11939, as Trustees of The Weaver Family Trust, dated 3126115,

WITNESSETH, that the party of the first part, in consideration of ten dollars and no/100
($10.00), lawful money of the United States, to them paid by the party of the second part, does
hereby grant and release unto the party of the second part, the heirs, successors or assigns of the
party of the second part forever,
ALL that certain lot, piece or parcel of land together with the buildings and improvements
located and to be erected thereon, situate, lying and being at East Marion in the Town of
Southold, County of Suffolk and State of New York, known and designated as Lot No. 49 as
shown on a certain map entitled, "Map of Pebble Beach Farms", and filed in the Suffolk County
Clerk's Office on June 11, 1975 as Map No. 6266 and being more particularly bounded and
described as follows:

BEING the same premises conveyed by Manzi Homes, Inc., Grantor, to Phillip R. Weaver and
Darlene C. Weaver, Grantee, by Deed dated October 25, 2006 and recorded in the Suffolk
County Clerk's Office on November 15, 2006 in Liber 12478 of Deeds at page 575.
THE PARTY OF THE FIRST PART named herein is the sole beneficiary of the Party of the
Second Part, The Weaver Family Trust, dated 3126115, during the lifetime(s) of the Party of the
First Part and is entitled to veterans and senior exemptions as provided under RPTL subsections
458(7), 458-a(5) and 467(9), and the school tax relief (STAR) exemption as provided under
RPTL section 425.
SUBJECT to covenants, conditions, restrictions and rights of way of record, if any.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
