Code, the Planning Board hired a Technical Consultant to aid in the review of the
application and the submission from your office of Check#5256, $4,000.00 was placed
into an escrow account with the Town Comptroller's Office to cover the cost of the
review by Cityscape Consultants.
Enclosed please find a copy of Amato Law Group check#5256 with the memo
transmitting it to our Accounting Department, the Purchase Order#28130, the Voucher,
the invoice from CityScape Consultants, Inc., a copy of their report dated 3/26/15 and a
print-out verifying payment to them.

As an addendum to the attached Site Plan Use Determination, the Planning Department
has conducted a review of the proposed modifications pursuant to §280-74 B.(2), and
has received a report from our Wireless Technical Consultant, CityScape, Inc. (see
attached report). We have the following recommendations for this application:
The proposed Verizon modifications and up-grades are in compliance with the General
Requirements of§280-70, therefore, we recommend a Building Permit be issued for this
application with the conditions listed below, and in accordance with the Structural
Analysis Report dated January 19, 2015:
Conditions:
1. The Building Permit must state the following:
a. All existing and proposed Verizon feed lines shall be installed inside the
monopole structure as approved;
b. Prior to the issuance of a Certificate of Occupancy, the Planning
Department is required to verify that the condition detailed above has
been met.

At your request on behalf of The Town of Southold in New York ("Town"), CityScape
Consultants, Inc. ("CityScape") in its capacity as telecommunications consultant for the Town has
considered the merits of an application provided by Verizon Wireless ("Applicant") to make
antennas and electronic equipment modifications to an existing monopole-type support structure.
The facility is owned by Crown Castle and is located at 21855 Country Road 48 in Cutchogue, see
figure 1.
The subject tower currently has all New York MSA licensed cellular-type operators (AT&T,
Sprint/Nextel, T-Mobile/MetroPCS, and Verizon) mounted on the tower. Verizon is in the process of
upgrading their existing services by adding spectrum in the 700MHz spectrum and modifying their
antenna and related equipment at all of their sites nationwide. This application is referenced as a
long-term evolution (LTE) upgrade intended to provide new fourth generation (4G) service into the
general area. The new technology is for high-speed wireless broadband implementation, which will
complement Verizon's existing cell phone service. Sprint/Nextel, AT&T, MetroPCS/T-Mobile have
all concluded their 4G upgrades and now Verizon will follow suit.
The subject tower has a total elevation of one hundred eight (108) feet with antennas for
MetroPCS mounted above tower top at one hundred eleven (I 11) feet. The Applicant's antennas are
mounted at the one hundred seven (107) foot and the one hundred five (105) foot level of the tower,
see figure 2. Additionally, the Applicant plans to add new electronic equipment within their existing
shelter installed in the ground compound area.
The Applicant's final antenna configuration will consist of nine (9) panel type antennas and
three (3) existing Remote Radio Head (RRH) units all to be located at the same level see figure 3.
The antenna sections of the construction drawings are not consistent between pages however the
difference is not something that would impact the Town's application process. Interconnecting the
antennas will be the fourteen (14) existing and one (1) new cable. The Applicant submitted a
Structural Analysis Report dated January 19, 2015 indicating that all existing feed lines are installed
within the monopole structure. The proposed new feed line from Verizon Wireless is stated to be
installed on the exterior of the structure. This should not be allowed for Verizon nor the reserved
exterior feed line at 88 feet proposed for T-Mobile; all existing and reserved feed lines should be
internally mounted, see figure 4.

Previously, Sprint/Nextel and AT&T both concluded 4G upgrades in 2012 and 2013. The
AT&T modifications made in March 2013 required that the tower be modified and strengthened to
support the AT&T upgrade. The new tower rating following the AT&T modifications brought the
tower in compliance with a rating of 92.8% out of a maximum 105%. T-Mobile made similar 4G
upgrades and modifications in October 2014. The equipment modifications made by T-Mobile
resulted in a reduction in tower loading and therefore the new tower rating was 88.6%.
The updated Structural Analysis submitted with application was conducted using the correct
ANSI-222-G standard and Exposure Category C. The new tower rating following the proposed
modification by Verizon will be 93.5% out of a maximum 105%, see figure 5. The new rating will
be of sufficient capacity to maintain the existing and proposed equipment for the subject tower.
Please note that the submitted construction drawings and structural analysis antenna elevation data
were inconsistent, as has been noted for all previous submitted applications for this site. Regardless,
Cityscape's analysis for this review and previous reviews is based on the structural analysis data,
which is the controlling factor.
The Applicant did not submit new calculations to assure compliance with all FCC standards
regarding human exposure to Radio Frequency energy. CityScape does not believe new calculations
are necessary or required because the subjects antennas are mounted in excess of 6 meters above
ground, which is considered by the FCC as sufficient threshold distance separation. The Applicant's
spectrum will operate in both the 700 MHz range and the 1900 MHz range which should not be an
interference concern to the Town's public safety communications. The operator complies with
applicable federal interference rules.
All designs and plans for the proposed new facilities were developed according to accepted
practices of RF propagation engineering and the persons completing all work are sufficiently
qualified within their disciplines.
In conclusion, CityScape recommends the application be approved with the condition that all
existing and proposed Verizon feed lines are installed inside the monopole structure.

The Planning Department is in receipt of an application to up-grade and maintain an existing
Verizon facility and related equipment at the existing site referenced above. Pursuant to §280-
130A of the Southold Town Code, the Planning Department is required to provide a brief report
to the Building Department concerning the proposed wireless communications up-grades to
determine whether they meet the guidelines for wireless facilities.
Pursuant to §280-74A(d) of the Town Code, the Planning Board will hire a Technical Consultant
to aid in the review of the application and hereby requires the submission of$4,000.00 into an
escrow account with the Town Comptroller's Office to cover the cost of the Technical
Consultant's review.
Please remit a check in the amount of$4,000.00 payable to the Town of Southold.

1. The TOWN OF SOUTHOLD is not responsible for materials, supplies or equipment delivered
or services performed without authority of written order. Quantities specified are not to be
exceeded.
2. No changes may be made in this order without written authority of the supervisor.
3. Inspection of delivery will be made at delivery point unless otherwise specified. Materials must
be properly packaged. Damaged material will not be accepted. Include itemized packing lists with.
all shipments. Delivery indoors is required unless otherwise specified. All prices quoted must in-
clude shipping, handling, packing and crating charges and be F.O.B. delivered, unless other terms
are agreed to.
4. Substitutions of specified items will not be acceptable. The Town of Southold reserves the
right to reject and return at shippers expense, materials delivered which do not conform to de-
scription of item ordered.
5. If order cannot be filled in whole or in part in time specified, notify the town immediately. In
case of delay in delivery, or in case of any default of the vendor,the town may procure the goods
or services from other sources and hold the vendor responsible for any EXCESS COST, EX-
PENSE OR DAMAGES occasioned thereby.
6. Upon acceptance of this rde the ver-lor agrees to comply with all Federal, State or local
laws relative thereto:
a. The vendor shall defend action- or :'airls b3 ought and hold the Town of Southold, its
agents and its employees harmless front loss, suits,costs, rights, patent or patent rights of any
invention or any other cause.
b.The vendor represents and warrants that the unit prices charged herein are not higher than
any applicable legal maximum prices permitted, and are not in excess of those currently
charged to other governmental, institutional or commercial users for similar items, quantities
and deliveries.
c. Insofar as applicable, the Vendor shall comply with Sections 220, 220-a, 220-b, 220-c,
220-d, 220-e and 222 of the Labor Law of the State of New York relating to maximum work-
ing hours and minimum wages of employees and prohibiting discrimination on account of race,
sex, color,creed or national origin in hiring employees within the State of New York involved
in the manufacture of materials, equipment, or supplies specified in this order.
d. The vendor shall comply with Sections 103a and 103b of the General Municipal Law
pertaining to disqualifications of contractor for failure to waive immunity before Grand Jury.
7. INVOICES RENDERED ON ENCLOSED CLAIM FORM MUST BE ITEMIZED IN DETAIL.
Claims for partial deliveries are not allowed unless indicated. Claims in question will constitute a
condition precedent to the right of the vendor or receive any payment and matters of dispute
must be adjusted before final acceptance by the Town of Southold.
8. Billing shall allow for exemption from taxes under Federal Excise Tax Exemption Certificate
No. A-163554 held by the Town of Southold.
9. Cash discount terms must be indicated on claim voucher; discount period will be computed
from date of acceptance of delivery or receipt of a correct claim voucher, whichever is later.
10. The provisions of the New York State Fair Trade Law (Feld-Crawford Act) and the Federal
Price Discrimination Law (Robinson-Patman Act) do not apply to purchases made by the Town
of Southold.
11. All P.O./Claims must be audited and approved by the Town Board prior to actual payment.
