SCTM# 1000-72-1-1.8 The lot was created as Lot 2 in the Minor Subdivision of Baxter Properties in 1981. A covenant and restriction (C&R) wag filed on the parcels at the time of approval. Clause 8. of the C&R (shown below) restricts access to the beach to a single access structure on or near the common property line between Lots 1 & 2. The intent of the clause is to establish common access to the beach. This proposal does not meet the clause. 7. Access to the beach shall be by means of a suitable structure designed and constructed in.a zwraies that will result in the least disturbance of the stability of the bluff. 8. The environmental impact of the project will be limited to the temporary loss/disturbance of bluff soils and vegetation immediately adjacent to the site of construction. As grade restoration and revegetation of these disturbed areas at the conclusion of construction is incorporated into the design plan, the project will have no significant adverse impact to the bluff ecosystem or adjacent beach and will be consistent with Policy 6.
