party of the first part,and FREDERICK W. COLLIGAN and ANN COLLIGAN, his wife,

party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part,the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot,piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being ink Mattituck, in the Town of Southold, County of Suffolk
and StateofNew_York,- more particularly bounded and describ-ed as---
follows:BEGINNING at a point on the ordinary high water mark of Deep Hole
Creek at the northeasterly corner of land conveyed by the party of
DIST. the first part to Brenda K. Helies (Plot D) ; running thence easterly
along said high water mark 80 feet, more or less, to land conveyed
by the party of the first part to Grace L. Drum, et al, as Trustees
(Plot F) ; thence along said land South 28° 40' East 165 feet, more
or less, to ordinary high water mark of Peconic Bay; thence westerly
along said high water mark 102 feet, more or less, to said land
SSC. conveyed by the party of the first part to Brenda K. Helies (Plat D) ;
` thence along said land, North 20° 40' West 150 feet, more or less ,
0 -3 to the point or place of BEGINNING.
TOGETHER with a right of way over the existing travelled road to
Bungalow Lane and subject to a right of way of others over said
e E= �" existing travelled road as it crosses the premises conveyed here-
under, as per an Agreement dated the 18th day of 'November, 1976, and
Q recorded in the Office of the Clerk of the County of Suffolk on .May
U ' 13, 1977 in Liber 8235 of conveyances at page 397, which Agreement
has been amended in accordance with an agreement to be recorded in
LOT the Office of the Clerk of the County of Suffolk.
TOGETHER with the right to lay and maintain a pipe in the bed of
r�d . the travelled roadway for the purpose,of supplying domestic water
r�Q from Bungalow Lane to the subject premises.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
L1 HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in anyway whatever, except as aforesaid.
\ AND the party of the first part, in compliance with Section 13 of the Lien Law-, covenants that the party of
the first,part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund 20 I;e applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any oftr purpose. :.
The word "party": shallI. construed as if it read "parties" whenever the sense of this indenture so requires.
