would you prefer I place this on as an add-on agenda item for the PB work session 11/13/07?
Please advise me on the above referenced issue and be advised it needs to be signed and dated

Hi Heather,
Per our conversation this morning I will add it on to the work session for verbal comments
from the PB.
After further research the Town Code dictates under Section 280-69(C) that " a wireless
communication facility is subject to site plan approval"
The wireless communication facility is defined in the 280- definitions and includes the entire
compound.
This would require a site plan and I will survey the PB for comments by telephone before the
final decision to have it as an add on agenda item.

I found out this is the BCI site from Mike. Since the Town Board issued the exemption from
the moratorium, we must proceed with the site plan as dictated by code. The Planning Board
has no authority to do anything else as far as I know.
That being said, I would rather respond to the SPUD as usual without bringing it to the
Planning Board Tuesday night.

In response to your letter dated September 13, 2007 for a report, the Planning Board (PB) held a Work
Session on October 15, 2007 to review the e-mail received from the applicant dated October 1; 2007 in
reference to the waiver request, and offer the following comments:
The moratorium was enacted to protect the health, safety and welfare of the Town and to enable the
Town to formulate a plan for the most efficient installation of cell towers throughout Southold. The
Planning Board feels that no additions or up -grades to the Town Cellular Network should be
completed until after the end of the moratorium. The Planning Board does not support a waiver at
this time.
We hope these comments will be useful to the Town Board in the review of this waiver.

Subject: Cell Tower waiver request from BCI
After a long conversation with a company that provides advice to local governments for
wireless communication issues (see planwireless.com), I am certain the antenna replacement
and cabinet construction are to modify the existing service, and not just an equipment
replacement. I don't think they should be granted a waiver to the moratorium. They have not
demonstrated any economic hardship, their antenna is functioning, and it is for this very reason
— our inability to accurately judge what the Town really needs in terms of wireless service —
that we placed a moratorium on more towers, and are commissioning a study.

In response to your letter dated September 13, 2007 for a report, the Planning Board (PB) held a work
session on September 24, 2007 to review the waiver request and issues this report with the following
comments:
• The PB is not currently processing a site plan application for the replacement antennas and
the addition of one equipment cabinet as described in the letter from BCI Communications,
dated August 27, 2007. Additionally the Building Department would need to determine if a
site plan is required for the proposed construction.
• On April 10, 1992, the Building Department issued a Building Permit under BP# 20540 and
a Certificate of Occupancy under CO# 29392 to construct a monopole radio tower antenna.
The Planning Department has no record of site plan approval for the actual Tower and first
cellular vendor.
• On August 12, 2002, site plan approval was granted for Nextel Communications to affix a
second wireless telecommunications antennae to an existing monopole. See attached
resolution A 1 - A-2.
• On May 13, 2003, site plan approval was granted for Omnipoint Communications, Inc. to
affix the third wireless telecommunications antennas to an existing monopole. See attached
resolution A-3 - A-4.
• On April 12, 2005 site plan approval was granted for LIN Cellular Communications, Inc. for
installation of new equipment to include a forth antenna. See attached resolution A-5 - A-7.
• On July 27, 2006 the Building Department issued a Certificate of Occupancy (CO.) under
Z-31711 for the T Mobile collocation of an antenna and received payment issued to the
Town that returned because of a "Closed Account". Be advised that the Town Attorney and
the Town Clerk have been unable to resolve this delinquent payment to date and the C.O.
was never released bythe Building Department. The Planning Board suggests that the Town
Board condition the waiver upon payment of outstanding fees and issuance of outstanding
C.O. For your review attached is a copy of the co noted above and two memos from the

• The Planning Board has had an issue with the landscape screening not surviving at this site
and feels the equipment cabinets and base of the tower area could be screened from view
and maintained as such.
• Be aware that the existing Tower site is along the County48 Road scenic corridor.
• Unlike the new style Flag Pole Cellular Communication Towers constructed with the
antennas internally mounted, which hides the antenna from view, this old Tower design has
the antennas affixed to the outside which adds to the visual impact.
The moratorium was enacted to protect the health, safety and welfare of the Town, and to
enable the Town to formulate a plan for the most efficient installation of cell towers throughout
Southold. We feel that more information should be provided to help us determine whether this
installation will affect the Town's efforts to effectively plan for cell towers. The Planning Board
believes that all outstanding fees must be collected and a proper C.O. issued before the waiver is
considered. The questions we have are the following:

1. Are the replacement antenna and new equipment box "in-kind" replacements with
no enhancement to the range or technology currently existing at the site?
2. Is the replacement antenna higher than the existing? We could not determine the
height of the existing antenna from the plans.
3. Will the new replacement antenna produce the exact same coverage area or will it be
a larger coverage area? It would not be fair to allow construction of a more powerful
antenna during the moratorium.
4. How will the replacement antenna affect the future cellular tower locations within
our Town?
5. Can the replacement antennas be installed inside the structure to enhance the visual
affect?
6. Would the vendors consider replacement of the old tower structure for a new style
with tower with concealed antennas?
The Planning Board does not have sufficient information to make a recommendation to the Town Board at
this time. We hope these comments will be useful to the Town Board in the review of this waiver.

The following resolution was adopted by the Southold Town Planning Board at a
meeting held on Monday, August 12, 2002.
The final public hearing was closed.
The following resolution was adopted:
WHEREAS, Nextel Communications is the lease holder and Arthur Junge is the owner
of the property known and designated as Nextel Antenna Site, located on the north side
of CR 48 in Cutchogue; and
WHEREAS, this site plan for Nextel Communications is to affix a wireless
telecommunications antenna to an existing monopole and install a related equipment
shelter; and
WHEREAS, this site plan was certified by the Building Department on August 12, 2002;
and
WHEREAS, the Town Engineer has reviewed the drainage calculations and the
Planning Board has accepted his recommendation for approval; and
WHEREAS, the Southold Town Planning Board has determined that this action is a
Type 11 Action and not subject to review under the State Environmental Quality Review
Act, (Article 8), Part 617; and

WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold
have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant final approval on the
surveys, dated May 22, 2001 and last revised August 22, 2001, and authorize the
Chairman to endorse the final surveys subject to a one year review from the date of the
building permit.
Enclosed please find two copies of the approved site plan; one for your records and one
to be submitted to the Building Department when you apply for your building permit.

RESOLVED that the Southold Town Planning Board, acting under the State
Environmental Quality Review Act (6NYCRR), Part 617.5 C-11, makes a determination
that the proposed action is a Type II and not subject to review; and be it therefore

WHEREAS, on February 11, 2005, the Southold Town Engineering Inspector reviewed
and approved the proposed drainage and the Planning Board has accepted his
recommendation; and
WHEREAS, on February 18, 2005, the Planning Board received a structural analysis
report and letter from Infinigy Engineering certified by Oscar Pedraza, a licensed
professional engineer, with several attachments to substantiate the report and the
Planning Board has accepted this report and has incorporated this in the site plan
approval; and
WHEREAS, on February 22, 2005, the Cutchogue Fire District recommended that no
additional fire well will be needed and the Planning Board has accepted this
recommendation; and
WHEREAS, on March 3, 2005, the Architectural Review Committee reviewed the site
plan materials and determined there are no architectural features requiring comments
and the Planning Board has accepted this approval; and
WHEREAS, on March 14, 2005, the Southold Town Building Inspector reviewed and
certified the site plan for "wireless communication equipment facility" use; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, the following two items are incorporated and included in the site plan:
1. All outdoor lighting shall be shielded so that the light source is not visible from
adjacent properties and roadways. Lighting fixtures shall focus and direct the
light in such a manner as to contain the light and glare within property
boundaries. The lighting must meet the Town Code requirements.
2. The applicant, agent and owner will install 6' high balled cedars instead of the
arborvitae detailed on the landscaping plan prepared by Infinigy Engineering,
certified by Paul M. Penman, Licensed Professional Engineer, dated September
28, 2004 and last revised January 10, 2005. In addition, the landscape will be
guaranteed for two years to ensure survivability; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold
have been met; be it therefore further
RESOLVED that the Southold Town Planning Board grant final approval on the site plan
prepared by Infinigy Engineering, certified by Paul M. Penman, Licensed Professional
Engineer, dated September 28, 2004 and last revised January 10, 2005; and authorize
the Chairperson to endorse the final site plans subject to a one year review.

I am sorry to be bothering you with this but I don't have an address or
contact number for the wireless communications antennas placed on your
property. The bank has returned T -Mobile's check no. 031259 in the amount of
$50.00 due to "Closed Account". The check was payment for a Certificate of
Occupancy issued by the Southold Town Building Deparatment. This office is
required to collect the money for the check and a $20 returned check charge for
each check. Payment must be cash, money order, or certified check. The total
amount due is $70.00 ($50.00 + 20.00). Payment must be received by the
close of business on Monday, August 28, 2006.
Failure to pay this amount within the specified time will result in the
referral to the Town Attorney's Office for collection and the Certificate of
Occupancy will be revoked.

The Southold Town Board held a public hearing on Tuesday, September 11, 2007 on the BCI
Communications_application for Waiver of Moratorium on Wireless Communications. The
public hearing was opened and testimony was taken. However, the Town Board held the
public hearing open and reserved decision on the application for referral to the Southold
Town Planning Board for their report and recommendation on the matter.
Please have the Planning Board review the enclosed copy of the file and send their report and
recommendation to the Southold Town Board. The next regular meeting of the Southold
Town Board will be held on September 25, 2007.

Today your office advised that the Town of Southold currently has a 180 days moratorium
against construction of cell sites within the Southold Township.
Nextel of New York. Inc, has a Cell site facility at the referenced address, managed by Crown
Atlantic Company LLC.
BCI Communications, Inc., Nextel's agent, is preparing a Building Permit Application to
perform equipment maintenance at the reference site.
The plan is to swap out the antennas, 12 p/n DB845N65ZAXT to 9 p/n RR65-as-OODBL and
3 p/n RR65-18-04DPL2 and also add one equipment cabinet into Nextel's existing shelter.
(See attached EX1 Drawing). There are no new construction or expansion efforts in our
plans.
Please review the above description and advise if Nextel can proceed with their plans.

Attached please find a letter sent 8/7/07 to the Southold Building Department, Mr. Michael
Vinity of the Building Department replied via phone to advise unfortunately that Nextel's plans
fall into the 180 day moratorium criteria the town has imposed.
I have called left messages to request a waiver to the moratorium. As the attached letter
states there are no new construction or expansion efforts in the plans for the facility.
I would appreciate your approval for the requested waiver. If you have any questions please

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee. according to schedule.

c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work:
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the, extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
