This Agreement made the 27th da of February 2015, between William L Pape, owner of ✓

property located at 500 Point Pleasant Road, Mattituck, NY 11952 (hereinafter "grantor") Party
of the First Part, and James Pape and Linda Pape, residing at 1885 HomeePi a NY 11952
(hereinafter "grantee") Party of the Second Part;
WHEREAS, the Party of the First Part is the owner in fee simple of certain real property known
as and by 500 Point Pleasant Road, Mattituck, NY 11952, designated as District 1000, Section
114.00, Block 01.00, Lot 007.001 on the Tax Map of the County of Suffolk, State of New York,
and as more particularly bounded and described on Schedule A attached hereto and made part
hereof (hereinafter "Parcel A"); and
WHEREAS, the Party of the Second Part is the owner in fee simple of certain real property
known as and by 1885 Home Pike designated as District 1000, Section 114.00, Block 01.00, Lot
007.002 on the Tax Map for the County of Suffolk, State of New York, and as more particularly
bounded and described on Schedule B attached hereto and made part hereof (hereinafter
"Parcel B"); and
WHEREAS, Parcel A adjoins Parcel B; and
WHEREAS, a survey of Parcel B has been prepared by Barrett, Bonacci & Van Weele, PC, land
surveyor, dated February 5, 2015 (hereinafter the "Survey"), a copy of which is attached as
Exhibit 1. Said survey shows,
The driveway for said Parcel B encroaches over said Parcel A to and continues to the road
known as Home Pike, and
WHEREAS, the parties desire to establish a driveway easement for the benefit of the premises
described in Schedule B.
NOW, THEREFORE, in consideration of the mutual promises and conveyances herein contained,
and other good and valuable consideration, the receipt of which is hereby mutually
acknowledged, the parties hereto for themselves and their heirs, legal representatives,
successors and assigns, covenant and agree as follows:
1. The party of the first part hereby grants to the party of the second part, their heirs,
successors and assigns an exclusive easement for the maintenance of a driveway and for
all other lawful purposes over the portion of the premises of the party of the first part as
shown on Exhibit 1 and as described in Schedule C annexed hereto and made a part
thereof.
2. The parties further agree that the party of the second part, their heirs, successors and or
assigns shall be responsible for the maintenance of the driveway.

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Mattituck, Town of Southold, County of Suffolk and State of New York, known
and designated as Lot Nos. 20 and part of Lot No. 19 on a certain map entitled "Map of Point Pleasant"
and filed in the Suffolk County Clerk's Office on 5/17/1916 as Map No. 720; said lots and part of lot
when taken together are more particularly bounded and described as follows:
BEGINNING at a point on the southerly line of "Home Pike" where the northeasterly end of a curve
connects the southerly line of "Home Pike" and the easterly side of "Silkworth Road" said "Home Pike"
and "Silkworth Road" being private roads shown on a certain realty subdivision map entitled "Map of
Point Pleasant" filed in the Suffolk County Clerk's Office on May 17, 1916 as Map No. 720;
RUNNING THENCE from said point of beginning easterly and northeasterly along the southerly line and
the southeasterly line of Home Pike north 63 degrees 15 minutes 00 seconds east 68.00 feet;
RUNNING THENCE south 59 degrees 38 minutes 38 seconds east 360.98 feet to the high water mark of
Darbys Branch of Mattituck Creek;
RUNNING THENCE southwesterly along the high water mark of Darby's Branch to a point which is the
following course and distances as measured along a tie line from the last mentioned point:
I. South 49 degrees 38 minutes 22 seconds west 57.73 feet;
2. South 77 degrees 57 minutes 34 seconds west 54.02 feet;
3. South 26 degrees 54 minutes 40 seconds west 66.06 feet;

BEGINNING at a point on the southeasterly line of Home Pike which point is north 63 degrees 15
minutes 0 seconds east 68.00 feet from the extreme easterly terminus of an arc of a curve connecting
the southeasterly line of Home Pike with the easterly line of Silkworth Road said Home Pike and
Silkworth Road being private roads shown on a certain subdivision Map No. 720;
RUNNING THENCE from said point of beginning easterly and along the southeasterly line of Home Pike
the following courses and distances:
