PROPERTY LOCATION: 67575 Main Road (aka State Route 25), Greenport, NY SCTM# 1000-52-5-58.3 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 12, 2014, stating that this application is considered a matter for local determination as there appears to be no significant county -wide or inter -community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicant's property is an irregularly shaped 40, 659 sq. ft. parcel in the LI Zone. The northerly lot line measures 180.94 feet along an adjacent parcel. The easterly lot line measures 304.03 feet along Main Road (SR 25). The southerly lot line measures 170.87 feet long another parcel. The westerly lot line measures 218.76 feet long anther adjacent parcel. The property is improved with several storage containers, as shown, with the proposed new 40ft. x 80ft. commercial contractor's building, on the survey SP -1 drawn by James Deerkoski, PE, dated Oct. 31, 2014. BASIS OF APPLICATION: Request for Variances from Article XV, Sections 280-64A and 280-63 and the Building Inspector's November 5, 2014, amended December 1, 2014 Notice of Disapproval based on an application for building permit to construct a commercial building for landscape contractor's yard, at; 1) less than the code required front yard setback of 100 feet, 2) less than the code required minimum rear yard setback of 70 feet. RELIEF REQUESTED: The applicant requests two variances in order to construct a proposed commercial contractor's building with a front yard setback of 59 feet, where a minimum of 100 feet is required, and a rear yard setback of 21 feet, where a minimum of 70 feet is required. ADDITIONAL INFORMATION: The property was the subject of ZBA Appeal #5095, dated May 16, 2002, in which a previous applicant was granted variances for a front yard setback of 75 feet, and a rear yard setback of 41 feet. The Town Planning Board submitted a memorandum dated Jan. 8, 2014 expressing concern about the status of access to Rt. 25 from this property. The memorandum referred to a Covenant & Restrictions document included with the original minor subdivision approval in 1988. They requested the Zoning Board adjourn the hearing to Page 2 of 3 - April 2, 2015 ZBA#6822 — Soundside Landscape, Inc. SCTM# 1000-52-2-58.3 allow the Planning Board to review the application in the site plan process. On March 17, 2015 the Planning Board submitted a second memorandum stating they are not requiring the cross access easement and that the applicant should explain to the Zoning Board how they meet Town Code for lot recognition under Code Section 280-9. They further stated they support the variances as applied for. At the hearing the applicant provided information proving they meet town code for lot recognition. Site Plan approval is necessary for the applicant, and the Planning Board will address those C&Rs, and any other concerns they have during the site plan approval process. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on Jan. 8, 2015, and on March 19, 2015, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This property has established commercial and industrial uses that are allowed by code, and that are compatible with the uses on other properties in the Light Industrial Zone. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The size and shape of the property limits the area where the proposed structure can be built, and still allow for on site maneuverability of the trucks and equipment used by the contractor. There is no conforming location available to locate the new building, and therefore the variances are necessary. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 41% relief from the code for the front yard setback of 59 feet, and 70% relief from code for the rear yard setback of 21 feet. However, the property is situated in an area containing long established industrial uses, and there are other commercial buildings with non -conforming front and rear yard setbacks located within the adjacent neighborhood. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant will establish vegetative screening along Rt. 25 as shown on the site plan. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new equipment storage building, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Goehringer, and duly carried, to GRANT the variance/variances as applied for, and shown on the survey SP -1 drawn by James Deerkoski, PE, dated Oct. 31, 2014. CONDITIONS: 1. Southold Town Planning Board site plan approval is required. 2. The applicant will establish vegetative screening along CR25 as shown on the site plan. Any deviation from the survey, site plan andlor architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. This drain is to contain 12 lenghts of 4” ADS perforated pipe, (3 wide x 4 high pattern). This French Drain is to be lined with filter cloth to insure sediment will not infiltrate the gravel and reduce the efficiency of the system. All 4" corrigated and perforated pipes are to be installed on a 4" bed of gravel at the base of the trench. The French Drain will then be filled with Gravel to @ 6" below the final grade and the filter cloth will then be overlapped across the top of the gravel and covered with 6" of clean sand to create the shoulder area. Southern French Drain dimensions are as follows: The 100 foot long by 4 foot wide Western leg of french drain runs North to South along the Western property line and then continues in an Easterly direction along the Southern property line for 65 feet by 4 foot wide. This drain is to contain 20 lenghts of 4" perforated ADS pipe, (5 wide x 4 high pattern). This French Drain is to be 4 feet wide and 3'-6" feet deep and lined with filter cloth to insure sediment will not infiltrate the gravel and reduce the efficiency of the system.. The depth of the French Drain will insure the that the bottom of the system will be at the level of the Brown coarse to fine sand as well as below the frost line giving us the max permability rate. The French Drain will then be filled with Gravel to @ 6" below the final grade and the filter cloth will then be overlapped across the top of the gravel and covered with 6" of clean sand to create the shoulder area. Southern French Drain dimensions are as follows: The 100 foot long by 4 foot wide Western leg of french drain runs North to South along the Western property line and then continues in an Easterly direction along the Southern property line for 65 feet by 4 foot wide. This drain is to contain 20 lenghts of 4" perforated ADS pipe, (5 wide x 4 high pattern). This French Drain is to be 4 feet wide and 3'-6" feet deep and lined with filter cloth to insure sediment will not infiltrate the gravel and reduce the efficiency of the system.. All 4" corrigated and perforated pipe are to be installed on a 4" bed of gravel at the base of the trench. This Agreement is exclusive of the claims, if any, of persons other than owners of the appropriated property, their tenants, mortgagees and lienors, having any right or interest in any stream, lake, drainage and irrigation ditch or channel, street, road, highway, or public or private right of way, or the bed thereof, within the limits of the appropriated property or contiguous thereto. 5. This Agreement is also exclusive of claims, if any, (other than the claim of Claimant) for the value of or damage to easements and appurtenant facilities for the construction, operation and maintenance of publicly owned or public service electric, telephone, telegraph, pipe, water, sewer and railroad lines. 6. The Claimant hereby reserves the right to file a claim with the Court of Claims, or, if a claim has been filed, reserves the right to prosecute said claim, it being understood, however, that such reservation shall not extend or affect in any way the time limited for the filing of such claim as provided for in the Eminent Domain Procedure Law. cm 7. It is agreed that, if the Court of Claims finds the value of the property appropriated and legal damages caused by said appropriation as set forth in paragraph numbered 1 above is equal to or exceeds the advance payment made hereunder, the amount of such advance payment shall be deducted from the amount so found by the Court and the award of said Court shall be in the amount of the excess, if any, over and above said advance payment. It is also agreed that no interest shall be allowed in such award on the amount of such advance payment. In the event the amount so found by the Court is less than the amount of said advance payment, upon the filing in the office of the Clerk of the Court of Claims of a Certified copy of this agreement together with Certification by the Comptroller of the State of New York of such payment and upon application made to the Court on at least eight days notice to Claimant, the Court shall direct the Clerk to enter judgment dismissing the claim and awarding to the State the difference between the award as found by the Court and the amount of said advance payment with appropriate interest. It is further agreed that in any trial of a claim that may be filed by the Claimant, neither the determination of the Commissioner of Transportation, as hereinabove set forth, nor any data, estimates or appraisals made or prepared in support thereof, shall be evidence of the value of the claim or of the property affected by said claim. 8.
