Orient on Sunday, July 5, 2015 staging to begin at 12:00 pm on Oysterponds Lane, from there
to Main Road to Village Lane to the end of Village Lane, provided they follow all the conditions
in the Town's Policy for Special Events on Town Properties Failure to comply with the
conditions will result in the forfeiture of the clean-up deposit and denial of future requests. In
addition, the police will post "No Parking" signs the night before the event as requested.

SUPERVISOR RUSSELL: With that, I am going to invite anybody that would like to address
the Town Board to please feel free.
Jill Franke, Southold
JILL FRANKE: Jill Franke, Southold. The family medical leave, is that a full-time employee or
a part-time employee?
SUPERVISOR RUSSELL: Full-time.
MS. FRANKE: Full-time, okay. And the three court officers that you are "hiring, it's 17 1/z
hours. Are you rotating them?
SUPERVISOR RUSSELL: Yes.
MS. FRANKE: And that's just for court days.
SUPERVISOR RUSSELL: Yes. And on an as needed basis of the Justice Court.
MS. FRANKE: Okay. And the contract for the Animal Shelter, what is that for?
SUPERVISOR RUSSELL: We have an existing contract for operation, they manage the shelter
for us. The terms of that contract are up; so we have extended the existing contract another 60
days to give us time to renegotiate.
MS. FRANKE: Okay. And you have rats out front. We just saw them out in the bushes.
Linda Goldsmith, East Marion
LINDA GOLDSMITH: Hi, Linda Goldsmith from East Marion. I wanted to ask if the
installation of the poles that were sort of a bone of contention, have they been installed? The
PSEG poles that supposedly contained the harmful chemicals.
SUPERVISOR RUSSELL: I don't know if they started the project yet. I can find out for you
tomorrow.
MS. GOLDSMITH: Have any of the other east end towns followed your lead and decided to go
ahead with it even though they had decided not to in the first place?
SUPERVISOR RUSSELL: Yes. Actually the issue wasn't to, none of the towns took a position
with the exception of East Hampton that we should not move forward with the project, what the
Supervisor's call for was a delay in the project to look at comparable alternatives to the use of
Penta. There is none on the market right now. this is going to be paid for by Sandy resiliency
money and the issue on the table was PSEG told us we can either move forward now or just
simply not do it at all but that money will go away, we won't be able to do it again. so the
Supervisor's, I know Riverhead and Brookhaven and Southold decided that we couldn't forgo
the opportunity to reinforce the infrastructure, the electric infrastructure out here, to create better
dependability during "storm events.

MS. GOLDSMITH: Did the Suffolk County Water Authority have any opinion on this?
SUPERVISOR RUSSELL: I believe that they, I can't speak for them...
MS. GOLDSMITH: And I am assuming that for this chemical, the Suffolk County Water
Authority will be testing the public wells in this area?
SUPERVISOR RUSSELL: I think they have historically tested for Penta, yes.
MS. GOLDSMITH: But those of us that still have the private wells and do not have the
opportunity to hook-up will be responsible for testing our own wells for this chemical, is that
correct?
SUPERVISOR RUSSELL: I would assume, under the terms. They are a public authority, they
are given broad, you know, it's all under the aegis of LIPA. I know they did some testing in East
Hampton, they found trace amounts in and around the poles. There was compounds, they didn't
find Penta in the water table there but they found, I guess, markers that would indicate that Penta
might invade the groundwater but the New York State Department of Health could not determine
that Penta was the source or not because it's, they were chemicals that might be found in the
actual atmosphere or by another contaminant.
MS. GOLDSMITH: Would you know if these Penta, these poles with these chemicals have been
used for any length of time anywhere else?
SUPERVISOR RUSSELL: The lifespan? I do not know.
MS. GOLDSMITH: No, I don't mean that, I mean having been put in and been there for 20
years, has anyone tested that, or is that something new? Is this a relatively new treatment on
telephone poles?
SUPERVISOR RUSSELL: No, it's a treatment that has been used for years. I think it's just
greater awareness now of why it's being more focused on. Federal government did an
environmental impact statement on it years ago, they approved its use. They did note in that EIS
however, that is should be subject to further testing. The position of the Supervisor's
Association and mine is that first of all, I would support a statewide ban of the product. I do not
believe you are going to see another comparable product unless the market demands one. But I
would also urge the, and I have, urge the federal government to update the EIS to consider and
include more of the knowledge that they have now that they might not have when it was done
maybe 1.5 or 20 years ago.
MS. GOLDSMITH: You also approved using these poles in Southold Town, is that correct?
SUPERVISOR RUSSELL: We are not in a position of approving it, we simply have stood down
on our opposition. Frankly, we are not in a position to stop it or approve it. We made a rallying
cry to say wait a second, put the brakes on this to see what other products are out there. PSEG

made it clear there are no other products. They said we have two options here, move forward
with the project or scrap the project. The problem we have is I have been through some pretty
significant storm events out here and the lack of reliable electric poses, from my position, a
greater immediate risk to public safety, health and welfare. We have to create warming centers,
we have to create cooling centers. We have to create special needs shelters, all those things
during the storm events because of, in some instances, the lack of reliability. Particularly around
the Bayview area and some of the areas where they are going to make the upgrades. If people go
7-8 days without electric, it's a long time.
MS. GOLDSMITH: Thank you.
SUPERVISOR RUSSELL: Thank you. Anybody else?
Kerry Nevar, Mattituck
KERRY NAVARRE: Kerry Navarre, Mattituck. 'Is this the proposal on the transient legislation
law, is that the whole thing?
SUPERVISOR RUSSELL: That you have in front of you? Yes, that should be the whole thing,
that's part of the public notice that you have? Yes, that should be the whole text, yes.
MR. NAVARRE: That's the whole thing. How are you going to identify the properties that are
renting? Is there going to be a license and registration of the property?
SUPERVISOR RUSSELL: Well, actually the way that legislation is crafted there is actually an
element of presumption in there. If you are advertising on a website, we are allowed to presume
that you are in violation of the code and we are allowed to issue a summons based on that.
MR. NAVARRE: But why would that be so?
SUPERVISOR RUSSELL: Because the intent to advertise it on that site is the intent to skirt
Southold Town code that doesn't allow it. Once, presuming the legislation is adopted.
COUNCILWOMAN DOHERTY: This is not a proposal for a rental code, as of yet. That is still
being discussed. This is just to button up and tighten up what we already have.
SUPERVISOR RUSSELL: This is to draw clear lines as to what the code would permit and
what it wouldn't permit with regard to regulatory oversight, the town is starting to take up for
discussion the idea of a rental permit. Not just for those, though. We are talking about rental
permits throughout the town for all residential properties. Including year round rentals.
MR. NAVARRE: Okay, because I mean, so this is really just addressing the issue of a seven
day...
SUPERVISOR RUSSELL: Seven nights or less.
MR. NAVARRE: Which means it's not permissible?

UNIDENTIFIED: Hi. I would like to speak about the rental issue here in Southold Town. I was
born here in Greenport and I lived in Mattituck. I went to Sacred Heart, I went to Mercy High
School. I shop local as much as I can but the rental issue here is, it's horrible. I mean, where are
we supposed to live? Right now I am homeless. Okay? I was homeless all winter, it is not a
pretty thing to say you are from Southold Town and you are homeless. I stayed at St. Agnes
Church, on Tuesday nights in the winter and one night there were 65 people there. And I am not
just talking people have mental issues or whatever. They just, a streak of bad luck. Can't find a
place to live, we are being priced out of Southold Town. People are renting out their houses for
$1,000 a week. Who here makes that kind of money? None of us do. You have people sleeping
in the cemetery in Mattituck. People are sleeping in their cars. Through Maureen's Haven who I
now volunteer for, I met Terry and you know, everybody is suffering. A friend of mine is living
in a hotel in Riverhead with her three kids. Social Services is running out of places to put
people. It is really a shame. I really hope the Board looks at this and takes care of people who
grew up here. My father was a farmer in Mattituck, you know, we are the ones that built this.
town. Not the people that are coming out from the city and people are renting rooms in their
houses for $1,000 a week. It is crazy. I mean there are even rentals in Mattituck now, $2,000 a
month, for what? A one bedroom? You can't afford it, you know? I want to stay in Southold, I
don't want to move, you know? It's, I really hope the town really looks at the people who grew
up here and who work here and would like to stay here because it is beautiful, you know? It's
beautiful, it's not for the city people, it's for us. and I realize- people have to make a living but I
was in Greenport, I mean, this is actually kind of funny, I was in Greenport getting a cup of
coffee in the coffee shop and the guy in front of me got a coffee, a latte and a croissant, it was
$17. You know? That's absurd. That's really absurd. So, thank you for listening to me and I
really hope the Board looks into this because it is just not fair.
SUPERVISOR RUSSELL: I will speak to the issue. We actually, one of the motivating forces
on trying to get a handle on short term rentals was we are very aware that what's happening now
is some of the houses that are going on the market and being bought are being bought by people,
they are not opting to rent year round, they are opting to rent nightly or weekly.. And that
removes housing from the inventory. So, that's one of the many social consequences, the
impacts that this might have. So I appreciate it, thank you.

BENJA SCHWARTZ: Good evening. How are you? Sorry, I couldn't get here, I was just
curious about that item, the recreation director brought up at this morning's work session?

SUPERVISOR RUSSELL: Yes, we actually offer an educational program through our rec
department and a lady is going to teach people how to maintain, grow and maintain an herb
garden. Today was just mainly discussing where that is going to be located.
MR. SCHWARTZ: Is that Heather?
SUPERVISOR RUSSELL: Yes, it's Heather.
MR. SCHWARTZ: And the discussion on the barn?
SUPERVISOR RUSSELL: We are going to convey back to the Historical Society that we are
not in a position to re -accept it but we are going to encourage them to try to find another not-for-
profit that might be willing to take it and maintain its historic integrity. Certainly we have to
give them flexibility because they just can't keep it anymore, so we are going to say that would
be our first goal that we would ask them to meet. If not, then they need to find hopefully a
private party that's still willing to protect its historic integrity.
MR. SCHWARTZ: Well, you know, I am all for historic integrity but if I could get a free barn, I
know I have got a lot of stuff I could put in there. Even a couple of cars. I am surprised the
town couldn't respect its historic integrity and yet, make some functional use out of it. I mean, it
could be converted into some kind of storage facility for records or maybe the town could have
some kind of an agricultural program in there to support some of the preserved lands that we
own, I don't know. Have there been any efforts to think of adaptive reuses for the building that
might be suitable....
SUPERVISOR RUSSELL: I think it would lend itself to a lot of uses, the problem is it's an 18th
century structure and it belongs in the hands of someone who has knowledge of maintaining an
18th century structure. I don't think the town has the expertise to do that. I wouldn't want to re -
accept it, use it for some, re -purpose it for some other use and hope that we are able to take care
of it over time. I think the historical society has been an excellent steward and I think we need
someone else that will be an excellent steward of the structure.
MR. SCHWARTZ: Well, we'll see who comes forward. But I wonder if some kind of an RFP
possibly could be issued that local architects might have some ideas as to how to preserve the
historical integrity and yet make, a useful, functional building and asset for the town. The
welcome centers, I think there's one in Greenport and one in Mattituck, those are not run by the
town are they?
SUPERVISOR RUSSELL: No, they are actually run by the North Fork Promotion Council.
MR. SCHWARTZ: Which is associated with the....
SUPERVISOR RUSSELL: We actually....
MR. SCHWARTZ: The Chamber of Commerce....

SUPERVISOR RUSSELL: Well, that was the original thought, to synthesize all the different
chambers but they are actually a free-standing group and part of their budget each year is
supplied by Southold Town.
MR. SCHWARTZ: Okay and then they get money from New York State and stuff.
SUPERVISOR RUSSELL: They might. I don't know.
MR. SCHWARTZ: Yeah. I just wonder if there weren't some property the Town owns that's
preserved, the agricultural rights, that that barn couldn't be put up and perhaps some kind of a
co-operative agricultural market could be created and the, town could act as an organizer, there
could be volunteers, of course, if they sold things there, there would be some money coming in.
just trying to think of different ways that barn could be used to help us preserve the agriculture,
there was a friend of mine talking to this week and they live up in I think it's Massachusetts
somewhere in a town where the last operating and last remaining farm in the town was set for
development and the town bought it and is operating it as a working farm. I don't know, we
have a lot of farms in town here but maybe they would be interested in getting together and
working on if they had the support, a little encouragement from the town to work with them,
maybe together we could create some kind of a, you know, I miss, you all grew up with the
farmstands all over the road, that's not happening anymore, so maybe there's a farmers market in
Greenport but who wants to go into Greenport on the weekend for you know and they were
doing something in Mattituck a little but it's not easy to get something like that going these days
for anybody but certainly with a little public/private cooperation, there's a lot more potential. Do
you think maybe there's still some possibility of developing an idea that would utilize that
structure?
SUPERVISOR RUSSELL: Possibly. I actually have a great deal of faith and confidence in the
Historical Society to reach out to various individuals and organizations, to make sure that it is
going to be in safe hands once they you know, remove it from their inventory. I am quite
confident that they will do the best they can, certainly, any prospective, interested party that
wants to approach the town, we would be happy to work with them.
COUNCILMAN DINIZIO: I have got to tell you, Benja, if the Southold Historical Society finds
it so difficult to keep that building up that they need to get rid of it, I don't think that the town
has the resources to do it. It's, you know, we are not in that business.
MR. SCHWARTZ: Do we have an estimate of, does it need a lot of work or....
SUPERVISOR RUSSELL: My understanding is they spent about $50,000 renovating it and it's
in good condition.
COUNCILMAN DINIZIO: But you know, it has got to stay that way. You start using a
building that's 200 years old, things are going to happen to it. In my opinion, it's better off in
someone's private hands. Someone who has preserved their home, their house....
MR. SCHWARTZ: You don't think you can put the town court in there?

COUNCILMAN DINIZIO: But I don't think you can insulate it or do any of that stuff. It's a
barn.
