WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last
will and testament and in consideration of TWO HUNDRED THIRTY NINE THOUSAND ($239,000.00)
dollars, paid by the party of the second part, does hereby grant and release unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at

BEING AND INTENDED TO BE THE SAME PREMISES conveyed to DONALD E. WACHTEL,
now deceased, by deed dated February 11, 2005 which deed has been recorded in the Office of the
Clerk of the County of Suffolk on February 22, 2005 in Liber12373 at page 022.
Grantee herein is prohibited from conveying captioned property for any sales price for a period of 30
days from the date of this deed.
After this 30 day period, Grantee is further prohibited from conveying the property for a sales price
greater than $286,000 (120% of short sale price) until 90 days from the date of this deed. These
restrictions shall run with the land and are not personal to the Grantee.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof, TOGETHER with the
appurtenances, and also all the estate which the said decedent had at the time of the decedent's death in said
premises, and also the estate therein, which the party of the first part has or has power to convey or dispose
of, whether individual, or otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and

Greenport, Town of Southold, County of Suffolk and State of New York, known
and designated as and by Lots Numbers 78 and 80 on a certain map entitled
"Map of Greenport, Suffolk County, New York known as Greenport Driving Park"
surveyed by CH Bateman and laid out in lots by EC Hall, Civil Engineer, as Map
No. 369 and filed in the Suffolk County Clerk's Office on December 1, 1909, said
lots when taken together are bounded and described as follows:
BEGINNING at a point on the northerly side of Flint Street where the same is
intersected by the southerly line -of the Metropolitan Transportation Authority
Long Island Railroad;
RUNNING THENCE north 84 degrees 15 minutes 40 seconds east along said
southerly lime of the Metropolitan Transportation Authority Long island Railroad
274.37 feet to a monument and land now or formerly of Timothy G. Clark;
THENCE south 07 degrees 12 minutes 50 seconds west along said land now or
formerly of Timothy G. Clark 61.50 feet to'a monument on the northerly side of
Flint Street;
THENCE north 82 degrees 47 -minutes 10 seconds west along said northerly
side of Flint Street 267.39 feet to the point or place of BEGINNING.
