The action is for interior renovations and to construct an 8' x 12' concrete pad for a walk-in cooler in the location of an existing concrete pad and not subject to review under SEQRA; and WHEREAS, on February 25, 2015, the Planning Board granted permission for the applicant to commence interior work to the building necessary to opening the proposed kitchen in order to support an existing catering business prior to Site Plan approval. The catering business operates off site and no public is permitted on site until Site Plan approval has been received and the turning lane has been provided pursuant to the SCDPW; and WHEREAS, on May 11, 2015, the Suffolk County Department of Health Services (SCDHS) granted Approval Reference #C10-14-006 for "Wet Store (16 seat maximum; single serve only)" at 402 gallons per day; and WHEREAS, on June 11, 2015, the Suffolk County Department of Public Works (SCDPW) approved a plan to re-stripe County Road 48 to provide a turning lane for westbound traffic into the proposed site; and WHEREAS, on June 15, 2015, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280— Site Plan Approval of the Town of Southold, have been met; and �y Creative Courses LL Page 3 July 7, 2015 WHEREAS, on July 6, 2015, the Southold Town Chief Building Inspector reviewed and certified the proposed Site Plan as a permitted use in the LB Zoning District; therefore, be it RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; and.be it further RESOLVED, that the Southold Town Planning Board grants Approval with one (1) condition to the Site Plan entitled "Creative Courses", prepared by Raymond W. Nemschick on August 8, 2014, last revised September 17, 2014, and authorizes the Chairman to endorse the Site Plan including the following two (2) plans: 1. SP-1 Plot Plan and Calculations 2. SP-2 Details Condition: Obtain and execute a 239-F from the Suffolk County Department of Public Works (SCDPW) to change the striping of County Road 48 to create a turning lane prior to the issuance of a Certificate of Occupancy. Please also note the following requirements in the Southold Town Code relating to Site Plans: 1. Any outdoor lighting shall be shielded so the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. 2. All storm water run-off from grading, driveways and gravel areas must be contained on site. 3. Proposed storm water run-off containment systems must be inspected by the Town Engineer at the time of installation. Please call the Southold Town Engineer prior to beginning this work. 4. Approved Site Plans are valid for eighteen months from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 5. Any changes from the Approved Site Plan shall require Planning Board approval. 6. Prior to the issuance of a Certificate of Occupancy, the Planning Board must inspect the site to ensure it is in conformity with the Approved Site Plan, and issue a final site inspection approval letter. Should the site be found not in conformance with the Approved Site Plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the .LWRP Consistency Assessment Form submitted to this department and the records available to me, the proposed action is CONSISTENT with the LWRP provided that the below recommendations are considered in the site plan approval to further the below listed policies. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The parcel is zoned Limited Business and the proposed restaurant use is a permitted use. However, there is a concern regarding vehicles travelling west bound on County Route 48 and the ability to make a left hand turn into the parcel (figure 1). Consider coordinating with Suffolk County Department of Public Works to develop traffic controls to increase safety of vehicles entering the parcel from travel lanes; specifically west bound. Further, to alleviate future traffic impacts from multiple, future curb cuts, consider requiring the opportunity for cross access'easements to the parcels to the east and west. This could be achieved through site design or a covenant and restriction. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. i. The parcel is zoned Limited Business and the proposed restaurant use is a permitted use. However, there is a concern regarding vehicles travelling west bound on County Route 48 and the ability to make a left hand turn into the parcel (figure 1). Consider coordinating with Suffolk County Department of Public Works to develop traffic controls to increase safety of vehicles entering the parcel from travel lanes; specifically west bound. ii. Further, to alleviate future traffic impacts from multiple, future curb cuts, consider requiring the opportunity for cross access easements to the parcels to the east and west. This could be achieved through site design or a covenant and restriction. Figure 2 shows multiple curb cuts and one cross access on LB zoned properties to the east on County Route 48 . Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. 3.1 Enhance visual quality and protect scenic resources throughout the Town of Southold. D. Use appropriate siting, scales, forms, and materials to ensure that structures are compatible with and add interest to existing scenic components. E. Preserve existing vegetation and establish new indigenous vegetation to enhance scenic quality: 3 4. Restore or add indigenous vegetative cover that presents a natural appearance. Suffolk County Route 48 is a designated New York Scenic Byway. It is recommended that the Board require landscaped areas, in the front yard adjacent to County Route 48. Plant materials should be native, low growing varieties placed to not impede the line of site of parcel access. The area is not included within an archeo-sensitive area (MAPINFO GIS-Archeo-sensitive layer). A cultural survey is not recommended. D. Town Engineer a. This renovation of an existing site should be reviewed by [Suffolk] County DPW to verify if the existing Curb Cut meets their standard requirements for access to the County Road. A County Curb Cut Permit and/or letter of compliance from the County should be required. b. The proposed drainage calculations provided meet the minimum requirements of Chapter 236 for Stormwater Management. The subsequent drainage design also meets the minimum requirements of Town Code. Please note, all new drainage installations will require inspections by either the Town Engineering Department or by a Certified Design Professional licensed in the State of New York. c. Erosion and sediment controls will be required to maintain all silt and debris on site throughout construction. d. New handicap parking as well as access to the building should be paved in accordance with ADA Standards and New York Building Code requirements. E. Staff Analysis: a. Due to the nature of the CR 48 roadway in this area, the egress on this site should be right turn only and no parking on the shoulder b. Consider including an area for a future cross access with the parcel to the east. This is a long term planning consideration; there may be an opportunity in the future for the two undersized LB parcels to share access to CR48 in order to limit curb cuts in this area. The subject site could be two-way traffic now but serve as one-way (enter only) with a connecting driveway to (52.-10-5) to share parking spaces and provide an exit-only access to CR 48. i. SCDPW recommendations 1. Pave from roadway to property line (improve apron) 4 2. Obtain a 239-F permit from the SCDPW for improvements to the turning lanes on CR 48. 3. Create a cross access easement with the adjacent parcel to the east (see above) V: Staff Recommendations 1. Consider a landscaped area within the front yard adjacent to County Route 48. Plant materials should be native, low growing varieties placed to not impede the line of site of parcel access. 2. Consider the concerns detailed above regarding access to the subject site and potential road way improvement options. -Due to the fact that the applicant is concentrating on opening a kitchen within the building to primarily serve an existing catering business; employees only, consider allowing the applicant to begin interior renovations and exterior septic work (with SCDHS approval) in connection with the proposed kitchen so that the kitchen can be operational to serve the catering operation.
