Several redesigns.made by the Engineer to the original grading plan (Additional Work Order #1 = $13,738.18). This work includes the following: a. All field and office time associated with the survey of the "woodchip windrows" present on site at the beginning of the project. b. All field and office time associated with the survey of Waste Excavation Area 3. c. All office time associated with all redesigns made to.. the original Contract Drawing #4 through revision #4D. d. All initial stake -out of previously staked areas required due to all redesigns of Contract Drawing #4 through revision #4D. 2. The Engineer's request made for additional surveys not originally required (Additional Work Order #2 = $6,734.35). This work includes the following: a. All office and field work associated with the requested survey of the gas vent layer below all liner installed as of this writing. 3. The Engineer's request to establish control for additional aerial photography (Additional Work Order #3 = $2,617.35). The requests for payment by L.K. McLean Associates and a complete breakdown of all work have been attached. It is our intention to bill the Town of Southold for .this work in its entirety. Dvirka and Bartilucci 330 Crossways Park Drive Woodbury, NY 11797-2015 Re: Southold Landfill Closure D&B No. 1314 Dear Mr. Maher: As discussed at the progress meeting of March 28, 2002, Terry Contracting and Materials, Inc. seeks approval to apply a single, 1.5' lift of screened sand in the area of the permanent, 17 -acre access road. �r The lower 6" of this lift will serve as the contour -grading layer. This portion of the lift will be compacted to a minimum dry density of 95% Standard Proctor (ASTM D698). The upper 12" of this lift will serve as the gas -venting layer. This portion of the lift will also be compacted to a minimum dry density of 95% Standard Proctor (ASTM D698). The subgrade will be graded and surveyed prior to placement of these lifts. The cost for screening of the sand used to construct this lift in this area will be the responsibility of the Contractor. Your written response is requested so that we may proceed with this work. As of this time, no revised grading plan has been provided. This delay has forced us park machinery for several days and to stop work on the Eastern Portion of the Landfill. Efforts are currently focused on grading of the 17 -acre property. It is the Contractor's opinion that, without the discussed revised grading plan, a large quantity of excess material will be generated in achieving the current grading plan. The Contractor will not be responsible for this excess material. We again request that this grading plan be provided so as to prevent further delay to the job. Dvirka and Bartilucci 330 Crossways Park Drive Woodbury, NY 11797-2015 Re: Southold Landfill Closure D&B No. 1314 Dear Mr. Maher: Terry Contracting and Materials, Inc. is in receipt of your letter dated March 14, 2002 concerning the placement of backfill in the anchor trenches. We take issue with your position that this backfilling was not performed in conformance with the landfill closure specification (Section 4.3 F -10a). The following points are made: 1. The first anchor trench on this job was excavated and backfilled during the early part of February. As all anchor trench currently required has been completed, it seems that you should have raised this issue at an earlier time. 2. At best, the referenced specification is ambiguous in its requirement to place the backfill in multiple lifts, as the only indication of this is that the word lift has been pluralized. The referenced specification offers no instruction on the size of these lifts, nor if these lifts should be uniform. 3. To bring our construction methods into conformance with this specification, as you have chosen to interpret it, would require only the spreading and compacting of an additional lift of material at any thickness (2" or 21) over what has previously been placed. This effort would offer no benefit to the integrity of the anchor trench. 4. The Contractor does concur that the backfill material needs to be compacted to 90 percent Standard Proctor. The Contractor maintains that this compaction requirement has been met. Further anchor trench will be installed once liner has been deployed on the remainder of the site. Please direct us as to how you would like the anchor trench installed in the future. Additional payment may be sought if your requirements vary from the Contract Specification. This work plan reflects comments received from your office on February 11, 2002. Drainaae Excavation and Installation 1. Open cut excavation with any unshored slopes greater than 4' high to be sloped back safely to 2H:1V. A trench box will be used over most or all of the run to reduce the open cut volume. 2. The excavation will be to a depth of: up to 22 feet and will average about 12 feet in-depth. 3. A11 excavations will conform to OSHA "regu'1-at:ions. 4. Excavation assumes 3H:1V cut-back in northeast corner of landfill from'"exi sting grades' pr or'`t­o 'work. Tlie'maximum -ground' disturbance 'is' test--ima-ted ,to -'be ;abou't x3.8:; feet wide centered along the pipe alignment, where the excavation•'is about -19 -feet deep. Landfill gas monitoring shall be performed in the excavation under compliance with OSHA regulations. 7. Any clean concrete or other rubble encountered from the old gas control trenches shall be deposited at the base of the landfill borrow pit area as part of reclamation as directed by the Engineer. A contingency item for removal of up to 2000 CY of this material and backfilling with clean material has been added to the estimate. 8. Backfill will be with native bank run that is excavated from the pipe trench. The number of passes of the bulldozer or tamping cycles with the excavator will need to be determined in the field. The excavation will be slightly mounded to accommodate settlement. Placement of Fill in Area of Former Recharge Basin #4 1. Fill for this area will be comprised of unscreened sand and loam excavated from the 17 -acre parcel. The maximum ratio for blending these materials will be 1:1. Blending of materials will take place during excavation. If any additional blending is required after excavation, additional charges will be incurred. 2. Material will be placed in approximate 1' lifts. Grades stakes will control lift thickness. 3. Compaction will be by rolling with a 10 -ton, minimum, vibratory compactor. Compaction efforts will proceed until the lift under construction presents a firm and unyielding surface. A firm and unyielding surface is defined as a maximum 2" of deflection under the action of the vibratory compactor as determined by the engineer. 4. A single lift will be placed and compacted in its entirety before proceeding with construction of the next lift. S. During operations in wet conditions, the Contractor may have the option of eliminating the loam material from the blend. The loam material is not compactable when wet. 6. When all available loam is used on the 17 -acre parcel, the Contractor will continue the filling operation using unscreened sand from the landfill stockpile located in the borrow pit and clean material resulting from the excavation of the gas migration control trenches. 7. Tensar BX1100 geogrid will be installed prior to placement of the final 2' of fill. The geogrid will extend a minimum of 20' beyond the fill area as directed by the Engineer. Geogrid installation will incur an additional charge. This proposal is made under separate cover. S. The top 2' of fill will be constructed of screened sand from the 17 -acre property and compacted to 95% Modified Proctor in accordance with ASTM D1557. 9. Payment for this work will be as per item 6 of the Contract Documents. This completes the work plan for installation of the eastern drainage system. As of this time, our request has gone unanswered. Current work involving the filling of former recharge basin *4 will be completed within 2-3 days. At this point,•,machinery, including two (2) off road haulers, one crawler excavator, and one bulldozer, will be placed on standby. All pipe penetrations into manholes and headwall wtll be grouted in place using a standard portland cement. 3. A rubber pipe seal will be clamped onto the pipe that penetrates the stilling basin. This, pipe seal will be greut*d. in place using a standard Portrl" Cement. 4. Drainage installat:3ot will be backfilled and completed as Specified. 5. A non -shrink construction grout wi,11 be installed on the interior surface of the pipe penetration into the stilling basin. All pipe -penetrations into manholes and headwall will be grouted in place using a standard portland cement. 3. A rubber pipe seal will be clamped onto the pipe that penetrates the stilling basin. I must dispute your claim that the area was -available on January 18, 2002 as.it' is still not available today. Our screening operation also had to slop'today because the southern area 'is too close to, the road to screen without the protection of the proposed berinsqiitwind'y.conditions. Based on the above, we had to park two (2) pay loaders, the screening.plant; two (2) 40 -ton haulers and a•hydraulic excavator today. This equipment could'have been shifted elsewhere on site if we had a decision on the driving range, so you can see the importance of getting that resolved soon. I realize I did not point out all the implications of your directions yesterday, because I was not expecting such a sudden change and had not thought of them at the time. As far as your comments regarding sand quantities and daily productions of our plant, I must state that those quantities did not come from us. We do need a decision on the town's intentions for screening.. Your direction.,does seem to conflict with the town board's authorization to produce 100,600 CY of screened sand.`for $3.65/cy at our meeting before them. I think we need to resolve some of these issues assoon as possible to mitigate the delays to both projects and continue with their'succe'ssful completion. Rolls slated for installation on the west hill were sampled in the presence of the Engineer on November 13, 2001 and have yet to be tested. As you are aware, this issue has been raised on several occasions with resulting confusion over which party, (Dvirka and Bartilucci or Tectonics), is responsible for conformance testing. Recent communications with you and with Tectonics' field representative indicate that Tectonics is responsible for conformance testing and does not wish to do so at this time. It has also been stated that Tectonics may perform conformance sampling and testing at a later date from material that has already been installed. We find this approach to conformance testing unacceptable and not valid under the contract documents. It is our position that the Engineer has now waved his right to perform conformance sampling and testing on this material and that such sampling and testing will not take place. We asked that Tectonic be onsite to retest because liner was scheduled to begin on Monday. Tectonic refused to work.Saturday and arrived late to work Monday to start testirkg this area. At the time it was the only issue remaining to began liner installation. I must remind you that you agreed to pay for Saturday's work if my assertions regarding Tectonics' Compaction. Dvi-rka and Bartilucci 330 Crossways Park Drive Woodbury, NY 11797-2015 Re: Compaction Testing Dear Mr. Maher: As discussed we have experienced difficulty in achieving acceptable compaction test results over the past two (2) weeks. We have consistently maintained that our methods and means as conditionally approved by your office yield acceptable compaction results. As you recall there have been several arguments about this issue where Peter Sutherland has maintained that he had to "direct our lab in correctmethods, to use to arrive at a meaningful proctor for this material." Our lab has consistently maintained that Peter Sutherland is not correct in his application of the Standard or his use of the Troxler equipment on this material. I checked with Troxler Electronic Laboratories, Inc. regarding their equipment and its use on materials with high gravel content. They feel their equipment would normally be used in the backscatter mode because direct transmission may disturb the aggregate and lower the density. At my request Tectonic tried this yesterday and- was not able to get a reading from the machine. The machine would not operate properly in the backscatter mode. Another question both Universal and Troxler wanted to know was how were the results of the cone tests as compared to the Troxler readings. Why didn't Tectonic run some sand cone tests, as is the normal procedure? Another serious flaw.in this process has been Peter Sutherland's insistence on a gravel correction being performed on the material. I went online to the ASTM web site to review the relevant documents, referenced in the project specifications'. I have enclosed copies of the relevant standards foryour reference: A review of test method D698 -00A Standard Test Methods for Laboratory Compaction Characteristics of Soil Using Standard Effort (12,400 ft-lbf/ft3 (600 KN-M/M3)) seems to indicate under section 1.2 Note 3 that for soils with 30% or less by weight of material retained on the 3/4- inch sieve we should see Practice D4718. A review of Practice D4718-87 (2001) Standard Practice for Correction of Unit Weight and Water Content for Soils Containing Oversize Particles under section 1.3 indicates that our -materials do not meet the criteria to be considered. for a gravel correction. The "practice- is applicable: to soils and soil -rock mixtures­iil which . up to 40% of the material is retained. -ori the No.4 sieve." That means at least 60% of the materials must pass the No.4 Sieve to fulfill the soil fraction of the soil -rock mixtures. To ignore this criteria would mean we could apply the standard to a combined mixture of/2" to 1" gravel without any soil component at all. I ihink we could agree that the Standard is written so as to avoid such an error. In. fact, there is .an appendix to this standard that I Y have enclosed that further substantiates the criteria for using the gravel correction. The section is x1.2 and states, "The upper limit of oversize particles in this practice has been set at 40% of the plus No. 4 material and 30% of the plus 3/4 inch material." It seems that they intend that both criteria be met. Every sample of the contour grading material tested failed to meet the basic minimum criteria necessary for performing a gravel correction. We tested nine (9) samples and not a single one retained less than 40% on the NoA Sieve, which indicates that the gravel portion of this material is too high to do a gravel correction on it. Peter Sutherland directed our lab to the standard and how he wanted it performed. It appears to me that he was completely in error and caused at least a two (2) - week delay on the job and the considerable expense of adding water and rolling this material. As you know, the gas venting materials now being placed are all passing at greater than 96% with no water added or rolling. It certainly requires less effort to compact bank run sand than screened sand yet we have expended tremendous efforts to achieve a lower value (90%) in the bank run (contour. grading material) than in the venting sand. I have spoken to Larry Mercandante at Universal laboratories, Inc. about this and he confirmed for me that Peter Sutherland specifically directed him as to how he wanted the gravel correction done. A letter from Larry Mercardante will follow. I think what I have outlined above speaks for itself. At this time I must reserve the right to make a claim for extra money and time, however, I would like to wait and see how the job progresses from this point forward before making a decision on whether to pursue this claim or not. An additional basis for this claim is the fact that the use of the 17 -acre materials was never contemplated at the time we bid for this project. However, I think it is unfair for the Town to have to pay extra for our working with a better material just because Tectonic failed to properly test the compaction of the material and caused us to incur additional expense trying to satisfy them. I look forward to your response to this letter and hope we can move on to a more productive working relationship on the job. I know you and I have discussed a mutual desire for this to happen. Using a nuclear density gauge in a direct transmission mode may cause the movement of the larger gravel particles during drill rod insertion causing a void and recording a lower density reading. Backscatter tests along with direct transmission tests would provide a better correlation. Direct transmission tests sites should be dug up and visually examined to determine, if the test material is. representative of the full material in general and if rock correction is required. The use of the sand -cone test method (ASTM D1556) may also prove to be helpful.
