SUPERVISOR RUSSELL: Would everybody please rise for the Pledge of Allegiance. Before
we get to the regular meeting of the Town Board, as many of you know, we celebrate Arbor Day
by having students from each of the school do posters. We have many of the posters on display
here, we like to display them every year. The Tree Committee works very hard to select among
the best. I know it's a very difficult decision every year because if you look at these posters,
they are all so good. I am going to do now is invite Dave Cichanowicz who is chairman of the
Southold Town Tree Committee to come on up and then we would like to make some
presentations.

DAVE CICHANOWICZ: Good afternoon everyone, welcome to our annual Tree Committee
Arbor Day poster contest 2015. This is something we started some years ago, we put it out to the
Southold Town Board Regular Meeting 4
April 7, 2015
local schools in Southold Town with the focus on what they feel would represent Arbor Day the
best. And we have some selected winners, we have Honorable Mentions and then the Grand
Prize winner for the overall Town of Southold. So first we will start off with the Honorable
Mentions which is a, we give also a gift card for $50, to Brendan Syron from Oysterponds. I am
not sure if they are in attendance, we didn't see anyone show up, so we may have to send this to
them. And I think another non -show is Olivia Grace Mannino from Cutchogue East and I don't
believe they came. But for the very first time we have a Fishers Island student, we are very
happy to see Arabella Hatfield.
SUPERVISOR RUSSELL: You know what, we have a little bit of a technical glitch (inaudible).
Congratulations.
MR. CICHANOWICZ: This is a $50 gift card for you. Great job on your poster. What we did
this year on our book marks that we will hand out to all the grade school kids later on, is all the
Honorable Mention posters are on the back side and on the front, the Grand Prize winner.
Thanks again, Arabella, and congratulations.
SUPERVISOR RUSSELL: Arabella, first of all (inaudible) and we wanted to thank you for
coming from Fishers Island.
MR. CICHANOWICZ: And our Grand Prize winner, Sadie Heston from New Suffolk.
Inaudible comments. Thank you so much. And again, this is Sadie's poster that we put on the
bookmark that we hand out to the grade schools on behalf of Arbor Day. Along with the Arbor
Day presentation, we have representatives from our Committee go around to all the schools and
teach all the kids what Arbor Day is all about (inaudible). Thank you.

SUPERVISOR RUSSELL: I would also like to congratulate all of the winners and for all the
students overall, -they did such a nice job and they make this community very proud. I will also
let you all know that certainly you are free to stay for the meeting but we completely understand
if you want to say, you know what? Thank you but this gets a little dry for us.

Police Department cost for Event = $16.46
RESOLVED the Town Board of the Town of Southold hereby grants permission to the
American Diabetes Association to use the following roads for their Annual Bike Ride event,
Tour de Cure on Saturday, June 13, 2015, from 6:00 a.m. to 4:00 p.m.: Route 25, Cox Lane, CR
48, Mill Road, Peconic Lane, Albertson Lane, Moores Lane, Stars Road, Cedar Drive, Aquaview
Avenue, Rocky Point Rd, Soundview Avenue, Hortons Lane, Kenneys Road, Mill Lane, North
Sea Drive, Leeton Drive, West Drive, Lake Drive, Bridge Lane, Oregon Road, Grand Avenue,
Wickham Avenue, Marys Road, New Suffolk Avenue, 5th Street, Bay Avenue, Depot Lane, New
Suffolk Road, Peconic Bay Boulevard, Cox Lane and Mt. Beulah Avenue throughout Southold
Town, providing they comply with all the regulations included in the Town's Policy for Special
Events on Town Properties and Roads and the Special Events Law in the Southold Town Code.
The town stresses that the total number of riders must be limited to 600 or less.
Support is for this year only, as the Southold Town Board continues to evaluate the use of town
roads. All fees for this event have been waived, with the exception of the Clean-up deposit.

Waive Parking Regs for Salty Flyrodders
RESOLVED that the Town Board of the Town of Southold hereby grants permission to Salty
Flyrodders of New York to park vehicles of participating fishermen, to use town beaches on
June 5, 2015 through June 7, 2015 day and night for the purpose of fly fishing, and these
vehicles shall be exempt from Southold Town parking fees for those days provided:
1. They file with the Town Clerk a One Million Dollar Certificate of Insurance naming the
Town of Southold as an additional insured;
2. Participants must display a club card visible in the car;
3. applicant contact Captain Kruszeski of the Southold Police Department with a sample of
cards and instructions for proper placement of the cards

space fee title on property owned by the Elizabeth H. Rose Trust. Said property is identified as
SCTM #1000-23.-1-19. The address is No # Private Rd #8, East Marion, New York, and is a
beach parcel located between Dam Pond and Long Island Sound in the R-80 zoning district. The
proposed acquisition is for fee title and is approximately 0.28 acre.
The property has been offered for sale to the Town of Southold as open space. The purchase
price is $2,000.00 (two thousand dollars). The property will be acquired using Community
Preservation Funds. The seller may claim a bargain sale.
The property is listed on the Community Preservation Project Plan Eligible Parcel List of
properties that should be preserved for the purpose of protecting undeveloped beach land and

WHEREAS, the Town Board of the Town of Southold (herein called the "Town"), in the County
of Suffolk, New York, on behalf of the Southold Solid Waste Management District, in the Town
(herein called the "District"), has determined that it is in the best interests of the District to
increase and improve the facilities of the District, by the acquisition of a front end wheel loader
and a self-propelled windrow turner at the aggregate estimated maximum cost of $850,000,
pursuant to Section 202-b of the Town Law; and
WHEREAS, grant funds are expected to be received by the Town from the State of New York
and may also be received from other sources in connection with the project described herein, and
any such grant funds shall be authorized to be applied toward the cost of said project or
redemption of the Town's bonds or notes issued to finance the project, or to be budgeted as an
offset to the taxes to be collected for the payment of the principal of and interest on said bonds or
notes; and
WHEREAS, the Town Board, as lead agency, has given due consideration to the impact that the
project may have upon the environment and, on the basis of such consideration, the Town Board,
acting as Lead Agency, pursuant to the New York State Environmental Quality Review Act
(hereinafter sometimes called "SEQRA") has found and determined that the project is a Type II
Action and no further environmental review is required;
Now, therefore, be it
ORDERED, that a meeting of the Town Board of the Town be held at the Town Hall, 53095
Main Road, Southold, New York, on the May 5, 2015 at 4:30 o'clock P.M. (Prevailing Time) to
consider said improvement of facilities of the District and to hear all persons interested in the
subject thereof concerning the same and for such other action on the part of the Town Board with
relation thereto as may be required by law; and be it,
FURTHER ORDERED, that the Town Clerk publish at least once in the "The Suffolk Times, "
hereby designated as the official newspaper of the Town for such publication, and post on the
sign board of the Town maintained pursuant to subdivision 6 of Section 30 of the Town Law, a

Choice Program and its predecessor LIPA Community Energy Program for a number of years;

WHEREAS, the incentives previously provided for participation in the Program are no longer
being made available; and
WHEREAS, the Town of Southold has taken numerous other steps to promote the growth of
renewable energy, including amending the Town Code and making Town -owned land available
for the installation of renewable energy production systems; and
WHEREAS, the Town of Southold will save approximately Ten Thousand ($10,000.00) Dollars

SUPERVISOR RUSSELL: Now with that, I would like to ask anybody that would like to
address the Town Board on any issue to please feel free? Please.
Warren Jackson, Mattituck
WARREN JACKSON: Good afternoon, members of the Board. My name is Warren Jackson, I
am from Mattituck. I just want to bring an issue up to the Town Board regarding our parking lot
off of Love Lane between Old Sound Avenue and Westphalia and Pike Street. It's a mess. I
don't just mean maintenance but there are four dumpsters in that parking lot, two 55 gallon
barrels of grease and cooking oil. Since when is that public property being used for private
dumpsters? I think that's something the Town Board needs to look into. We are proud of our
town, we have a problem with parking as it is on Pike Street and Love Lane. These dumpsters
take up at least six parking spaces, although they are not actually full in the parking spaces, they
are sitting on grass medians. There are also three additional dumpsters, one behind the Episcopal
Church and I don't know if that is there property or not, one by the bank and there is another one
directly behind the Broken Down Valise which is pretty much in the roadway. I took some
photographs today, I have them in my camera, I haven't printed them so it might behoove the
Board or a member to go out and take a look at this condition. I know there was a lot of
construction for businesses on Love Lane and they have got patios behind their little restaurants
or bistros or what have you and I think what's happened is the dumpsters have now become part
of the public parking lot. It is public access.
SUPERVISOR RUSSELL: We have actually, or Assistant Town Attorney has actually been
working for some time now to resolve the issue with the landowners or the business owners
down there. There's a couple of options on the table to try to rectify the situation. With regard
to the condition of the parking lot itself, it is actually scheduled for repaving and restriping at
some point this year.
MR. JACKSON: That I understand but my concern is the garbage. I have seen the dumpsters
over -flowing. But 55 gallons of grease, if that ever gets dumped in your parking lot, you have
got a mess on your hands.
SUPERVISOR RUSSELL: Right.
MR. JACKSON: That really should not be taxpayers responsibility.
SUPERVISOR RUSSELL: We hope to have it resolved soon. We appreciate it, thank you.

KERRY NAVARRA: This is in reference to, I don't know what you would call it, the....
SUPERVISOR RUSSELL: Short term rental?
MR. NAVARRA: Yeah. I am from Mattituck. I have been in the, involved with seasonal motels
for probably 30 years. You know, I observed something that where these short-term rentals,
where they were weekend rentals or week rentals and stuff like that in the Hamptons area, they

actually put out of business all those hotels. So they went from having seasonal properties that
were there with 90 business, it's a short, tough business; the week rentals where you have 5
families, 10 families or whatever you can pile and their kids, just took away that whole entire
business. The way this runs is that the houses start off as rental houses for the week, two weeks,
whatever it may be. The owners that own these houses, they are doing great, they rent the
houses out, the houses start getting in disrepair, they get fed up with their houses getting wrecked
every once in a while, so then they just start to look the other way and they start to rent to
basically day laborers or workers, so you have got 10 workers that pay year round which is a lot
easier to deal with, there's no demands made on the condition of the house and then that house
ends up being eventually usually it turns into a foreclosure house. The people usually refinance
these houses, they take their money out of it, they take their equity out of these houses and then
the next thing you know, these houses are, they are just collecting rents on them, not paying the
taxes, not paying the mortgage. It takes usually the bank a couple of years to get them out and in
the meantime, the neighborhood and the residents and the town are stuck with these blighted
houses. Fifty percent of foreclosed houses on the Island are rental houses or were rental houses.
So it is something to keep in mind, it sounded great, all these people talking about they wanted
legislation, I mean, I am listening to people that are in violation of fair housing act, you know,
with their screening of their tenants. You have people that are running illegal boarding houses,
they have ads on Craig's list, daily rentals, all like that. We have a 90 day season, that's 90 days
of rentals. It may take six months to do it but it is basically 90 days. in that time you have got to
pay commercial insurance rates, commercial electric rates, we have demand meters on these
places. We have to pay labor to clean these rooms every day. These people are not doing that,
not to mention the dumpsters that he is talking about. Those dumpsters are over -full from rental
houses dumping their garbage into those dumpsters. It's not just in those businesses. If you go
down to the end of any beach, you will look there and all the garbage is from rental houses.
There's no provision made when these people draw up these agreements, they usually say let the
tenant take care of their garbage and that garbage ends up in the private dumpsters or at the town
beaches and parks and stuff like that. So that also should be part of a law and the law should be
stated that you need a minimum of 31 days, 31 days because July and August are 31 days. Those
are your main rental period of time in this area. Someone wants to rent a house for a month, they
want a kitchen or whatever, all the stuff I heard, that's great. The ones that come in for a week,
two weeks, they don't care, they just need that Saturday night, they want to put 10-15 people in,
they don't care if they pay for two weeks and they only use it that night because it's very hard to
get rooms for the one day. That's the bread and butter for the business out here. The town of
Riverhead has a 30 day minimum stay in order to have a rental period. Those days should be
logged in, so you don't have conflicted dates and there should be penalties for violating that time
period because without repercussion to the renter and the landlord, then it is useless to have
anything on the law. And it's got to be a penalty of twice the rental rate. And that should be
filed and you're also in violation of the county sales tax. The county has a 3 and 5/8t" percent
occupancy tax. All those people are not paying that tax, that's not to mention the state sales tax,
11 5/8th percent that's not coming to the state or the county, these people are basically pocketing
the things and that's how it turns out. They get all this cash in, they are not using credit cards,
they are not taking checks, they are getting big deposits. A lot of people end up with this game
where they say the place was damaged so they get even more money with these deposits. And
the cash flow will be great for a while and that's how they start realizing the house is getting

rundown, real estate markets change. Right now the real estate market is good. Sometimes you
can't get rid of these houses and you know, your property taxes go up and they walk away from
it and we are all stuck with it. The biggest thing is that if you stick to a 31 day minimum rental
period, I think it will be fair for people who want to rent and I think it will be fair for people that
actually do make a business here. The bit about bringing business into this town, I think the
problem in this town is there is too much business. The quality of life is going down as the
population increases. I mean, you can just see tour buses and things like that, limo companies
and things like that. this is not business, these are basically like invaders coming into the town,
you know, taking the cream of the crop in the best weather and actually hurting the local
businesses and restaurants. The only thing that I can see that would be a fair compromise is the
31 days. because that kind of eliminates these people that are renting them every single weekend
and then you have got to really do some investigation, put a committee together, I bet you can
get some volunteers, go onto craigslist, Airbnb or whatever these sites are, call up, find out who
is renting these houses and what the deal is and then do the enforcement.
SUPERVISOR RUSSELL: I have a comment, we actually have draft code to address the issue
and I can speak for the whole board when I say we are committed to addressing it. I think the
issue that we haven't resolved is what was going to be the minimum duration for a rental. But
we have had a discussion about 7 days, 14 days, the issue of 30 days has come up in the past.
The town is actually, historically, had two week rentals, one week rentals, it had been part of the
landscape out here long before the world of this industry and you know, we try to be cognizant
of that as we discuss the threshold.
MR. NAVARRA: See, what I find is that everybody needs, they have weddings, they have these
groups, they just need Saturday nights and they pay $5,000 for two weeks and they use it two
nights because it doesn't matter. So if that house is locked up for 31 days, you know you are not
going to have, well, you may have it but they will be paying more but that house will only be one
weekend out of the month and not four weekends out of the month where it's annoying the
neighbors and stuff. And your prime season is June, July, August, 31 days covers it all.
SUPERVISOR RUSSELL: We actually had draft code we were hoping to have it at work
session today. I have to be honest, my fault, when I set the agenda up on Friday because we
were so involved with it, I just didn't get it on the agenda and in the interests of transparency, we
delayed the discussion for two weeks but what I believe, we will have draft code in two weeks

CHRIS BAIZ: Good afternoon everybody. Chris Baiz, Town of Southold, village of Southold.
I think to that discussion point on the transient rentals, I am not sure what the right number is.
whether it's 2 nights, 7 nights, 14 nights, 30 or 60, I do know that we do have ordinances in place

for parking and noise that should mitigate a lot of the issues. I am concerned and I think
everyone should be concerned that if we have the headline after we have adopted 31 days or a
month or whatever that the headlines will read `Southold denies tourism'. And I don't think we
can afford that. this is a community for our lifetimes we know that it has very much been a
tourism destination, especially in the summertime and most of those families are families who
have been here in years gone by just returning, there are others who are new to the area and they
have quote discovered the north fork and the Town of Southold. I think the biggest concern, if
you are going to take some 1,000 or 1,500 houses that seem to be in this loop now since the
economic recession, more out of economic need of those individual house, homeowners more
than anything else that when you take a house and put it into a long rental period, you will lose a
great deal of economic activity for all these young families especially who seem to be a very
large portion of the tenancy that comes to these and if we are going to do that, I think the other
side of the coin is, is we really need to look at what the town might consider for more hotel
space, more rezoning of land to allow more hotel rooms in the summertime because you are
probably going to take anywhere from 3,000 to 4,500 bedrooms out of the weekly or bi-weekly
system on the one hand and relegate it to unrented on the other hand unless somebody is going to
try to be a rule beater. The backside of that is, young families that come here on a weekly basis,
they come here, they go out three or four nights a week for dinner or for lunch, they go to the
local restaurants and shops. A monthly tenant is not going to do that and therefore, it hurts the
rest of the community as a tourism destination. As I said before, our generation has certainly
seen this place or our generations have seen this place as a tourism destination. Let me just say,
my great grandparents came here in the 1880's and the 1890's because this was a tourism
destination even at that time and there were many more hotels at that time for room occupancy in
fact, my grandparents bought an old hotel and converted it into their own home which now my
wife and I live in and our daughter lives in the other building. So, I think there's a lot to think
about. I am not sure what the right number is. I think certainly in terms of the occupants who
might be the tenants, just from our experience, it seems that the weekly tenancy is probably the
best number to arrive at. It is basically on affordability for these young families that want to
have a week at the shore with their children and their grandparents and what have you. Thanks

SUPERVISOR RUSSELL: Thank you, Chris. One of the issues we discussed was the one week
versus the two week and the one issue that we were very cognizant of is the one week which
seems to be, people are lobbying us very heavily for no less than 7 nights rather than 14 nights.
The, one of the issues with the 7 nights, you are still getting the turnover every weekend, if there
is 12 weeks of summer, you still have a new party every weekend which is the, the issue for us is
we don't want to solve a problem by not solving a problem but at the same time, we are
cognizant of the economic benefits that many refer to and you know, it's a balancing act for us
too. We are trying the best we can. Would anyone else like to address the Town Board on any
