Dear Mr. King:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, December 16, 2015:
WHEREAS, MARK KING applied to the Southold Town Trustees for an Amendment to
Wetland Permit#8585 under the provisions of Chapter 275 of the Southold Town Code,
the Wetland Ordinance of the Town of Southold, application dated November 20, 2015,
and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and.to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found to be Consistent with the Local Waterfront Revitalization Program policy
standards, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #8585 for a full demolition of existing dwelling and foundation, and construction
of new as per originally approved; and to install a new sanitary system;and as depicted
on the site plan prepared by Jeffrey T. Butler, P.E., P.C., dated November,19, 2015,
and stamped approved on December 16, 2015.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at,a fee of$50.00 per inspection. (See attached schedule.)

This is not a determination from any other agency.

At the meeting of the Southold Town Conservation Advisory Council held Wed.,
December 9, 2015 the following recommendation was made:
Moved by Doug Hardy, seconded by Jack McGreevy, to
TABLE the application of MARK D. KING to Amend Wetland Permit#8585 for the
demolition of the existing structure and foundation and construction of new as originally
approved and install a new sanitary system.

The CAC Tables the application due to the untimely submission of the application. The

TERMS AND CONDITIONS
The Permittee, Mark King, residing at 200 East Mill Road, Mattituck,New York as part of
the consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit,and the-said Permittee will,at his or her own
expense,defend any and all such suits initiated by third parties,and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. .That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as.a result of the work
herein authorized. '
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized;or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation,the said Permittee will be
required, upon due notice,to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
10. This permit does not convey to the permittee any right to trespass upon the lands or
interfere with the riparian rights of others in order to perform the permitted work nor does
it authorize the impairment of any rights,title,or interest in real or personal property held
or vested in a person not a party to the permit.

Dear Mr. Steinfeld:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 22, 2015 regarding the above matter:
WHEREAS, Gary Steinfeld on behalf of MARK KING applied to the Southold Town
Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code,
the Wetland Ordinance of the Town of Southold, application dated October 31, 2014,
and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 22, 2015, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approves the application of MARK KING for the
partial demolition and reconstruction of existing 30.5'x22.4' dwelling including removal
of southern portion of structure (5.2'x22.2'); expansion of footprint to 28'x32' with
additions on north and east elevations; addition of a second story; and construction of a
12'x29' deck on west elevation; and 4'x6' covered entry porch on east elevation; with
the condition to install gutters to leaders to drywells in accordance with Chapter 236 of
the Town Code-Stormwater Management; and as depicted on the site plan prepared by
West Creek Builders, LLC, last dated October 30, 2014 and stamped approved on April
22, 2015.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the
Minor Actions exempt list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION: Subject property is a non-conforming 22,972 square foot parcel located in
an MII district. The property is a water front parcel with 80.82 feet along Mattituck Creek. The parcel runs 213.52
feet along the North side, 161.43 feet along the East side, and 190.00 feet along the South side. There is a 25 foot
wide Right of Way roadway along the North side of the property. The property is improved with a one story frame
house, a one story concrete building, an accessory one and two story frame and concrete building with the one
story portion partially on the creek with a dock surround and a boat ramp. All is shown on a survey by John C.
Ehlers L.L.S. dated October 15, 2013. .
BASIS OF APPLICATION: This is a request under Section 280-146D for an Interpretation of the Town Code,
Article VIII, Section 280-56, "Bulk Schedule", appealing the Building Inspector's December 11, 2014 Notice of
Disapproval for demolition and construction of a new single family dwelling(residential use) in MII Zone district
required side yard setback.
RELIEF REQUESTED: The applicant requests an interpretation of the bulk schedule regarding setbacks for a
residential use in an MII zone district.
BACKGROUND INFORMATION: There is an existing residential building on the subject property which is
located in an MII zone. The existing residential building has a side yard setback of 6.6 feet. The applicant is
proposing to demolish the existing single family dwelling and construct a new single family dwelling with a
minimum side yard setback of 15 feet. At the hearing the agent for the applicant presented the Town Bulk Schedule
and the sequence of footnotes and notations regarding residential uses in business, office, industrial and other non-
residential zones.
FINDINGS OF FACT/DETERMINATION:
The Zoning Board of Appeals held a public hearing on this application on March 19, 2015 at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property

and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following fmdings:
1. Under Town Code Chapter Section 280-56 and applicable Bulk Schedules Article XIII. Marine II (MII)
District, 280-56 states that 'No building shall be used and no building or part thereof shall be erected or
altered in the MII district unless the same conforms to the Bulk Schedule...incorporated into this chapter
by reference...'
2. Bulk Schedule 280 Attachment 4 states that it is to be used for Minimum requirements for business, office,
industrial, or other nonresidential use. Note 1 then states for minimum requirements for residential use,
refer first to Density and Minimum Lot Site Schedule for Nonresidential Districts and then to appropriate
indicated column in the Bulk Schedule for Residential Districts.
3. Bulk Schedule 280 Attachment 2 states in note 1 that Roman numerals refer to the applicable column in the
Residential Bulk Schedule. Following the MII column with Residential unit without utilities refers to
column VII in the Residential Bulk Schedule.
4. Bulk Schedule 280 Attachment 3-Bulk Schedule for residential districts states in column VII that the
minimum side yard setback is 15 feet.
