MINUTES OF JULY 26, 2001

1. Opening Discussions
• D&B pointed out delay in operational status of office trailers. Terry indicated all
efforts were being made to expedite power and telephone connections. Terry
indicated a Nextel cell phone would be provided to Jim Mulligan on 7/29/01 for
his use.
• D&B expressed concerns about the lack of a site superintendent and confusion
regarding lines of communication. Terry indicated that beginning the next day,
Tim Howell would be on-site full time and would be the primary contact for
D&B's field inspectors.
• D&B expressed concerns about the lack of a designated on-site health and safety
officer. Terry indicated that Mike Jones was responsible for health and safety on
site and that Mr. Jones has the proper training for this responsibility.
D&B stated that appropriate notification was not being provided on a daily and
weekly basis regarding scheduled activities on the site. Terry stated that a weekly
look ahead schedule would be provided on 7/29/01 and thereafter routinely on
Fridays and that Mr. Howell would begin to provide daily information, on
scheduled work activities.
2. Fencing of Cox Lane Access Route
D&B stated that placement of fence along access route is required as soon as
possible. Terry stated installation is being hampered by adjacent property owners.

D&B agreed to follow up with Town regarding materials and equipment of
neighboring property owners.
3. Installation of Construction Fence
Terry noted that temporary green plastic fence was being installed today near trailers
and in landfill areas. D&B pointed out that orange colored fence is required in specs.
Terry agreed to replace with orange fencing.
4. Installation of Signs
Terry stated signs for Access Route at Cox Lane will be installed by July 27, 2001,
and other signs are being manufactured and will be installed in the near future.
5. Survey for Topsoil Removed from 17 -acre Parcel
Terry submitted survey results which showed 12,887 cu. yds. of topsoil removed
from 17 -acre parcel and stockpiled in northwest corner of borrow pit area.
6. Daily Cover Thickness
Agreement was reached with Igor ' Sikiric of NYSDEC that spec requirement of
6 -inch minimum daily cover could be waived and less than 6 -inch cover applied so
long as waste is not exposed and intent of specifications is satisfied.
7. Staking of `Buffer Area" for Exclusion of Loam
and Topsoil/Use of Sand from Borrow Area
It was agreed by Terry that the topsoil and loam exclusion area would be staked.
Stakes will be placed by Terry every 100 feet. Terry also acknowledged that sand
brought over from the borrow area will be spread and compacted to satisfy the
applicable specification requirements.
8. Placement of Loam (Compaction)
D&B stated that Tectonic suggested a spec that essentially would require a maximum
3 -inch deflection after contractor placed loam in 2 -foot lifts and compacted each with
6 passes. Not agreed on by Terry at meeting, but will consider.
9. Working Hours
D&B indicated Terry must adhere to normal work hours unless approved in advance
for deviation. It was noted that Terry had installed the temporary gate by the Cox
Lane access route on Saturday, July 21, 2001, with no advance notice to anyone and
such occurrences are not acceptable.

10. Site Superintendent and Lines of Communications (2 -Way Radio)

11. Trailer Hookup (Electric and Telephone), Furnishings and Keys
Terry indicated LIPA requires installation of a pole near the trailer, which will be
completed shortly, before electric can be hooked up. According to Terry, Verizon
(telephone) was to be at the site that day to review their hookup requirements.
12. Dust Control/Air Monitoring/Health and Safety
• According to Terry, a water tank was delivered to the site that day. Terry also
stated they are trying to set up an irrigation system, needed primarily for dust
control while working on the 17 -acre parcel, by using water from the existing
Town well on-site.
• Mike Jones, Terry's foreman/equipment operator, will be monitoring for
combustible gases on-site.
• Terry suggested looking into installation of fire hydrant on CR48. Town and
D&B acknowledged.
• D&B cautioned Terry about use of electric generator on-site in areas where
combustible gases may be present.
13. On-site Maintenance of Equipment
Terry stated no major equipment maintenance would be performed on-site.
14. Town Access to 17 -Acre Parcel (Temporary and Permanent)
Town acknowledged options must be presented to the Town Board and Town
Supervisor since work would involve a major expenditure for all options.
15. Limits of Work Boundaries for Contractor's Equipment)
D&B pointed out that a safety fence is needed when work is performed near limits of
work.

Terry agreed to have the borrow pit area staked to be sure that material taken from the
pit ultimately conforms to the grading plan for that area.
