After further research the Town Code dictates under Section 280-69(C) that " a wireless communication facility is subject to site plan approval" The wireless communication facility is defined in the 280- definitions and includes the entire compound. This would require a site plan and I will survey the PB for comments by telephone before the final decision to have it as an add on agenda item. I don't think they should be granted a waiver to the moratorium. They have not demonstrated any economic hardship, their antenna is functioning, and it is for this very reason — our inability to accurately judge what the Town really needs in terms of wireless service — that we placed a moratorium on more towers, and are commissioning a study. A 8 - A 10 • The Planning Board has had an issue with the landscape screening not surviving at this site and feels the equipment cabinets and base of the tower area could be screened from view and maintained as such. • Be aware that the existing Tower site is along the County48 Road scenic corridor. • Unlike the new style Flag Pole Cellular Communication Towers constructed with the antennas internally mounted, which hides the antenna from view, this old Tower design has the antennas affixed to the outside which adds to the visual impact. The moratorium was enacted to protect the health, safety and welfare of the Town, and to enable the Town to formulate a plan for the most efficient installation of cell towers throughout Southold. We feel that more information should be provided to help us determine whether this installation will affect the Town's efforts to effectively plan for cell towers. The Planning Board believes that all outstanding fees must be collected and a proper C.O. issued before the waiver is considered. The questions we have are the following: The questions we have are the following: 1. Are the replacement antenna and new equipment box "in-kind" replacements with no enhancement to the range or technology currently existing at the site? 2. Is the replacement antenna higher than the existing? We could not determine the height of the existing antenna from the plans. 3. Will the new replacement antenna produce the exact same coverage area or will it be a larger coverage area? It would not be fair to allow construction of a more powerful antenna during the moratorium. 4. How will the replacement antenna affect the future cellular tower locations within our Town? 5. Can the replacement antennas be installed inside the structure to enhance the visual affect? 6. Would the vendors consider replacement of the old tower structure for a new style with tower with concealed antennas? The Planning Board does not have sufficient information to make a recommendation to the Town Board at this time.
