release unto the party of the second part, the heirs or successors and assigns of the party of the second part

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Southold, in the Town of Southold, County of Suffolk and State of New York,
SEE SCHEDULE `A' ATTACHED HERETO AND MADE A PART HEREOF
Being and intended to be the same premises conveyed to the party of the first part by deed recorded in
Liber 11903 page 199.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the same
for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so

ALL that certain plot piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Southold, Town of Southold, County of Suffolk and
State of New York, known and designated as Lot No. 28 on a certain map entitled, "Map of
Smithfield Park" and filed in the Office of the Clerk of the County of Suffolk on December
27, 1966, as Map No. 4770, said lot being more particularly bounded and described as

.BEGINNING at a monument on the northerly side of Clearview, Avenue Which marks the
division line between Lot 28 and 29 on said map;
RUNNING THENCE along the northerly side of Clearview Avenue;
1. Northwesterly along an arc of a curve which bears to the right having a radius of 358.70
feet, a distance of 42.48 feet;
2. North 57 degrees 29 minutes 30 seconds West 65,00 feet;
3. Northwesterly along an arc of a curve which bears to the right having a radius of 25.00
feet, a distance of 39.27 feet to the easterly side of Mailler Court;
THENCE northeasterly along the easterly side of Mailler Court;
1. North 32 degrees 30 minutes 30 seconds East 83.01 feet;
2. Along an arc of curve which bears to the left having a radius of 270.72 feet, a distance
of 83.15 feet;
THENCE South 71 degrees 14 minutes 50 seconds East 94,06 feet to a monument;
THENCE South 18 degrees 08 minutes 50 seconds West 216.48 feet to the monument set
in the northerly side of Clearview, Avenue, the point or place of BEGINNING.
