PROPERTY FACTS/DESCRIPTION: The subject property is improved with a two story dwelling with attached porch and carport. It also has an accessory in -ground swimming pool. It has 271.32 feet along a private right of way, 818.18 feet along the eastern property line, 275.71 feet along the southern property line and 740.17 feet along the 'western property line as shown on the survey dated 06-05-98, last revised 06-27-02, prepared by John C. Ehlers, LS. BASIS OF APPLICATION: Request for Variance from Article XXII Section 280-105C the Building Inspector's December 23, 2014 Notice of Disapproval based on an application for building permit to construct 8 foot high deer fence, at; 1) 8' deer fence proposed in location other than side and rear yard. RELIEF REQUESTED: The applicant requests a variance to install deer fencing in the front yard where the code permits side and rear yard locations only. ADDITIONAL INFORMATION: A letter objecting to the variance request was received from a neighbor expressing concerns about access for emergency equipment via the existing 50 foot R.O.W. Another letter from a neighbor was received supporting the application. A letter was also received from the Orient Fire Department requesting that the Zoning Board ensure that all access for emergency vehicles not be impeded or hampered by the deer fence and that the Town Code required 15'X15' clearance would not be violated, if approved. The subject property is one of four lots of approximately 5 acres in size accessed by an easement across the properties to create a common 50 foot wide R.O.W. with an improved road approximately 12 feet in width. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 19, 2015 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property r�r Page 2 of 3 — April 16, 2015 ZBA#6838— Roman/Birenbaum SCTM# 1000-27-3-4.5 and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance with the setback as conditioned herein will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This property is located on a private right of way. It is the third of four improved properties that use this right of way. The subject lot is approximately 1/4 mile from King Street and the existing home has a front yard setback of 153 feet from the northern (front yard) property line. The parcel is 5 acres in size and the other properties that use the R.O.W. are similar in size. The subject property is not visible from the public road and there are existing trees that screen the property from view from neighboring. properties. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The zoning ordinance does not permit deer fencing in a front yard without variance relief. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, locating the proposed deer fence 60 feet from the northerly property line, as conditioned herein, will meet the code required front yard setback for a principal structure (dwelling) and will mitigate any potential adverse impacts on access for emergency equipment to the 4 lots that use the R.O.W. Additionally, there are many mature trees along the front property line and the southerly side of the right of way that will screen the deer fence from view by neighboring properties, including the adjoining properties to the north of the right of way whose back yards are adjacent to the R.O.W. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community, as conditioned, will have an adverse impact on the physical or environmental conditions in the neighborhood. The property is large and uniquely situated along a private R.O.W. that is not visible from the public street and the front yard setback for proposed deer fencing, as conditioned herein, meets the code required front yard setback for a principal use. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of is the minimum action necessary to enable the applicant to enjoy the benefit of a deer fence in the front yard while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Horning, and duly carried, to GRANT the variance requested for deer fencing in the front yard, subject to the following conditions; CONDITIONS: 1. The proposed deer fence shall be setback no less than 60 feet from the northerly (front yard) property line.. 2. The fence shall be constructed per Southold Town Code. 3. The applicant shall submit a survey showing the location of the deer fence in the front yard as conditioned herein That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. Name of Owner: Mary Roman & Ellen Birenbaum ZBA E�TyVE�® REASONS FOR APPEAL (additional sheets maybe used with prenarer's signature): JAN 15 2015 AREA VARIANCE REASONS: BOAR® OFAPPEALS (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: Poquatuck Lane is a private dead-end dirt road that is only used by residents of the 4 homes in a 22 acre subdivision in Orient. Each home, including the subject property, is located on the northern end of 5 acre parcels, with 2 acres constituting the lane which serves as the right of way. Over 15 acres of the subdivision south of the building lots are open field (former farmland). An additional 14.5 acres south of the subdivision are open field extending down to Narrow River Road. Thus there is a very large area (-30 acres) that serves as a preserve for the deer. There are frequently 5-10 in the front yard of the subject property at dusk. Attached are the following documents supporting the variance application: the proposed location of the deer fences the fence specs 4 photographs showing the three front beds which the applicant wishes to protect from deer infestation—the `woodland bed' that stretch all along Poquatuck Lane in front of the house (within which the fence would run and be largely concealed by bushes, trees, grasses, etc.), beds along front facade of house, and the bed along front walk way. The last photograph shows the backyard with some beds as well as the pool area. You can see the picket fence but the other fencing is buried in a `rough' area. The rear yard will be protected from the deer, a building permit for the rear yard deer fence was issued. Google maps 1) a photograph of Poquatuck Lane with the four houses and the RomanBirenbaum encircled 2) a close-up of the house and 3) lines drawn of the existing 4 foot fences in the back (gray lines) and the proposed new fencing (black lines). You will notice that there is a long line of trees and brush that conceal Poquatuck Lane from the backs of houses on Old Farm Road. 740 Poquatuck Lane is the third house on Poquatuck Lane and about 0.3 miles from the entrance off King Street. The proposed front yard deer fence for 740 Poquatuck Lane would extend from the approved back yard deer fence, lengthening the two side fences and adding a front fence. The two side extensions would continue along overgrown natural borders and thus be minimally visible. The front fence would be buried in a preexisting, mature woodland garden bed that extends along almost the entire border with Poquatuck Lane (with the exception of the RECEIVEDg . T11Qa FAPtRi ALS proposed 3 sections of the front yard fence would be inconspicuous and largely invisible by virtue of being immediately adjacent to or buried within existing trees, vegetation and plantings. (2) The benefit sought by theapplicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: On an annual basis, the applicants have had to install (and, if appropriate, remove) temporary deer fences around many plants, which has been costly and only partially effective. Doctor Roman and Doctor Birenbaum have been home owners on the North Fork since 1983 and purchased the Poquatuck property because of it's rural and agricultural use. Both Doctor Roman and Doctor Birenbaum are serious gardeners and agricultural entrepreneurs (they have a truffle orchard under cultivation which is surrounded by a deer fence). The deer are a nuisance and destroy the vegetation. Until a better solution is offered, deer damage can only be effectively controlled with fencing. (3) The amount of relief requested is not substantial because: 740 Poquatuck Lane and the other three homes on five acres are "small estate farm parcels". The size of the lots and surrounding fields create small farms for gardening enthusiasts and farmers. Agricultural use is permitted to have perimeter deer fencing. The proposed variance would be consistent with the legislative purpose for deer fencing. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The front fence would be buried in a preexisting, mature woodland garden bed that extends along almost the entire border with Poquatuck Lane (with the exception of the driveway and a small portion of the front yard east of the driveway). As previously stated, virtually all the proposed 3 sections of the front yard fence would be inconspicuous and largely invisible by virtue of being immediately adjacent to or buried within existing tress, vegetation and plantings. Through Mary, we have learned that there has been some concern expressed about"recent alarms" from our house. We have owned our home for about 10 years. Over that decade, we have had few alarms go off and we have never exceeded the number of alarms in any year that would cause the town to charge us an extra fee. Further, when we are not in Orient, our home is closely monitored by Bob 'H61-srnarn6who lives a few minutes away. In checking with Bob, who you may know, he stated that he is not aware of any recent issues related to false alarms. We did have a situation last year in which our smoke alarms were going off, while we were out at the house. We had Suffolk Security come out, clean and replace the relevant equipment, and we have had no issues since then. I do not recall this causing the fire department to visit our location. Like Mary, I am writing in hopes of clarifying the nature of the potential problem, if there is one. We have never had any safety or access concerns communicated to us. If there is any issue we would, of course, deal with it promptly. While we are not full time residents, we love Orient and view it as our home and we take the care and maintenance of our property and safety very seriously. Roman and Ellen Birenbaum in response to Bredemeyer letter of March 3, 2015 to Southold ZBA We appreciate the opportunity to respond to the Bredemeyer letter and request that this communication be included in the official record. Our specific responses are below: Introductory paragraph: Our neighbors to the east and west on Poquatuck Lane, both of whom have registered their support for the proposed fence, have comparable, if not longer, contiguous plot Fines given the recently -erected deer fence surrounding the back and side yard of a portion of our property and the proposed fence around the front line. 1. Question of Accuracy and Intent: In considering the erection of a deer fence, we sought estimates from two contractors. We specifically asked each contractor whether a permit was necessary and were told by both that a permit was not necessary. By the time the stop work order was issued, posts had already been placed, several of which are within the 50 foot right of way. Our intention is to move these posts outside the right of way if permission for a deer fence is granted. To insure that posts are properly placed, we will ask a surveyor to stake the right of way. 2. Public Safety: As mentioned above, the few fence posts located within the right of way will be relocated to outside the right of way. The Bredemeyer letter refers to "planned plantings on the south side." Our application does not describe any "planned plantings" nor is it our intent to create new gardens but rather to protect existing beds and trees. We are very disturbed by the mention of "public safety" concerns that appear to be unrelated to a possible fence. Neither we nor our neighbors to the east mentioned in the Bredemeyer letter (Esther and Steve Rotella) have been informed of this issue (confirmed with the Rotellas on the morning of 3/4/2105). It is, of course, imperative that access by emergency equipment be available to residents of Poquatuck Lane. If the fire department equipment has been unable to negotiate the circular driveway on the Rotella's property and/or pull or back into our driveway, we are very concerned that this issue has not been brought to our attention by those within the fire department who are aware of the problem. Independent of the ZBA decision, we plan to contact the fire department to discuss this issue. The proposed fence to the east of our driveway can be further recessed beyond the 50 foot right of way to allow adequate access if the equipment can, in fact, not negotiate existing driveways and requires greater than 50 foot right of way. Moving the fence further away in this location will not be an issue for us as this is the one location where the fence would not be buried in or protecting existing vegetation. The road and right of way are maintained by 3 of the 4 homes on Poquatuck Lane, so this issue will be discussed once we have received clarification from the fire department about any changes that should be made to the right of way, independent of the current fence application. Firstly, our property is located at the end of a long private dirt road off King Street. Our property is completely invisible from King Street and only barely visible from a distance at certain location on Old Farm Road and Narrow River Road. Thus we are not certain how "community character" will be impacted. Secondly, with regard to fencing, on our "tour" of the "block," we see extensive deer fencing on the corner of Old Farm Road and King Street, chain link fencing on the corner of Old Farm Road and Orchard Street, split rail fencing on the corner of Old Farm Road and King Street, and a deer fence in the backyard of the Bredemeyer property which faces our front yard. We have a one -acre truffle orchard in our back acreage that is already surrounded by a deer fence. We see extensive tall privet elsewhere. As mentioned in our application, we are planning to site the fence running along our front yard within existing mature plantings in our woodland bed to further limit visibility. 4. Environmental Concerns: Although we not animal scientists, we both have advanced scientific degrees (doctors of medicine) and are not completely ignorant of biology and nature. While we appreciate the brief essay regarding wildlife in our area, we did not suggest in our application nor do we assume that deer will confine themselves to the 30 open acres surrounding our property. We were implying that we are not closing off critical access of any wildlife to open spaces. Again, we are not certain how the specific concern and essay is directly related to our proposed deer fence. 5. Possible Mitigation: 1. We are the only residents on Poquatuck Lane to have spent time, effort and money to liberate the row of olives (planted by the original developers of the subdivision) from invasive rose, thereby providing the most cleared right of way on Poquatuck Lane. While we are aware that they are an invasive species, so are many others. We are not aware of others in the community being asked to remove invasive grasses, olives, roses, or other species from their property. We have the olives pruned, at least, annually to facilitate access, maintenance, and mowing. We strongly disagree that they "offer sparse visual screening" as they largely block the view when they are in leaf. 2. We have stated above that we will move fencing outside the 50 foot right of way and further, if needed, to facilitate access by emergency equipment, particularly in the area to the east of our driveway. We are again unaware of the reason for the letter's mention of "screening trees/shrubs as planned" as we are not intending to extend the existing gardens. 3. We are confused by this point as the right of way on the south side of Poquatuck Lane is level with the dirt road. We have repeatedly stated in this letter that we are not planning to place additional plantings along Poquatuck Lane. In summary, we hope that this letter adequately addresses the concerns raised in the Bredemeyer letter. We have every intention of maintaining a "50' wide wildlife corridor" as suggested in the letter, if our fence is approved. In responding to two recent emergency alarms at SCTM. 27-3-4.2, (the applicants neighbor to the east at the end of Poquatuck Lane) the fire apparatus had trouble negotiating the end of Poquatuck lane and were forced to back into the applicants driveway with great difficulty. (This prior to the fence posts left from the unauthorized start of construction.) If fencing were installed on the posts remaining from the now halted start of construction that may be as much as 10' within the right of way, as little as 20' in width would be available for emergency vehicle use if the planned plantings on the south side overgrow their boundaries to the extent no -%v evident in the autumn olives on the north. 3) Community Character Concerns: Beverly and I took a "tour" around our "block", which includes the properties of the applicant and our home and saw no visible permanent 8' high deer fencing on the front of residential lots. Fencing on most properties is restricted to rear yard garden food plots or to protect .individual specimen shrubs/trees. We believe that fencing the applicants front vard without mitigation, resulting in nearly 100% perimeter fencinZ for all uses on the applicants property, is not in keeping with the community standard where the residential portion of lots have no permanent deer fencing at all, and most properties have no fencingperiod. 4) Environmental Concerns: The applicants display a lack of understanding of Virginia Whitetail Deer and its' habits and needs in the vicinity of thea home when their application states that 5-10 deer using the front yard justifies 8' high exclusionary fencing by imputing that 30 acres of nearby preserved open space is sufficient to sustain the displaced deer. The unpaved portion of the Poquatuck Lane ROW along with all the front Yards in the applicants subdivision are contiguous to the unfenced naturalized rear Yards of Old Farm Road and Orchard Street This area forms an ecological unit, a "wildlife corridor", that ultimately connects with hundreds of acres of preserved NYS and Town owned wetlands surrounding Hallock's Bair, as well as the dedicated open space of several subdivisions that include several ponds This interconnected area is used by diverse"large" wildlife other than deer, among them: wild turkeys foxes, racoons, opossums, hawks and owls. The ability of the Hamlet of Orient to enjoy "large" wildlife long after the deer problem subsides can be assisted by a careful approach to fencing. Attached find a map depicting preserved, reserve and travel lanes in the vicinity of our block. (I, John, advise the North Fork Deer Management Association, have a B.S. in Animal Science from Cornell where I assisted grad students in deer research) 5) Possible Mitigation: 1) Remove all the autumn olive trees from the north side of the right of way "Poquatuck Lane"on the applicants property. Since their original planting, they have degraded into various stages of dying or have blown over and offer sparse visual screening that was the original intent of the developer. Additionally, autumn olives are now considered an invasive species. Removal would avail 15-18 feet of the ROW for emergency vehicle use and remove an undesirable invasive. 2) Locate the proposed 8' high deer fence at least 6' into the applicants unencumbered propem, embedding screening trees/shrubs as planned, using temporary fencing as necessary out to the limit of the ROW to establish the plantings and protect them from initial deer predation. 3 ) Level the ROW on either side of the Poquatuck Lane roadway as necessary so emergency vehicles may maneuver without obstruction. Plant the Poquatuck Lane shoulders with durable native grasses such as blue stem or orchard grass that will stabilize soils from erosion/or let naturalize and maintain to no more than 20" in height so as to not hinder emergency vehicle use. We believe the forgoing would: help maintain a natural 50' wide wildlife corridor that the applicants front yard currently functions as, assist emergency vehicle use and in no way reduce the intent of the applicants request for relief. We believe this suggested mitigation is minimal and reasonable.
