(631) 765-1809 Fax (631) 765-9064 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of 'Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 7,673 sq. ft. parcel has 65.96 ft. along the west side of Village Lane, 45.34 feet along the rear property line adjacent to land of the Oyster Ponds Historical Society, 138.84 feet along the northerly side line, and 137.90 feet along the southerly side line. BASIS OF APPLICATION: Building Department's July 20, 2004 Notice of Disapproval, citing Sections 100-242A and 100-2448, in _its denial of a building permit to construct a porch addition to dwelling for the reason that the addition will constitute an increase in the degree of nonconformance with a proposed .25% lot coverage, in excess of the code limitation of 20%. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 19, 2004 at which time written and oral evidence were .presented. Based upon all testimony, documentation, personal inspection. of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a 7' x,10' new porch addition, replacing the existing step area at the rear of the dwelling. The setbacks to the property line will not be changed because the addition will maintain the same lines of the house for the new porch.
