WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,

at Peconic in the Town of Southold, County of Suffolk and
the State of New York, bounded and described as follows:
BEGINNING at a point on the northerly line of Middle Road, County Road
27, at the South westerly corner of Lot 2 on "Map of Peconic Homes" ,
filed Map No. 4181;
RUNNING THENCE North 42 degrees 09 minutes 00 seconds West along the
easterly line of the property shown on Map, 180 feet; THENCE North 51
degrees 51 minutes 50 seconds East along land of Vincent Simeoni 125
feet;
THENCE South 42 degrees 09 minutes 00 seconds East still along Land of
Vincent Simeoni 180 feet to the northerly line of the fill easement
taking area appropriated by the County of Suffolk in connection with the
the reconstruction of a portion of Riverhead-Greenport Road (Middle
Road) , County Road 27; Suffolk County Action Index number 141464;
THENCE South 51 degrees 21 minutes 50 seconds West partly along said
0 0 fill easement taking area and partly along the northerly line of the
Middle Road, County Road 27, a distance of 125 feet to the point or
place of BEGINNING.
Being and intended to be the same premises as conveyed to the grantors
herein by Spartan Holding Co. , by deed dated 5/16/90.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of

aAND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
Lo1 the same first to the payment of the cost of the improvement before using any part of the total of the same for
f any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
