HomeMy WebLinkAboutLP-04/14/2015 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, April 14, 2015 at 7:00 p.m. Town Hall Annex Executive Board Room Members Present: John Sepenoski, Chairman Anne Murray (left 8:30 pm) Peggy Dickerson Eric Keil Sam McCullough Members Absent: Lillian Ball Maureen Cullinane Also present: Melissa Spiro, Land Preservation Coordinator Melanie Doroski, Land Preservation Secretary Bob Ghosio, Town Board Liaison Luke McKay, Peconic Land Trust Commencement:  The meeting began at 7:03 p.m. with five LPC members present. Adoption of Meeting Minutes:  Acceptance of LPC meeting minutes from March 31, 2015 MOTION made by Sam McCullough, seconded by Anne Murray, to accept the March 31, 2015 LPC meeting minutes. Motion carried: 5/0 Land Preservation Applications and Inquiries:  SCTM #1000-22.-3-5.1 (SINATRA) Land donation status LPC reviewed opinion and recommendation made by Mary C. Wilson, Esq. (LPC legal counsel) regarding encroachments on the Sinatra property that has been offered as a gift donation to the Town for open space purposes. LPC acceptable to recommendation and will have a split rail fence installed to prevent vehicle access and eliminate neighbor’s driveway encroachment after the Town closes on this gift of property.  SCTM #1000-95.-1-11.2 (BIGGANE) Request to re-activate application Melissa Spiro, Land Preservation Coordinator, gave background information regarding Biggane’s former LPC application, and for his most recent request to re-activate his application for the sale of an 18± acre development rights easement on his property located along Oregon Road. The landowner, in order to eliminate driveway encroachment on farm area is proposing a lot line change that will result in adding acreage to his existing residential home lot and that of his neighbor’s. He has discussed same with Planning staff and is willing to restrict any further subdivision of the soundfront lots. He has also agreed to remove the man-made pond and lawn area around the pond. LPC would want topsoil to be replaced in this area. Property consists of prime soils, is actively farmed, and adjacent to other farmland; however, it is not adjacent to other preserved farmland. Since it is not adjacent to other preserved farmland, the LPC has considered this application of lower priority; however, landowner is proposing a Bargain Sale component. MOTION made Eric Keil, seconded by Peggy Dickerson, to direct Melissa Spiro, Land Preservation Coordinator, to commission an appraisal to value the development rights for the Biggane property, SCTM #1000-95.-1-11.2, provided Melissa gets confirmation from landowner that he is proposing a bargain sale component. Motion carried: 5/0  SCTM #1000-73.-1-1 & 73.-2-4 (THE VINES) Appraisal review \[executive session\] Melissa Spiro, Land Preservation Coordinator, gave background information regarding N&L Properties’ LPC application and concept plan of proposed subdivision being reviewed by the Planning Board. EXECUTIVE SESSION. The LPC members entered into Appraisal reviewed and preservation scenarios discussed by committee members. END OF EXECUTIVE SESSION MOTION made by Sam McCullough, seconded by Anne Murray, to authorize Melissa Spiro to share appraisal methodology and values with property agent and to discuss potential options for pursuing preservation. Motion carried: 5/0  REVIEW 2014 LIST PREPARED FOR COUNTY CONSIDERATION FOR OPEN SPACE ACQUISITIONS LPC revisited 2014 list prepared for County consideration of open space. LPC prioritized list to discuss with County at applicable time.  PROJECT STATUS UPDATES \[executive session where applicable\] No specific projects were discussed at this time. Applications & Inquiries for Uses or Structures on Preserved Property: Addition to Agenda:  SCTM #1000-96.-3-4.3 (GOERLER) Melissa Spiro, Land Preservation Coordinator, met with Ron Goerler on April 14, 2015, regarding his plan. Ron has worked with Alan Connell of USDA-NRCS and NRCS supports the plan to install a chemical handling facility within the Town’s easement area near the existing greenhouses on the Goerler property. LPC briefly discussed plan. MOTION made by Eric Keil, seconded by Sam McCullough, that the proposed installation of a proposed chemical handling facility is consistent with the purposes and other terms and conditions of the recorded Easement on the Goerler property. Motion carried: 4/0 (Anne Murray not in attendance at time of vote) Stewardship and Management:  STEWARDSHIP GENERAL UPDATE Chairman John Sepenoski gave his updated stewardship report. DPW is reviewing two policies related to project lists for Town open space and public requests to do projects within Town open space lands. Lists are currently drafted and being reviewed before distribution to LPC for comments. LPC will be provided with project lists via e-mail towards the end of this week and LPC can respond to John in a timely manner with any comments they may have. Mill Road Preserve Management Plan has been revised and will soon be ready to present to Town Board. General Land Preservation Items:  ANNOUNCEMENT OF FEDERAL AGRICULTURAL CONSERVATION EASEMENT PROGRAM DEADLINE - MAY 15, 2015 Melissa met with Tim and Luke to review pending Town farmland preservation projects that would potentially meet federal qualifications for grant funding. No projects meet NRCS requirements or timeframe; therefore, no application will be made for 2015 funding round. Next Regular Meeting: Tuesday, May 12, 2015.
