'x?u C- TERMS AND CONDITIONS The Permittee, Pasquale & Martin Romanelli, residing at 515 South Oakwood Drive, Laurel, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Moore, Esq. on behalf of PASQUALE & MARTIN ROMANELLI applied to the Southold Town Trustees fora permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 21, 2014, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit on structures; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 22, 2015, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of PASQUALE & MARTIN ROMANELLI for the existing 47'x40' dwelling; existing 20'x36.5' westerly wood deck attached to dwelling; existing 9.2'x10.4' wooden deck to be cut back and subsequently maintained at not less than 3' landward from the rear property line on the east and west sides resulting in a 9.2'x7.4' deck, with 3' wide beach stairs with railings leading to a 5'x6' platform, and 3'x7' platform with stairs to beach; and for the existing 150 linear foot long wooden bulkhead; and as depicted_ on the survey prepared by Stanley J. Oakwood Road, Laurel SUM # 1000-145-03-9.1 Dear Mike: I have a pending application from the Southold Town Trustees for the existing structures on the above property. The application is for the existing residence (47' x 40'), existing westerly deck (20'x 36.5'), existing wood platform associated with the beach stairs. (9.2'x 10') (less than 100 sq.ft.) and 3' beach stairs with railings, 5'x 6' landing/platform and Tx 7' landing/platform, and existing bulkhead. I was advised that you needed additional information. regarding the regulations applicable to these structures to determine if a Zoning Board application is required . . In review of the Romanelli property I found the following: 1. The original house and garage with dormers was constructed prior to zoning (see co pre -co issued 1981 #10726); the bank went down to the beach. 2. The existing house was renovated (deck removed) and an addition, deck, covered porch and second story was constructed with a building permit, however, the electrical inspection was missing from the file, we paid to renew the building permit, obtained the electrical inspection and plumbing certificate, and the co was issued(see co #37070) 3. In 1984 a storm damaged the bank and the owners obtained from NYSDEC a permit for the bulkhead. The stairs and deck were constructed at the same time. The Zoning Board did not get jurisdiction for structures within 75 feet from bulkhead or 100 feet from mean high water until Local Law #4 of 1985 was adopted. The beach stairs and upper platform predate the regulations. Once the Trustees issue the permits for the .existing structures, all permits for the existing structures on this property will be in place.
