Box 1179 Southold, New York 11971-0959 Telephone (631) 765-1892 Fax (631) 765-6641 Thank you for your referral to this office for a review of the Michael Nicoletti parcel at SCTM# 1000-50-3-19.1 for jurisdiction under Chapter 275 of the Town Code. Trustees Michael Domino and John Bredemeyer visited the site on Saturday, April 4, 2015 and found that there exists wetlands with standing water (including breeding frogs) on the site that are much more extensive than mapped by Suffolk Environmental Consulting on December 2, 2014, and as depicted on the survey prepared by John Metzger last dated January 15, 2015. We owe this omission to extremely thick. vegetative cover on the site also encountered by Mark McDonald of McDonald Geoscience. These wetlands, a portion of which may be wet year-round, exist within the proposed house and cesspools, possibly as close as ten (10) feet. Accordingly, the plan you submitted is jurisdictional under Chapter 275 of the Town Code and a major revision thereto will be necessary prior to any submission to this office for a wetland permit. The applicant should have his surveyor judiciously hand clear no more than one -four (4) foot wide path northeast from the proposed house to access the wetlands and map the edge of standing water under current spring conditions. This along with the addition of site elevations should provide the reliable information necessary to format a proper submission to the involved agencies. Thank you for your assistance in this matter. My client is in contract to purchase this property and the contract has been made conditioned on obtaining all the necessary permits to construct a new house and new sanitary on the property. The existing house will be demolished (it is dilapidated and property overgrown). Mark McDonald of McDonald Geoscience and the surveyor have advised us that the property is too overgrown for any equipment to access the property. In order to obtain a test hole for the Health Department application the property must first be cleared. We have identified the jurisdictional 100' from the edge of freshwater wetlands so as not to clear within the Trustees's jurisdiction. We would request a letter of no jurisdiction from the Trustees in order to proceed with the clearing and Health Department application. Enclosed is my client's check for the fee.
