No claim shall be made against the State of New York on account of any such removal or alteration. 4. State May'Require Site Restoration Ifupon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition.. No claim shall be made against the State of New York on account of any such removal or alteration. 5. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings; paints, concrete, leachate or any other environmentally deleterious materials associated with the project. Work Area Limits Any work, disturbance, and or storage of construction materials shall be confined to within the limit of clearing and ground disturbance shown on the approved plan. 7. Materials Disposed at Upland Site Any demolition debris, excess construction materials, and/or excess excavated materials shall be immediately and completely disposed of on an approved upland site more than 100 feet from any regulated freshwater wetland. These materials shall be suitably stabilized so as not to re-enter any water body, wetland, or wetland adjacent area. 8. Straw Bales - Prior to commencement of any construction activities, a continuous row of straw bales shall be staked end to end as shown on the approved plans. 9. Straw Bales to Be Entrenched Straw bales shall be entrenched two to four inches into the ground. lo. Maintain Bales .The bales shall be maintained, repaired and replaced as often as necessary to ensure proper function, until all disturbed areas are permanently vegetated. The average useful life of a - bale is approximately 3-4 months. Sediments trapped by the bales shall be removed to anapproved upland location before the bales themselves are removed. 11. Clean Fill Only All fill shall consist of clean soil, sand and/or gravel that is free of the following substances: asphalt, slag, flyash, broken concrete, demolition debris, garbage, household refuse, tires, woody -materials including. tree or landscape debris, and metal objects. The introduction of materials toxic to aquatic life is expressly prohibited. 12. Equipment Storage 100' from Wetland, Water Body All equipment and machinery shall be stored and safely contained greater than 100 feet landward of the regulated wetland. or water body at the end of each work day. This will serve to avoid the inadvertent leakage of deleterious substances into the regulated area... 13.. Seed, Mulch Disturbed Areas All areas of soil disturbance resulting from this project shall be seeded with an appropriate perennial grass, and mulched with straw immediately upon completion of the project, within two days of final grading, or by the expiration of the permit, whichever is first. 14. Temporary Mulch, Final Seeding If seeding is impracticable due to the time of year, a temporary mulch shall be applied and final seeding shall be performed at the earliest opportunity when weather conditions favor germination and growth but not more than six months after project completion. . 15. Minimum- % Vegetative Cover Suitable vegetative cover is defined as a minimum of 85 % area vegetative cover with contiguous unvegetated areas no larger than 1 square foot in size. 16. Notice Covenant The permittee shall incorporate the attached Covenant (or similar Department - approved language) to the deed for the property where the project will be conducted and file it with the Clerk of SUFFOLK County within 30 days of the effective date of this permit.. This deed covenant shall run with the land into perpetuity. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous location on the worksite and adequately protected from the weather. 18. Notice of Commencement At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top.portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, the bottom portion of the.form .must also be signed and returned; along with. photographs of the completed work. 19. Path Restriction The four foot wide path may be left bare or. surfaced with no more than three inches deep of wood chips, stone, gravel or pavers. RCA or other material is not permitted. . 20. Fence Required A permanent split rail fencemust be installed as shown on the approved plan. Fence must also be installed along the northern property line between the landward edge of this lot's (SCTM # 1000-90-2-28) buffer and the landward edge of the northern lot's (SCTM # 1000-90-2-27) buffer within three months of submission of the Commencement Notice. GENERAL CONDITIONS - Apply to ALL Authorized Permits: i. Facility Inspection by The Department The permitted site or facility, including relevant records, is subject to inspection. at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether. the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available - for inspection by the Department at .all times at the project site or facility. Failure to produce a copy of the permit upon request -by a Department representative is a violation of this permit. 2._ Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order. or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. Permit Renewals, Modifications or Transfers The permittee must submit a separate written application to the Department for permit renewal, modification or transfer of.this permit. Such application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. Submission of Renewal Application The permittee must submit a renewal application at least 30 days before permit expiration for the following permit authorizations: Freshwater Wetlands. 5. Permit Modifications, Suspensions and Revocations by the Department The Department reserves the right to exercise all available authority to modify, suspend or revoke this permit. The grounds for modification, suspension or revocation include: a. materially false or inaccurate statements in the permit application or supporting papers; b. failure by the permittee to comply with any terms or conditions of the permit; c. exceeding the'scope of the project as described in* the permit application; d. newly -discovered material information or a material change in environmental conditions,. relevant . technology or applicable law or regulations'since the'issuance of the existing permit; e. noncompliance with previously issued permit conditions, orders of the commissioner, any provisions of the Environmental Conservation Law or -regulations of the Department related to the permitted activity. 6. Permit Transfer. Permits are transferrable unless specifically prohibited by statute, regulation or another permit condition. This indemnification does not extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or intentional acts or omissions, or to any claims, suits, or actions naming the DEC and arising under Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision under federal or state laws. Item B: Permittee's Contractors to Comply with Permit The permittee is.responsible for informing its independent contractors, employees, agents and assigns of theirxesponsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee.. Item C: Permittee Responsible.for Obtaining Other Required Permits The permitteeis;responsible for obtaining any other permits, approvals, lands, easements and,rights-of- way that may be required .to carry out the activities that are authorized by this permit. Item D: No Right to Trespass or Interfere with Riparian Rights This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Masonry walls shall have not less than 3/3 inch (9.5 tarn) pordand cement parghK applied to the exterior of the wall. IRR406.2 Concrete and masonry foundation waterproofing. In areas where a high water table or other severe soil -water conditions are known to exist, exterior foundation walls that retain earth and enclose habitable or usable spaces located below grade shall be waterproofed with a membrane extending from the top of the footing to the finished grade. The membrane shall consist of 2 -ply hot -mopped felts, 55 pound (25 kg) roll roofing, 6 -mil (0.15 mm) polyvinyl chloride, 6 -mil (0.15 mm) polyethylene or 40 -mil (1 mm) polymer -modified asphalt. The joints in the membrane shall be lapped and sealed with an adhesive compatible with the waterproofing membrane. EXCEPTION: Organic solvent based products such as hydrocarbons, chlorinated hydrocarbons, ketons and esters shall not be used for ICF walls with expanded polystyrene form material. Plastic roofing cements, acrylic coatings, latex coatings, mortars and pargings are permitted to be used to seal ICF walls. Cold setting asphalt or hot asphalt shall conform to type C of ASTM D 449. Hot asphalt shall be applied at a temperature of less than 200 degrees. IRR406.3 Dampproofmg for wood foundations. Wood foundations enclosing habitable or usable spaces located below grade shall be dampproofed in accordance with IRR406.3.1 through IRR406.3.4. IRR406.3.1 Panel joint sealed. Plywood panel joints in the foundation walls shall be sealed full length with a caulking compound capable of producing a moisture -proof seal under the conditions of temperature and moisture content at which it will be applied and used. IRR406.3.2 Below grade moisture barrier. A 6 -mil -thick (0.15 mm) polyethylene film shall be applied over the below -grade portion of exterior foundation walls prior to backfilling. Joints in the polyethylene film shall be lapped 6 inches (152 mm) and sealed with adhesive. The top edge of the polyethylene film shall be bonded to the sheathing to form a scat Film areas at grade level shall be protected from mechanical damage and exposure by a pressure preservatively treated lumber or plywood strip attached to the wall several inches above finish grsde level and extending approximately 9 inches (229 mm) below grade. The joint between the strip and the wall shall be caulked full length prior to fastening the strip to the wall. Other coverings appropriate to the architectural treatment may also be used. The polyethylene film shall extend down to the bottom of the wood footing plate but shall not overlap or extend into the gravel or crushed stone footing. IRR406.3,3 Porous fill. The space between the excavation and the foundation wall shall be backfilled with the same material used for footings, up to a height of 1 foot (305 mm) above the footing for well - drained sites, or one-half the total backfill height for poorly drained sites. The porous fill shall be covered with strips of 30 -pound (13.6 kg) asphalt paper or 6 -mil (0.15 rem) polyethylene to permit water seepage while avoiding infiltration of fine coils. IRR406.3.4 Backfill. Ends shall be returned or shall terminate in newel posts or safety terminals. Handrail adjacent to it wall shall have a space of not less than 1.5 inches (38 mm) between the will and the handrail. IRR315.2 Handrail grip size. All required handrails shall be of one of the following types or provide equivalent graspability. Type L handrails with a circular cross section shall have an outside diameter of at least 1-1/4 inches (32 mm) and not greater than 2 inches (51 mm). If the handrail is not circular it shall have a perimeter dimension of at least 4 inches (102 nun) and not greater than 6-1/4 inches (160 mm) with a maximum cross section dimension of 2-1/4 inches (57 mm). Type II. Handrails with a perimeter greater than 6-1/4 inches (160 mm) shall provide a graspable finger recess area on both sides of the profile. Stairways shall not be less than 36 inches (914 mm) in clear width at all points above the permitted handrail height and below the required headroom height. Flandrails shall not project more than 4.5 inches (114 mm) on either side of the stairway and the minimum clear width of the stairway at and below the handrail height, including treads and landings, shall not be less than 31.5 inches (787 mm) where a handrail is installed on one side and 27 inches (698 mm) where handrails are provided on both sides. Exception: The width of spiral stairways shall be in accordance with IRR314.5. IRR314.2 Treads and risers. The maximum riser height shall be 8-1/4 inches (209 mm) and the minimum tread depth shall be 9 Inches (229 mm). The riser height shall be measured vertically between leading edges of the adjacent treads. The tread depth shall be measured horizontally between the vertical planes of the foremost projection of adjacent treads and at a right angle to the tread's leading edge. The walking surface of treads and landings of a stairway shall be sloped no steeper than one unit vertical in 48 units horizontal (2 -percent slope). The greatest riser height within any flight of stairs shall not exceed the smallest by more than 3/8 inch (9.5 mm). The greatest tread depth within any flight of stairs shall not exceed the smallest by more than 3/8 inch (9.5 mm). IRR314.2.1 Profile. The radius of curvature at the leading edge of the tread shall be no greater than 9/16 inch (14.3 mni). A nosing not less than 3/4 inch (19.1 mm) but not more than 1-1/4 inches (32 mm) shall be provided on stairways with solid risers. The greatest nosing projection shall not exceed the smalltst nosing projection by more than 3/8 inch (9.5 mm) between two stories, including the nosing at the level of floors and landings. Beveling of nosing shall not exceed 1/2 inch (12.7 mm). Risen shall he vertical or sloped from the underside of the leading edge of the tread above at an angle not more than 30 degrees from the vertical. Open risers are permitted, provided that the opening between treads does not permit the nassage of a 4 -inch -diameter (102 mm) sphere. EXCEPTIONS: 1. A nosing is not required where the tread depth is a minimum of 11 inches (279 mm). 2. The opening between adjacent treads is not limited on stain with a total rise of 30 inches (762 mm) or less, IRR314.3 Headroom. The minimum headroom in all parts of the stairway shall not be less than 6 feet, 8 inches (2032 tun) measured vertically from the sloped plane adjoining the tread nosing or from the floor surface of the landing or platform, IRR314.4 Winders. Winders are permitted, provided that the width of the tread at a point not more thz.:12 inches (305 mm) from the side where the treads are narrower is not less than 10 inches (254 mm) and the minimum width of any tread is not less than 6 inches (152 mm). The continuous handrail required by IRR315.1 shall be located on the side where the tread is narrower. IRR314.5 Spiral star � . Spiral stairways are permitted for interior use as a component of, anl egress from a habitable room, a basement or an attic, provided 'minim(#, tread width shall be 26 inches (660 mm) with each tread having it 7-1/2-ir.A (190 mm) minimum tread depth at 12 inches (305 mm) from the narrow edge. All treads shall be identical, and the rise shall be no more than 9-1/2 inches (241 mm). A minimum headroom of 6 feet, 6 inches (1982 tram) shall be provided. A spiral stair is not permitted to be the only means of egress from a story of a building. IRR314.6 Circular stairways. Circular stairways shall have a tread depth at a point not more than 12 inches (305 mm) from the side where the treads are narrower of not less than 11 inches (279 mm) and the minimum depth of any tread shall not be less than 6 inches (152 tram). Tread depth at any walking line, measured it consistent distance from it side of the stairway, shall be uniform as specified in IRR314.2. IR1014.7 Illumination. All stairs shall be provided with illumination in accordance with IRR303.4. I11tR314.8 Under stair protection. Enclosed accessible space tinder stairs shall have walls, under stair surface and any soffits protected on the enclosed side with 1/2 -inch (12.7 mm) gypsum board, IRR314.9 Bulkhead enclosure stairways. Stairways serving bulkhead enclosures not part of the required building egress and providing access from the outside grade level to the basement shall be exempt from the requirements of IRR312, IM14 and IRR315 when the maximum height from the basement finished floor level to grade adjacent to the stairway is covered by a bulkhead encl.:sure with hinged doors. IRR309 GARAGES AND CAP"RTS IRR309,1 Opening protection, Openings from a private garage directly into a room used for sleeping purposes shall not be permitted, Other openings between the garage and residence shall be equipped with a 45 -minute fire- rated oo-rated door assembly equipped with a self-closing device. IRR309.1.1 Duct penetration. Ducts in the garage and ducts penetrating the walls or ceilings separating the dwelling from the garage shall be constructed of a minimum No. 26 gage (0.48 mm) sheet steel and shall have no openings into the garage. IRR309.2 Separation required. The garage shall be separated from the residence and its attic area by horizontal or vertical separations conforming to IRR309.2.1 and IRR3092,2. IRR309.2.1 Vertical separations. Where partitions are used to separate vertically an attached garage from a dwelling or its attic, the partition assembly shall have a 3/4 -hour fire -resistance rating. IRR309.3 Floor surface. Garage floor surfaces shall be of approved noncombustible material. The area of floor used for parking of automobiles or other vehicles shall be sloped to facilitate the movement of liquids to a drain or toward the main vehicle entry doorway, IRR309.4 Carports. Carports shall be open on at least two sides. Carport floor surfaces shall be of approved noncombustible material. Carports not open on at least two sides shall be considered a garage and shall comply with the provisions of this section for garages.
