WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Matti tuck, Town of Southold, County of Suffolk and State of
New York, known and designated as Lot No. 47 on a certain map entitled
"Map of Farmvue Associates" and filed in the Office of the Clerk of
the County of Suffolk on September 1, 1989 as Map No. 8808, said lot
being bounded and described as follows:
BEGINNING at a point on the easterly side of Aldrich Lane distant
135.54 feet southerly from the extreme southerly end of an arc of a
curve connecting the southerly side of Harvest Lane with the easterly
side of Aldrich Lane; running thence North 70° 19' 30" East 247.35
feet; thence South 19e 53' 40" East 159.75 feet; thence South 70° 18'
00" West 248.02 feet to the easterly side of Aldrich Lane; thence
along the easterly side of Aldrich Lane North 19° 39' 16" West 159.86
feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of
the first part by deed dated June 5, 2003 and recorded in the Suffolk
County Clerk's Office on October 29, 2003 in Liber 12280 Page 911.
THIS conveyance is subject to a certain mortgage in the principal
amount of $280,000.00 made by Robert J. Kull Jr. and Monica Denise
Kull, as mortgagor and Continental Home Loans Inc., as mortgagee,
which mortgage is dated May 11, 2012 and was recorded in the Suffolk
County Clerk's Office on June 1, 2012 in Liber 22210 Page 292. The
Grantee of this conveyance hereby agrees to assume the above-described
mortgage and the Grantee hereby covenants to pay the principal and
interest on said mortgage in accord with the terms and conditions
thereof.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the total of. the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
