That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in theopinionof the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. After forwarding the copy of the C & Rs filed on July 15, 1981, to the owner's attorney for his review, he in turn forwarded to me the attached "Amended Declaration of Covenants and Restrictions," which were subsequently filed in 1982 for the specific purpose of removing the provision referenced in Mark Terry's LWRP report that required the use of common access stairways. The replacement provision, No. 7, states only that "Access from any lot to the beach shall be by means of a suitable stairway or structure designed and constructed in a manner that will result in the least disturbance of the stability of the bluff." Therefore, the placement of the proposed stairway is precisely consistent with the amended provision, as the proposed location was identified by Jeff Butler, the design engineer, and myself as the most suitable location for the stairway given the existing site conditions and bluff elevations and vegetative cover. A location on or near the westerly property line would have been a far less suitable location for a stairway on this property, so we are quite pleased to have learned of the amended restrictions. Please be kind enough to add a copy of the attached document to the file and advise the Trustees of this turn of events in advance of their upcoming work session. Butler, P.E., P.C., last dated March 12, 2015, three (3) copies of which are attached hereto: 1) The two "non-essential" 4' x 8' landings, i.e., those not associated with a designed turn in the stairway, have been reduced in size to 4' x 6' (a revised project description with these changes highlighted is attached hereto); 2) The scope of the "area of work," wherein there may be incidental disturbance to existing bluff vegetation associated with the stairway construction that must be restored upon completion of construction, has been reduced from +3,300 sf to ±2,300 sf; 3) The machinery access, which was incorrectly noted as coming along the beach from Duck Pond Road, has been revised to indicate that access will be gained from Castle Hill Road and through the subject property. A brief recap of this issue: the Planning Board place a condition on the approval of the subdivision that required owners on lots 1 and 2 as well as lots 3 and 4 to share a stairway accessing the beach. The owner subsequently filed C & Rs in 1981 which included a term that "the [owner of subdivision] reserves the right to alter, modify, extend, terminate or annul any of these covenants in whole or in part, by agreement with the owners of the premises." Thereafter, the owner of the subject parcel filed a new C & R removing the language requiring a shared stairway between the neighboring properties. By the terms of the Planning Board's original resolution, this was not subject to or conditioned upon Planning Board approval. The original limitation place on the location of the stairway is no longer an enforceable covenant on the property. I have discussed this information with the applicant's attorney, Robert Lasky, who requested the matter be placed back on the Trustee's agenda for decision.
