BOUNDARY LINE AGREEMENT
AGREEMENT made as of this 18th day of March, 2015 by and between North Fork
Housing Alliance, Inc., with an address of 116 South Street, Greenport, NY 11944 ("NFHA")
and Sound Industrial Inc., with an address of 11550 Sound Avenue, Mattituck, NY 11952
("Sound").
WHEREAS, the parties to this agreement are the present owners in fee of adjoining
parcels of improved real property and there is some confusion, doubt and uncertainty concerning
the precise location of the common boundary line between their respective properties, and the
parties wish to define and establish such boundary line for all time, it is agreed as follows:
1. NFHA represents that they are the present owner in fee of the premises known as
11600 Sound Avenue, Mattituck, Town of Southold, County of Suffolk, State of New York,
which property is more fully described in a certain deed executed by NFHA, dated August 17,
1995, and recorded in the office of the of County of Suffolk on August 24, 1995 in Liber 11738,
page 766. See Schedule "A" attached.
2. Sound represents that they are the present owner in fee of the premises known as
11550 Sound Avenue, Mattituck, Town of Southold, County of Suffolk, State of New York,
which property is more fully described in a certain deed executed by Sound Industrial Inc., dated
June 8, 2000, and recorded in the office of the of County of Suffolk on June 22, 2000 in Liber
12050, Page 609. See Schedule "B" attached.
3. The boundary line on the southerly edge of NFHA's property (the "Southerly
Boundary Line") is uncertain because of a storage container maintained by Sound on the north of
the southerly Boundary Line.
4. The boundary line on the westerly edge of NFHA;s property (the "Westerly
Boundary Line") is uncertain because a portion of a building erected by Sound lies east of part
of the Westerly Boundary Line (the `Building Encroachment").
5. Annexed hereto and made a part of this agreement is a survey made and certified
by Nathan Taft Corwin III Land Surveyor and dated February 25, 2015, which establishes the
common boundary of the adjoining parcels in accord with the agreement of the parties to this
agreement.
6. NFHA hereby releases and quitclaims to Sound and its heirs and assigns forever,
all right, title and interest in and to any and all land south of the Southerly Boundary Line
established by the above survey and all land west of the Westerly Boundary Line established by
the above survey.
7. Sound hereby releases and quitclaims to NFHA and its heirs and assigns forever,
all right, title and interest in and to any and all land lying east of the Westerly Boundary Line
established by the above survey and all land north of the Southerly Boundary Line established by
the above survey.
8. NFHA and Sound agree that the Building may remain for as long as same shall
stand.
9. This agreement shall run with the land and be binding upon the parties hereto and
inure to the benefit of their respective heirs, representative, successors and assigns.
