I will not re -review this action as my original recommendation that the action is INCONSISTENT stands. Ido
have a concern with creating lawn on the parcel area that slopes towards the bluff. Even with a 10' wide
buffer. Erosion of the bank may increase due to runoff.

grade (at 19' existing contour) with French drain to drywells; repair/reset stones at existing stone patio; add
approximately 100 cubic yards clean fill, if and as needed, to pitch grade for drainage and plantings; install a
landscaped buffer with landscape boulders and natural drought tolerant native vegetation along landward side
of pool fence; install stone walkway and stone steps to existing slate patio; install stone steps from walkway to
dock, and from patio area to side yard; install stone base for outdoor grill area; and install an outdoor shower.

Patricia C. Moore, Esq. on behalf of THOMAS & MAE MAURI requests a Wetland Permit to
demolish the existing single-family dwelling; construct new dwelling with new sanitary system
in front yard; install in -ground swimming pool and patio; and install drywells as required.
Located: 1135 Calves Neck Rd., Southold. SCTM#63-7-33
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is INCONSISTENT with the denoted following Policy
Standards and therefore is INCONSISTENT with the LWRP:
Note that the survey contains mistakes in the proposed lot coverage table.
All referenced setbacks from the natural protective feature are incorrect. Setbacks
should be measured from the "top of bank" or bluff. Chapter 275 defines a bluff as:
BLUFF -- Any bank or cliff with a precipitous or steeply sloped face adjoining a beach
or a body of water. The waterward limit of a bluff is the landward limit of its waterward
natural protective feature. Where no beach is present, the waterward limit of a bluff is
mean low water. The landward limit is 25 feet landward of the receding edge or, in those
cases where there is no discernible line of active erosion, 25 feet landward of the point
of inflection on the top of the bluff. The point of inflection is that point along the top of
the bluff where the trend of the land slope changes to begin its descent to the shoreline.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town
Board of Trustees laws and regulations for all Andros Patent and other lands
under their jurisdiction.
The proposed pool location does not comply with Town Code setbacks. The required
setback is 100' from a bluff line (top of bank) to a sanitary leaching pool.

In the event that the action is approved:
1. It is recommended that the pool and related structures be relocated to comply
with regulatory setbacks to the greatest extent practicable.
2. Retain existing trees on site to the greatest extent practicable incorporating them
Into a non -disturbance buffer.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.
