Final Grading Plan

Dear Mr. Terry:

Following up on our recent discussions, the purpose of this letter is to confirm my understanding
that you do not foresee any difficulty with completing landfill closure construction for the
referenced project without a revised final grading plan, even though changes have been made to
the subgrade grading plan to accommodate the placement of additional materials under the
landfill cap. As discussed, after final subgrade surface elevations are established and agreed to,
the final elevations of the landfill cap surface and the final elevations of the surfaces of related
features within the limits of the cap (e.g., roads, Swale linings and drainage structures) will be
established in accordance with the details and sections shown on the Contract Drawings. In
instances where a specific detail is shown in plan view only (e.g., the crowning of a road) the
intent of the final grading plan shown in the Contract Drawings shall be complied with at the
elevations reached by constructing to the details shown in the appropriate sections.
Since for the most part, at the perimeter of the limits of the cap the subgrade has not been
changed, the final grading plan shown in the Contract Drawings should be referred to during
construction of these areas. The exceptions to this are in the southeast corner, where the
perimeter subgrade plan has been altered to move the perimeter swale north to allow for future
improvements to the transfer station, and along the southwestern perimeter, where construction
of a permanent access road to the 17 -acre parcel is planned. Additionally, as discussed, the steep
portion of the northeast corner of the cap may be revised if this is determined necessary based on
the results of the interface friction testing.

Also, my understanding is that you agree that final elevations of the cap and all related surface
features will be shown on the final as -built drawings to be provided by you. The as -built
drawings shall be provided as specified in the Contract Documents and, at a minimum, consistent
with the level of detail shown on the Contract Drawings. The final elevations of the cap should
be provided by a New York State Licensed Land Surveyor and the. as -built drawings should be
sealed by a New York State Licensed Professional Engineer.
Please contact me immediately if you foresee any difficulties in constructing the cap and related
features as outlined above.

To date we have received two Schedule of Values submittals: The submittal dated June 22,
2001, provided a breakdown for the lump sum Bid Items 2 (Mobilization, Maintenance and
Demobilization), 17 (Landscaping), 18 (Riprap, Stone Fill, Gravel Fill and Reno Mattresses), 26
(Drainage Pipe, Inlet/Outlet Structures, Stilling Basins and Manholes), 28 (Water Supply Well
and Electrical Service) and 29 (Siren and Electrical and Telephone Service). The submittal dated
August 8, 2001, provides a breakdown for Bid Item 2 only.
Our comments on the June 22nd submittal were provided to you in correspondence dated June
25, 2001. To date, we have not received a response to these comments, except with respect to
Bid Item 2 by way of the August 8th submittal. Our comments on the August 8th submittal are
presented below:
1. Monthly amounts for telephone and electric services to the trailers should be itemized
separately from the costs for installation of temporary utility service connections.
2. The cost for furnishing and installing privacy slats in the Cox Lane Access Route gate
and fencing should be provided.
3. The cost for final record drawings should be provided.
4. It should be confirmed that demobilization includes the cost for removal of temporary
utilities.

Dear Mr_ Maher:
This letter is to provide a cost estimate for excavation of test pits
outside the staked waste limits for purposes of waste limit inspection.
Due to surface conditions present in many test pit excavation areas.
Terry Contracting & Materials, Inc. is recommending. the use o and
crawler excavator for this work. The charge for all equipment
labor associated with test pit excavation will be $1200 per day.

limits. Should large amounts of waste be discovered, additional time
may be needed to effectively determine the extent to which it extends

As you are aware, on Friday, August 10, 2001, Terry Contracting
Materials, Inc. commenced test pit excavation. This excavation was
undertaken For four hours_ During this time, waste was discovered
extending beyond the staked limits of waste in the area abutting the
sand pit borrow area. This waste vein appears to extend 35' beyond the
staked limits of waste at a depth of approximately 13'_ It is my
opinion that additional excavation will be necessary in this area to
adequately determine the actual limits of waste.
Please contact me with any questions and/or comments. Terry
contracting & Materials, Inc. is prepared to begin this work as soon an
an agreement is reached.

You are directed to make the following changes in the Contract Documents:
Description: Removal and Consolidation of Vegetation

For each acre (or part thereof) of vegetation removed from and windrowed on the 17 -acre parcel adjacent to the landfill, measurement and
payment shall be in accordance with Bid Item 3 — Clearing and Grubbing at $1,200/acre (or part thereof).
Since the area of clearing and grubbing required on the landfill will be, at a minimum, 17 acres less than the estimated quantity in the bid
(i.e., 50 acres) there will be no increase in cost to the landfill closure project for clearing and grubbing the 17 -acre parcel.
Removal and Stockpiling at Landfill
For each cubic yard (yd3)(in-place volume) of topsoil removed from the 17 -acre parcel and stockpiled at the landfill, the Owner will pay
the Contractor $5 (Bid Item 4 — Unclassified Excavation and Relandfilling). Measurement for payment shall be based on .surveys
furnished by the Contractor,, before and after excavation of soil. The surveys shall be sealed and signed by a New York State licensed land
surveyor and shall be in accordance with the requirements specified for. Bid Item 4.
The Contractor shall remove and stockpile approximately 12,700 yd (in-place volume) of topsoil at the landfill.
The Contractor shall use the topsoil to prepare vegetative growth medium for use on the landfill site. One part topsoil shall be mixed with
one part compost and one part sand to produce vegetative growth medium in compliance with NYSDEC's approval for use of topsoil from
the 17 -acre parcel. Payment to the Contractor for mixing, processing and placement of vegetative growth medium shall be $7/yd' (Bid
Item 13A— Vegetative Growth Medium Using On -Site Compost and On -Site Soil from Borrow Area).
There shall be no payment to the Contractor under Bid Item 13B — Contingency Topsoil from Approved Off -Site Sources
Removal and Windrowing Soil on 17 -Acre Parcel
For each cubic yard (in-place volume) of soil windrowed on the 17 -acre parcel, the Owner will pay the Contractor $2 (New Payment Item
31— Topsoil/Loam Removal and Stockpiling). The Contractor shall stockpile the soil in windrows as directed by the Owner.
Approximately 9.1 acres of topsoil (1 -foot deep) and 4.6 acres of loam (2 feet deep), collectively, approximately 29,500 cubic yards of
loam and topsoil, will be windrowed on the site. Measurement for payment shall be based on surveys furnished by the Contractor, before
and after excavation. The surveys shall be sealed and signed by a New York State licensed surveyor and shall be in accordance with the
requirements specified for Bid Item 4.
If directed by the Owner, the windrowed soil, shall lie used by the Contractor as fill material beneath.the upper 6 inches of subgrade. The.
fill material shall be compacted as specified for relandfilled waste and covered with a minimum of 6 inches of compacted General Fill in
accordance with the Specifications. Measurement and payment for this work shall be in accordance with Bid Item 6 — Contour Grading
Material, General Fill and Daily Cover from On -Site Sources at $3/yd'.
Reason for Field Order: This field order is being issued to expedite removal of topsoil and loam from the 17 -acre parcel to
relocate yard waste composting operations from the landfill and to avoid the need for contingency
topsoil for closure of the landfill at no additional cost to the Owner for the landfill closure project.

This letter is in response to your June 12, 2001 letter to me regarding the Southold
Landfill Closure Project. The procedures detailed in your June 12, 2001 letter regarding
the processing of the manufactured topsoil layer for the Southold Landfill Closure
Project is compliant with the provisions of 360-1.15(b)(10). 'The approved landfill
closure plans and specifications should be appended with these procedures_ We have
contacted Igor Sikirk of our Region 1 Office and he concurs with this modification of the
approved closure plans and he concurs with this approval. The final construction
certification documentation needs to note compliance with these approved procedures
and must be submitted to the Region for Department review and approval upon
construction completion.

Dear Mr. Phaneuf:
As requested, please find below additional information pertaining to the manufacture of
vegetative growth medium for closure of the Southold Landfill.
1. 13,000 cy of topsoil will be removed from the Town -owned 17 -acre parcel located
adjacent to the landfill and transported to and stockpiled in the former borrow pit on
the landfill property.
2. Equal volumes of sand, yard waste compost and topsoil,. as measured by the bucket of
a bucket loader, will be mixed to create a batch pile of vegetative growth medium.
The pile will be turned using the loader bucket for initial mixing.
3. Following initial mixing, the batch material will be put through a vibrating grizzly
into a hopper and through a soil shredder to a vibrating two -deck screen head. After
passing through two .screens, the product will be stockpiled using a 60 -foot radial
stocking - conveyor ready to be loaded onto - an off-road hauler to be placed on the
landfill _cap.

Manufactured Topsoil
Dear Mr. Maher:
Below, I have outlined the procedure for mixing/blending topsoil for the above
referenced project. The appropriate percentage is batched together by bucket loader, for
example, if the component required 1/3 soil, 1/3 sand, and 1/3 compost than the Ioader
operator could make a batch by mixing an equal number of buckets of each material to
make a batch pile. That pile is then turned over with the loader for the initial mixing.
Next, the material is put through a vibrating grizzly into a hopper and exits the hopper
through a soil shredder on its way up the conveyor to the vibrating two (2) -deck screen
head. After passing through two (2) screens the product is stacked off a 60' radial
stacking conveyor and ready to be loaded on to an off road hauler.
The above process completely mixes the three soil components to create a well
graded, blended growing medium. If you would like to see this performed as described,
our pit on Roanoke Avenue does this on most dry days and I could arrange a site visit at

This letter _is to confine our telephone conversation today regarding waste removal in Waste Excavation
Areas No. 2 and 3 which are beyond the limits of the cap.
Waste in these areas will be removed until clean soil is reached. Soil beyond the limits of waste that
exhibits evidence of leachate impacts (e.g., staining and odors) also will be removed. In addition, six (6)
to twelve (12) inches of soil beneath the vertical limits of waste' or leachate impacted soil will be
removed. Based on this protocol, no soil sampling will be required.
After the limits of waste have been reached and underlying soil removed, the excavation areas will be
backfilled. Records, including daily field reports and photographs, will be obtained to document removal
of waste.

As you likely are aware, NY( have been trying to get a pole delivery date and construction
schedule for installation of the poles from KeySpan for about a month. We were told by
KeySpan that they would prt.vide the delivery date to us at least three weeks ago. We. also
provided a design drawing to KeySpan about three weeks ago illustrating how the cap would be
connected to the new poles Kised on the pole configuration they provided to us. For the last
three weeks, we have placed a number of calls to KeySpan to obtain ,the pole delivery and
installation dates, and comme; its on the drawing, but did not receive any return .calls. We need
the installation date so that tLe landfill closure construction contractor .can be informed of the
anticipated Notice -to -Proceed date and we need comments on the pole drawing to finalize the
design drawings for bid.
I finally was able to contact K, ySpan (Vincent Esposito) this morning and learned the following:
I. KeySpan did not want to place the pole order without LIPA's express decision to
proceed with repla• anent of the poles. The concern was that it could cost LIPA a
few hundred thous;end dollars which would be wasted if the ultimate decision was to
bury the new lines,a the Town of Southold.
2. LIPA has decided 1.) proceed even though it could be a costly liability. The decision
was made last wee+,.- and, since that time, KeySpan has been contacting various pole
manufacturers to ol.tain delivery dates. KeySpan did not want to contact us regarding
the LIPA decision loithout a delivery date.
I Based on discussic.:is with pole manufacturers that KeySpan has used in the past,
because the order would involve only three poles, the earliest delivery time frame
would be.a minimu,n of 150 days, which from today would result in delivery in mid-
February 2001, wi t h installation complete at the earliest in mid-March based on
KeySpan's prelimi ._n estimate of 30 days to install the poles.

4. In contacting pole manufacturers, KeySpan located a Canadian firm, with 'whom they
previously have nc,;: worked, which indicated that their pole delivery period would be
77 days. This time frame would result in a delivery date of on or about December 1,
2000, which fits into our schedule, assuming KeySpan can install the poles within 30
days, which woula be on or about January 1, 2001. However, the poles would be
manufactured in f ranee which involves transatlantic shipping that could result in
delays.
5. During our van toi x a few months ago we were told that the new poles would be
about 80-85 feet high; however, based on KeySpan's recent engineering calculations,
two of the new poll will be 95 feet high and one will be 105 feet high. Since the cap
will raise the grade about 5 feet in the area of the poles, and the existing towers are
about 55-60 feet hi,,h (according to KeySpan) the new poles -will be nearly twice as
high as the existing ,;owners.
6. To expedite installation of the new poles in order to keep within the 30 -day
construction period KeySpan will construct the foundations for the poles concurrent
with manufacture of the poles.
7. KeySpan plans to order the three new poles this Friday (September 15) and provide
us with the constru, - tion schedule early next week. They also will provide us with
approvaUcomments on our cap to pole connection drawing by the end of this week.
Based on this discussion with) .eySpan and the pole delivery and installation periods they have
provided to us, and assuming 1..e will get comments on the pole connection drawing this week,
we have all the information w,! need to complete the construction contract documents for bid
advertisement by the Town anti will proceed to have the documents printed (50 copies) as soon
as we receive approval from tl,,; Town. T will coordinate this with Greg yakaboski and Mary
Wilson on selecting a bid advert isement date and printing.
With regard to the construetiol: easements, so as not to delay bidding, the contractors will be
informed that the easements ct<<rently are being prepared and that they will be in place at the
time that the Notice to Mobilize will be provided to the contractor.

This letter is in response to the Department's concern regarding use of clay from the two ponds planned to
be constructed adjacent to the Town of Southold Information Center as part of closure of the Southold
Landfill. '
Based on discussions with the Town, only the sandy material above the clay, together with concrete from
a former building's foundation, will be used at the landfill.' All concrete will be adequately reduced for
use as general fill at the landfill.
The clay will be removed at a later date by the New York State Department of Transportation to complete
construction of the ponds.

This is to confirm my conversation with. Jim Bunchuck today regarding payment to Terry
Contracting & Materials, Inc., (Terry) for the disposal of approximately 6,500 cy of pesticide
contaminated soil to be placed on the landfill.
Jim Bunchuck stated that all costs, including placement and compaction of this material, will be
under separate agreement between the Town and. Terry, and that the Town will negotiate and
agree to the cost for placement and compaction on the landfill. Jim Bunchuck has arranged for
the counting and weighing of Terry's trucks at the landfill scale to facilitate accounting and
payment for this work.

We have reviewed the submittals stamped as follows: 2a (Geocomposite Manufacturer Data and
Specifications - Resubmit 1) 4a (Geomembrane Manufacturer Data and Specifications -
Resubmit 1), 5a (Geomembrane Prequalifications - Resubmit 1) and 16 (Preconstruction
Submittals, as to 4.3.C.4.a). The submittals were received on August 30, 2001, and in accordance
with your stamp have been reviewed with respect to the requirements of Sections 4.4(13)(2),
4.3(C)(1), 4.3(C)(3) and 4.3(C)(4), respectively, of the specifications for the above -referenced
project. Our comments are presented below.
Comments on Submittal 2a - Geocomposite Manufacturer Data and Specifications
1. The results of the specified interface friction tests must be submitted.
2. Regarding Chenango Contracting's Geocomposite Installation Procedures, there are
several inconsistencies between the plan and the specifications. Specific comments
are as follows:
• Geonet components shall be overlapped by at least 4 inches, not 1 to 4 inches as
indicated in the installation procedure.
• Cable ties shall be made of nylon not plastic as indicated in the installation
procedures.

• The installation procedures indicate that geonet will be fastened at 5 -foot intervals
longitudinally; however, the specifications require tying at a minimum every 5
feet along the slope, every 1 -foot across the slope, every 6 inches in -any anchor
trench and'every 10 feet on horizontal surfaces.
• The installation procedures state that geocomposite should be continuously sewn,
wedge welded or leistered on the top layer of geotextile. The specifications state
that the top layer of geotextile shall be continuously sewn. The bottom layer of
geotextile shall be overlapped.
• In accordance with the specifications, all terminal ends and edges of the
geocomposite (top of slope, toe of slope or lateral limits of the geocomposite)
shall be finished by wrapping the ends and edges of the geocomposite with
geotextile and heat bonding the geotextile wrap to the bottom and top geotextiles
of the geocomposite.
• In accordance with the specifications, any holes or tears in the geocomposite shall
be repaired by placing a patch extending 2 feet beyond the edges of the hole or
tear, not 6 inches as noted in the procedures.
• In accordance with the specifications, geocomposite shall not be left exposed to
sunlight for more than 14 days, not 30 to 45 days as noted in the procedures.
• Defect documentation procedures for the geocomposite drainage layer have not
been provided.
Comments on Submittal 4a - Geomembrane Specification and Submittal
5a - Geomembrane Pregualification
1. Although a letter was provided from Poly -Flex, Inc. which states that the
geomembrane will meet the specified requirements, be advised that prior to delivery,
notarized certifications are required from the manufacturer stating that each roll
conforms to the requirements of the specifications.
2. Chenango Contracting indicates that samples have beenshipped for interface friction
tests. The results of the interface friction testing must be submitted.

3. Poly -Flex, Inc. indicates that the unbound data sheet of geomembrane properties
titled "Southold, NY" is the proposed data product Data Sheet. However, we again
note that values for several specified parameters are not shown (e.g., coefficient of
Iinear thermal -expansion, volatile loss, water adsorption and resistance to soil burial).
Poly -Flex, Inc. indicates that we should refer to the manual for coefficient of linear
thermal expansion, volatile loss and water adsorption and then certifies values for soil
burial in their letter dated August 10, 2001. We request that all properties be listed on.
one page so that there is no confusion with regard to the properties and values
required for the geomembrane.
4. Although we do not approve at this time, we will consider the proposal to weld below
40° F. if documentation of the claim that NYSDEC permits welding at temperatures
of 32° F. is provided.
Comments on Submittal 16 - Preconstruction Requirements
1. At this time, we have no comments on the Panel Layout Drawing.
2. An installation schedule has not been provided.
Based on the above we have stamped Submittal 2a, 4a, 5a and 16 "Approved as Noted"
contingent upon receipt of the results of the interface friction tests and the specific comments
above being satisfactorily addressed. Four (4) complete copies of each submittal shall be
provided for final approval.

This letter is 'to provide the °scope -of- work and budget to support,`the "Town's need to remove
topsoil and loam from the17=acre parcel for'construction of the Yard Waste Compost Facility, to
use this material as part of closure of the landfill and to provide appropriate grades near the
southeast perimeter of the landfill cap to accommodate modification of the Collection Center.
The work involved in this effort includes the following:
Work Completed
Numerous planning discussions and negotiations with the Town and Terry
Contracting & Materials, Inc. (Terry) regarding options for removal, handling and use
of the 17 -acre material.
• Preparation 'of a Field Order to use the avoided cost of off-site topsoil for landfill
closure ($248,400) for removal and consolidation of vegetation on 17 -acre parcel,
removal and stockpiling of a portion. of topsoil from 17 -acre parcel at the landfill,
manufacture of vegetative growth ' medium - using - the topsoil, and- removal . of the
remainder of topsoil, -and, a-portion,of. the loam and placement at the landfill as fill.
(Several drafts of the Field Order were prepared.)

• Collection, analysis and evaluation of topsoil and loam samples for geotechnical and
chemical characteristics for comparison to specifications for vegetative growth
medium and general fill to insure that the material is compatible with the closure plan
and intended use.
• Preparation of optional approaches for removal of topsoil and loam from the 17 -acre
parcel and use for landfill closure for consideration by the Town. (A number of drafts
of the options were prepared.)
• Meetings with the Town and Terry to discuss the removal and use options and
formation of an agreeable approach.
• Inspection of the material on the 17 -acre parcel, including oversight of construction
of test pits to determine the depth of topsoil and loam.
• Preparation of a letter to NYSDEC requesting use of the 17 -acre topsoil for
manufacture of vegetative growth medium.
• Preparation of a letter to NYSDEC requesting approval to utilize the remaining 17 -
acre topsoil and loam for fill/alternate grading material
• Preparation of revised grading plans for the landfill to accommodate the 17 -acre
topsoil and loam under the cap. The revised plan involved changes to the swale
slopes, as well as the surface contours. Cut and fill calculations were required to
establish a revised grading plan suitable for the increase in fill volume. A number of
plans were developed in an effort to balance the objectives of promoting drainage,
minimizing the potential for off-site landfill gas migration and minimizing aesthetic
impacts (i.e., minimizing increases in the elevation of the landfill due to the increase
in fill).
• Preparation of a revised landfill gas venting plan due to the use of the low
permeability 17 -acre topsoil and loam under the cap.
• Preparation of a letter to NYSDEC requesting approval of the revised grading plan
and landfill gas venting plan.
• Provision of assistance to the Town regarding potential excavation and disposal of
topsoil and loam at the Town of Brookhaven Landfill.

• Construction inspection for removal of topsoil and loam from the 17 -acre parcel,
including monitoring records of truck volumes and review of survey data for
verification of quantities for payment.
• Coordination and review of Terry's application for payment for work on the 17 -acre
parcel.
Work to be Completed
• Preparation of a Change Order to remove topsoil and loam from the 17 -acre parcel,
and use of topsoil and loam for landfill closure.
• Preparation of revised grading and drainage plans for the southeastern perimeter of
the landfill cap to provide planned modifications to the Collection Center.
• Revisions to 14 contract drawings to incorporate the new grading, drainage and gas
venting plans.
A breakdown of the cost of this extra work is provided below. It should be noted that by
utilizing the 17 -acre topsoil and loam as part of landfill closure, assuming the Town likely would
pay a contractor $10 per cubic yard to load and haul the topsoil and loam, exclusive of a cost for
disposal, the estimated cost savings to the Town is $630,000.

With the presentation of the recommended reconfiguration of the Collection Center and Transfer
Station,;we'essentially have completed this task. When the Town is ready to proceed with the
project, we can begin work on a detailed engineering plan.
To date, we have slightly exceeded the budget amount to develop proposed changes to the
Town's recycling program and to address the impact of the proposed changes to the Town's
recycling program which was not in the original scope of work. To cover this additional work,
we request the budget for the task to be increased to $15,000.
