Sanders, Trustee `'oum Fax(631) 765-6641 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD May 20, 2015 Mr. Michael Kimack 321 Riverside Drive Riverhead, NY 11901 RE: MIMI COLOMBO 350 OAK STREET, CUTCHOGUE SCTM# 136-1-48 Dear Mr. Kimack: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, May 20, 2015 regarding the above matter: WHEREAS, Michael Kimack on behalf of MIMI COLOMBO applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated November 17, 2014, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies 6.3, 9 & 9.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice.requirements: the seaward most section of proposed upper fixed dock to be shortened by 8' for an overall length of 69 feet; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on December 17, 2014, January 21, 2015, and again on May 20, 2015 at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of MIMI COLOMBO to remove existing 24' long wood retaining wall, 4' wide wood decking and staircase; replace with ±24' long ACQ wood retaining wall with shore-guard sheathing; install 4'x±24' thru-flow decking along top of retaining wall; construct 4'x69.4' of fixed upper dock with staircase and 3' high railing on one side off of new deck; install two staircases to grade for public access at landward end of upper dock; construct 4'x24' of fixed lower dock with staircase from up.per,do.Ck; overall.length of fixed dock structure to be 4' wide by 93.4' long; and as depicted on the site plan prepared by Michael Kimack, last dated May 22, 2015, and stamped approved on June 1, 2015. The docks located to the north (1000-136-1-46) of the subject parcel are does not have valid permits for the length and should not be considered in decision making. The parcel immediately adjacent and to the north (1000-136-1-47) received a Wetlands Permit for a dock structure in 2014. The total length is 78'. II The parcel adjacent to the south (1000-136-1-49) received a Wetlands Permit for a 53' long dock (including end stairs) in 2001. The parcel next to that(1000- 136-1-50) received a permit in 1999 for a 86' long.dock. The applicant has not demonstrated that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. The dock structure does not comply with the Board of Trustee dock standards or Purpose of Chapter 275. "Purpose. It is the intention of this chapter to ensure for the citizens of the Town of Southold the protection, preservation, proper maintenance and use of its wetlands, giving due consideration to the reasonable economic and social development of the Town. In addition, the Town Board declares that it is the intention of this chapter to regulate the type and placement of fixed and floating piers and docks for the protection, preservation, proper maintenance and use of its waters and wetlands. Therefore, the Town Board declares that the regulation of the wetlands of the Town of Southold is essential to the health, safety and welfare of the people of the Town of Southold. The wetlands shall be regulated in order to maintain and contribute to the following resource area values and the attributes and functions they possess:protection of public and private water supply, groundwater, flood control, erosion and sedimentation control; storm damage prevention, water pollution control, fisheries, shellfish, including spawner sanctuaries, wildlife habitat, agriculture; aquaculture; aesthetics,public access, and recreation. In addition, the following resource area values shall be maintained and protected.,prevention of flood damage by limiting development in flood hazard areas,prevention of damage to structures and natural resources as a result of erosion;improvement of water quality,protection and enhancement of existing vegetation r , � F cover in order to maintain water quality and wildlife habitat.protection of wildlife, waterfowl, and plant habitat and the maintenance.of existing populations and species diversity,prevention of loss or degradation of critical wildlife and plant habitat;prevention of new stormwater runoff discharge and the improvement of existing stormwater runoff discharges;protection of coastal ecosystems which support the continued viability of harvestable shellfish and finfish habitat,public access to water and land;improvement of groundwater recharge, and the minimization of the impact of new development, restoration and/or expansion on the resource area values listed above." Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. Use the following factors in assessing potential adverse impact: The applicant currently enjoys access to public waters via waterfront property. The proposal would place a private dock structure in public waters and on public bottomlands. The placement of a private dock structure into public waters does not meet this policy. To lessen the permanent reduction of use of public water and lands, a temporary vessel mooring is recommended. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The board rejected the fixed dock as being proposed at a height greater than surrounding docks and, in a itcd�[' io also re'e the proposed floating dock as being in a location where the water depth was shallow at low tide. The board recommended the owner consider a bouy in the channel with a fixed dock at a lower height. -4� Ms. Columbo respectfully requests you reconsider your rejection of the height of the fixed dock and the floating—dock as you have recent y approved two such floats, Cooper is the adjacent property to the north and Kelinson floating dock is approx. 120 feet from Ms Columbo's property, also to the north. Both of these floating docks are located in shallow water, similar to the proposed floating dock for Ms. Columbo.(see plans for each floating dock) Ms. Columbo's floating dock would be at approximately the same distance from the shoreline and be located in essentially the same water depth as the cooper floating dock since it would be located 30 feet to the south (see survey) Both floating docks would have been approved by DEC for shallow water placement. SCTM# 136-1-48 It is my recommendation that the proposed actions to construct a 4'x60' fixed dock on 8 diameter pilings at 8'o.c.; a 3'x16' removable aluminum ramp; a 4'x16' floating dock with a 4'x4' float extension using trex decking; with four(4) 10" diameter pilings in two sets; ,overall length of docking facility from retaining wall to be 80' are INCONSISTENT with the below Policy Standards and.therefore is INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. The applicant has not demonstrated that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [5] Whether the dock will cause degradation of surface water quality and natural resources; The mean low water (MLW) measurements at the terminus of the dock structure is shown as between -1'. Operation of a motorized vessel to and from the dock could result in bottom scaring and increased turbidity in the water column impacting marine life in the water body. It is recommended that the Board clarify the size and type of vessel and tidal range. [6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats, The action is located in East or Eugene's Creek a listed New York State Significant Fish and Wildlife Habitat and New York State Department of Environmental Conservation Critical Environmental Area (Cutchogue Harbor Wetlands). The proposed construction practices of the dock have not been identified. It is recommended that the applicant identify the proposed construction practices. 11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts. The action is also inconsistent with the following policy standard. Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold.
