provision supersedes and amends such sections insofar as they place any limitation on the Planning Board's 10158.6 06-10-2005 § 100-259.1 ZONING § 100-259.1 application of such clustered development to residential site plans or the requirement of the fulfillment of the park and recreation requirement. (7) Design considerations: (a) The location, arrangement, setbacks, size, design, and general site compatibility of buildings, structures', landscaping, lighting, and signs, in keeping with the character of the community; (b) The adequacy, safety and convenience of vehicular traffic access and circulation, including driveways, rights-of-way, curb cuts, intersections, pavement surfaces, traffic controls, and designated areas for access to public transportation; (c) The adequacy, safety and convenience of pedestrian and bicycle traffic and circulation, including sidewalks, walkways, and pedestrian/vehicle conflict points; (d) The sufficiency, convenience and appearance of off-street parking and loading areas, including visitor and overflow parking, parking and storage for trailers, boats, and recreational vehicles, and the provision of alleyways; (e) The provision of and adequacy of emergency lanes, exits, tap streets, other safety zones, and the provision of fire hydrants to promote the public safety; and (f) The proximity of recreational facilities and open space. B. Preliminary hearing requirement. Prior to and in addition to the public hearing required by § 100-254H, the Planning Board shall hold a separate preliminary hearing on the application with notice provided pursuant to Chapter 58. 10158.7 06-10-2005 § 100-259.1 SOUTHOLD CODE § 100-259.1 C. Affordable housing requirement. Every new residential site plan involving the creation of five or more dwelling units shall comply with the requirements of § A106-11B(2)(c) of the Code of the Town of Southold, Subdivision of Land, pertaining to the provision of affordable housing. The requirements applicable to lots within subdivision in that subsection shall apply equally to dwelling units in affected residential site plans. D. Park and recreation requirement. The provisions of § A106-60 of the Code of the Town of Southold, Subdivision of Land, pertaining to the reservation of parkland in subdivisions, shall apply equally. to residential site plans approved under this chapter, except the fee per lot therein shall herein be applicable to each dwelling unit. E. Performance bond requirement. The provisions of Article IX, Bonds and Other Security, and Article X, Required Public Improvements; Inspections; Fees, of Chapter A106, Subdivision of Land, of the Code of the Town of Southold, shall apply equally to residential site plans approved under this chapter. Pursuant to Municipal Home Rule Law § 10, § 100-259.1B, C and D herein supersede and amend New York State Town Law § 274-a regarding site plan review to the extent that the Planning Board is empowered to impose affordable housing, park and recreation and performance bond requirements in the residential site plan review process. F. Phased development. The Planning Board shall permit the phased development of residential properties that meet all other applicable standards, but shall condition the approval of the development of any permitted phase upon the maintenance of the undeveloped phases in their undeveloped condition, and shall prohibit all clearing and site preparation on such undeveloped phases until such time as development is permitted. G. Planning Board authority to vary requirements for setbacks, building length and separation and courts. 10158.8 06-10-2005 0 § 100-259.1 ZONING § 100-259.1 (1) The Planning Board shall have the authority to reduce or amend yard setback requirements for individual buildings in favor of a perimeter setback for entire groups of buildings, to require that setbacks from interior streets be varied, and to reduce or amend the requirements of §§ 100-233 and 100-234. In making these decisions, the Planning Board shall take into consideration the benefit to the applicant, as weighed against the detriment to the health, safety and welfare of the neighborhood or community. In making such determination, the Planning Board shall also consider: (a) Whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties will be created by the granting of the amendment; (b) Whether the benefit sought by the applicant can be achieved by some method feasible for the applicant to pursue, other than the sought variance; (c) Whether the variance is substantial; (d) Whether the proposed variance will have an adverse effect or impact on the physical or envi- ronmental conditions in the neighborhood or district; and (e) Whether the alleged difficulty was self-created, which shall be relevant to the decision but shall not necessarily preclude the proposed amendment or variance. (2) This provision supersedes and amends New York is State Town Law §§ 267, 267-a, 267-b and 267-c insofar as these sections give such authority to the Zoning Board of Appeals. 10158.9 06-10-2005 § 100-259.2 SOUTHOLD CODE § 100-260 § 100-259.2. Fee schedule for site plan applications. [Added 3-29-2005 by L.L. No. 4-20051 A. The fee for new site plan applications, including without limitation applications relating to vacant sites or sites with no previously approved site plan, shall be a flat fee of $500 plus an additional $500 for each acre (or fraction thereof) in excess of the first acre, plus $0.10 for each gross square foot of proposed construction. B. The fee for amended site plan applications shall be a flat fee of $250 plus $0.10 for each gross square foot of proposed construction in excess of the square footage of construction included in the previously approved site plan. C. The fee for agricultural site plan applications, excepting retail winery operations, shall be a flat fee of $500. ARTICLE XXVI Special Exception Uses [Added 1-10-1989 by L.L. No. 1-19891 § 100-260. Purpose. The provisions of this Article are designed to provide for administrative review of selected types of proposed land uses. Certain uses which are allowable under zoning are nevertheless so likely to significantly affect their surroundings that they require individual review to assure compatibility with existing land use patterns, community character and the natural environment before being permitted to come into existence. Similarly, certain authorized uses may take on such diverse forms in their actual implementation that it is wise to review • and pass upon the adherence of each individual proposal to standards and guidelines previously established for the use involved. Finally, the case-by-case review achieved by use of the special exception approval mechanism can increase the flexibility and appropriateness of local development review and better enable local officials to avoid negative consequences 10155.10 06-10-2005 L` § 100-260 ZONING § 100-260 which sometimes arise from the otherwise lawful development or use of a particular site. Where it is necessary to have a drainage area located beyond the fifty -foot bounds of the highway, an easement to such area shall be provided, together with the necessary land to connect such area to the bounds of the highway. Easements shall have a minimum width of • twenty (20) feet. B. Corrugated pipe having a minimum diameter of eighteen (18) inches, extending from the drainage area to the bounds of the highway, shall be installed with clean-out boxes at one -hundred -fifty -foot intervals. § A108-14. Temporary roads. A. When temporary traffic is permitted on subdivision roads prior to construction of stabilized base courses and asphalt binder courses, a passable all-weather road must be maintained at all times with specific attention to winter and spring weather. B. Traffic on stabilized base courses and asphalt binder courses shall be subject to approval by the Superinten- dent of Highways. ARTICLE III Roadway Construction § A108-15. A10812 9-10-2004 § A108-15 HIGHWAY SPECIFICATIONS § A108-17 4 On-site parking is required. General note. On-site parking is required for all lots in all subdivisions containing roads with lesx than a twenty -eight -foot -wide pavement surface. No on -street parking will be permitted. B. A fifty -foot right-of-way with a minimum pavement width of twenty-four (24) feet shall be required for • dedication to the Town. See Drawing No. 15-2.1 C. Upon the recommendation of the Planning Board, the Superintendent of Highways may require wider right-of- ways and paved surface areas when necessary. § A108-16. Clearing and grubbing: A. Clearing and grubbing in a fifty -foot right-of-way with five (5) or more lots shall consist of the removal of all trees, brush, stumps, fences, debris and other miscellaneous materials within the designated right-of- way areas as shown on the plans. Clearing and grubbing in a fifty -foot right-of-way with less than five (5) lots and in a twenty -five-foot right-of-way shall consist of the removal of all trees, brush, stumps, fences, debris and other miscellaneous materials for a distance of three (3) feet outside the proposed paved area but not to extend beyond the proposed right-of-way. B. Off-site disposal. All tree trunks, stumps, roots and other materials shall be removed from the site and disposed of by the contractor at an approved landfill facility. § A108-17. Stripping and stockpiling soil. • Existing topsoil shall be stripped to its full depth between the right-of-way limits, or as ordered, and stockpiled on the site for future use. Stripping shall be completed prior to starting general excavation in an area. 1 Editor's Note: Standard Drawing No. 15-2 is included at the end of this chapter. A10813 9-10-2004 § A108-18 SOUTHOLD CODE § A108-19 § A108-18. Excavation and embankment. A. Excavation shall consist of the excavation, use of or disposal of all materials of any description encountered in the course of construction. B. The proposed road section in cuts or fills shall meet the existing abutting surface with a one on two (1:2) slope or • as shown on the plans. Where the proposed slopes extend beyond the bounds of the highway (right-of-way), the necessary releases, easements or deeds must be obtained from the property owner or owners. C. Roadway embankments shall be constructed with suitable material from excavation or from acceptable borrow when necessary. Embankments shall be constructed ' in successive uniform layers not exceeding eight (8) inches. Each layer shall be thoroughly compacted with steel wheel or pneumatic tired rollers to the approval of the Construction Inspector. The drainage system may be installed at any time before the final grading of roads is completed. D. When feasible, excavation and embankment within the construction site shall have a reasonable balance. § A108-19. Base course for stone blend road. A. The base course shall consist of bank run compacted to a six-inch depth. If clay or other unsuitable material is found below the base course, it shall be removed and replaced with additional bank -run material for a total compacted depth of twelve (12) inches. Bank -run material shall contain a minimum of fifteen percent • (15%) gravel. B. The soil base shall be compacted to the satisfaction of the Engineer and shall be smooth, parallel to and at the required depth below the base course. The soil base shall not be in a muddy or frozen condition before placing base course material. The base course material shall be A10814 9-10-2004 § A108-46 HIGHWAY SPECIFICATIONS § A108-47 § A108-46. As -constructed survey. An as -constructed curb and drainage installation survey will be required and submitted for approval before permission will be given to construct pavement. • § A108-47. Streetlighting specifications. Streetlight standards, luminaries, conduit, splice boxes, fuses and all related hardware for streetlighting systems shall be installed in all residential and commercial subdivisions. A. Lighting layouts shall be designed to provide a generally even level of illumination based on the use of seventy - watt colonial -type, high-pressure sodium luminaries. In general, streetlights shall be installed at every street intersection and at the end of each cul-de-sac. Additional lighting may be required at regular intervals where existing site conditions and topography warrant. B. All wiring, splices, conduit and workmanship shall be in accordance with the National Electrical Code, the requirements of the National Board of Fire Underwriters and the Long Island Lighting Company (LILCO). All work on the streetlighting systems shall be performed by and tested for continuity and safety by electricians licensed by the County of Suffolk. Copies of test results shall be furnished prior to release of performance bonds. C. Upon commencement of the installation work, periodic inspections of the work being performed will be made by the town. The developer shall be responsible for notifying the town's engineering office and/or streetlighting personnel at least forty-eight (48) hours prior to • performance of any work in order to allow for daily inspections of all work being performed. Upon completion and final testing of the streetlighting installation, a final inspection will be made before the town will accept the completed installation. A10837 6-26-93 § A108-47 SOUTHOLD CODE § A108-47 D. All lighting standards shall be fiberglass in accordance with town Specifications. Fiberglass poles may be either gray, black, brown or as specified by the town. All poles shall have an overall length of twenty (20) feet, embedded four (4) feet, and shall be installed approximately twenty-four (24) inches behind the curb. Luminary mounting height shall be sixteen (16) feet above finish grade. Poles shall be plumb and soil • thoroughly tamped after installation. Wire in poles shall be copper RR -USE or XLP-USE, minimum gauge AWG No. 10. All poles shall be sequentially numbered with two-inch lettering at five (5) feet above grade. E. Standard light fixtures shall be seventy -watt high- pressure sodium and shall be town and Country 100 series by G.E. or approved equal. Lamps used shall be manufactured by General Electric, Westinghouse, Sylvania, Norelco or approved equal. Additional fixture requirements are as follows: (1) A photoelectric control shall be individually connected to each streetlight installed. F. Wire and cable for lighting system circuitry shall be direct burial, copper, type RR -USE or XLP-USE with a minimum gauge of AWG No. 6. Wire shall be approved and complete installation shall meet all requirements of the National Electrical Code. All wire splicing shall be performed within approved splice boxes or within pole at hand hole. All splices and connections shall be made using approved split bolt or compression -type connectors and shall be insulated using an approved waterproof method. Cable shall be buried twenty-four (24) inches below finished grade installed directly behind the curbing. Any and all wiring under a roadway, driveway, • walkway, sidewalk or other load-bearing paved surface shall be installed within one -and -one -fourth -inch galvanized rigid steel conduit. All cable terminations and splices shall be color -coded using Scotch Tape 2210 as follows: red — hot leg; white — neutral leg; green — ground. All underground wire and cable shall have A10838 6-25-93 i § A108-47 HIGHWAY SPECIFICATIONS § A108-47 caution tape installed at ' eight (8) inches below finish grade. G. Polyethylene splice boxes may be installed at the base of each streetlight pole for splicing and fusing. Splice boxes shall be installed so that the top of the installed box is at finished grade. Splice boxes shall be located behind the curb in front of each light pole. H. Fuses shall be individually installed for each streetlight pole and fixture in its splice box using a Bussman Type HEB-AA fuse holder and a Bussman KTK-15 amp fuse or approved equal. Each lighting loop shall be fused in the corresponding service box to protect and isolate each individual lighting circuit. Each service box is to contain a Bussman Type HEB-AA fuse holder and an appropriately sized Bussman KTK fuse. I. Splices between fixtures or between transformers and splice boxes, unless specifically authorized by the Engineer, are not acceptable. Where splices are authorized and locations approved such as at fixture connections to circuit cables, the contractor shall make a splice with an approved mechanical connector encapsulated by Scotch Tape 2210, Scotch Tape 33+, and then coated with Scotch Cote in a manner as approved by the Engineer. J. A service splice box referred to above shall be installed at the point of connection to the LILCO facilities. This installation shall meet all requirements of the Long Island Lighting Company. Direct burial service cable shall be installed from the streetlight service splice box to LILCO service point and a length of slack cable sufficient for LILCO to connect to their facilities shall be left coiled at the LILCO service box and shall be color - coded at connection ends as follows: red — hot leg; white — neutral leg; green — ground. K. All conduit shall be hot -dipped galvanized, one -and -one- fourth -inch inside diameter, UL approved, rigid steel. Conduit shall be used as a wireway for circuit cables A10839 6-25-93 § A108-47 SOUTHOLD CODE § A108-48 where lighting circuits pass under roadways, driveways, sidewalks or other paved load-bearing surface. Conduit shall be installed directly behind the curb where applicable or in the most direct route as specified by the Engineer and installed twenty-four (24) inches below grade. Such conduit shall extend a minimum of six (6) inches beyond the edge of any paved area as specified above. L. Streetlights to be installed on existing utility poles located on existing town property at all new intersections created by the subdivision shall be the developer's responsibility. All required Long Island Lighting Company permits as' well as coordination and installation shall be obtained and provided by the developer. The installation shall be approximately twenty-five (25) feet above finish grade and shall meet all the requirements of the Long Island Lighting Company. Fixture type shall be Cobra Head with fifty- ,. seventy-five- or one -hundred -fifty -watt high pressure sodium as directed and approved by the Commissioner of Public Works and the Superintendent of Highways. The remaining assembly shall be an eight -foot ,arm with rubber bushing and grounding lug. Risers shall be Schedule 80, three -fourths -inch PVC. Wire shall be RHW-USE or RHH-USE with a minimum gauge of AWG No. 8. The power supplied to lights on existing utility poles in existing town rights-of-way shall be the responsibility of the Town of Southold. M. All power supplied to .the new lighting systems shall be the responsibility of the developer or housing association until such time that the roads and power systems have been dedicated to and accepted by the Town of Southold. • § A108-48. Alterations or modifications to specifications.
