Land Preservation Applications and Inquiries:
SCTM #1000-22.-3-5.1 (SINATRA)
Land donation status
LPC reviewed opinion and recommendation made by Mary C. Wilson, Esq. (LPC legal counsel)
regarding encroachments on the Sinatra property that has been offered as a gift donation to the Town
for open space purposes.
LPC acceptable to recommendation and will have a split rail fence installed to prevent vehicle access
and eliminate neighbor’s driveway encroachment after the Town closes on this gift of property.
SCTM #1000-95.-1-11.2 (BIGGANE)
Request to re-activate application
Melissa Spiro, Land Preservation Coordinator, gave background information regarding Biggane’s
former LPC application, and for his most recent request to re-activate his application for the sale of an
18± acre development rights easement on his property located along Oregon Road. The landowner,
in order to eliminate driveway encroachment on farm area is proposing a lot line change that will
result in adding acreage to his existing residential home lot and that of his neighbor’s. He has
discussed same with Planning staff and is willing to restrict any further subdivision of the soundfront
lots. He has also agreed to remove the man-made pond and lawn area around the pond. LPC would
want topsoil to be replaced in this area.
Property consists of prime soils, is actively farmed, and adjacent to other farmland; however, it is not
adjacent to other preserved farmland. Since it is not adjacent to other preserved farmland, the LPC
has considered this application of lower priority; however, landowner is proposing a Bargain Sale
component.
MOTION
made Eric Keil, seconded by Peggy Dickerson, to direct Melissa Spiro, Land Preservation
Coordinator, to commission an appraisal to value the development rights for the Biggane property,
SCTM #1000-95.-1-11.2, provided Melissa gets confirmation from landowner that he is proposing a
bargain sale component.
Motion carried: 5/0
