SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance. Thank you. Just
quickly, let me briefly explain how the meeting will run. What we will do is we usually take
comment on items that are specific to the agenda that's printed. That's at the beginning, then
what we will do is we will go through the agenda, we will vote on the resolutions and then after
that we will certainly open up the microphones to anyone that wants to comment on any issue.

Comment regarding resolution 261
COUNCILMAN RULAND: Mr. Supervisor, I am going to recuse myself from voting on the
warrant as there is a conflict of interest between myself and one of the vendors.
JUSTICE EVANS: I also need to excuse myself as there is a payment to myself for
reimbursement for the Association of Towns.

WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk
County, New York, on the 10th day of February, 2015, a Local Law entitled "A Local Law in
relation to Amendments to Chapter 280, Zoning, in connection with Historic Preservation
District" and
WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid
Local Law at which time all interested persons were given an opportunity to be heard, Now
therefor be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, "A Local Law in relation to Amendments to Chapter 280, Zoning, in

LOCAL LAW NO.3 of 2015
A Local Law entitled, "A Local Law in relation to Amendments to Chapter 280, Zoning, in
connection with Historic Preservation District".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Chapter 280 of the Code of the Town of Southold is hereby amended as follows:
Article XXXIII. Historic Preservation District (HPD)
4280-190. Purpose; applicability of amendments.
The Town Board of the Town of Southold has found that there exists within the Town certain
structures with historic or community significance that are in danger of being permanently
removed from the Town's scenic viewshed. The Town Board further finds these structures are
deserving of preservation for this and future generations. The Town Board has determined that it
is necessary to create a floating zone which will be known as a Historic Preservation District to
afford an opportunity to protect these structures from demolition by providing an incentive to
developers to maintain the fagade of said structures in exchange for the ability to enjoy
additional uses not currently permitted in the underlying zoning district
4280-191. Definitions.
Unless otherwise expressly stated the following terms shall for the purpose of this Chapter,
have the meanings as herein defined. Any word or term not noted below shall be used with a
meaning as defined in Webster's Third International Dictionary of the English Language
unabridged (or latest edition).
ARTISAN MARKET - A retail space for artists to sell their individually crafted art work
jewelry, furniture sculpture, pottery, leather craft handwoven articles and related items
ARTIST STUDIO/WORKSHOP - An establishment for the preparation display and sale of
individually crafted artwork jewelry, furniture sculpture pottery, leather craft handwoven
articles and related items.
COMMUNITY FACILITY - A structure located on a property owned or formerly owned by
religious institution governmental institution school fraternal organization library district or
fire district.
GARDEN CENTER - A place of business where retail and wholesale products are sold to the
consumer. These centers, which may include a nursery and/or greenhouse import most of the
items sold, and may include plants nursery and stock potting soil hardware small scale power
equipment and machinery for residential purposes hoes rakes shovels and other garden and
farm variety tools and utensils.

SMALL BUSINESS OFFICE - Offices such as insurance agencies, real estate agencies,
computer software services, financial planning securities brokers and like -kind small business
establishments excluding retail sales of any kind or nature and limited to overall floor space of
3,000 square feet.
4280-192. Eligibility.
An application for the creation of a Historic Preservation District shall not be accepted unless the
property contains:
1. A communityfacility; acility; and
2. Said facility was designated as a "historic" landmark pursuant to Chapter 170 of the Code
of the Town of Southold or the Town Historic Preservation Commission recommends, in
a writing, that it should be designated as such.
4280-193. Use regulations.
In the HPD. no buildina or premises shall be used and no buildina or Dart of a building shall be
erected or altered which is arranged, intended or designed to be used, in whole or in part, for any
use except the following_
A. Permitted Uses. The following are permitted uses and, except for uses permitted under
subsection (A)(1), (2) and (3) hereof, are subject to site plan approval by the Planning
Board:
1. Single-family homes
2. Two-family homes
3. Bed and breakfasts, subject to the procurement of a bed and breakfast permit
4. Multiple dwelling units - apartments (for properties located within 1 mile of
the hamlet centers)
5. Educational Institutions
6. Philanthropic, eleemosynary (charitable) or religious institutions
7. Retail businesses limited to:
(i) Farmers markets,
(ii) Artisan markets;
(iii)Artist studio/workshops;
(iv)Craftsman studio/workshops;
(v) Garden centers;
(vi)Dance studios; and
(vii)Exercise studios
8. Day-care facilities
9. Small business offices
10. Professional offices
11. Museums and historical societies
12. Meeting hall and cultural centers
13. Auditorium/theatre, library, art gallery, exhibit halls
14. Buildings, structures and uses owned or operated by the Town of Southold,
school districts, park districts and fire districts.
B. Accessory uses. Accessory uses shall be limited to those which are clearly incidental and
customarily accessory to the permitted principal use.

§280-194. Pre -application procedure.
Prior to submitting an application for a proposed HPD the applicant shall participate in a pre-
submission conference with Planning Department staff in order to confirm that a community
facility is located on the proposed site discuss the nature of the proposed HPD the desired
results and submittal requirements.
§280-195. Application procedure.
A. Application and fees. The application for the HPD shall be filed with the Town Clerk. in
a form approved by the Town Board and available in the office of the Town Clerk Fees
applicable to the HPD application shall be set by resolution of the Town Board
B. The procedure for approval of any future development in a proposed HPD shall involve a
four -stage application process as follows:
1. Submission to the Town Clerk of completed application for an HPD
2. Confirmation that the community facility is a "historic" landmark or recommended as
such, in a writing, by the Town of Southold Historic Preservation Commission
3. Recommendation by the Planning Board to approve the concept plan of the subject
property_
4. Public hearing on the posed HPD by the Town Board.
C. Referral to Historic Preservation Commission Upon receipt by the Town Clerk of a
properly completed application for the establishment of a HPD one copy of the
application shall be referred to the Historic Preservation Commission in order to confirm
that the community facility is either a "historic" landmark or is recommended as such
Within 45 days from the date of the Historic Preservation Commission meeting at which
such referral is received, the Historic Preservation Commission shall report its
determination to the Town Clerk.
D. Referral to Planning Board Upon the receipt by the Town Clerk of a report by the
Historic Preservation Commission confirming that the community facility is either a
"historic" landmark or is recommended as such one copy of the application shall be
referred to the Planning Board for its review and reportand one copy shall be referred to
the Suffolk County Planning Commission for its review and recommendation if required
by the provisions of the Suffolk County Charter. Within 60 days from the date of the
Planning Board meeting at which such referral is received the Planning Board shall
report its recommendations to the Town Board. No action shall be taken by the Town
Board until receipt of the Planning Board report or the expiration of the Planning oard.
review period, whichever first occurs. Said review period may be extended by mutual
consent of the Planning Board and the applicant.
E. Planning Board report. The Planning Board in its report to the Town Board may
recommend either approval of the application for the establishment of the HPD with or
without modifications, or disapproval of said application. In the event that the Planning
Board recommends disapproval of said application it shall state in its report the reasons
for such disapproval. In preparing its report and recommendations the Planning Board
shall give consideration to the Town Comprehensive Plan the existing and permitted
land uses in the area, the location of buildings on the site traffic circulation both on and
off the site, the adequacy and availability of community facilities and utilities including
public water and public sewer systems to service the proposed development and other

factors as may be related to the purposes of this Article.
F. Town Board public hearing. Within 45 days from the date of the Town Board's receipt
of the Planning Board's report and recommendation or the expiration of the Planning
Board review period, whichever first occurs, the Town Board shall hold a public hearing
on the matter of establishing HPD on the property described in the application. Such
hearing shall be held upon the same notice as required by law for amendments to the
Town Zoning Map and/or Zoning
G. Town Board action.
1. Within 45 days after the date of the close of the public hearing. the Town Board
shall act either to approve, approve with modifications or disapprove the proposed
HPD. A copy of the Town Board's determination shall be filed with the Planning
Board and a copy mailed to the applicant. A copy shall also be filed in the Town
Clerk's office. If such determination approves the establishment of a new HPD,
the Town Clerk shall cause the Official Zoning Map to be amended accordingly.
2. If not designated already, the Town Board shall designate the subject community
facility as a "Historic" landmark prior to issuing approval and as such the said
facility shall adhere to all the requirements imposed by Chapter 170.
3. Revocation; extension.
a. Upon request to the Town Board, on notice to the applicant, and for good
cause shown, the establishment of an HPD may be revoked 18 months
after said Town Board approval thereof if work on the site has not
commenced or the same is not being prosecuted to conclusion with
reasonable diligence.
b. The Town Board, upon reauest of the anolicant and upon good cause
being shown, may, in the exercise of its discretion, extend the above time
period.
C. In the event of the revocation of approval as herein provided, the HPD
shall be deemed revoked, and the zoning classification of the subject
property shall revert to the zoning classification that existed on the
property immediately prior to the establishment of the HPD thereon, and
the Town Clerk shall cause the Official Zoning Map to be amended
accordingly -
4280 -196. Maintenance and termination.
A. The communitv facility and its facade shall be maintained in good repair and in
accordance with all applicable provisions of the Property Maintenance Code of the New
York State Uniform Fire Prevention and Building Code and Chapter 170.
B. Following the Town Board approval of the HPD, the applicant shall file in the office of
the Suffolk County Clerk covenants and restrictions in a form approved by the Town
Attorney. The covenants and restrictions shall contain terms and conditions as the Town
Board and the Planning Board deem necessary to ensure that the community facility and
facade are maintained in good repair and in accordance with the Property Maintenance
Code of the New York State Uniform Fire Prevention and Building Code and Chapter
170.
C. If the community facility is demolished or otherwise destroyed, the HPD shall terminate

immediately and the zoning classification of the subject property shall revert to the
zoning classification that existed on the property immediately prior to the establishment
of the HPD thereon, and the Town Clerk shall cause the Official Zoning Map to be
amended accordingly.
D. Failure to comply with this section shall be a violation punishable pursuant to X280-155
II. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
III. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

Financial Impact:
Create Capital Budget for Stormwater Mitigation Project funded by NYS DEC grant
WHEREAS in 2014 the Town Board of the Town of Southold appropriated a $193,844 grant
from the New York State Department of Environmental Conservation Aid to Localities
(C303426) for Stormwater Control Infrastructure Upgrades and Mitigation for the Grove Road
Stormwater Mitigation Project that requires no match from the Town, and
WHEREAS the Grove Road Stormwater Mitigation Project was completed at a cost of $53,590
leaving $140,254 available for other Stormwater Mitigation Projects, and

this grant and that a new appropriation for Stormwater Mitigation Projects should be created in

RESOLVED that commercial landscaping and tree removal companies will no longer be
permitted to deposit any loads of branches or yard debris for removal in the Town's right-of-
way. It will be the homeowner's responsibility to make certain that their contractor(s) haul their
yard debris to the Cutchogue Compost Facility as anyone caught dumping in the Town right-of-
way will be fined for illegal dumping; and, be it further
RESOLVED that the Fishers Island Spring Clean -Up will also commence on Monday rip l 20
2015.

Countywide Comprehensive Debris Management Plan
WHEREAS, the Town of Southold wishes to work with the Suffolk County Fire, Rescue and
Emergency Services, the nine Townships in Suffolk County and our Federal, State and
Local partners to develop a Countywide Comprehensive Debris Management Plan pursuant to
the requirements as set forth by the Federal Emergency Management Agency (FEMA); and
WHEREAS, FEMA recommends that all municipal entities prepare management plans in
order to receive Federal reimbursement as the result of a Presidential Declaration; and
WHEREAS, as the partners prepared and submitted to FEMA the Suffolk County Multi -
Jurisdictional Hazard Plan in 2014 to comply with the Federal mandate, the same partners
will submit the Countywide Comprehensive Debris Management Plan to FEMA in June of
2015; and
WHEREAS, as a partner in the development of the Plan, the Town of Southold is eligible to
receive reimbursement for administrative costs pursuant to the grant obtained by Suffolk
County Fire, Rescue and Emergency Services not to exceed $8,500; and
WHEREAS, the development of this Plan is a Type II action pursuant to 6 N.Y.C.R.R.
§617.2 ( b ) and therefore no further SEQRA review is required; now, therefore, be it

opportunity for anybody that would like to address the Town Board on any issue to please feel
free?
Robert Hanlon, President Orient Association
ROBERT HANLON: Good evening. I am Robert Hanlon, I am the president of the Orient
Association. I would like to thank Supervisor Russell and the Town Board for prompt and firm
action in regard to the Cross Sound enhancement project that was part of NIMTIC's proposed
plan. The Board and the Supervisor have taken a very clear and firm view and stance objecting
to an increase in ferry traffic and truck traffic on Main Road coming through Orient, East Marion
and the rest of Southold and we do appreciate that. The project will be voted on in April, by that
board and we are hopeful that they will remove it from their agenda but the work is not done.
We still have the federal and state DOT's as well as the Connecticut DOT and MARAD that list
this project as an ongoing activity and we will be working and we look forward to looking to the
Board to continue to fight this project so we can have high quality roads without an additional
burden. Thank you again for your very firm and clear assistance on this.
Lori Hollander
LORI HOLLANDER: My name is Lori Hollander and I am from Southold Town. Supervisor
Scott Russell and Board members. I would like to talk about the short term rental concerns in
Southold Town. The quality of life for residents in North Fork is being increasingly affected by
the unregulated short term rental market. People who bought their homes in residential
neighborhoods can now find themselves living next to an unregulated, unsupervised and
unlicensed property functioning as a commercial business. The ability to make a profit from
short term rentals is encouraging speculators to buy up lower priced homes to be used as rental
businesses. This practice is depleting the affordable housing market needed to ensure working

class families a place to live in our community. One in two family homeowners situated in
residential neighborhoods are increasingly advertising their homes for rent on commercial
websites such as Airbnb and Home Away. When they list their homes for rent to large groups of
unrelated adults, they are not in compliance with the Southold Town code. The code defines one
and two family homes as non-profit housekeeping units. B and B's in residential neighborhoods
are licensed to rent to transients on a short term basis. B and B's owners must be in residence
and undergo a rigorous licensing procedure that includes regular inspection for room size per
person, safety regulations, minimum on-site parking space requirements and insurance. B and B
owners must obtain permits and supervise their property as well as pay licensing fees and taxes
to the town. These taxes pay for such things as police, fire, highway services to name a few.
Currently, short-term rental property owners who are using their homes as businesses are not
subject to any of the regulations or taxes that other similar businesses such as B and B's, hotels,
motels must follow. The towns of East and South Hampton have grappled with the negative
effects of these short term rentals for a much longer time than we have. To protect their
residents, they were forced to implement regulations. The following regulations are examples of
what South and East Hampton adopted. We would like Southold Town to consider similar
guidelines to protect its residents. One, required issuing rental permits on a yearly basis. Two,
limiting property owners ability to rent for less than two weeks to only three times in a six month
period. Three, restricting acceptable sleeping area to 70 square feet for one person and an
additional 50 square feet of floor area for each additional person. Four, onsite parking
restrictions limiting renters and their guests to parking only in the driveway of the home which
they are renting. Five, routine inspections to ensure that health and safety regulations are met.
Six, rental tax implementation to meet with current tax code for commercial rentals. The
residents of Southold Town understand that there are tools within our code to remedy the spread
of this rental problem. The codes are enforceable and amenable. The residents of Southold
Town are asking the Town Board to join them in an effort to preserve our community's integrity
by initiating code restrictions for this form of rental. The following are examples of the number
of Southold Township family residents that are advertising home rental availability on websites
such as BRBO and Home Away and I am just going to say that these are only two of the many
websites that these homes are listed on. Orient Point currently has 9 available rentals on BRBO,
Orient itself has 16 available rentals on BRBO and 25 available on Home Away. East Marion
has 30 available rentals on both. Greenport has 64 available rentals on BRBP and 67 on Home
Away. Southold has 99 on BRBO and 100 available rentals on Home Away. Peconic has 10 on
both, Cutchogue 27 on both, New Suffolk 9 on both, Mattituck 21 on both and Laurel has 11 on
BRBO and 9 on Home Away. That is a total of 296 rentals in our area on BRBO and 298 on
Home Away and I can tell you that we looked last week and we looked last night and it went up
by 8 rentals, 8 houses in one week. Thank you.

Mike Griffin, East Marion
MIKE GRIFFIN: Good evening, Mike Griffin from East Marion. I would like to address the
issue of short-term rentals also. Supervisor Russell and Town Board members. My wife and I
moved permanently out to East Marion about 5 years ago for our retirement. We had been
vacationing out here since the early 70's, my wife since the 50's and built here about 10 years
ago. The reason we moved here include the same reasons you are here. The beauty of the area,

the family atmosphere, easy access to fishing and boating, clean waters for swimming and
clamming. The different pace of life. In short, we were attracted to the area because of the
quality of life that is found here that is no longer found up island. Recent advances in software
technology have created websites such as Airbnb and Home Away which allow for different type
of rental than most found in B and B's, hotels and motels in our area. Unlike the B and B's
which are highly regulated included owner residents, licensing requirements including room size
per person, minimum parking requirements, insurance and safety regulations and taxes to the
town. These new rentals are not subject to the same requirements. In other words, property
owners using their homes as businesses are not subject to the same regulations as B and B's,
hotels must follow. It is my understanding that current town code prohibits short term rentals
and rentals to more than 5 unrelated people. The violation of this code is already occurring and
is negatively impacting the quality of life here, something that we all cherish. As speculators
buy up lower priced housing stock to be used as rentals, working class families are losing
opportunities to own their own home and may seek alternatives such as Habitat for Humanity.
One home is currently being built in Orient. The proliferation of party houses in our town will
only degrade our neighborhoods and change a very beautiful place. But something can be done.
As mentioned previously, the south fork has been dealing with this problem longer than we have.
The town of East Hampton has created a set of codes which offer a template for our town.
Guidelines should include rental permits, required on a yearly basis; property owners limited to
rent for no less than two weeks, three times in a six month period. Defining bedroom sleeping
areas as 70 square feet per person and an additional 50 square feet for each additional person.
Parking restrictions requiring renters and guests to only park in the driveway of the home.
Routine inspections for health and safety. Application of commercial tax codes to residential
rentals. The creation of codes brings up the issue of enforcement. Enforcement is required not
just during the week but more importantly on the weekend. The cost for this should not have a
major impact on the town budget. It was reported in the July 30th Traveler -Watchman, the
Independent, that Southampton town's code division levied $94,000 worth of fines from June 1,
2014 to July 30, 2014. The collection of close to $100,000 in fines could itself pay for a couple
of code enforcement officers. Please take action on short term rental codes. We are on a crest of
a wave, just check Airbnb for your local community. Thank you.

Miriam BIssu, Orient -By -The -Sea, Pres. Prop Owners Assoc
MIRIAM BISSU: My name is Miriam Bissu and I live out by Orient Point. I would like to offer
these personal thoughts about the short term rental issue that is coming up before the code
committee, I understand tomorrow. I have been living in Orient by the Sea for 10 years now and
I have served on the board of directors of the association and am now the president. Our
community is a peaceable group of many older and retired people, veterans and families.
Recently some of our neighbors have been renting out their property for one or two weeks or
weekends at a time. There have been parties at all times of the day and night with loud music.
Unruly groups of what appear to be unrelated adults have rented homes for the sole purpose of
partying all weekend. In some instances, the homes were rented from speculators who chose to
put their capital at risk by investing in properties they do not live in. they are taking advantage of
newly created websites to draw vacationers to our area. They are maximizing their profits at the
expense of the majority of homeowners in our subdivision who have invested their time, energy

and financial resources in their home and in their community. Not all of the property owners
using commercial websites are speculators. Some of them are people who own second homes in
our area, who are finding they can no longer use them or afford them. Rather than sell the
property, they open it up to strangers. The result is just as damaging to the community.
Weekend or weekly vacationers do not build community. They do not subscribe to the same
values, interests or life-styles of those who have retired here or are raising families, working and
voting in the community. Those who rent their homes for short periods diminish the value of
property of homeowners who reside full-time in the community. Orient by the Sea is a
residential community. Our subdivision is not zoned for commercial use. We do not want
homes in the subdivision to become motels or rooming houses. I would like the Town of
Southold to enact a code that would regulate short-term rentals and limit rentals to no more than
four to six unrelated adults. The Town Board has a long history of listening to the will of the
people and coming to their assistance in resolving issues such as the one I have described. I am
confident that the Board will consider the needs of the community at large in developing a code
that enables us to preserve our community and our way of life. Thank you.
Maribeth Edmonds, Mattituck
MARIBETH EDMONDS: Hi. My name is Maribeth Edmonds, I live in Mattituck and I am
here is support of Airbnb, albeit with regulations. My husband and I travel a lot of we
discovered Airbnb and we found that it was a way that we prefer to travel because it is so
interesting, to stay in a home with a family that is full of life and full of the unique perspective of
people who actually live in the place that you are visiting. And once we have done enough of
that over the years, we decided to do it ourselves. I would like you to see the other face of
Airbnb which are people like myself and my husband, people who are working professionals,
who have a lovely home that we cherish. We also love our community, we love our neighbors,
we don't want any harm to come to our house and we don't want any loud noise, we go to sleep
early. We regulate who comes to our house. We are there, in attendance. We offer them local
North Fork treats. North Fork potato chips, Catapano cheese. We send them out in search of
North Forks treasures. The carousel, the observatory, all the restaurants, we show them what the
North Fork is and we regulate their behavior. We also want good, strict regulations but don't
throw out the baby with the bathwater.
Anne Murray, East Marion
ANNE MURRAY: I am Anne Murray from East Marion. I have been here before about this
issue, a couple of months back and again, I want to say that I believe the Town Board should
take action very, very soon and address this problem of the residential short-term rentals before
the summer season starts. It may already be too late because I understand a lot of homes have
already been rented for most of the summer on some of these sites, so I am told by my neighbors.
I think that short-term rentals and rentals to more than five unrelated people are negatively
impacting the quality of life in many neighborhoods, as you have heard. And the problem is
escalating. Unless the Town Board takes timely action, party houses will exist in every hamlet
and I think they already do. Reducing a number of negative consequences, reminiscent, I might
add, of the Vineyard 48 scenario. And I have heard stories like that. It won't be long before
young people in a party house are going to be going in people's yards, I have heard stories about
that already. Many communities have adopted codes to address this problem. As you know,
East Hampton, Southampton. Those codes might be a blueprint for you to draft a new code in

this regard. But the key is going to be rigorous enforcement. And we know code enforcement is
always an issue in this town. I wish it weren't but if you institute permits for rentals and fine
those who ignore the codes, that would ensure that code enforcement might pay for itself. And
again, I think that no one should have to live next door to a nightmare scenario. Please take
action before the summer season starts again and I have no problem with people like this woman
before me who obviously maybe stays in her home while she rents through Airbnb and entertains
her guests something like what a B&B would do but it's the speculators who worry me and I
have seen it, I have seen homes like that. They have no interest in our community except taking
money out of it and they are not putting anything into it. Several of my neighbors in East Marion
have also signed letters similar to mine, I will give these to you and I think you have gotten some
more comments via email. Thank you.
Abigail Field, Attorney, Cutchogue,
ABIGAIL FIELD: My name is Abigail Field and I am an attorney in Cutchogue and I represent
about a dozen homeowners who rent their houses on VRBO. They couldn't come tonight but
they will whenever you have an actual bill in front of you because they are eager, like the woman
before to give a face to the responsible slice of the renters, the property owners. This is not, not
everyone who does this is a speculator who is looking to simply extract the wealth by exploiting
the community. In fact, my clients use their homes part of the year. They hope to retire here.
They purchased here because they love the community and because they have invested a lot of
money in the renovating their properties and they want to live in these properties, they very
carefully screen their tenants. Require copies of drivers licenses, for example, large security
deposits. They do questionnaires to try to make sure that this isn't some kind of bachelorette
parties, some crazy scenario because they want to protect the asset that is their home, they want
to protect the community they live in. This is a real slice of who these people are. And in fact,
they request responsible regulation. They would like the bad actors to be caught and stopped
because they want to be able to continue doing what they are doing and they understand the
impact, the whole concept of the bad apples who wreck their neighbors quality of life. So just a
couple of points, I am not going to address all of the specific line items that people have put on
the table. But in general, we support rental permits and we support a rental permit fee that would
level the playing field with the B&B's and the hotels. We support strict enforcement. Again, we
want to get the bad actors caught. In fact, we support enforcement not just of a rental permit
code but of your light ordinances and noise ordinances which in and of themselves would
address some of these issues. The trespass code, right, nobody wants people invading people's
properties or being really bad actors. And as I will get into in a moment, we very much support
allowing weekend rentals to continue as long as it is done responsibly. Not one night because
those really are, tend to be the party crowds and besides which my property owners don't want
one night rentals, it is too much work, too much wear and tear on the property and it just doesn't
make any sense. But weekends are very important. Why do I say the weekends are very
important? Well, we wanted to get a handle on the economic benefit to Southold Town of
having all of these rentals because, you know, when people come into town on vacation they
spend money. Now it is very hard to quantify how that impact directly because a comprehensive
survey is tough but my property owners and some of the people they know who do this sent a 10
question survey to former renters and 91 former renter groups responded. And those 91 groups
represented about 400 people and I will just give you some top line results from that survey.
Now remember this is maybe because of the friends, the survey went to maybe 2 dozen rental

properties and not every one of their renters responded to the survey and as you have already
heard, there's about 300 rentals in the Town of Southold during the year, so all of this economic
data understates the money being spent here by about an order of magnitude, it's even bigger
than that. so the first takeaway, the majority of rentals are one weekend, 57%; one third were
one week; 6% were two weeks and only 4% were more than two weeks. So if you really make a
long minimum, you will either result in large illegal renting because if the code isn't enforced
and to us, that's crazy. If you are going to pass a code, you should enforce it or if you pass a
long minimum and you enforce it, you are going to lose all of the economic benefit to the town
as a whole. And let's remember that the economic benefit isn't simply to the business owners as
I get into it that get patronized, it's also to the young people who work there or the old people
who work there. there aren't a lot of jobs that you can make good money on but tip based ones
in high end restaurants are pretty good, right, I am talking about people that don't have
professional degrees and all the rest, it is helpful if our restaurants could stay open year round. It
is helpful if they are full during the week, on and on, right? Not just the restaurants, our farm
stands, our crafts people, so I will get into the data in a second. The impacts, the positive ones,
affect a broad swath of people. Not simply the property owners. So like I said, most of them are
weekenders or one week, most plan to come again but fully 71% said if you don't have VRBO,
they either are unlikely or somewhat unlikely to stay in a B&B or a hotel. And what that means
is, there is some overlap. There is some overlap between these markets but it is not a one for one
and one of the reasons it's not a one for one is that some of these are families with kids or they
come with a dog or they want to be able to cook a meal together and they shop at the farm stands
for the fresh, local produce. It's not, and frankly, I know someone who gets clients as a B&B
from people who are previously rented from VRBO because they come out here that way, they
discover how wonderful the community is and then they want to come back for the romantic
getaway or something. So actually while they are not always the same market, there is ways
they blend into each other. It can actually be a win-win in that regard. So in terms of actual
dollars, these groups reported spending on average per group about $1,850 and it was a total of
almost $170,000. And again, that understates it by at least an order of magnitude because this is
such a small percentage of the renters. So you are talking about more than $1.5 million a year.
and where is this $1.5 million going to? The biggest category was dining out, people tended to
go to a restaurant between 3 and 5 times while they were here. Fully a quarter went out 5 to 7
times; 13% went out more than 10 times. You know, they tend to go to multiple establishments.
More than half went to 3 to 5 different establishments, another quarter went to 6 to 9%. They
tend to go to expensive restaurants. Almost half went to the Frisky Oyster, 39% to Noah's, 31 %
to North Fork Table and Inn; 30% to Blue Canoe. By the way, those were just voluntary recall,
right? That's not supposed to be a comprehensive list of establishments. And like I said, food
and retail 81 % for produce at a local farm stand, 76% bought local art or handicrafts, 35% rented
local transportation, 35% rode the Greenport carousel or skated on the ice rink, 27% went to a
local spa, 14% chartered a fishing boat and you know, on just those activities, a quarter of the
residents spent somewhere between $500 and $1,000. And 21% spent more than $1,000. So it is
real money coming and again, this is a large enough sample to mean something but still, it's a
very small proportion of the total number of people coming in, so the economic benefits are
vastly greater. Almost half were first-time VRBO renters in our area, so it's sort of a gateway
for people to discover us and again, people can come back and stay in B&B's and the like. A
quarter, in fact, had been twice to VRBO because they came back. So just to give you a flavor

for some of the comments that were given. `This is such a shame if it gets prohibited. I
completed the survey and made sure to comment on how disappointing this would be and how
much potential business the town of Greenport would lose out on just based on our group of 7's
desire to return both as a group of 7 and with other friends and relatives. And Greenport, as you
know, the Village would be outside this law. They are considering their own law but large parts
of Greenport itself would in fact be covered, so (inaudible). Part of the survey, `As part of our
trip, we actually met with a realtor because we are actually interested in buying property and he
told us of this possible law. I mentioned it in the survey, if not for VRBO, we never would have
visited and since discovering it, we have been back more than three times. We truly love it there
and given our circumstances (children, a dog etc.) a hotel or B&B just doesn't suit our needs.
We go into town a lot and bring in revenue that would otherwise not come in.' `Hi, I would like
to add, there wasn't a space for comments anywhere else, everyone in my family, I have five
adult children, a sister and a brother received Christmas gift baskets from Vines and Branches
this past Christmas and I intend to order to restock my supply. We discovered the lovely store in
our stay in your lovely home last year.' and it goes on, and I actually should have pulled 20 or 30
comments but I didn't want to come with a huge stack. The point is to illustrate these people do
come, they fall in love out here, they spend money. And so, in conclusion, we urge you guys to
pass a responsible regulation. We want to out and catch and stop the bad actors. We want to be
able to continue to enjoy both the profound economic benefits but also protect the quality of life
of year-round residents. So we urge you to be very careful in how you do this, so that the right
balance can be struck to both allow this to continue and to protect people. And as you said
before, at the end of the day it's all going to be about enforcement. So we really encourage
yourself to invest in it and really dedicate both the resources and commitment to it. Thank you.

Deborah Pitareno, Prop. Greenporter Motel
DEBORAH PITARINO: Good evening, my name is Deborah Pitarino and 15 years ago, my
husband and I bought a small hotel with some adjacent property, the motel is called the
Greenporter Motel and we purchased that and we did an enormous renovation and purchased
other parcels of land and built new construction. In order for us to operate that property, first of
all we had to get building permits and there were zoning issues and we weren't able to build a
party hall because there were noise ordinances, there were zoning issues as a result. We needed
to have permits to operate, so we needed to get a hotel license. We need to renew that hotel
license every year. every year we also are subject to Suffolk County inspections, so Suffolk
County comes and inspects unannounced on a regular basis, to ensure that we are following all
protocol to ensure that our customers are safe and that we are in compliance as a hotel property.
We are also required to have insurance that is related to, it's directly connected to our gross
annual sales and we are also obligated to collect local occupancy taxes, there's a local hotel
occupancy tax. That's 3%, we are obligated to collect 8% New York State sales tax and the list
goes on and on and on. All of the regulations that we are subject to and all the taxes that we pay,
as we all should as American citizens, I believe we should all pay taxes. So I think that what
bothers me as a business owner and as a lodging establishment is that this is not a level playing
field. So I am obligated to collect sales tax, which adds about 10% on to the cost of the room, I
am obligated to pay for hotel permits, I am obligated to have commercial insurance in place and
all of this is an enormous cost, so then I also couldn't build more rooms because of parking
constraints in the area. An interesting thing is, when many people come to stay at the Greenport,

many of them are going to weddings and because we don't do after party hour parties because
we are in a residential area and there are noise ordinances, we tell them we cannot have an after-
hours party, so they rent houses. And we know for a fact they rent houses and they have the
after-hours party there because they give their guest an itinerary for the weekend which states
where the after-hours parties are. So it bothers me that these people, they are probably not
paying income tax on this money or I don't imagine that all of them are, by the way, I am not
against Airbnb, I am not against this, I believe any American should have the right to operate a
business as long as they are operating within the terms of the community laws and as long as
they are paying taxes. But if you look at the, I didn't bring a copy of this because I just wrote
this off the top of my head, there is a publication published by New York State called publication
848 and it gives you all of the entities in New York State that must pay sales tax and there is a
special section called 848 for hotels and it gives you the definition of a hotel. The definition of a
hotel is a building which is regularly used and kept open for lodging of guests. So in my
estimation, these private homes that are being rented for regular lodging as a hotel or operating
hotels, they are not subject to the same, all of the restrictions and code enforcement and taxes
that I have to pay, so it makes me wonder as a businesswoman, well, perhaps I will surrender my
hotel license, since I live at the Greenporter hotel, I am going to surrender my hotel license and
then I won't be subject to this anymore. I am going to have after-hours parties, I am not going to
charge sales tax, I won't have to pay an occupancy tax, I won't have to pay commercial
insurance anymore and I will be in line with everybody else and how does that sound? So, you
know, we need to keep in mind that our founding father's tossed a sea of tea into the water
because they didn't want taxation without representation. But now what we have is
representation without taxation. And I think that that's wrong and I think that you are all
obligated to take a stand on this and create a fair playing ground for all of us as Americans and as
citizens of the North Fork. Thank you.

Tom Edmonds, Mattituck
TOM EDMONDS: Good evening, my name is Tom Edmonds, I live in Mattituck. My wife
spoke before. We started our Airbnb business this fall because my wife and I both work for non-
profits and we both have an enormous mortgage, so yes, we do pay taxes, quite a bit and we love
paying the taxes, we love supporting the schools. The schools are wonderful out here but as
homeowners, we were having a tough time. We opened up our business this fall and we were
booked immediately through the winter. I think we have absorbed a lot of interest in the North
Fork from people from Europe and from Brooklyn. Those are our primary guests and they are
fulfilling, they are sustaining the North Fork businesses. 50% of our guests to our Airbnb place
and we have between 2 and 4 guests at a time, no more, 50% arrive here by public transportation.
And anybody that has taken Sound Avenue in the fall knows what day trippers do to the North
Fork. Our guests come by, 50% of our guests come by Jitney or the Long Island Railroad and
they stay for 2 or 3 days and they eat out 2 or 3 times during their stay. We do not provide a
kitchen, we actually just provide two bedrooms, so they are supporting the economy all winter
long and I think that's what we want here on the North Fork. The rising interest in the North
Fork can't be stopped, motels and hotels and B&B's and Airbnb's can absorb this new economic
growth that we can experience here and also, by having short stays, we are helping provide the
right kind of visitors we want on the North Fork, not day trippers who come out, buy a pumpkin

and go back to mid Island or wherever they come from. These are people who stay for a long
time, enable working people to survive here year round. Thank you.
COUNCILMAN DINIZIO: Sir, can I ask you a question?
MR. EDMONDS: Sure.
COUNCILMAN DINIZIO: Do you live in the house?
MR. EDMONDS: It is my primary residence, yes. And I live there full-time.
COUNCILMAN DINIZIO: Do you have a B&B license?
MR. EDMONDS: I welcome regulation. No, we just started this in the fall.
COUNCILMAN DINIZIO: There is already a regulation that allows you to do what you are
doing.
MR. EDMONDS: We haven't done the research but my wife and I are all for regulations of all
kinds, so that we can all enjoy the new economy.
SUPERVISOR RUSSELL: Just in the interest of clarity, I think Jim's question was, do you live
there while you are renting it out?
MR. EDMONDS: Yes, it is our only home.
COUNCILMAN DINIZIO: you are running a bed and breakfast, sir. That is not the subject,
even the subject of this hearing, actually. You can go to the town, to the building department
and get a permit to do exactly what you are doing, sir.
MR. EDMONDS: I didn't know that and I ....
COUNCILMAN DINIZIO: What you are trying to support here isn't what we are talking about.
MR. EDMONDS: Okay. Okay, good.
COUNCILMAN DINIZIO: I wish you all the luck. We actually encourage that.
MR. EDMONDS: Okay.
COUNCILMAN DINIZIO: Our rules anticipated that we would, you know, probably 15-20
years ago we wanted people who couldn't afford their homes to live in their homes and rent out
to people, we thought of that. it is in our code. And you are just exactly what we were thinking
about.

Scott McIntyre, Greenport
SCOTT MCINTYRE: Hi, I am Scott McIntyre from Greenport. One thing that hasn't been
mentioned is the value of my property and how it decreases by the party house that I live next
door to. And this particular house is not like the people who have just talked, they are absentee
landlords, they rent to and we, they were rented all summer and most of the winter and they are
filled up for the next season. Four of the weekends had at least 12-15 people in that house, they
were here for weddings, the limousine came, picked them up, took them to the vineyards. It is
great, they are bringing in lots of money for Greenport but what does it do to the value of my
property is what I would like to know. That is it for what I have to say.
SUPERVISOR RUSSELL: Thank you. Who else would like to address the Town Board on this
issue or any issue under the sun? Yes.
Roger Herman, Greenport
ROGER HERMAN: My name is Roger Herman and personally, I haven't been affected as Mr.
McIntyre because my next door neighbor is living in her house. But if she followed the same
practice and went to Texas where she is planning to migrate to and she rented her house every
weekend to a party or college kids or other people having a party late at night and you call the
police and the police come by and for 20 minutes it is quiet and then it gets noisy again and you
get 8 or 10 cars parked in front, I wouldn't like it either and I don't think that renters per se, if it
is a short term basis, not two weeks or more or even for the summer but overnight or a weekend,
they don't care about noise, they don't care about inconvenience of neighbors. If they come with
a limo it might block the street to fire and other emergency vehicles. So I do think it does create
a problem and I wouldn't prefer to live next to that myself. And that is not why I moved to
Greenport. Thank you.

MS. FIELD: If it is possible, I would just like to add two comments I forgot to make before.
One is simply that we actually support a limit on the number of permits that any person could
have and it would need to be done and the drafting on this would be tricky but we don't want
speculators either, right. It is important in the regulation to not facilitate rental farming
essentially, we want to make sure that whatever you guys come up with makes it possible that it
is people like my clients or some of the other people that you have heard about and not LLC's or
whatever from way up island who want to be absentee landlords and just buy up properties. The
second point I forgot to make before, if you go on the VRBO site, these are not low end

properties that are being snapped up to turn out, for starters, 300 of these out of 20,000 housing
units in the town, so at the moment it is not having a big impact on the quantity of housing stock
at any sort but when you look at the rentals, they are high end properties. If you think about that,
that makes sense. I mean, they may not be multi-million dollar mansions but they are nice
properties, they might have a pool, they might have a view, so we just would like this is having
zero impact on affordable housing as of now. we could imagine a world in which if you allowed
people to have 10 or 4 or whatever number of rental permits, that maybe it would eventually
become a significant portion of housing stock and maybe it would go down into a lower
(inaudible) that we would like to put on the table that you look at regulating that down the road.
At the moment, we see that there is absolutely no impact whatsoever on affordable housing. You
could maybe find one here, one property there, that's not the big driver of this. Thank you.
SUPERVISOR RUSSELL: Thank you. Would anybody else like to address the Town Board on
any issue?

MS. MURRAY: I have a question. Is the Town Board going to take any action on this in the
next month or so?
SUPERVISOR RUSSELL: We have a code committee meeting scheduled for tomorrow at 4:30
at the Annex. We have to, we will get in the room, look at some drafts and see if we can develop
consensus and develop input. I think we recognize we need to act, we certainly would like to act
as expeditiously as we can but that conflicts with our intent to be deliberate and thoughtful in
doing it. We are trying to accomplish two roles here.
MS. MURRAY: Thank you.

Councilman Dinizio
COUNCILMAN DINIZIO: I would like to say something. We had our work session today and
I just want to announce that we have a paper shredding event going on Saturday between 9 and 1
at the Peconic Rec center and I didn't see it on our website so I wanted to make sure everyone
was aware of that, it is really a good thing to get rid of all your check stubs. You can bring up, I
think 5 boxes full and they will grind them all up for you. Also, we also met with the CAC,
Conservation Advisory Commission and these gentlemen wrote a very detailed report about our
shorelines, that I think everybody in town should take a look at. They put a lot of work into it
and it is a problem that is not going to go away. You should make sure that's on the website, on
the CAC part of the website, you should all go to it and read it because that is the next 20-25
years they are talking some pretty serious things we are going to need to have to do and we are
going to still have some committees on that, that you should pay attention to and try to come
because if we let it go, if we let sea rise take hold, there's some roads that we are not going to
ever be able to pass. So, I have that and then on this Airbnb thing, you know, the only person
that came here for it is a bed and breakfast, I think I read your letter, you sent us a letter, no the
lady behind you. You sent us a letter, right? I am going, she has a bed and breakfast, just needs
a permit. And you know, the sticking point as I see it and I think we have gotten maybe 16-17

letters are all against it. I heard from only one gentleman who has a house in the Village of
Greenport which is not the subject of this law, that is for it. to me, it is not a question of whether
you want to make money or that someone is taking advantage of, it has to do with residents. It
has to do with people's expectations of their neighborhoods. And having a change of a neighbor
every weekend. Especially in the summer, you only got 8 weekends, you get 2 bad weekends
because some people want to you know, celebrate the fact that they are out here in this nice area
you know, and you lose, you have only got 6 left. It's not really a question of whether someone
can afford a house or not afford a house, I mean, on my street would have been a nice affordable
house for a nice family to live in and you know, if we have 300 houses, if they are sold to people
who live here, those people do the same thing that these people do. They shop in IGA, they go
to the farmstands, they do really everything except maybe eat out 5 times, okay, I can't imagine
myself doing that during the course of a week, so I think the economic impact really is skewed,
at least from the report we heard tonight, you know, because people who live here contribute to
our fire departments, to our ambulances, to our police department, they work here and they spend
plenty of money, pay their taxes, so you know, I am not buying that argument and I would hope
that you know, if there is any compromise I firmly believe that it's not legal to do but 300 people
in this town are doing it now. I just don't think that, I think that our codes address that, address
transients and transients are supposed to go in motels, bed and breakfast's are supposed to live in
those homes with those people and there is a reason for that because those people are going to
have to put up with whatever nonsense that someone comes out here and wants to celebrate on
the weekends, so, that's all I have to say. I hope you can come to that meeting tomorrow
because the more people that come, the more people give us the idea the better that law will be in
the end. Thank you.

MS. HOLLANDER: Will all the letters that we presented be present to read at this meeting
tomorrow?
SUPERVISOR RUSSELL: Tomorrow is basically a working meeting. It's a code committee
meeting, it is a more informal event. We look at drafts of what type of code we discuss with
each other, where we want to go with it, ultimately, code language is going to be presented as
part of a public hearing. It will be noticed in the paper and it will be printed on the website and
then there will be the formal process where we take all the input. Obviously all the emails I get,
pro and against, I distribute to the Board as quickly as I can so they have an understanding where
the community is coming from. But as far as the input, the formal input, that would be during a
public hearing. Tomorrow, like I said, is just a working meeting.
MS. HOLLANDER: But when they do this working meeting tomorrow, are they looking, they
are not looking at all these letters?
SUPERVISOR RUSSELL: The Board gets all of the input. How they view that input in terms
of their own decision making is something that each of them needs to answer.
MS. HOLLANDER: I know that the Board gets it but what I am asking is, will the code
committee?

COUNCILMAN DINIZIO: We are. I can tell you this, I would really like to get the drafts out
so you people can see where we are going with this but I am not so sure I can do that. I think that
you would benefit from the ongoing thinking on this thing. Basically the only way you are going
to do that is to come to the meeting. From what I can gather.
SUPERVISOR RUSSELL: If we can develop a draft that everybody is, yes, there is a consensus
with this then obviously that's something that comes to work session of the Town Board and
then we will set up the noticing of it, we will distribute it to everybody. Like I said, we advertise
it, put it on the website and then we will have a hearing 30 days subsequent to that. Anybody
else?
Councilman William P. Ruland
COUNCILMAN RULAND: I would only like to say that it is a real credit to each and every
person who came here tonight to express their opinion, one of the things that I and I am sure my
colleagues appreciate more than anything is public input. When there is a problem or
occasionally when there is something good but usually it has something to do when there is a
problem and there is nothing better to see people come out and support it and I am sure many of
you have something better to do on a Tuesday night than to come here. But the fact of the matter
is, it is an important part of the process and as the Supervisor said, as this moves forward and I
for one would like to see it move forward quickly rather than slowly. I think that we have had a
fair amount of discussion, we have had a lot of input, we have received a lot of letters. I am sure
when we review drafts from the Town Attorney's office, the scope is rather narrow. It is not, in
my mind, a really wide scope because the issue is quite narrow. Can you or can't you? And if
you can't, that's one thing and if you can, can you do it with certain restrictions and I would
think they would be rather narrowly defined, in my mind. But more than anything, once that
draft is ready for as the Supervisor said, public hearing, we will notice that and people would
come and I would hope all of you would come to that public hearing. And for the written record
that goes along with the hearing, you would get up and say what you said tonight. From your
heart, however you feel because that's when it really counts. So again, thank you for coming.
