Specifically, the applicant must provide the following additional information: a. A copy of its FCC license or other suitable evidence that the carrier is duly licensed under the FCC regulations to provide the proposed services in the proposed location. b.• Provide an analysis of the Maximum Permissible Exposure to radio frequency emissions that fully complies with. Town Code §280-7 LH (1)-. (4): In particular, the analysis must address the cumulative effects of all emitters (including the existing AT&T facilities) on, or proposed to be, on, the site. The analysis must also address any potential exposure to persons inside the church building and/or steeple, -including the general public, church staff and outside contractors who may have a need to be in or near the facility. c. Provide an access control plan, including the text of any warning signage that will prevent inadvertent radio frequency exposure to persons not trained in radio frequency safety.' . d. Submit complete'specifications, including material, color and texture of the proposed RF compatible concealment material as. well as photos and architectural renderings showing the appearance of the building before and after construction. e. .On the plan show the cable routing between the equipment room and. the.antennas including any means of concealment and protection proposed, such as. metal wireway. f. Provide a full description of the battery plant (type of batteries, how they are.charged, etc.) and details regarding the safeguards in place, and any hazard mitigation that might be necessary. g. , Submit a description of the service needs of the carrier and current gaps or deficiencies on Fishers Island, and describe how the proposed facility will address this need. Box 1179 Southold; New York 11971 Via e-mail RE: Town of Southold — Omnipoint Communications at Our Lady of Grace Church Oriental Avenue, Fishers Island SCTM#1000-9-7-11.1 Dear Ms. Lanza: I have reviewed the plans dated December 17, 2008, which were submitted for the proposed Omnipoint wireless facility, and offer the following comments and recommendations. General Comment: The plans describe a good solution for minimizing the visual impact of the proposed facility,. but the application appears to be incomplete. The application does not include all the reasonably available information that the Town will need in order to determine if the proposed facility meets the General Requirements. (§280-7 1) and Requirements for Permitted Uses (§280-72) of Town's wireless law. Also, it is in the Town's best interests to understand the applicant's service needs and the degree to which the proposed facility meets these needs.. The Town should not consider the application complete until these matters are resolved. Specific Comments: 1. The application does not include evidence, as required by §280-71 A, that the applicant a carrier duly licensed under the FCC Regulations to provide the proposed services in the proposed location The applicant should be asked to submit a copy of its FCC license or other suitable evidence. 2.. The proposed facility would not comply with §280-71 C(3) because the wireless equipment would be located less than 500 feet from adjacent residential buildings Ms. Heather Lanza Town of Southold May 11, 2009 Page 2 Since the wireless equipment is to be completely concealed inside the church building, the Town may want to consider waiving this requirement as long as the Town finds that there will be no adverse impact from electromagnetic radiation or other unacceptable impacts on the residences._ 3. The application does not comply with §280-71H which requires the applicant to demonstrate that radio frequency emissions would fall within the Maximum Permissible Exposure (MPE) limits established by the FCC. The applicant should be asked to fully comply with §280-71 H(1)-(4). In particular the MPE analysis must address the cumulative effects of all emitters (including the existing AT&T facilities) on, or proposed to be on, the site. The analysis should also address any potential exposure to persons inside the church building and/or steeple, including the general public, church staff and outside contractors who may have a need to be in the facility. The applicant should also provide an access .control plan, including the text of any warning signage that will preclude inadvertent radio frequency exposure to persons not trained in radiofrequency safety. 4. The application does not show that outward appearance of the existing building will remain identical or nearly identical to its appearance prior to the construction of the facility as required by §280-72 c. Notes on the plans (Sheet SP -3) state .that an RF compatible concealment material will replace the existing wood steeple, but no material specifications are provided. In addition', no routing for the antenna cables is shown and itis not clear if they would be routed inside or outside the building. The applicant should be asked to submit complete specifications, including material, color and texture ofthe proposed RF compatible concealment material as well as photos and architectural renderings showing the appearance of the building before and after construction. In addition, the applicant should be asked to revise the plans to show the.cable routing between the equipment room and the antennas, including any means of concealment and protection proposed, such as metal wireway. The plans (Sheet SP -2) indicate that there will be a battery rack in the equipment room, but the types of batteries are not identified. Are these wet cell batteries? Will they produce fumes or the risk of chemical spills? W ill containment measures and/or special ventilation be required? The applicant should be asked to fully describe the battery plant and provide assurances acceptable to the Town that the installation will not create any unacceptable hazards. Although it is not specifically required under §280-71 or §280-72, it would be beneficial to the Town to understand the service deficiency the proposed installation would address and the degree to which the facility would cure the deficiency. This will help :provide an understanding of the level of service available from Omnipoint within the town and help the Town in planning* where future facilities may need to be located. - The town should ask the applicant to submit a description of its service needs and current gaps ox deficiencies on Fishers Island as'ivell as a description of how the proposed facility would address this need.. The applicant should be'asked to include "before" and "after"propagation neaps, drive test maps and other appropriate data. Conclusion: The Town should receive and review the requested data before taking final action on this application: Please let me know if there are any questions. or comments, or I have missed anything else that needs to be addressed.
