with two(2)handrails supported by eight(8) 6"x6"timber pilings; an elevated 6'x20' platform including
an access ladder supported by six(6) 6"x6"timber pilings; all decking to be open-grate decking on entire
dock; and all hardware to be hot-dipped galvanized; with the condition the elevated walkway and
platform be constructed straight out off of existing catwalk in an"L"shape;

The New York District, U.S. Army Corps of Engineers, has received a request for
Department of the Army authorization for the following activity:
APPLICANT: Vincent Fischetti

West Hempstead, New York 11552
ACTIVITY: Construction of a 4-foot wide by 24-foot long elevated walkway
supported by eight 6-inch by 6-inch timber pilings and construction
of a 6-foot wide by 20-foot long elevated platform, including an
access ladder supported by six 6-inch by 6-inch timber pilings, all
off end'of existing dock and ramp. The dock structures will extend
approximately 30 feet from the mean low water(MLW) into
Richmond Creek.
Under authority of Department of the Army Nationwide General
Permit;Number 3, the applicant proposes to reconstruct the existing
4-foot wide by 53-foot long dock and ramp in-kind, supported by
twelve;timber pilings. The top decking is proposed to be replaced
with open-grate decking and the 4-foot wide by 10-foot long
seaward steps will be removed.
The purpose is to provide for safe and more practical access to
docked watercraft. -
WATERWAY: Richmond Creek tributary to Little Peconic Bay
LOCATION: 650 Spring Lane, Hamlet of Peconic, Town of Southold, Suffolk
County, New York -

TERMS AND CONDITIONS
The Permittee,Vincent Fischetti, residing at 650 Spring Lane, Peconic,New York as part of
the consideration for the issuance of the Permit does understand and prescribe to the following:
I. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will,at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents,and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized,or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation,the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
10. This permit does not convey to the permittee any right to trespass upon the lands or
interfere with the riparian rights of others in order to perform the permitted work nor does
it authorize the impairment of any rights, title,or interest in real or personal property held
or vested in a person not a party to the permit.

Dear Mr. Anderson:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, March 18, 2015 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of VINCENT FISCHETTI
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated February 19, 2015, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policies 6.3 & 9.3 of the Local
Waterfront Revitalization Program to the greatest extent possible through the imposition
of the following Best Management Practice requirements: the use of open-grate decking
on the entire dock; the dock will be constructed at a lower profile; the new elevated
walkway and platform will be constructed straight out off of existing catwalk in an "L"
shape; and '

WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on March 18, 2015, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of VINCENT
FISCHETTI to reconstruct the existing ±4' x ±53' ramp and dock including twelve (12)
4"x4" timber pilings in-kind/in-place using open-grade decking and removing seaward
4'x10' steps; off of seaward end of existing dock construct a proposed 4'x24' elevated

Suffolk Environmental Consulting, Inc. on behalf of VINCENT FISCHETTI requests a Wetland Permit to
reconstruct the existing ±4' x±53' ramp and dock including twelve (12) 4"x4" timber pilings in-kind/in-
place using open-grade decking and removing seaward 4'x10' steps; off of seaward end of existing
dock construct a proposed 4'x24' elevated walkway with two (2) handrails supported by eight (8) 6"x6"
timber pilings; an elevated 6'x20' platform includingan access ladder supported by six (6) 6"x6" timber
pilings; all decking to be open-grate decking; and all hardware to be hot-dipped galvanized. Located:
650 Spring Lane, Peconic. SCTM# 86-5-6
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this -
department, as well as the records available to me, it is my determination that the proposed actions
are INCONSISTENT with the below listed LWRP policy and therefore are INCONSISTENT with the
LWRP: ,
The purpose of the dock extension has not been identified.
6.3 Protect and restore tidal and freshwater wetlands.
The applicant has not demonstrated that the following dock standards pursuant to § 275-11.
Construction and operation standards have been met.
(d) Review and approval of dock applications. Before issuing a permit' for a dock structure, the
Trustees shall consider whether the dock will have any of the following harmful effects:
[1] Whether the dock will impair navigation or be located in areas of high vessel traffic or
vessel congestion;

The proposed dock extension would extend into the public waters. The increased draft of
larger vessels and decreasing water depths do not warrant incremental extension of
permanent, private, dock structures into public water bodies. Alternatives such as a
seasonal mooring in pre-established areas with adequate water depth is a better option.
[2] Whether the dock will unduly interfere with the public use of waterways for swimming,
boating, fishing, shellfishing, waterskiing and other water-dependent activities;
Private dock structures extending into public waters decreases the public use of
bottomlands and the nearshore area.
[5] Whether the dock will cause degradation of surface water quality and natural resources;
Richmond Creek is a New York State Significant Coastal Fish and Wildlife Habitat
and New York State Department of Environmental Conservation Critical
Environmental Area.
[12] Whether adequate facilities are available to boat owners and/or operators for fueling,
discharge of waste and rubbish, electrical service and water service.
9.3 Preserve the public interest in and use of lands and waters held in public trust by the
state and the Town of Southold.
A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance
with an assessment of potential adverse impacts of the proposed use, structure, or facility on
public interest in public lands under water.
The dock structure will extend further into public waters resulting in a net decrease in
public access to public underwater lands and the nearshore area.
The applicant currently enjoys access to public water via an existing private, dock
structure.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed actions.
