D&B 1314 Dear Mr. Cava: The Contractor (Terry Contracting and Materials) has encountered difficulties in attempting construction of the gas migration control trenches due to caving of soils which results in large excavations and use of materials. The present design is shown in Attachment 1. To mitigate this difficulty, Terry has proposed an alternate design which can be more readily constructed by placing the gas venting materials along the sidewall of the excavation rather than vertically, which would require shoring and likely damage the geotextile as the shoring is removed. The proposed revised design is shown in Attachment 2. To enhance the venting of gas from. the trench, Terry has also proposed to place perforated pipe laterally in the trench with wind driven ventilators. We have reviewed this revised design and find it acceptable, pending your review and approval. Since these gas migration control trenches need to .be constructed prior to placement of the geomembrane, and we plan to lay geomembrane in the very near future on the western half of the landfill prior to the onset of cold weather, your expeditious review of this design revision is greatly appreciated. Re: Southold Landfill Closure Michael Neuberger, P.E. Brian M. Veith, P.E. D&B 1314 Charles J. Wachsmuth, P.E. Dear Mr. Terry: October 17, 2001 This is in response to your letter dated October 17, 2001, regarding your request for additional payment for construction of the gas migration control trenches. 1. Based on your extensive experience in subsurface construction on eastern Long Island, we cannot understand your claim that unforeseen site conditions, that is "looseness of soils in the areas of installation" were encountered in a recent test excavation. You undoubtedly are aware that there is sand in the area of the Southold Landfill. Site reports and documents available for review during preparation of your bid were referenced in the Contract Documents for closure of the Southold Landfill, which clearly describe geologic conditions and presence of native sand from just below ground surface to a depth of approximately 100 feet at the landfill. These documents are the following; • . Part 360 and Phase II Hydrogeologic Investigation Report, Southold Landfill, Dvirka and Bartilucci Consulting Engineers, October 1991. • Part 360 and Phase II Supplemental Investigation Report, Southold Landfill, Dvirka and Bartilucci Consulting Engineers, March 1993. • Part 360 Closure Investigation Report, Southold Landfill, Dvirka and Bartilucci Consulting Engineers, December 1996. • Test Pit Waste Delineation Report, Southold Landfill, Dvirka and Bartilucci Consulting Engineers, November 1998. Your attention is directed to Section 4.3 of the General Conditions of the Contract Documents which defines unforeseen conditions. We think that encountering sand at the Southold Landfill is not "of an unusual nature" and "which could not reasonably have been expected." 3. You attention is directed to Section 1.14 (Measurement and Payment) Item 5B (Excavation of Gas Migration Control Trenches), which specifies that the bid unit price shall include "sheeting, shoring and bracing" ... "as specified and as required t6- satisfactorily complete the Work." 4. Yo'iir 'atfenfion -is -directed `to"Section `6.1 of the General Conditions (Contractor's Resp'on'sibilities) thatthe Contractor "shall be solely responsible for the means, methods"techniques, sequences -and procedures of construction." Based on the above, your request for additional payment to construct the gas control venting trenches is without merit and you are directed to proceed with construction of the trenches. Any delay in proceeding will not be cause for an increase in the time for completion of the project. If you have any questions with regard to this letter, please contact me. This use involves construction of a golf driving range on the capped eastern portion of the landfill. A conceptual layout and grading plan to accommodate this driving range is enclosed. We realize that this first cut at a design shows less than 4% slopes over a portion of the landfill; however, the final design will have minimum 4% and maximum 33% slopes. For maintenance_ of the driving range, low pressure mowing and ball collection equipment will be used to mitigate adverse impacts to the cap. The Town will be responsible for maintaining the surface of the driving range and the cap. The cover over the geomembrane presently comprises 12 inches of barrier protection/drainage material and 6 inches of vegetative growth media. We feel that the 18 inches of cover, use of low pressure equipment and maintenance of the cover by the Town will adequately protect the cap. A DIVISION OF WILLIAM F. To comply with the Town's request, we have modified the approved closure design to route drainage from the southeastern area of the landfill to Recharge Basin No. 3 in the northeastern area of the landfill. This will involve construction of a catch basin and pipe to convey storm water to Basin No. 3. As described in the enclosed feasibility study, the pipe originating at the catch basin will run below ground for about 900 feet along the eastern property line outside the limits of waste at a slope of 1% and 300 feet through waste at a slope of 2% to a currently designed Swale to Basin No. 3. The pipe will be 30 inches in diameter, corrugated HDPE, to accommodate a 100 -year storm event and will be a dual containment corrugated HDPE outside and smooth HDPE inside in the area of waste. Maher, P.E. Vice President October 10, 2001 (REVISION 2.0) RE: WO#3138.01, FEASIBILITY ASSESSMENT TO ELIMINATE RECHARGE BASIN NO. 4, SOUTHLOLD FINAL LANDFILL CLOSURE, SOUTHOLD, NEW YORK Dear Mr. Maher: At the request of Dvirka & Bartilucci (D&B) Tectonic has performed a conceptual feasibility study for the alternative of eliminating Recharge Basin No. 4 and directing the stormwater flow to Recharge Basin No. 3 using a pipe. The evaluation of this alternative is based upon the drainage analysis contained within D&B's Final Landfill Closure Plan for the Southold Landfill dated December 1998. The findings of our feasibility study are discussed as follows. The proposed drainage pipe size was determined by assuming the pipe would be flowing full at 1.0% during the 100 -year storm event. A slope of 1.0% was chosen for the pipe outside the limits of waste to minimize the depth of trenching while maintaining a suitable flow. The last approximately 300 feet of pipe would be within the limits of waste and thus.a 2% slope was chosen. Runoff amounts were taken from the drainage report included in the Final Closure Plan. The drainage report labeled the area draining to Recharge Basin No. 4 as Subcatchment 4, and generated a runoff of 26.1 cfs during the proposed condition of a 100 -year storm event. It was determined that a 24" pipe can convey 22.6 cubic feet per second (cfs) at 1.0% while 30" pipe can transfer 41.0 cfs at 1.0%. It is our recommendation that 30" corrugated HDPE be used for piping material outside the waste limits. The total length of dual containment HDPE pipe in unavoidable portions of the waste mass on the property is likely to be about 450 feet. To the extent practical, the location of the proposed pipe run was chosen to avoid trenching in buried waste. Runoff will continue to be collected through the use of swales to a low point where it will be collected through the use of a flared end section ENGINEERS -SURVEYORS -CONSTRUCTION MANAGERS An Equal Opportunity Employer ;ft ENGINEERING TECTONIC CONSULTANTS PC Mr. Thomas F. Maher, P.E. 2 October 10, 2001 and run through the proposed drainage pipe along the eastern property line and end in the swale leading to Recharge Basin No. 3. The length of pipe will be approximately 1,200 linear feet. Figure 1 shows the conceptual layout of the proposed piping. Trenching for installation of the proposed drainage pipe will be extensive. The trench will vary from 5 feet to over 18 feet in depth. It is our suggestion that the trench be dug vertically to the greatest extent practical to avoid unnecessary waste disturbance and encroachment on the property line. All trenching activities should be properly shored and protected in accordance with all OSHA regulations. Excavation in waste will also generate landfill gases in a confined space and thus air monitoring is recommended. Recharge Basin No. 3 will be required to be enlarged to accommodate the additional inflow, based upon the storage volume stated in the drainage report. Recharge Basin No. 4 was designed to have 2.30 acre-feet of storage and the 100 -year storm event created a runoff volume of 1.93 acre-feet. Recharge Basin No. 3 was originally designed for 4.96 acre-feet and had a storage of 4.40 acre-feet during the 100 -year storm event. Based upon this information, Recharge Basin No, 3 will require enlargement to accommodate an additional 1.37 acre-feet of available storage to handle the runoff generated during the 100 -year storm event. Figure 2 shows an approximate alternative configuration of the new Recharge Basin No. 3. A conceptual opinion of probable costs has been prepared and is attached for reference. The conceptual cost opinion indicates the cost of this alternative is approximately $211,800. If this alternative is chosen, a final cost opinion should be prepared based on final design plans and specifications prior to authorizing construction activities. Please be advised that our cost opinion is based on the assumption that the limit of waste is as indicated on the plans and that pockets of waste do not extend beyond this limit. In addition, we assume the earthwork will be performed during favorable weather and seasonal conditions prior to capping this portion of the landfill. New York State Department of Environmental Conservation - Region 1 SUNY - Building 40 - Stony Brook, NY 11790-2356 Re: Southold Landfill Closure D&B 1314 Dear. Mr. Cava: As you are aware, the Town of Southold is planning to construct a new yard waste composting facility on a 17 -acre parcel located adjacent to the Southold Landfill. To provide access to the 17 -acre parcel, we have redesigned the 15 -foot RCA "maintenance road" specified in the approved closure design to a "permanent" 30 -foot wide asphalt road. This will require a change in the grading plan in the southwestern portion of the landfill. In addition, to mitigate noise created by traffic using this new road on the adjacent residential community, it is planned.to replace the chain link fence in the approved design with a 10 -foot noise barrier and plantings. Also, construction of the new road and noise barrier will require minor changes in the design and location of the swales and gas venting trench in this area. These revisions are shown on the attached drawings. For reference, the approved drawing numbers are 4, 5 and 6. A DIVISION OF WILLIAM F. COSULICH ASSOCIATES, P.C. Dvirka and Bartilucci CONSULTING ENGINEERS Anthony J. Cava, P.E. Regional Solid and Hazardous Materials Engineer New York State Department of Environmental Conservation - Region 1 October 12, 2001 Page Two Since the Town needs to construct and use this new road as soon. as possible, and in order to allow the capping of the west side of the landfill to proceed as soon as possible, your expeditious review and approval of this design revision is greatly appreciated. In addition, since it is no longer planned to -use the borrow pit in the northeast corner of the landfill property for yard waste composting, and the "main access road" through the center of the landfill will not handle the previously anticipated traffic, it is planned to construct this road with 12 inches of RCA rather than asphalt as specified in the approved design. The difference in the thickness of the road between the asphalt road (15 inches) and the RCA road (12 inches) will be made up by an additional 3 inches of barrier protection material. The portion of the road leading down to the floor of the borrow pit will remain asphalt to prevent erosion of the road (see attached drawing). Also, the 15 -foot wide RCA "maintenance road" along the northwestern boundary of the landfill will be increased to a 24 -foot wide RCA road to accommodate traffic between the 17 -acre parcel and the borrow pit which will be utilized for storage of brush and compost. Gas Vent Trench Presently, Terry Contracting & Materials is screening sand from the 17 -acre parcel adjacent to the landfill for Town purposes. After removal of material by the Town and Terry, the remaining material, based on a grain size analysis, essentially will comprise stone between 3/4 -inch and 11/2- inches (90-95%) .with some larger stone (2 to 4 inches). We plan to use this stone in the gas vent trench in place of the material currently specified in the approved design (Section 2.11, Paragraph B.5.), which is the following: Sieve Size Percent Passim 1 -inch 100 -inch 30-100 1/4 -inch 0-30 No. 10 0-10 No. 20 0-5 A DIVISION OF WILLIAM F. COSULICH ASSOCIATES, P.C. i Dvirka and Bartilucci CONSULTING ENGINEERS Anthony J. Cava, P.E. Page Two Regional Solid and Hazardous Materials Engineer New York State Department of Environmental Conservation - Region 1 October 12, 2001 We believe that the replacement material would be a suitable substitute. In addition to a change in material, we plan to change the application of geotextile in construction of the gas vent trenches, use of geotextile on the ends of the geocomposite and modification of the geocomposite beneath the swale drain (see Attachment 1). We believe that these modifications would not change or will improve the effectiveness of the design. Gas Vent Wells We also plan to use the above described replacement material in place of the material currently specified in the approved design (Section 3.1, Paragraph D.2) for construction of the gas vent wells, which is the following: Sieve Size Percent Passing 4 98 6 64 8 8 10 2 12 1 In addition, we also plan to change the method of construction of the gas vent wells from that specified in the approved design (Drawing 20) (see Attachment #2) to that shown in Attachment #3. We believe that the replacement material and changed method of construction is a suitable substitute. Since we plan construction of the gas venting trenches during the week of October 15, 2001, your expeditious review and approval of this change is requested. Maher, F.E. Dvirka and Bartilucci 330 Crossways Park Drive Woodbury, NY 11797-2015 Re: Southold Landfill Closure D&B No. 1314 Dear Mr. Maher: Due to the 15, roll length of the type I geotextile that is to be installed in the gas migration control trenches, Terry Contracting and Materials, Inc. proposes the following change to installation methods for this fabric in the trenches. 1. Fabric will be draped down one side of the trench so that the bottom edge of the fabric is in contact with the bottom of the trench and the top edge of the fabric extends 2' beyond the top of the trench. 2. Fabric will be draped down the opposite side of the trench so that the bottom edge of the fabric is in contact with the bottom of the trench and the top edge of the fabric extends 5' beyond the top of the trench. 3. Gravel will be installed in the trench. 4. The 2' extension of fabric will be folded in, over the top of the gravel fill. 5. The 5' extension of fabric will be folded in, over the top of the gravel fill. This piece will overlap the 2' extension completely and extend 2' beyond the limits of the trench. In addition to allowing for efficient use of fabric, the above method will eliminate a geotextile seam in the gas migration control trenches and better accommodate imperfection in the edges of the control trenches. The above method results in a 3' strip of geotextile for future use. We would like to use this strip for sealing of the ends of geocomposite. This would result in an overlap at the terminal ends of 1.51 on either side. The current specification is for 2'. This sealing would take place only at the up gradient terminal end of the geocomposite. The down gradient terminal end would be stripped of geotextile and left open to allow for drainage from the geocomposite. Furthermore, we suggest that, in the drainage swales, the geotextile layer of the geocomposite directly beneath the swale drain be removed to allow for direct uptake of the water draining from the geocomposite. The thickness of loam in this area varies from 1 to 6 feet. This area comprises approximately 4 acres and 10 additional vents are planned in this area for a total of 17 vents. This equates to approximately 4 vents per acre. Since the area where loam was placed is substantially less than originally anticipated, and the buffer area between the loam and property boundary is greater, we feel that additional gas monitoring wells along the western and northern perimeters will not be necessary. Also enclosed is a drawing which shows the installation of the gas vents in loam. A DIVISION OF WILLIAM F. COSULICH ASSOCIATES, P.C. rrd Dvirka and Bartilucci CONSULTING ENGINEERS Anthony J. Wachsmuth, P.E. Dear Mr. Terry: October 8, 2001 We have reviewed the Schedule of Submittals that was received in this office on October 4, 2001 and have the following comments: 1. As stated in our September 26; 2001 comment letter on Item 2 of the Schedule of Values the following comments still have not been addressed: • monthly amounts for telephone and electric services to the trailers should be itemized separately from the costs for installation of temporary utility service connections; • the cost for furnishing and installing privacy slats in the Cox Lane Access Route gate and fencing should be provided; and • the cost for final record drawings should be provided. 2. In addition, the August 8, 2001 submittal provided a cost for the Truck Stand in the Item 2 breakdown. This cost has been included in "Equipment Maintenance and Setup" cost in the most recent submittal. The cost for the truck stand should be provided- separately. 3. Bid Item 26 (Drainage Pipe, Inlet/Outlet Structures, Stilling Basin and Manholes) should be further broken down to include costs for materials and labor for culverts. A DIVISION OF WILLIAM F. To date, we have not received a response to this letter nor a revised Schedule of Submittals. Please find below basically a reiteration of comments contained in the September 12 letter, plus. additional comments in italics. I intend to review these items at our progress meeting on October 4, 2001, and to receive comments from you. In the interim, if you have any questions or comments, please call me. 1. In accordance with Section 1.7(A)(3)(c) of the Specifications "The Contractor shall use potable water for construction activities as specified and as directed by the Owner. Approval from the Engineer of all sources of water shall 'be required prior to delivery to the site." This must be added to the Schedule of Submittals. 2. The dates on the Schedule for submittal of the As -Built Survey and New Groundwater Monitoring Wells - Casing Location and Elevations should be ,corrected. This work cannot be completed on 5/24/01 as noted on the Schedule. We believe this date should be 5/24/02. Also, the date for submittal of the Barrier Protection Layer material certification and survey should be revised from 1/14/01 to 1/14/02. A DIVISION OF WILLIAM F. COSULICH ASSOCIATES, P.C. Due to surface conditions present in many test pit excavation areas. Terry Contracting A Materials, Inc. is recommending, the s of a and crawler excavator for this work. The charge for all equ'pm labor associated with test pit excavation will be $1200 per day. Approximately three daxa of excavation is required to adequately complete the inspection. This is assuming -th90excThis°time peri Pits complete at an interval. of approximately every vary depending on the amount of waste found outside the staked waste limits. should leffectivelysOf waste be determine the extentrto, whichtitnextends time may be needed to of beyond the staked limits of waste. As you are aware, on Friday, August 10, 2001, Terry Contracting Materials, Inc. commenced test pit excavation- This excavation was undertaken for four hours. During this time, waste was discovered extending beyond the staked limits of waste in the area abutting the sand pit borrow area. This waste vein appears to extend 351 beyond the staked limits of waste at a depth of approximately 13'_ It is my opinion that additional excavation will be necessary in this area to adequately determine the actual limits of waste. Please contact me with any questions and/or comments. Terry Contracting & Materials, Inc. is prepared to begin this work as soon as an agreement is reached. Thank You, f Timothy J.
