I will not be reviewing this action again. My recommendation that the action is INCONSISTENT still stands... the
improvements to the action should be taken in to consideration by the Board to the policies.
VINCENT & MICHELE SCANDOLE request a Wetland Permit to install an approximately 10" high by 4' long berm
along the landward edge of the driveway consisting of either asphalt or bluestone, sand and clay behind;
existing approximately 12' wide by 38' long driveway on side of house shall be filled with W bluestone to an
average depth of 12"; at north end of driveway, imbed a 10" gravel encased perforated drainage pipe running
the full length of the driveway which will terminate into a 4' drywell; install a 4' precast concrete drywell with
inspection cover; replace existing shed with new shed less than 100sq.ft. in overall size; install approximately
190-220 cubic yards of sand or clean fill; install approximately 85-100 cubic yards of top soil; area of fill to cover
approximately 80'x95' with slope to be approximately 25-30 degrees; area of proposed fill to be no higher than
abutting properties. Located: 500 Beebe Drive, Cutchogue. SCTM# 97-7-4

LWRP CONSISTENCY ASSESSMENT FORM

1. All applicants for permits* including Town of Southold agencies, shy ,
proposed actions that are subject to the Town of Southold Waterfront istency Review Law. This
assessment is intended to supplement other information used by Town of Southold agency in
making a determination of consistency. *Except minor exempt tions including Building Permits
and other ministerial permits not located within the Coastal Er ion Hazard Area.
2. Before answering the questions in Section C, the prepar of this form should review the exempt
minor action list, policies and explanations of each poli contained in the Town of Southold Local
Waterfront Revitalization Program. A ro sed on will be evaluated as to its si ' icant
beneficial and adverse effects upon the coastal area 'ch includes all of Southold Town .
3. _ If any question in Section C on thus form is ans red "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy st dards and conditions contained in the consistency
review law. Thus each answer must be ex ained in detaillisting both supporting and non -
supporting facts. If an action cannot be c ed as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

Area A— STREET BERM
Berm shall be approximately 10" high by 4' long consisting or either
asphalt or bluestone, sand and clay blend.
Area B — DRIVEWAY
Drive way on side of house shall be be filled with 3/a" bluestone
approximately 12' wide by 38' long to an average depth of 12"
Area C — Drainage Trench
At north end of driveway (Area C) we shall imbed 10" gravel
encased perforated drainage pipe, running the full length of the
driveway which will terminate into a 4' dry well (Area D).
Area D — Dry Well
Install a 4' precast concrete dry well with inspection cover.
Area E - Replace preexisting shed consistent with code.
Area F — Fill
Install approximately 190 to 220 yards of sand or clean fill.
Install approximately 85 to 100 yards of top soil.
Area of fill will cover approximately 80' by 95'
Slope will be approximately 25 to 30 degrees.
Area of fill will be no higher then the adjoining properties, except for
any raised flower beds if installed.
All surface water runoff will be address by items in Area A, B, C and D

VINCENT & MICHELE SCANDOLE requests an Administrative Permit to install and level out
approximately 190 cubic yards of pure sand; top with approximately 85 cubic yards of topsoil; and
replace existing shed with new 8'x10' shed located on north side of property. Located: 500 Beebe
Drive, Cutchogue. SCTM# 97-7-4
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with the LWRP policies and therefore INCONSISTENT with
the LWRP. This recommendation is based on the following:
a. The purpose of the project has not been defined.
b. The existing grade elevations and finished grade elevations have not been provided.
c. Impacts (runoff) to adjacent properties have not been analyzed.
d. No storm water erosion controls or buffers are proposed.
e. No plan to mitigate impacts to existing trees (burying of trunks) has been provided.
The replacement of the shed is EXEMPT.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.
