This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage -disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of I% lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non -conforming uses, or buildings and "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
.sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of 'Actions,
without an adverse effect on the environment if the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 7,673 sq. ft. parcel has 65.96 ft. along the west
side of Village Lane, 45.34 feet along the rear property line adjacent to land of the Oyster Ponds
Historical Society, 138.84 feet along the northerly side line, and 137.90 feet along the southerly side

dwelling for the reason that the addition will constitute an increase in the degree of nonconformance
with a proposed .25% lot coverage, in excess of the code limitation of 20%.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on August 19, 2004 at which
time written and oral evidence were .presented. Based upon all testimony, documentation, personal
inspection. of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a 7' x,10' new porch
addition, replacing the existing step area at the rear of the dwelling. The setbacks to the property
line will not be changed because the addition will maintain the same lines of the house for the new
porch.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an Undesirable change in the character of the
neighborhood or a detriment to nearby properties. The proposed porch addition will be built within a
7'x 10' pitch of the existing dwelling and will square off the exterior dimensions of the rear, one-story
part of the dwelling. The new porch will replace a.smaller 14 sq. ft. porch. The change will not

create any new nonconformance with respect to required setbacks, and will be in keeping with the
character of the village hamlet neighborhood.
2. The benefit sought _by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The applicant's lot coverage on this 7,673 sq. ft.
parcel is currently 24+- percent. Because of the small size of the lot, without the variance a new
porch addition would not be possible.
3. The variance granted herein is not substantial and represents a one -percent increase over the
existing lot coverage of 24+- percent. The actual increase in lot coverage is an area of.56 sq. ft. (70
sq. ft. proposed porch less 14 sq. ft. of existing porch to be removed results in 56 sq. ft.).
4. The alleged difficulty has been self-created and is due 'to the applicant's wish to improve their
home in excess of the'code limitation.
5. No evidence has been submitted to suggest that the relief granted will have an adverse impact
on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a new porch addition, while preserving and protecting the character
of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town .Law 267-B, motion was offered by Member Tortora, seconded by
-Member Dinizio, and duly carried, to
GRANT the variance as applied for, as shown on the May 14, 2004 site map prepared by
James Garretson, Architect.
This action does not authorize or condone any current or future use, setback or other feature of the subject
property that may violate the.Zoning Code, other than such uses, setbacks and other features -as are expressly
addressed in this action.

Upon the application of James Garretson, filed pursuant to 19 NYCRR 1205 on August 6, 2004, and upon
all other papers in this matter, the Department makes the following determination:
NATURE OF GRIEVANCE AND RELIEF SOUGHT
The petition pertains to an addition to, and the alteration of, an existing one -family dwelling, two stories in
height, located at 1620 Village Lane, Town of Southold, County of Suffolk, State of New York.
The petitioner is seeking relief from:
19 NYCRR Part 1220, The Residential Code of New York State, Section R305.1, which requires that
habitable rooms shall have a ceiling height of not less than 7 feet 6 inches. [The petitioner requests
habitable space with ceiling heights less than required.]
FINDINGS OF FACT
1. Dormer additions are to be constructed on the second story of the subject building to allow the extension of
two existing bedrooms located on the second story.
2. The two bedrooms in question have an existing ceiling height of 7 feet.
3. The roof pitch of the existing dormer is only 3/12. Raising the ceiling height would cause the roof pitch of
the new dormers to be less than 3/12. The lower roof pitch would necessitate the use of different roofing
materials, and, aesthetically, would not match an existing dormer. Furthermore, the ceilings in the existing
rooms would be of two different heights.
4. The 7 feet ceiling height would represent only a 6.7 percent deviation from the required 7 feet 6 inches.
5. The petitioner argues that raising the roof to accommodate the required ceiling height would result in
practical and financial difficulty.
6. The petitioner has proposed to install hard wired smoke alarms in the bedrooms in question, which will be
interconnected with devices in the remainder of the dwelling in conformance with Section R317 of The

Residential Code of New York State.
7. The petitioner proposes that an emergency escape and rescue opening, complying with Section R310 of
The Residential Code of New York State, will be provided.in each of the existing bedrooms.
8. The petitioner has proposed that the addition and alterations will meet all other applicable provisions of The
Residential Code of New York State.
The local code enforcement official has been consulted in this matter and does not object to the granting of
a routine variance under the provisions of 19 NYCRR 1205.
CONCLUSIONS OF LAW
Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a
negligible additional health, safety and security benefit to the occupants of the building.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220, Section
R305.1, to permit habitable spaces with ceiling heights less than required, be and is hereby PROPOSED TO BE
GRANTED with the following conditions:
That hard wired smoke alarms be installed in the bedrooms in question which will be interconnected with
devices in the remainder of the dwelling in conformance with Section R317 of The Residential Code of New
York State.
2. That an emergency escape and rescue opening, complying with Section R310 of The Residential Code of
New York State, will be provided in each of the existing bedrooms
3. That the addition and alterations will meet all other applicable provisions of The Residential Code of New
York State.
This DECISION is issued under 19 NYCRR 1205.6. Unless obiected to by the petitioner in a writing
received by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the
parties.
This decision is limited to the specific building and application before it, as contained within the petition, and
should not be interpreted to give implied approval of any general plans or specifications presented in support of this

GENERAL CONSTRUCTION NOTES
1. The information on this set of construction documents is to relate basic design
intent and framing details. They are intended as a construction aid, not a substitute
for generally accepted good building practice and compliance with current New York
state building codes. The general contractor is responsible for providing standard
construction details and procedures to ensure a professionally finished, structurally
sound, and weatherproof completed product.
2. General Contractor to coordinate all sub contractors, scheduling of work, and
interaction between trades.
3. The general contractor is responsible for ensuring that all work and construction
meets or exceeds current federal, state,' and local codes, ordinances and regulations,
etc. These codes are to be considered';as part of the specifications for this building
and should be adhered to even if they are in variance with the plan.
4. Dimensions shall take precedent over scale drawings (do not scale drawings).
5. The designer has not been engaged for construction supervision and assumes no
responsibility for construction coordinating with these plans, nor responsibility for
construction means, methods, techniques, sequences, or procedures, or for safety'
precautions and programs in connection with the work. There are no warranties for a
specific use expressed or implied in the use of these plans.
6. Refer to floor plans, exterior elevations, and window schedule for types and sizes of
windows. All windows to be Andersen high performance quality or approved equal.
7. Door and window headers to align unless otherwise noted.
8. General contractor is to ensure that masonry and prefabricated fireplace
construction meets or exceeds all manufacturer's specifications and applicable codes.
9. General contractor to consult and coordinate with the owner and the plans for all
built in items such as bookcases, shelving, pantry, closets, etc.
10. Provide hardwired smoke detectors, with battery backup, on all floors and in each
bedroom, verify with local code requirements as per Section R317, New York State
Residential Construction Code. Install carbon monoxide detectors as per code.
GENERAL FOUNDATION NOTES
1. General contractor to review plans, elevations, and details to determine intended
heights of finished floor(s) above typical grade.
2. All footings to rest on undisturbed soil.
3. Provide Y2" expansion joint material between all concrete slabs and abutting
concrete or masonry walls occurring yin exterior or unheated interior areas.
4. Unless otherwise noted, all slabs on grade to be 2500 psi. Concrete on 4" sand or
gravel fill minimum, with 6x6 -10/ 10 wire mesh reinforcing. Interior slabs to be placed
on 6 mil. stabilized polyethylene vapor barrier.
5. Provide crawl space ventilation per local code requirements.
6. General contractor to install cop-r-tex (or copper) sheet metal termite shields
between all wood surfaces that are exposed to concrete or masonry surfaces.
7. Dampproof exterior of foundation with a bituminous coating as per code and soil
conditions.
GENERAL FLOOR PLAN NOTES
1. Dimensions shall take precedent over scale drawings (do not scale drawings).
2. All interior walls to be covered with Y2." gypsum board with metal comer reinforcing.
Tape, float, and sand (3 coats).
3. Walls common to garage and house to have a layer of 5/8", fire rated gypsum boarc
at garage side with 5'-0" return on adjacent walls and ceiling. Manufactured lumber
requires 2 layers of 5/8", fire rated gypsum board.
4. All bath and toilet area walls and ceilings adjacent to wet areas to have water
resistant gypsum board, or wall the set on wonderboard or equal.

GENERAL CONSTRUCTION NOTES
1. The information on this set of construction documents is to relate basic design
intent and framing details. They are intended as a construcUQn aid, not a substitute
for generally accepted good building practice and compliance with current New York
state building codes. The general contractor is responsible for providing standard
construction details and procedures to ensure a professionally finished, structurally
sound, and weatherproof completed product
2. General Contractor to coordinate all sub contractors, scheduling of work, and
interaction between trades.
3. The general contractor is responsible for ensuring that all work and construction
meets or exceeds current federal, state, and local codes, ordinances and regulations,
etc. These codes are to be considered as part of the specifications for this building
and should be adhered to even if they are in variance with the plan.
4. Dimensions shall take precedent over scale drawings (do not scale drawings).
5. The designer has not been engaged for construction supervision and assumes no
responsibility for construction coordinating with these plans, nor responsibility for
construction means, methods, techniques, sequences, or procedures, or for safety,
precautions and programs in connection with the work. There are no warranties for a
specific use expressed or implied in the use of these plans.
6. Refer to floor plans, exterior elevations, and window schedule for types and sizes of
windows. All windows to be Andersen high performance quality or approved equal.
7. Door and window headers to align unless otherwise noted.
8. General contractor is to ensure that masonry and prefabricated fireplace
construction meets or exceeds all manufacturer's specifications and applicable codes.
9. General contractor to consult and coordinate with the owner and the plans for all
built in items such as bookcases, shelving, pantry, closets, etc.
10. Provide hardwired smoke detectors, with battery backup, on all floors and in each
bedroom, verify with local code requirements as per Section R317, New York State
Residential Construction Code. Install carbon monoxide detectors as per code.
GENERAL FOUNDATION NOTES
1: General contractor to review plans, elevations, and details to determine intended
heights of finished floor(s) above typical grade.
2. All footings to rest on undisturbed soil.
3. Provide Y2" expansion joint material between all concrete slabs and abutting
concrete or masonry walls occurring in exterior or unheated interior areas.
4. Unless otherwise noted, all slabs on grade to be 2500 psi. Concrete on 4" sand or
gravel fill minimum, with 6x6 -10/ 10 wire mesh reinforcing. Interior slabs to be placed
on 6 mil. stabilized polyethylene vapor barrier.
5. Provide crawl space ventilation per local code requirements.
6. General contractor to install cop-r-tex (or,copper) sheet metal termite shields
between all wood surfaces that are exposed to concrete or masonry surfaces.
7. Dampproof exterior of foundation with a bituminous coating as per code and soil
conditions.
GENERAL FLOOR PLAN NOTES
1. Dimensions shall take precedent over scale drawings (do not scale drawings).
2. All interior walls to be covered with 1/7" gypsum board with metal comer reinforcing.
Tape, float, and sand (3 coats).
3. Walls common to garage and house to have a layer of 6W, fire rated gypsum board
at garage side with 5'4" return on adjacent walls and ceiling. Manufactured lumber
requires 2 layers of 518", fire rated gypsum board.
4. All bath and toilet area walls and ceilings adjacent to wet areas to have water
resistant gypsum board, or wall the set on wonderboard or equal.
