Amend Sketch Plat Determination/ SEQRA/ Set Hearing/ Preliminary Plat
Extension:
Vice -Chairman Rich: Harold R. Reeve & Sons, Inc. - This proposal is for a Standard
Subdivision of a 5.1 acre split -zoned parcel into 4 lots where Lot 1 equals 1 acre
inclusive of 0.06 acres of unbuildable land, Lot 2 equals 1 acre inclusive of 0.05 acres of
unbuildable land, Lot 3 equals 1 acre inclusive of 0.04 acres of unbuildable land located
in the R-40 Zoning District and Lot 4 equals 1.8 acres located in both the R-40 and B
Zoning Districts. A 0.3 acre proposed private road, Creek View Lane, is located on the
northeast side of the subdivision off of Wickham Avenue. The property is located at

WHEREAS, this proposal is for a Standard Subdivision of a 5.1 acre split -zoned parcel
into 4 lots where Lot 1 equals 1 acre inclusive of 0.06 acres of unbuildable land, Lot 2
equals 1 acre inclusive of 0.05 acres of unbuildable land, Lot 3 equals 1 acre inclusive
of 0.04 acres of unbuildable land located in the R-40 Zoning District and Lot 4 equals
1.8 acres located in both the R-40 and B Zoning Districts. A 0.3 acre proposed private
road, Creek View Lane, is located on the northeast side of the subdivision off of
Wickham Avenue.
This proposal includes a Change of Zone Application where the zoning on Lot 4 is
proposed to change from the R-40 and B Zoning Districts to the LB Zoning District; and
WHEREAS, on November 3, 2014, the Southold Town Planning Board granted
Conditional Sketch Plan Approval upon the map prepared by Howard W. Young, Land
Surveyor, entitled "Subdivision Map of Harold R. Reeve and Sons, Inc.", dated October
25, 2013 and last revised January 23, 2014, with the following conditions:
Submission of all Preliminary Plat requirements pursuant to §240-16
Submission and §240-17 Technical Requirement of the Southold Town Code.
2. Continue with the next steps of the petition to the Town Board to amend the
zoning district on a portion of the subject parcel from Residential -40 and
Business to Limited Business so that the matter may be scheduled for a
public hearing prior to the Preliminary Plat Public Hearing; and

WHEREAS, on April 29, 2015, the agent requested an Extension of Conditional Sketch
Plan Approval due to additional time needed to meet Health Department Requirements;
and
WHEREAS, on May 3, 2015, Conditional Sketch Plan Approval expired; and
WHEREAS, on May 5, 2015, the Planning Board, at their Work Session, agreed to
remove Clause Two of the Sketch Plan Approval "Continue with the next steps of the
petition to the Town Board to amend the zoning district on a portion of the subject parcel
from Residential -40 and Business to Limited Business so that the matter may be
scheduled for a public hearing prior to the Preliminary Plat Public Hearing". This revision
would allow the Board to continue with the review of the Preliminary Plat Application
before a public hearing for the Change of Zone petition is scheduled; and
WHEREAS, on May 8, 2015, the agent submitted a letter requesting that the Sketch
Plan Resolution be amended to allow the Planning Board to continue with the review of
the application; and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed
action is an Unlisted Action as it does not meet any of the thresholds of a Type I Action,
nor does it meet any of the criteria on the Type II list of actions; be it therefore
RESOLVED, that the Southold Town Planning Board hereby grants an Amendment of
Conditional Sketch Plan Approval upon the map prepared by Howard W. Young,
Land Surveyor, entitled "Subdivision Map of Harold R. Reeve and Sons, Inc.", dated
October 25, 2013 and last revised January 23, 2014, with the following condition:
1. Submission of all Preliminary Plat requirements pursuant to §240-16

an Area Variance to allow for this parcel to be subdivided into two lots where Lot 1
equals 0.71 acres and Lot 2 equals 1.30 acres, located in the RO Zoning District. The
property is located at 3070 Peconic Lane, on the east side of Peconic Lane and on the

Subdivision - This proposal is for a Standard Subdivision of a 4.98 acre parcel into two
lots where Lot 1 = 3.05 acres and Lot 2 = 1.93 acres located in the R-80 Zoning District.
The property is located on the corner of Montauk .and Oriental Avenues, approximately

WHEREAS, on April 6, 2015, the Planning Board granted Conditional Preliminary Plat
Approval; and
WHEREAS, on April 15, 2015, the agent submitted the Final Plat Application and the
Final Plat Application Fee; and
WHEREAS, on April 20, 2015, the Planning Board found the application incomplete with
items to be submitted; and
WHEREAS, on April 20, 2015, at their Work Session, the Planning Board agreed to
waive a second public hearing on the basis that there were no changes to the plat; and
WHEREAS, on April 29, 2015, the applicant submitted a request for the Planning Board
to waive the recommendation from the Natural Heritage Data Program to conduct a field
survey of the site in order to determine the present or absence of endangered plants;
and
WHEREAS, on April 30, 2015, the agent submitted the following:
A Letter of Water Availability from the Fishers Island Water Works

WHEREAS, on May 4, 2015, the Planning Board reviewed the Natural Heritage Data
Program's recommendations and agreed to waive the recommendation to conduct a
field survey of the site to determine the present or absence of endangered plants; and
WHEREAS, on May 14, 2015, the applicant submitted 4 mylar prints and 10 paper
prints of the Final Plat; and
WHEREAS, on May 18, 2015, the Planning Board reviewed all items submitted on April
30, 2015 and final maps (mylars and prints) endorsed by the Health Department and
agreed that all documents pursuant to Article VII have been submitted; and
WHEREAS, all conditions 'of Conditional Preliminary Plat Approval and all requirements
of Final Plat pursuant to §240-21 Technical Requirements have been met; be it
therefore
RESOLVED, that the Southold Town Planning Board hereby waives the Final Plat
Public Hearing on the basis that pursuant to Southold Town Code §240-24, the Final
Plat is in substantial agreement with the approved Preliminary Plat and, therefore, no
Final Public Hearing is required.

Facility - This proposed wireless communications Site Plan is to replace an existing
±84' communications tower with a 120' antenna support structure/tower with associated
equipment and a generator to be mounted on the roof of the existing firehouse. There
are ±14,370 sq. ft. of existing buildings including the main fire house and associated
accessory structures, all on 1.38 acres in the Hamlet Business Zoning District,
Mattituck. The property is located at 1000 Pike Street, on the s/w corner of Pike Street &
Wickham Avenue, Mattituck. SCTM#1000-140-3-11.1

John Coughlin: Good Evening, I am John Coughlin, on behalf of the applicant,
Mattituck Fire District. I am from the law firm, Re, Nielsen, Huber and Coughlin. I'm
here this evening with a team of experts who have prepared materials, many of which
have already been submitted to the Board. I do have a couple of new reports that I
would like to submit to the Board, and I'll tell you a little bit about who they are and the
analysis they have done. I think, as the Board is aware, this project is to modify and
upgrade the communications facility at the Mattituck Fire District. In addition we have
Mr. Gary Musciano, who is the engineer on the project who designed the replacement
pole. Lou Cornacchia is here, he is the FCC compliance expert who confirmed that the
proposed facility will meet and satisfy all FCC standards, not just for the Fire District,
which I know is licensed by the FCC, but also for future tenants on the proposed uni-
pole. Potentially the Town itself and also wireless carriers, specifically Verizon, is
projected to be the top carrier tenant on the proposed replacement pole, and space has
been reserved for other carriers to locate in the areas where Brian is hovering right now.
At least those first couple of canisters have been included in Mr. Cornacchia's analysis.
Additionally, the new materials that I have for you this evening, one is a Real Estate
Appraisal Report from Mike Lynch. He has analyzed the potential impact on real estate
values in the area for the pole going from the current, approximately 84 foot height, to
the proposed 120 foot pole, which I know that the top antennas will extend to a height of
approximately 132 feet. Also the other report I have for you, from the next expert Erin
Echevarria, this is a Planning and Visual Analysis. The Board has already seen the
photographic simulations; those were included as part of the original Site Plan
Application that was submitted in January. Ms. Echevarria has added some code
analysis, which I'm sure the Board and Staff are fully aware of the various provisions
that need to be satisfied, so I'd like to submit those. Additionally, I have Andrew Hintze,
from IWT. He's the individual who has done the Radio Frequency Engineering Analysis
on behalf of the Fire District, to determine the best configuration and optimal

configuration for the Fire District to have on this replacement pole. Obviously, the
district has multiple antennas and multiple frequencies for the different communication
efforts that it undertakes and support of its district and the surrounding areas that it
supports. I also have some of the Commissioners here with us this evening, who would
be happy to speak with the Board about the need of the improved communications.
Understanding that the Board is very familiar with the project, I leave it to you as to
whether you would like me to have each witness come up and tell you about what they
have done and their analysis or whether we should stand down and wait and see if
there are any questions.
Vice -Chairman Rich: I think that unless somebody in the audience has some questions
that they want to ask of us or comments, we are pretty comfortable with what is going
on here. Our biggest concern is that the Mattituck Fire District is adequately protected
in their lease on this.
John Coughlin: Sure, and I would submit to the Board that the applicant in conjunction
with the tenant tower builder, Elite Towers, has agreed that the project will be
constructed within a period of 6 months after permit issuance, assuming all other
approvals are issued by this Board. I would also ask that the Board consider the
applicants request for waivers of the landscaping, to the extent that's required. Also the
height limitation and 500 feet to residential districts that are included as items this Board
can waive under 76.2.
