c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall, be required.

NAME OF APPLICANT: Ralph and Catherine Caselnova
PROPERTY LOCATION: 26609 Main Road (aka StateRoute 25), Orient, NY SCTM# 1000-18-03-9.11
SEORA DETERMINATION: The Zoning Board of Appeals has visited the properly. under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A'14-14 to 23, and the Suffolk County Department of'Planning issued its
reply dated August 7, 2013 stating that this application is considered a matter for local determination as there
appears to be no significant county -wide or inter -community impact.
LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is' listed under the
Minor Actions exempt list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION: The subject parcel -is 2.3518 Acres in an R-80 district. The parcel includes
and is bounded to the north by a 50 foot wide R.O.W. running a distance of 432.49 feet, and includes and is
bounded to the east by a 50 foot wide'R.O.W. running 851.41 feet. The subject parcel's allowable building area is
approximately 165 feet by 267 feet. The parcel is improved with a 2 story frame house with attached garage and
the subject as -built in -ground swimming pool, as shown on the survey prepared by John T. Metzger, LLS dated
April 11, 2013- The parcel is subject to two front yards determined by the *intersecting Right -of -Ways.
BASIS OF APPLICATION: Request for Variance from Article III Section 280-15 and the Building Inspector's
May 14, 2013 Notice of Disapproval based on an application for building permit for an. "as built" accessory in -
ground swimming pool: 1) less than the code required side yard setback of 25 feet, 2) less than the code required
minimum rear yard setback of 25 feet
RELIEF REQUESTED: The applicant requests variances to maintain the location of an as -built in -ground
swimming pool having one rear yard setback of 7.7 feet and a second rear yard setback of 18.2 feet, where the code
requires a minimum of a 25 foot setback from the rear property line. This parcel is subject to two front yards
determined by intersecting Rights -Of -Way. .
ADDITIONAL INFORMATION: The subject parcel rear yards are adjacent to an 11.3+/- acre agricultural parcel
whose development rights have been sold. This agricultural parcel is owned by the applicant. There is a shed, pool
fencing and pool equipment located on the adjoining agricultural parcel.

FINDINGS OF FACT/ REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on August 8, 2013 at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property
and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law .&267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. An in -ground swimming pool is characteristic and a common
accessory structure to residential use. The non -conforming as -built location is adjacent to an agricultural parcel
having no development rights, thus eliminating any detriment to an adjacent dwelling. The use of the swimming
pool should not affect the adjacent agricultural use.
2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The applicant could feasibly relocate the swimming pool in the
rear yard in a conforming location, however the relocation may not be economically feasible.
3. Town Law 4267-b(3)(b)(3). The variances granted herein for a 7.7 foot rear yard setback and an 18.2 foot rear
yard setback are both mathematically substantial, representing 69% relief and 27% relief from the code
respectively. However, the adjoining parcel possibly affected by this granting is an undevelopable agricultural
parcel which is presently owned by the applicant.
4. Town Law -4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant constructed an accessory in -
ground swimming pool without the benefit of finalizing a building permit and acquiring a Certificate of Occupancy
for the subject as -built swimming pool.
6. Town Law 4267-b., Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an as -built in -ground swimming pool with non -conforming rear yard setbacks,
while preserving and protecting the character of the neighborhood and the health, safety and welfare of the
community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New.York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Dantes, and duly
carried, to
GRANT, the variances as applied for, and shown on the survey prepared by John Metzger, L.S.S. dated April 11,
2013, subject to following conditions;
CONDITIONS:
1. All accessory structures and equipment of the subject residential parcel including but not limited to,
fencing, sheds and pool equipment shall be located upon the subject parcel in a code conforming location.
2. Pool mechanicals shall be placed in a sound deadening enclosure.
3. Drywell for pool de -watering shall be installed.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.

above, such as alterations, extensions, or demolitions, are not authorized under this application when involving

APPROVING MODIFICATION TO THE " RALPH ;AND
CATHERINE CASELNOVA PROPERTY "(1000-018.00-03.00-
009.009), TO WHICH THE COUNTY OF .SUFFOLX OWNS THE
DEVELOPMENT RIGHTS
WHEREAS, pursuant to Chapter.8 of the Suffolk County Administrative Local Laws ("Chapter 8"), a
proposal to modify .the property currently owned by Ralph and Catherine.Caselnova has been received by
the Suffolk County Farmland Committee ("Committee"),. where_ .such proposal is known by application
number 2015001; and
WHEREAS, the property owned by Ralph, and Catherine Caselnova is located on land situated north of
Main. Road (S.R. 25) and east of Hales Road, in the hamlet of Orient, Town of Southold, identified by
Suffolk County Real Property Tax Map ("SCRPTM") number 1000-018.00703.00-009.009 ("premises" );
and
WHEREAS, the applicants seeks Agricultural Development Permits for the installation and maintenance
of existing structures including a 12.3 foot by 8.3 foot wide by -8 foot high agricultural storage shed, 18
foot long by12�oot wide concrete pad, and 1,242 linear feet of `deer fe icn ng, in associon n with'a fruit
tree, grape and vegetable operation; and �--- - - - -
WHEREAS, said application was considered by the Committee at its meeting on February 10, 2015;
now, therefore, be it
1st RESOLVED, that the Committee hereby finds and determines that this proposal constitutes a Type II
action pursuant to 6 NYCRR §617.5(c)(3), which completes the SEQRA review; and
2°d RESOLVED, that the Committee hereby approves and adopts the report of its staff, as may be
amended; and be it further
3 d RESOLVED, that the Committee hereby approves said application, subject to the following
conditions:
1. The deer fence structures totaling 1,242 linear feet and enclosing three areas of the property
where agricultural products are being grown shall be sited as is shown on the survey plan
received by the County and entitled "Survey of Property At Orient: Town of Southold, Suffolk
County, New York (1000-18-03-9.9)" with the latest revision date of November 18, 2014 and
attached as Exhibit A to the Department of Economic Development and Planning, Division of

2. The first plastic deer fence structure located on the eastern portion of the property shall not
exceed a total length of 635 feet and a maximum height of 8 feet; and

4. The third wire deer fence structure located on the northern portion of the property shall not
exceed a total length 310 feet and a maximum height of 8 feet; and

toot long by 12 foot wide concrete pad shall be sited a is sshown on the survey plan received by

6. The agricultural storage shed shall, be constructed from wood=pine; and
7. A site visit of the property (tax map lot munber 1000-018.00-03.00-009:009) was conducted on
September 26, 2014 wherein it was noted that the property was not .engaged in commercial
agricultural production. In accordance with.Chapter.8 of the County Code.,which was amended
on November 19, 2013 by Local Law No. 44-2013, no owner shall leave agricultural land
uncultivated and not engage in commercial agricultural production for more than two consecutive
years; and

Exhibit A to the Department of.Economic Development and Planning, Division of Planning. and
Environment Staff Report Application No. 2015 00 1; and
2. The agricultural storage shed shall be constructed from wood -pine; and
3. A site visit of the property (tax map lot number 1000-018.00-03.00-009.009) was conducted on
September 26, 2014 wherein it was noted that the property was not engaged in commercial
agricultural production. In accordance with Chapter 8 of the County Code which was amended
on November 19, 2013 by Local Law No. 44-2013, no owner shall leave agricultural land
uncultivated and not engage in commercial agricultural production for more than two consecutive
years; and
4. The landowner shall be responsible for compliance with all conditions of Farmland Committee
Resolution # FC -7-2015, the deed of development rights, the contract of sale, and all applicable
federal state, county, and town regulations, rules and statutes.
