WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid
by the party of the second party, does hereby grant and release unto the party of the second part, the heir; or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Southold, -in the Town of
Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING
at a point on the easterly line of Oaklawn Avenue at the northwesterly corner of land of John A. Gagen
and the southwesterly comer of the premises herein described (which point is North:6 degrees 12
minutes 00 seconds East a distance of 100.0 feet from a monument at the intersection of the easterly
line of Oaklawn Avenue with the northerly line of Clearview Avenue); RUNNING THENCE along the
easterly line of Oaklawn Avenue, North 6 degrees 12 minutes 00 seconds East a distance of 100.0 feet;
RUNNING THENCE along other land of the party of the first part at right angles to said easterly line,
South 83 degrees 48 minutes 00 seconds East a distance of 144 feet, more or less, to land of Charles.
E. Gagen; RUNNING THENCE South 1 degree 28 minutes 10 seconds West a distance of 100 feet,
more or less, to land of John A. Gagen; RUNNING THENCE in a westerly direction along said land of
John A. Gagen, North 83 degrees 48 minutes 00 seconds West a distance of 154.15 feet to the point
or place of BEGINNING. SUBJECT, however to the following covenants and restrictions: (1) That
everydwelling house erected ons aid premises shall cost not less than EIGHT THOUSAND ($8,000.00)
Dollars; (2) No fowl and/or animals other than the usual type of household pets are to be kept on said
premises.
SAID premises being commonly known as 4715 Oaklawn Avenue Extension, Southold, New York.
This conveyance is subject to grantors reserving to themselves a life estate in and to the premises
herein conveyed.
BEING AND INTENDED TO BE the same premises as those conveyed to the grantor herein by deed
dated June 29, 1957and recorded in the Suffolk County Clerk's Office on July 10, 1957inLiber4327
at page 135.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
