HENRY L. FERGUSON III, Trustee of the Henry L. Ferguson III Trust Agreement dated February 12, 2015,
390 High Street, Mystic, Connecticut 06355, and SUSAN S. FERGUSON, Trustee of the Susan S. Ferguson
Trust Agreement dated February 12, 2015, 390 High Street, Mystic, Connecticut 06355, as tenants in common,
each with an undivided one-half (%) interest,
party of the second part,
WITNESSETH, that the party of the first part, without consideration paid by the party of the second part, does
hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
being at Fishers Island, Town of Southold, County of Suffolk and State of New York, being more particularly
bounded and described as set forth on Schedule A hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed, dated July 9,
1989 and recorded in the Office of the Suffolk County Clerk on July 17, 1989 in Liber 10895 page 227.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose. The
word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

BEGINNING at a brass plug in the sidewalk at the southwesterly corner of the herein
described tract, said point being located 3339.15 feet North and 2283.16 feet West of a
stone monument marking the United States Coast and Geodetic Survey Triangulation
Station "PROS'; and
RUNNING THENCE South 79 degrees 47 minutes 10 seconds East, 101.55 feet to an iron
on the northwesterly line of Mansion House Drive abutting southerly on Equestrian Avenue
and land now or formerly of Fishers Island Farms, Inc.;
THENCE North 44 degrees 11 minutes 50 seconds East, 221.83 feet to a stone bound;

intersection with the southerly line of the above described tract.
(2) BEGINNING at a point on the above described power line right of way, said point being
located 3496.80 feet North and 2250.49 feet West of said Triangulation Station "PROS";

RUNNING THENCE North 59 degrees 24 minutes 00 seconds West to a point at the
intersection with the westerly line of the above described premises.
ALSO SUBJECT TO a right of way ten (10) feet in width for telephone line purposes which
crosses the herein conveyed tract in two places described as follows:
(1) BEGINNING at a point on the southerly line of the above described tract, said point
being located 8.9 feet southeasterly from the above mentioned brass plug in the sidewalk;
and
RUNNING THENCE northerly, 32 feet more or less, to the westerly line of the above
described tract.
(2) BEGINNING at a point on the northwesterly line of the above described tract, 101.6
feet southwesterly from the northwesterly corner thereof; and
RUNNING THENCE northeasterly, 113.0 feet to a point on the northerly line of the above
described premises and being 36.1 feet easterly from said northwesterly corner.
TOGETHER WITH the appurtenances and all the estate and rights of the party of the first
part in and to said premises.
ALSO SUBJECT TO a certain right or easement previously granted to the Hay Harbor
Realty, Inc., its heirs or assigns, to continue the use of present existing sewer lines
crossing the above described premises.
ALSO TOGETHER WITH the right in favor of the party of the second part to use the
drains, sewer connections, septic tanks and cesspools appurtenant to the foregoing
premises situated on other lands now or formerly of Hay Harbor Realty, Inc., and to enter
upon such lands in order to make necessary repairs and renovations thereto.
